NCAA SVP of Legal Affairs and General Counsel Scott Bearby sent an email to schools this week clarifying that student-athletes who are cut from their teams due to roster limits should not lose their scholarships, even if they enter the transfer portal but end up staying. “As we have discussed, the settlement provides that the new roster limits cannot cause any current scholarship student-athlete to lose his or her scholarship. This provision of the settlement also means that a current scholarship student-athlete who enters the transfer portal after being told that they will lose their roster spot cannot lose their scholarship based on the decision to enter the portal if they ultimately decide not to transfer. While we do not have information to suggest that any program has informed a student-athlete that he or she will lose a scholarship because of the new roster limits, we are sending this communication to remind you of this important settlement protection. We encourage you to remind your coaching staffs of this issue and ask that they be mindful of it in communicating with student-athletes about roster management decisions.” Venable LLP Partner Philip Sheng notes the “email does not address other benefits and money lost.” (link)

Missouri AD Laird Veatch talks about how the Tigers are preparing for the House settlement, which has included a rebranding of the Mizzou Athletics Funds and the restructuring of the sales and fundraising teams. “There’s been a clear recognition of our need to raise prices, and that’s been evidenced by really strong renewal rates and an early wait list of well over a thousand new season ticket holders. So, a lot of good momentum there. There’s been a real appreciation for our need to simplify and modernize our fundraising structure. That’s been evidenced in particular by a real interest in being a part of the Missouri Leadership Circle and that, the Missouri Leadership Circle, is really what’s going to ultimately drive our ability to share those revenues at the highest level and drive our ability to compete.” Veatch also says the Tigers are doing a “real deep dive” into the budget process to reduce expenses and reallocate them to rev-share funds. “We're going to reinvest our resources into what really drives winning and we are going to continue to ask more of our people. We’re going to have to continue to ask more and more of the Missouri fan base and ask them to be a part of this, and I'm convinced more and more that that desire is there.” (link)

SBJ’s Ben Portnoy wonders if mid-major programs will be able to retain basketball student-athletes once revenue-sharing begins, and FAU AD Brian White says: “You know, I sure hope so. I don’t think that we’re in the final iteration [of college sports]. … My hope is we end up in a new world that will be better for the student-athletes, better for the schools, better for the fans and better for the sport to have a little bit more stability and security on both sides. I’m an optimist and I’m hopeful there is a better way.” Southland Commissioner Chris Grant says that to create a pool of cash to incentivize March Madness success, his league’s basketball advisory subcommittee is considering assigning point values for certain metrics, including final NET rankings, hosting three nonconference DI opponents, competing in one neutral-site game, participating in a multiple team event, schedule strength and conference standings. Grant: “Equal distribution is good, but it’s not rewarding the ones who are truly carrying the weight of men’s basketball for us and having success.” (link)

Kennesaw State AD Milton Overton explains that the Owls’ goal is to share over $1M in revenue with student-athletes and can only do so by “identifying new revenue streams and maximizing those already available to us. … We are closely examining all our budgets, exploring sponsorship opportunities, discussing the Owls Fund structure, and more. As part of this effort, beginning with the 2025 football season, we are incorporating an Owl Enhancement Fee as part of our season ticket structures. This fee on all ticket purchases ensures that each time a ticket is purchased by one of our fans, it includes a direct benefit to our student-athletes. This additional investment will directly support our student-athletes, providing greater financial stability while enhancing their experience at Kennesaw State. Universities across the country are making similar adjustments, and we must take bold steps to secure the future of Owl Athletics. Continuing to grow our revenue-sharing budget will help us to be more competitive on a national scale.” (link)

Louisville Women’s Basketball HC Jeff Walz acknowledges to CBS’ John Talty that he worries about how the House settlement will impact schools’ investment in the sport. "We've worked so hard in the 30 years I've been involved in getting parity in the game. When I first got in everybody played it but you had only eight, nine schools that truly had a chance to get to a Final Four. Now, I truly believe it's 20, 25 depending on the year. I just wonder if it's going to be like, 'Hey the ones who can afford this are going to be the ones who get the players.'” Duke AD Nina King says that Men’s Basketball HC Jon Scheyer, Women’s Basketball HC Kara Lawson and Football HC Manny Diaz all asked for more in rev-share than the Blue Devils could give them, so “they all three didn't get what they wanted.” Those internal battles, Talty notes, are happening all across the country, and South Carolina AD Jeremiah Donati tells Talty: "It's a zero-sum, and not everyone is going to be happy. I've been very candid with our coaches that it starts with football. It starts with football at this level, it starts with football in the SEC and it's going to start with football at South Carolina. It is not possible in this era to keep all your coaches perfectly happy within the parameters of the rev-share. "Rather than try to accomplish that, I think [for] any athletic director who is really being honest with themselves a better goal to strive for is to keep your coaches content and as competitive as possible." Walz goes on to ask when deciding to fund sports that don’t generate revenue: “At what point does an AD say I'm already losing $5M, why am I going to lose another $2M?" More from Talty. (link)

The Illinois men’s basketball team reported just $9,100 in NIL deals during the 2023-24 season, according to the Chicago Tribune’s Stacy St. Clair and ProPublica’s Jodi Cohen, who point out that the “average earnings reported for a male basketball player in the Big Ten and the three other biggest college conferences were more than $145K during that school year.” Despite a state law requirement to do so, the players reported very few deals to the university, and St. Clair and Cohen write: “The Illini basketball team’s missing disclosures reflect an indifference to documenting NIL deals across the athletic department, the news organizations found. Athletes from 20 sports combined have reported earning only about $1.2M in three-plus years, compared with the $20M Ohio State University’s football team reportedly received in a single year. … By shrugging its shoulders at Illinois’ reporting requirements, the university is failing to compile a complete picture of how its students — some of them still teenagers — are navigating a relatively new terrain rife with legal, moral and financial pitfalls.” St. Clair and Cohen go on to explain that “the athletic department acknowledged students are underreporting their earnings and did not dispute any of the figures in this story. The statement noted it is students’ responsibility to report NIL agreements and said the university has fulfilled its obligations under the law by paying for an app that allows athletes to do so. It called the state’s disclosure rules — which the university had advocated for — ‘ineffective,’ noting the law carries no penalties and arguing that punishing players internally would harm the institution’s reputation.” Meanwhile, UI professor Michael LeRoy says: “There is nothing in the Illinois law that would be difficult for any Big Ten athletic program to follow. But they’re clearly choosing not to do it. You have to wonder why.” Lots more. (link)

The Ohio House Republican budget proposal includes $1.6M over two years for Cleveland State's wrestling program, which school officials recently said would end this year. Signal Cleveland’s Amy Morona reports the bill states that $400K in each fiscal year be used to support the Vikings’ men's wrestling program with the other $400K to be used to establish and maintain a women's wrestling program. However, a Cleveland State spokesperson tells Morona the university's board is standing by the decision to cut three sports, including men's wrestling, women’s golf and softball. (link, link)

A recently filed North Carolina bill states that schools can’t compensate athletes “for athletic performance or participation,” but Kennyhertz Perry attorney Mit Winter notes that it then says schools may compensate athletes “for participating in interscholastic athletics at that institution.” Next, it gives tax credits (up to $500K per year) for businesses that enter into NIL agreements with NC athletes. The credit is equal to 50% of the NIL compensation paid. In addition, it creates a state fund that matches funds raised by NIL collectives. So the state would be funding collectives. The author of this bill is bullish on collectives and doesn’t seem worried about the FMV process. Finally, the bill says school NIL agreements can’t condition the receipt of the compensation on enrollment at a specific school. This would actually be bad for schools. And it contradicts how most school NIL agreements are being written.” (link)

FloSports closed a Series D funding round led by Dream Sports, which joins existing investors Causeway Media Partners LP, Warner Bros. Discovery, DCM Ventures, Bertelsmann Digital Media Investments and Fertitta Capital. The funding round brings total funding raised by FloSports to more than $100M to date. The investment “will be used to fuel FloSports’ growth through content acquisitions that will expand the company’s sports portfolio. It will also be allocated toward efforts that elevate the customers’ product experience, scale production and streaming capabilities, and increase the company’s distribution efforts to reach wider audiences.” SportsPro CEO Nick Meacham: “If you don’t know Dream Sports, it’s time to start paying attention. They’re one of India’s biggest digital sports giants, with a portfolio that includes: Dream11 – 230M+ fantasy sports users; FanCode – 150M+ registered users on their digital sports platform; gaming, travel, experiences & even a cricket player trading platform. With their investment in a U.S.-based sports media company, it raises a big question: Are we about to see a wave of Indian capital flowing into Western sports media? Or is this just a one off? So what will Flosports invest in with this new injection of capital? U.S. District Judge Claudia Wilken has “staked her claim as the most influential single force in dismantling the NCAA’s foundational principle of amateurism, issuing a series of rulings addressing college athletes’ rights that were cautious and methodical in their approach but, ultimately, transformative in their impact,” according to Sportico’s Daniel Libit and Michael McCann, who note that Wilken’s first college-sports related case came in 2009, at which point she’d already spent 25 on the federal bench. Former U.S. District Judge Jeremy Fogel: “I remember thinking when she started doing these cases that it’s great she doesn’t come into it with any pre-existing leaning, for or against the NCAA. Because [she did not] come in with a lot of familiarity of the college sports culture, or the downstream consequences of some of her rulings. And I don’t mean this as a criticism, just as sort of an objective observation that she probably didn’t know what might happen with them.” Jon T. King, who served as lead counsel for the O’Bannon case, recalls that Wilken “made it very clear, right from the get-go, that this wasn’t an industry she claimed to have any prior knowledge of—and that was a good thing. That meant everything would be above board, with full transparency. The discussion would be based entirely on the evidence, not on some personal viewpoint the judge might have formed from watching college football for 30 years.” Now 16 years removed from the case, King tells Libit and McCann: “The issues with college sports often carry potential political ramifications, and I think incremental change has been the right approach. She may have seen it this way—though I can’t speak for her—but there was a much greater risk of reversal, retrial or political intervention that could have undermined the lawsuits’ (O’Bannon’s and those that followed) impact. The way things have moved forward, though slowly, seems to be the most sustainable path.” (link)

Texas AD Chris Del Conte covers several topics with the Austin American-Statesman’s Cedric Golden and the Houston Chronicle’s Kirk Bohls, including the hire of Men’s Basketball HC Sean Miller, the women’s basketball team’s run at a national title and how the industry is evolving via NIL and revenue-sharing, and more. Del Conte explains that “I firmly believe what is getting lost in this argument is the ability to educate young people, to change your life through education. We’re talking about, ‘Oh, we’ve got to have publicity rights’ – the reality is only 2% of our young people go pro. Doing a yeoman’s job of getting young people to come to the University of Texas, get an incredible degree and get a job and become productive citizens is the basis of what we do. And when they went from a scholarship limit to a roster limit, we decided that we were going to focus on fully funding those roster limits to their fullest.” Del Conte also points out that “college athletics – outside the GI Bill – provides more free education for young people in this country, and with only 35% of the United States population having a college degree, our responsibility is to educate young people to go maybe sit in your chair, sit in my chair, become a lawyer, a doctor, whatever it may be.” Del Conte goes on to say that by moving from one school to the next while “chasing a bag,” student-athletes are “devaluing [their] long-term opportunities…and sometimes it’s the lowest denominator you’re trying to go to because ‘they have a bag,’ and that’s so wrong.” More from Del Conte. Montana State AD Leon Costello joins the FCS Football Talk podcast to talk about several topics, including opting into the House settlement, roster limits, realignment in the West, the overall football landscape and more. Costello explains that as it relates to roster limits, the Bobcats, unlike many FCS schools, didn’t have an issue. “Our football number hovered between 107 and probably 109, so through natural attrition of graduation and kids leaving the program, that 105 number for us was not hard to get to. And really the only other sport that we had a little bit of an issue was women's track and we were three over. And again, through natural attrition that number for us wasn't going to be hard to meet.” From a recruiting and operational standpoint, Costello believes opting into the House settlement now gives the Bobcats an advantage. “I think being able to say we're opting in and we're going to participate and being able to give student-athletes some more benefits – obviously limited with what our resources are – but to say that we're doing that, I think, will help us earlier in recruiting than the schools that don't. I think that is a definite advantage, but it also allows us to get our mechanisms in place on, ‘Hey, how do we do this?’ So we're dealing with all of that now to be ready for the settlement update on April 7, but also hopefully the July 1 implementation date. We’re going to have all that stuff ready to go and then as more people are opting in a year from now, our systems are already set up. … Then we can focus on generating the resources to be able to share with the student-athletes.” Was there any communication between Montana State and the Mountain West regarding potential membership? “Zero. Men’s and women’s basketball teams, including those still playing in their respective NCAA Tournaments, are scrambling to spend money and sign players before Monday’s House settlement hearing, and Auburn HC Bruce Pearl tells Yahoo’s Ross Dellenger: “Everybody is playing, ‘Beat the clock.’ It’s obviously really challenging. It presents even more challenges for us because of what our focus is. … I have personally looked at the kids we really want, but my staff, in between watching games, has taken a lot of it. We are focused on two to three guys [in the portal]. The rest, we are reaching out and saying, ‘Look, we are busy right now. If you’re still available come Tuesday, we have some interest.’” One basketball agent says the situation is “f***ing bananas,” and a hoops GM calls it a “pre-settlement cash dump.” And there’s this from an athletics administrator for a team who is competing in the Final Four: “Everyone has been calling it The Wild West. Well, the next seven days, it will be the Wildest of the West. Monday is D-Day.” South Carolina Men’s Basketball HC Lamont Paris, as well as many stakeholders in the sport, believe that a power conference starter is valued at seven figures, and one agent tells Dellenger his client just transferred for an annual salary of $2M starting next year. + The Big Sky has reportedly increased its buyout from $250K to $1M, per CollegeAD, which adds Sacramento State’s push for FBS membership played a role in the increase. (link)
+ The LSU athletic department is not subject to the cost-cutting measures the university announced for all departments last week. The school will withhold 2% of each department’s budget, with 75% of that money going to a fund to support academic and research initiatives. LSU Faculty Senate President Dan Tirone says he “would certainly hope that, moving forward, if they do have surplus in their budget that they would want to support the academic side of campus as they have in the past; however, he acknowledges that “I think that athletics has some questions about their own financial status at the moment, given some of the changes with the NCAA and some of the obligations they may be taking on.” (link)
+ ULM students voted in favor of an athletics fee, and Warhawks AD John Hartwell says: “We don’t take this lightly. We know that a lot of our students have to pay their own way through school or work or their parents don’t have a ton of means to pay for them. We understand that. But really [this is a] relatively small amount of investment for what we think will be a significant payoff not just for our student-athletes, but for the branding and image of our institution.” (link, link)

Church Church Hittle and Antrim Partner Todd Shumaker outlines what comes next for NCAA enforcement if/when the House settlement is approved, and writes in an SBJ guest column: “First, any new process must meaningfully incorporate experienced decision-makers who understand college sports violations and their impact on the world of college sports. … Second, any new process cannot be adversarial. This seems nonsensical, but it is also mostly where NCAA infractions processes have gone wrong in the past. In fact, much of the discussion around reforming college sports investigations has focused on the exact opposite, touting the need for subpoena powers in college sports. These powers are great…when the stakes are extremely high and the circumstances call for thorough investigations, even if it takes a lot of time. While subpoenas certainly allow for investigators to collect more information less voluntarily, it also invites the legal process into investigations. Subpoenas can be challenged – or ignored – which takes courts to resolve.” Shumaker goes on to posit that a new process must have “truly collective ownership. … The NCAA has always been an easy place to lay the blame for poorly policing violations, but it is not the cause of ineffectiveness. The expectation that a membership association’s investigation can simultaneously provide fair process with timely results and harsh penalties, all while the members challenge the process when they are actually in it, is the underlying problem. Replacing investigation with dispute resolution, putting the responsibility to timely produce and cooperate on the shoulders of all parties, and attaching agreed-upon penalties for both failures in the process and violations of underlying rules might get closer to those goals.” (link)

South Carolina Women’s Basketball HC Dawn Staley believes GMs for women’s hoops are “necessary” to navigate the transfer portal, especially for teams who are still playing. “I don’t know if we’ll call it GM, but it will be some of the duties of a GM. It’s a lot of money in the space. … We need somebody singularly focused on that movement and ways in which we need to navigate in that space, so that if we’re here at a Final Four, the GM can be taking care of some of the stuff that we have to take on now.” UCLA HC Cori Close observes that “there’s two sides to this. One is what is best for the student-athletes and what is best for our game. The part that concerned me a little bit about the game part is how quickly athletic departments were trying to fill coaching positions so that they had people in place during the transfer portal opening.” Staley goes on to remark: “We’re in the Final Four. We’re talking to parents. I’m talking to people in the transfer portal. I’m talking to agents. It’s a lot, but if you’re not someone that can easily pivot, this thing will swallow you up. We’re fortunate that we’ve been working in chaos for a long time.” (link)

How does Kansas State Football HC Chris Klieman feel about the state of college athletics as an industry? “I still think the industry of college athletics is a disaster. It just is." Klieman adds that “during this month of April – it's not our decision as coaches and not our decision at Kansas State – but the industry-wide decision because of the House settlement and because of different legality things and litigation, we've got to remove a lot of kids from the program and it sucks. … I’ll be honest with you. There's a lot of kids that want to be here, want to stay here, that we can't have in the program. There are kids that are paying their way, that have put a lot of blood, sweat and tears into this place. Kids that are invested academically. Now those kids have to make a choice. It's frustrating to me because I don't understand why the number came about of 105. Why can't we slowly bring it down? I don't even know who decided it, but as a lot of us coaches talk about it, we're not in those meetings. We're not in the rooms. The practitioners and the guys that have their boots on the ground everyday aren't in the meetings that decide some of these things. I'm sure it happens in other sports as well, but in football in particular. Make no mistake, I'm not in favor of this at all. We have a lot of kids that want to be in the program that are not going to be able to be in the program. Then we also have the transfer portal happening in the month of April. There are some positives with that, in kids that maybe won't make your 105 will have the opportunity to go on and play somewhere. I think that's great. The negative, which you all know and can assume, is our best players are getting contacted every day right now." (link)

A crime ring is traveling around the nation and inviting student-athletes to parties where there's gambling with the goal of putting the student-athletes in debt and compromising them for future exploitation, according to Southland Commissioner Chris Grant, who tells ESPN: "What we found out is they're going into towns, throwing parties and having events, getting guys to come. And when they come to these parties, they get [players] to gamble on site and [then say], 'OK, well you owe me X amount of dollars on the back end.' … For us, it seems to point back to an organized crime ring that's not just localized in the Southland footprint. It is going on around the country." Grant notes the league has hired IC360 and explains that “from a president and commissioner standpoint, I want that preventive care on what to look out for before getting in compromising situations, ending your eligibility, ending the season for a team and mistakenly doing it.” NCAA Managing Director of Enforcement Mark Hicks says the system overall is “fragile” and “in terms of educating athletes, we [constantly repeat that] you don't have to be the star player in order to be at risk. That is something that is a key message point in every delivery session on campus. That's why they go to Divisions I, II and III and speak to all high-profile athletes and also nonrevenue-generating sports to drive home that message. You know it can affect everyone in every sport regardless of your competition level." (link)

Legal Matters…
+ U.S. District Court Judge James R. Sweeney II has ruled that neither Butler nor Senior Assoc. AD for Student-Athlete Health, Performance and Wellbeing Ralph Reiff had a legal duty to protect four current and former women’s soccer student-athletes from the alleged abuse perpetrated by former Asst. Athletic Trainer Michael Howell. Additionally, any claims falling outside the statute of limitations, which is two years in Indiana, were also dismissed. Sweeney has allowed the vicarious liability claims against Butler to proceed, meaning the university could still be held responsible for the alleged misconduct committed by Howell. Unless the plaintiffs settle, a jury will decide whether Howell’s actions occurred within the scope of his employment, which could result in Butler being held liable for his conduct. However, a jury trial will not commence until Howell’s bankruptcy proceedings, which he filed on Jan. 14 of this year, are resolved. (link)
+ Tulane has suspended QB T.J. Finley after he was arrested for possession of stolen property over $25K. Court records show the case revolves around a Dodge Ram that was reported stolen in Atlanta. Tulane officials say they are aware of the incident and that Finley “has been suspended from the football program pending the outcome of the case." (link)
+ The parents of former Bucknell football student-athlete Calvin "CJ" Dickey Jr. have filed a lawsuit against the university after Dickey collapsed on the field last summer and eventually passed away. Dickey’s collapse was due to sickle-cell related rhabdomyolysis, and the family, which says it made Bucknell aware of Dickey’s condition, wants to know what happened leading up to the collapse. The university declined a request to comment. (link)
+ The Philadelphia Phillies’ motion to block rival teams from accessing analytics platform Zelus Analytics and its parent company, Teamworks, was denied Monday by the Common Pleas Court of Philadelphia County, which found that the Phillies “failed to meet the standard for relief or satisfy all elements to obtain the extraordinary restrictions that they sought to impose.” (link)
