U.S. Congresswoman Lisa McClain (R-MI) revealed during today’s House Committee on Education and Workforce subcommittee hearing that she has introduced a bill that would prohibit college athletes from becoming employees of their schools, conferences and associations based on participation in college sports. USA Today’s Steve Berkowitz observes that “this appears to be similar to a bill that the full Education and Workforce Committee passed last June in a straight party-line vote. That bill did not get a House floor vote. McClain is the current House Republican Conference chair, which makes her the GOP's fourth-highest ranking member in the House. As the hearing ended, subcommittee chair Rick Allen (R-GA) said: ‘It's my hope that my committee colleagues will join this effort.’” The bill is titled the “Protecting Student Athletes’ Economic Freedom Act of 2025.” A release from McClain’s office after the hearing included a statement from full committee chair Tim Walberg (R-MI) that endorsed the legislation. The Orlando Sentinel’s Mike Bianchi credits Florida AD Scott Stricklin with showing patience when Gators Men’s Basketball HC Todd Golden was beset by misconduct allegations before the start of the season: “In today’s cancel-culture climate, the expedient path would have been to suspend or even dismiss Golden to mitigate potential reputational damage. After all, nobody had any inclination at the time that the Gators had a national championship-caliber team. However, Stricklin chose a different course – one rooted in the principles of unwavering support, due process and innocent until proven guilty. He put his own job on the line by allowing the investigation to unfold without prejudgment, allowing Golden to keep coaching his team despite the potential of the damning allegations being proven true.” Stricklin last week told Bianchi: “Both morally and legally, it was the right thing to do. Anyone can make an allegation, but it doesn’t mean it’s true. He [Golden] has rights just like the people who make allegations have rights. And so there’s a process and we followed that process. Todd has been completely honest and truthful since I first met him and I had no reason to think that was any different in this situation.” Stricklin added: “You’re investing in people. And I have a lot of faith in our people. Even successful people stub their toe every once in a while. As Billy Donovan once said: Great coaches know how to overcome adversity and not let it distract them.” (link)

Florida State AD Michael Alford joins the Noles247 podcast to discuss several topics, including ongoing facilities upgrades, and says of the progress being made at Doak Campbell Stadium: “It's really exciting to see the investment that we're making into football which ties into some of the long-term vision that we have here as an athletic department. But [we’re] playing catch-up with others. As an institution, we just kind of let people pass us and didn't invest to keep up with what everyone else [has]. This is going to be the finest facility in the country for football. … I think it's going to set new trends for the rest of the country.” In regards to the football-only facility, Alford explains that “you’re not going to see any gimmicks with this building. This building is about development, it's about for the program what can we do to make us better? And having input from all the different stakeholders really allows us to go out and do things that are going to set us apart.” Alford also explains the Seminoles are looking for ways to improve the David L. Tucker Civic Center, home of FSU’s basketball teams, particularly as it relates to increasing student involvement. “That’s something that I’ve been wanting to do since I’ve been here as athletic director was to look at how we can get the students more involved around courtside. So that’s something we’re looking at. I haven’t made a decision on it yet, but it is a priority for us when it comes to basketball and now’s a great opportunity. But just looking at the arena, at the indoor facility, I would have built a different one, but it's not bad when I look at indoor facilities across the country.” Full podcast. (link)

Penn State AD Pat Kraft joins the On the Fly podcast with Gene DeFilippo and says the Nittany Lions are prepared for revenue-sharing. He also says he supports student-athletes being able to profit from their NIL, adding: “My issue right now is are we able to control just the utter chaos that is going on? Meaning agents playing schools against one another and saying this number and we don't know what's true and what's not. And that's fine, but…when [the House settlement] gets passed, which I'm assuming it will, it will be a shift in our world. … We’ve just got to be able to, like I said, be nimble and understand this is going to be bumpy.” Kraft adds that “it’s new and it’s change and it’s hard. You just don’t know what you don’t know yet. I’m one of those [people who thinks] just give me the guardrails and we’ll figure it out.” Kraft also talks about alignment and says: “That doesn’t mean you always have to agree…but I do think you all have to align on the main thing.” He adds: “It goes back to what I said. Our foundation is our foundation. Academics, work hard, win championships. That’s just who we are and that resonates from top to bottom. And then let’s do everything we can to give our coaches and our student-athletes the most we can to be successful, and for me, I’d want them to know no matter what – win, lose or draw – I’m gonna have their back, I’m gonna fight with them.” (link)

Toledo AD Bryan Blair sees the House settlement as a “massive opportunity” for the Rockets, telling the Toledo Blade’s David Briggs: “I just see nothing but blue ocean regarding this topic. This is such a relief based on where we have been the past three years with a whole lot of indecision and not knowing: Can you touch the stove? Is the stove hot? Who's going to get in trouble for what? Versus now we get to go all in…all gas no brakes. Let’s pour gas on this flame more than we ever have. The next five years are critical. That’s maybe what we don't talk about enough. Most people believe in 2029-2030, as some of these TV contracts and conference agreements come to a head, there may be a massive reshuffle of the deck in college athletics. Every institution is really trying hard to be their best over these next three to five years. I would argue Toledo is in a position where these next three to five years are even more critical for us if we truly want to be the best version of what we can be, which I think, big picture, is pretty doggone amazing. We've got to act now.” While Blair declined to share specific rev-share plans, he tells Briggs that “we want to be top 10 in the Group of 5 landscape, and when you think of some of the schools that are going to be aggressive in it, we want to be right there. … Toledo athletics is at a tipping point. We've had some tremendous successes over the last handful of years, but we're that one down away, that one basket away, that one player away from some truly monumental moments.” (link)

South Dakota State AD Justin Sell talks conference realignment: “Our best thing that we can do is be really good and put ourselves in a position that we will have a place in however this sorts itself out. We don’t control those things. Most people don’t unless you’re in probably the Big Ten and SEC. They're controlling a lot of stuff and I think everyone else is kind of seeing what’s going to happen, what’s the ripple effect, where are we going to go. I focus on what’s really good competition for South Dakota State? What’s going to engage our fans in wanting to come? What you’re trying to be and what you’re shooting for continues to change. That’s the challenge. But try not to chase something you’re not. You gotta stay true to who you are. And then you have to be prepared for what's coming in options A, B and C. How do you kind of weigh those and be ready to go when you might not have a lot of time to make a decision.” (link)

Northwestern is finalizing settlements with former football student-athletes who filed hazing-related lawsuits against the university and former Wildcats HC Pat Fitzgerald, according to ESPN’s Adam Rittenberg, who notes Fitzgerald’s $130M wrongful termination lawsuit against the school is set to go to trial in November. “In a motion filed last week, requesting a continuation of the trial date in Fitzgerald's claim, Northwestern stated it recently began mediation with the athletes that resulted in an undisclosed settlement currently being finalized. Northwestern said athlete plaintiffs ‘will be witnesses in the ongoing litigation’ involving Fitzgerald. Fitzgerald's attorneys on Tuesday said Northwestern's motion for continuation was denied, and that the trial date for his case remains set for Nov. 3. … In last week's filing, Northwestern said that after repeated requests, attorneys representing the athletes responded Jan. 29, noting that 81 athletes had relevant information. Northwestern said it had conducted six depositions and has 33 more scheduled, and has identified 40 former athletes to be witnesses in its defense against Fitzgerald's claim, as well as non-plaintiffs ‘identified as having information related to the hazing and other conduct in the football program during Fitzgerald's tenure.’” (link)

Extra Points publisher Matt Brown takes a look at how the Trump administration’s tariffs could impact college sports and cites athletic apparel as the first example. “It’s not great for consumers looking to buy new Air Jordans in the near future, but you know who else buys a ton of athletic shoes? Athletic departments. While most schools get a certain quantity of free equipment via their athletic partner, that usually isn’t enough to satisfy all the needs of a department. For everything else, schools are able to purchase a certain amount of product (shoes, polos, tracksuits, etc.) at a % discount, based on retail pricing. If the costs of manufacturing jump by 20% or more, will the major apparel companies pass all of that along to regular ol’ consumers? Will they push to renegotiate previous contracts with athletic departments? Or will that 60% off retail discount suddenly look a bit less generous than it did in 2022? If this trade policy continues for several months, which is an open question, it’s hard to see how athletic equipment expenses don’t increase for many athletic departments.” Brown also points out that “plenty of actual athletic equipment, beyond apparel, is also manufactured overseas. Wilson baseball gloves? Asia. Speedo swimwear? Made in China, Italy, and Portugal, among other locations. Lots of weight room equipment, like squat racks, come from China and Europe as well. And you know who buys a ton of food? It ain’t just Washington apples, Texas beef and Florida oranges that athletic departments are buying, after all.” All of these issues, Brown continues, will impact donors, both mega and otherwise. “So don’t be shocked if ol’ State U has to make some different decisions, because suddenly, shoes are a lot more expensive, and fans aren’t buying quite as many t-shirts as they were projected.” (link)

House (Almost) Rules…
+ As expected, U.S. District Court Judge Claudia Wilken did not issue a final ruling on the House case, but remarked when wrapping up the hearing: “Basically, I think it is a good settlement — don’t quote me. I think it is worth pursuing and I think some of these things could be fixed if people tried to fix them, and that it would be worth their while to try to fix them.” Regarding what she would like to see changed, Yahoo’s Ross Dellenger notes that “Wilken was clear: Change the roster limit situation or risk not having me approve the settlement.” Wilken explained that “my idea is to grandfather in” those currently on rosters. “It would save a lot of angst.” Dellenger also reports that Wilken “turned most of her attention to two concepts: the new roster limits and the settlement’s injunctive class. Athletes, even those not currently in college, are automatically part of the 10-year settlement’s injunctive class that releases any future legal claims that they might have.” Wilken called the latter a “difficult concept,” adding: “I’m having trouble with binding people who aren’t here and releasing claims for things that haven’t happened.” Wilken recommended that attorneys adjust language in the settlement agreement so that future athletes are only part of the injunctive class once they are provided an opportunity to object to the deal after joining a DI program. [NCAA/power conferences’ counsel Rakesh] Kilaru said the 10-year injunctive class is necessary and without it, “there will not be stability and there will not be a deal.” Wilken said to Kilaru: “See what you think you can do about all these issues. Maybe some you can fix or some you can’t but can give (me) a better explanation.” (link)
+ According to The Athletic’s Justin Williams, Kilaru told Wilken that “I just want to really reiterate here, this was a long road to get to this point, we needed a lot of schools to approve it, there are a lot of different pieces of this settlement. I cannot make you any promises that we’re going to say anything is different because we think what we did is appropriate and enough, but we’ll take it under advisement and come back.” As far as a timeline goes, Wilken remarked: “I would like to have you all think about what you heard today and what I’ve said today, talk about it with your clients, talk about it with each other. See what you think you could do about all these issues. … We’ll have at least some sort of report in a week and at that point, we’ll decide what to do next.” She also noted: “You’re the ones who are in touch with people with the time problem, not me. But I would like to schedule things.” (link, link)
+ On the question of 10-year injunctive class, plaintiffs’ attorney Steve Berman told Wilken: “I understand the question you’re on, but I think it is solved in our case in particular by giving this future notice a right to object. You’ve got to have a system that applies across the athletes. We think what we’re doing is actually better than doing a class-by-class.” Plaintiffs’ attorney Jeffrey Kessler added to Wilken: “At a minimum, we will agree to iron out a procedure for future objections. ... We can give you some process on fixing data errors. There are some things where I’m sure we’ll be able to address some of your concerns.” (link, link)
+ USA Today’s Steve Berkowitz provides more context about Wilken’s concerns regarding NIL regulation: “Judge Wilken says she needs a ‘pro-competitive justification’ for the proposed system under the settlement that would set up a more stringent evaluation by the NCAA and conferences of the athletes' NIL deals that are worth more than $600. That is, how would this promote competition for athletes' NIL services and how would it not hurt athletes. Kilaru says these evaluations are necessary to prevent circumvention of the schools' annual cap on direct NIL payments to athletes and that it's part of the overall agreement. Wilken responds: ‘Each thing (in the agreement) needs to be reasonable.’” Berkowitz also has this from Kilaru: "We need a 10-year agreement. There's got to be the same rules for everyone. We need the 10 years. (Without that), there won't be stability, there won't be a deal." Also from Berkowitz: “Wilken still wants to know what happens if she or another judge decides that a future objector has a sufficient problem to merit a change in the agreement. Kessler says a judge would then be allowed to terminate the settlement.” (link)

NCAA President Charlie Baker yesterday acknowledged that Congress has been slow to act on a college sports bill but noted: “That doesn’t mean you shouldn’t try. And sometimes interesting things happen. We spent a lot of time talking to people on both sides of the aisle, both branches, and in the privacy of their offices I think there is a path forward here. We’ll see if we can get there.” (link)

NCAA President Charlie Baker was also asked whether regulating the NIL market as is outlined in the House settlement could push payments to players back under the table and responds: “Well, I mean, the prediction on that, that’s a big ask. What I would say is right now we have nothing like that. … And we really don’t have any way to gauge or judge exactly what is going on out there – it’s all anecdote and representation, which is not really very helpful if you’re trying to determine what’s really happening.” The Washington Post’s Jesse Dougherty also catches up with Dropback co-founders Luke Bogus and Nick Siscoe, who discuss how their software platform helps teams manage roster construction and salary caps. Bogus notes: “You need to optimize every penny that you’re spending. Because if you leave cap space, you’re leaving talent on the table. And so spending whatever on players, adding it up and begging donors? That’s gone. You’re going to be given a number and, like any business, you’re going to be expected to spend to budget. And if you don’t, you’re going to be fired, or your donors and schools are going to be asking a lot of questions as to why you overspent their money. The decisions will need to be defensible.” (link)

Learfield CEO Cole Gahagan joins the Bloomberg Business of Sports podcast and highlights the company’s modernization efforts to refocus the company on data, media and digital products to serve as the “foundation for what we can go do now around NIL. What I mean by that is when we started this journey of modernizing the business around data and media, we knew two things: We knew anything that we would do to create value for our school partners and for brands had to be rooted in the principle of fan connectivity. We had to know who our fans were, we had to have an ability to reach them and we had to have an ability to engage them once we were able to reach them. And that was what led to us building Fanbase, which is now the largest data platform in all of college sports. We have 107M known fans, collegiate fans, and we can now talk to those fans on a 24-hour, seven-day-a-week basis. And then we built Learfield Studios.” As of June 30, 2024, Gahagan says Learfield has “delivered 1.2B impressions through Learfield Studios and our ability to connect with those fans.” All of which, he says, was made possible because the company started building that foundation before July 1, 2021, when the NIL era began. Wichita State AD Kevin Saal submits that “if you look at the [men’s basketball] transfer portal and the activity that’s going on now, I would share that it is probably 30 to 40% more expensive than it was last year [to land a recruit]. There’s a lot of money that is in flux in the market right now because the traditional definition of the collective is going to go away. I don’t want to get into specific amounts but it is more expensive than it was last year and it’s significant.” Regarding his recent letter indicating the Shockers need another $1M to be competitive on that front, Saal explains: “We’re invested heavily. As the letter said, another $1M puts us in the neighborhood of NCAA Tournament and second weekends of NCAA Tournaments. … We don’t need to be the nicest house in the neighborhood, but we’ve got to put our guys in the neighborhood to be competitive.” (link)

South Dakota AD Jon Schemmel and South Dakota State AD Justin Sell discuss how their respective athletic departments are navigating NIL and the transfer portal, and Sell says the collision of the transfer portal, COVID and NIL made for a particularly challenging combination. “The two key pieces and where the consternation is really revolved around, it's not supposed to be pay-for-play, and it's not supposed to be an inducement in recruiting. And we all sit here, and we'll tell you that's exactly what it is.” Sell adds that there needs to be changes made to get all 50 states operating in the same way, but in its current state both universities prioritize educating their athletes to ensure they’re taking advantage of the experiences they could have through NIL opportunities. Schemmel says USD has made it a priority to look into NIL deals at other schools to make sure they won’t negatively impact student-athletes down the road. “We're trying to vet these offers and make sure before they make that decision to go into the portal that it's a legitimate offer. We just kind of hope that that's a winning message and a winning strategy for the long game. So, I think you take it on the chin a little bit in the short term, knowing some of the things you're doing long term will play out in the averages.” More from the Argus Leader’s Jonathan Fernandez. Sunday’s women’s hoops national championship between Connecticut and South Carolina averaged 8.5M viewers on ABC and ESPN, trailing only the past two years as the most-watched national title game in the Nielsen people meter era. Sports Media Watch’s Jon Lewis offers some more context: “Viewership sank 55% from last year’s record 18.9M for South Carolina-Iowa and also fell a more modest 14% from LSU-Iowa two years ago. Compared to the last time Caitlin Clark and Iowa failed to make the title game, viewership jumped 75% from the same matchup of South Carolina and UConn in 2022, which aired in primetime exclusively on cable (4.85M). … It would seem clear that while women’s college basketball is unlikely to return to Clark-era heights any time soon, it is not returning to the pre-Clark norm either. Even with the majority of last year’s audience tuning out, nearly three times as many viewers watched the Huskies cruise Sunday afternoon than watched the last time they won a national title in 2016 (3.0M).” (link)

Point guards are coming at a premium in this year’s men’s basketball transfer portal, according to On3’s Pete Nakos, who pegs the market at $500K to $2.5M for high-level players. “Multiple top guards have landed deals north of $2M in recent weeks. Most top guards landed $1M deals in last year’s portal. But that has now been shaken up. UCLA commit Donovan Dent, LSU commit Dedan Thomas and UConn commit Silas Demary are viewed as market leaders at the point guard position. Princeton’s Xaivian Lee is one of the top remaining point guards in the transfer portal.” The market for elite wings can run anywhere from $800K to $2M, as Nakos reports that “shooters with size are another spot on the hardwood that programs are willing to spend dollars on. Unlike the point guard market that is pushing in the $2.5M to $3M range, the majority of these deals sit between $800K and $1M, with some contracts climbing to $1.5M. Louisville went all out to land shooting guards Adrian Wooley and Ryan Conwell, who sources have said are both valued at north of $1M. [...] It’s a significant increase in value compared to a year ago, when multiple top shooting guards were valued at $500K.” Top-rated power forwards and centers are commanding between $750K and $2M, and Nakos notes the majority of deals are between $1.5M and $1.8M. “But that does not mean there are [not] outliers. Sources have indicated one of the top available big men in the portal landed a contract north of $3M.” (link)
