Amid speculation that he could challenge for U.S. Senator Ed Markey’s (D-MA) seat in 2026, NCAA President Charlie Baker has no plans on stepping aside in the near future, telling SBJ’s Ben Portnoy: “I certainly want to see through all this stuff. It’s kind of up to the board, I guess, right? I would hope (he’ll still be in the role in two years).” (link)

House Hearing…
+ U.S. District Court Judge Claudia Wilken began the hearing by explaining that she would not rule from the bench on Monday but complimented the attorneys as she listed figures from the settlement. Specifically: 390K class members, 73K claims, 343 opt-outs and 73 objectors. “That’s quite a surprising and large number of responses (of claims made).” (link, link)
+ House plaintiffs’ attorney Steve Berman says the “risk” in Wilken not approving the settlement is that Congress could pass a bill that grants the NCAA “complete immunity,” and he specifically mentions Senator Ted Cruz’s (R-TX) drafting of a bill that grants NCAA antitrust protection. Berman also makes clear that Title IX is not released in the settlement for future student-athletes: "If any one of the female athletes wish to bring a (Title IX) claim, they can bring that case. It says only the distribution numbers (are released).’” (link, link); Wilken says whether Congress could pass a bill giving NCAA antitrust immunity is not relevant to whether she approves the settlement, and Sportico’s Michael McCann agrees that “risk also seems super far-fetched. Not a very persuasive argument, IMO, by the players' attorneys. Congress won't pass anything.” (link)
+ Wilken, per Yahoo’s Ross Dellenger, suggests that she will not necessarily grant the NCAA and power conferences’ request to “bless” the current NCAA regulations, saying: “They can ask but that wouldn’t be something the court would be inclined to do one way or the other.” (link)
+ Dellenger distills Wilken’s most interesting points so far: “She suggested a phase-in for roster limits; she suggested collective bargaining is a better way to establish a compensation cap but that's not part of the House case; her biggest issue in the settlement, it seems, is binding future athletes to the 10-year deal; she is not leaning toward blessing the NCAA's current rules as part of settlement approval; and she has talked positively about the high number athletes who have filed claims for the backpay.” (link)
+ Dellenger also notes Wilken raised issues “with the new roster limits, specifically for those athletes who are cut. She just suggested to NCAA attorney [Rakesh] Kilaru that, perhaps, there could be an exception for those currently on rosters (grandfathering in).” (link)
+ NCAA lawyer Rakesh Kilaru remarked that third-party NIL will be “opened up” more under the settlement than now. Though “NIL transactions will generally be permitted," he says, a “set” of “associated entities” offering NIL comp will get further scrutiny (clearinghouse). (link)
+ Wilken acknowledged that it “may be a great idea to have a collective bargaining agreement but this case isn't the vehicle through which one could get student-athletes declared employees...or rewarded with the ability to negotiate for collective bargaining agreement. … It’s just not in this lawsuit. We’re not adjudicating an antitrust violation here, we’re adjudicating whether it’s the proper balance of the risks and rewards.” (link, link)
+ LSU gymnast Livvy Dunne objected to the amount of the settlement set aside for men’s sports and noted that her backpay projection is much lower than her actual NIL earnings. Dunne to Wilken: “This entire process defines athlete value based on the sport you played in and how much revenue your team brought in. But NIL is about more than wins and revenue. This settlement uses old logic to calculate modern value. ... Your honor, I ask the settlement not to be approved as it stands. We deserve more than an estimate (of backpay). We deserve to be compensated at the value we deserve." (link, link)
+ The Athletic’s Stewart Mandel: “Objector attorney Michael Hausfeld is arguing that athletes will lose money if there's a $20.5M cap, AND the settlement is successful in neutering collectives. ‘They (the NCAA) are trying to control the market.’ It's not working. + Mandel also notes that Wilken “doesn't seem particularly concerned about whether the settlement will lead to more antitrust legislation. The Department of Education and Department of Justice are creating a special Title IX investigations team that will include OCR investigators and attorneys as well as attorneys from the DOJ’s civil right division and the Education Department’s general counsel’s office. Officials say the team will allow OCR investigators to more rapidly resolve investigations and ensure that cases are “fully prepared for ultimate DOJ enforcement. Education Secretary Linda McMahon: “From day one, the Trump Administration has prioritized enforcing Title IX to protect female students and athletes. Traditionally, our Office for Civil Rights takes months, even years, to complete Title IX investigations. OCR under this Administration has moved faster than it ever has, and the Title IX SIT will ensure even more rapid and consistent investigations.” (link)

James Madison is offering two new premium seating options at Bridgeforth Stadium for the 2025 football season. Sections 4+5 in the east stands will have new mesh-style chairs. Each seat will cost $935 for the season and be accompanied by a bar rail that extends the length of the seating sections. JMU will also introduce the Southern Endzone Suites on the APC patio, which will consist of four dedicated suites, two on either side of the video board. Each suite will include 14 seats, eight of which will be high back mesh style chairs with cupholders, with an additional back row of six high-top mesh style swivel chairs accompanied by half circle bar top tables to create a two tier suite experience. The space will cost a total of $33,058 for the season ($16,058 for tickets, $14,000 for Duke Club Seat Contribution, and $3,000 minimum Proud and True Fund contribution for parking benefits). Oregon Deputy AD/COO Lisa Peterson joins Connect's Steph Garcia Cichosz on the latest episode of The Career Hustle to discuss the importance of relationship-building before breaking down her career trajectory, which has included stops at Miami (FL), Maryland, Kentucky, Oregon, the Pac-12 and Big 12. In terms of the relationships that led to each opportunity, Peterson explains: “It has to be authentic. You can't just say that you want to build a relationship...you have to care about the person that you are trying to build that relationship with. It has to be authentic or else you can see right through it." Peterson also talks about the importance of being willing to go beyond the scope of one’s job in order to be of service, noting that when she began her career at Miami, she held cords for football coaches during games, worked the scoreboard for women’s basketball games and helped in the ticket office. “None of that was part of the job that I was hired to do. I was working in the business office, but I think what it did is it showed me that when you can understand the whole business, what it means, you understand what your colleagues are going through. And then when you're trying to get to that same goal, it just helps blend it all together. But I also had an athletic director who could be seen vacuuming up the hallways. The wrongful death lawsuit brought against former Alabama basketball student-athletes Brandon Miller and Darius Miles, along with fellow defendant Michael “Buzz” Davis, has ended with a settlement, according to AL.com’s Matt Stahl and Nick Kelly, who report that “all parties agreed to drop the case with prejudice and a trust fund was set up for the benefit of the late Jamea Jonae Harris’ lone child.” Court documents did not indicate how much money was in the trust. A criminal trial date for Miles and Davis has yet to be set. (link)

+ SBJ’s Bret McCormick catches up with Ryan Sports Development CEO/prominent Northwestern donor Pat Ryan to discuss the Wildcats’ new football stadium. McCormick explains that the “stacking of the venue’s stands, making it a more theater-like, vertical viewing experience, is one of three broad ways the stadium will differentiate itself most from the existing American stock of college football venues. Ryan’s idea of a premium experience for every fan, regardless of their ticket price, centers on basics usually missing from college football venues: intimate sightlines, a chairback and overhead coverage from weather for every fan; a level of concessions beyond rubbery hot dogs cooked hours before game time in another part of campus; and game-day experiences beyond just the actual football.” Ryan explains the rationale: “How do you build a football-sized arena? How do you create a premium experience for every fan? You go to the movies today, it’s hard to find an old-fashioned theater. If movie theaters have gone premium, how do sporting events not go premium? But we didn’t just go premium for the people that pay a lot of money; we decided to go premium for everyone, because that fits a college culture.” McCormick explains that “building a steeper stadium, with more steel and cantilevering, is much more expensive — think tens of millions of dollars…but the result is that Ryan Field will have a similar feel to the west sideline of Intuit Dome, making concerts more intimate, too.” Meanwhile, extending Ryan Field’s canopy from the sidelines to both end zones cost an extra $20-25M, but the canopy will reach the edges of the playing field, protecting fans from the elements. + SBJ’s Bret McCormick takes a look inside Populous’ design for the New York Liberty’s new locker room, which is less of a locker room than it is a players’ lounge with private suites instead of lockers. “The player suites (their dimensions haven’t been finalized) contain a seven-foot daybed for naps or relaxing, a desk at which Zoom calls with agents or potential brand partners could be conducted, and vanity mirrors for pre- and post-practice skin and hair care routines. Ample closet space, especially for shoes, was a specific request from Liberty players. Liberty GM Jonathan Kolb: “It just made so much sense from a recovery standpoint and privacy standpoint for our players. Then we figured why don’t we make that shared space in there the player lounge, so that they’re interacting and you’re getting team bonding, but also a reprieve.” The lounge is part of an $80M training facility in Brooklyn and Kolb adds: “When we’re trying to be efficient about our space, that should be a sanctuary for our players and no one else should step foot in it but the players. Then the imagination can wonder, if no one else is setting foot in there, what can we do with that space to make it different from anywhere else?” Have a look at some renderings. (link)

Congratulations to the Connecticut women’s basketball team for taking home the Huskies’ 12th national championship yesterday. (link); UConn HC Geno Auriemma on winning his first title since 2016: “Being honest, I think there was a big part of my inner circle of people that I trust that were hoping that after the Stewy fourth in a row that I should have called it a day back then. That would have been apropos, I guess -- ride off into the sunset with Stewy and Tuck and Moriah and those guys. But when you make the decision you're not finished yet, and then three, four years go by and people start telling you that UConn is not UConn anymore and it's somebody else's turn. And then five years go by and six years go by and seven years go by -- it's not like it was extra motivation, but it just happened to coincide, the last five years, with the pandemic, the bubble, the injuries. And I just kept thinking, you know, I kind of owe it to these people to kind of let me see if we can take a whole team, what could happen, because these people that have been playing against us for the last seven, eight years have not played a University of Connecticut team, yet beating UConn always seemed like the national championship to them. SEC Commissioner Greg Sankey tells SEC Network/ESPN host Paul Finebaum that the House settlement is not the finish line but rather a “chapter, an important chapter in this process. Let’s go back to the issues. It’s not simply litigation that produces the challenges we have. States setting different rules so that you might have 50 different sets of rules threaten the ability to have a Final Four. There will be a point at which people don’t want to come together for this competition if we don’t have uniformity on a national basis. We have to enact the settlement, we have to make decisions and fulfill commitments around the settlement. No one’s asking, at least from my perspective, for some kind of antitrust exemption, but there has to be a level of protection from a liability standpoint to enact those standards. That has to be done nationally. … If we just continue on and allow lawsuit after lawsuit, state legislation after state legislation, we’re simply going to grind this into no standards at all. And I think that poses a threat to that Olympic development program. It poses a threat to the opportunities for young people. That’s, in brief, the communication of both the what and the why. And we could go on for hours and people can debate, and I'm certain that people will post and criticize and say, ‘Well, he’s got one point of view.’ I do have a point of view. I have a point of view that understands the depth of the opportunity we provide, the new economic benefits provided, but the need for the opportunity broadly to still be protected.” (link)

Former Arizona State men’s swimming student-athlete/eponymous House plaintiff Grant House voices support for maintaining Cal Poly’s swimming & diving program and contends it’s “not the House v. NCAA settlement, it’s athletic departments making this decision and making these choices to cut these programs.” However, the Mustangs’ athletic department in its decision to eliminate swimming explains that the “House vs. NCAA settlement, which addresses past and future compensation for student athletes related to name, image and likeness (NIL) rights, will have a significant financial impact – resulting in a loss of at least $450K per year for our programs. This comes amid additional national class-action lawsuits pending against the NCAA, further compounding financial and operational challenges for collegiate athletics.” (link, link)

College of Charleston men’s basketball student-athlete Ante Brzovic has sued the NCAA over its five-year rule and is seeking an injunction for the 2025-26 season. Front Office Sports’ Alex Schiffer caught up with players on 10 NBA teams and found that among players a “new role has emerged in locker rooms: the House settlement expert.” For the Los Angeles Lakers, that player is forward/former Kentucky men’s basketball student-athlete Jarred Vanderbilt, who explains he “got an email, so I checked my email, and once I found out, I told some of the guys in the locker room to check their email to see if they were eligible for it.” Schiffer notes that Vanderbilt played just one year at Kentucky and is halfway through a fully guaranteed four-year, $48M extension. “Per game, Vanderbilt earns roughly $146K, and his House settlement figure isn’t likely to amount to anything more than a single game check paid out over 10 years. Still, Vanderbilt saw no excuse for not filing for it.” Vanderbilt: “It takes two minutes to do it. And that’s a lot of money. I don’t care how much money you make. That’s still a lot of money. Especially when all you have to do is fill out a little form. And I feel like I earned that money as well.” Dallas Mavericks forward P.J. Washington says Arkansas Men’s Basketball HC John Calipari, who coached Washington at Kentucky, and Calipari’s son, Brad, both nudged him and his former teammates to file for their money. Players are expecting payouts ranging from $40K to $400K, and Nets guard Cam Johnson, who played at Pittsburgh and North Carolina, is expecting upwards of $120K and says he’s accepting the money “on principle.” (link)

ACC Commissioner Jim Phillips is optimistic about getting more teams in the NCAA Men’s Basketball Tournament in the future and says of the recent departures of Duke HC Mike Krzyzewski, North Carolina HC Roy Williams, Syracuse HC Jim Boeheim, Virginia HC Tony Bennett and others: “You don’t replace 5,488 wins, 30 Final Fours and 10 national championships, you just don’t do that overnight.” Phillips also asserts that “we better recruit to a higher level than we have recently. We just have to. That’s the name of the game. It’s high school, but it’s also the transfer portal. We have to continue to invest in basketball, and I think our presidents understand that. I know our ADs understand that, and that’s a commitment from our schools and from the conference.” Additionally, Phillips notes the league must continue to be smart about scheduling, and “ the final and fourth piece is you’ve got to win. You can’t have a challenge and go 2-14. You just can’t. That just cannot happen. No one is accepting that the ACC is a conference that should now and in the future get four bids. We should be at that eight, nine, 10 number and we will be back there. … That being said, even in the last three to four years, even with a reduction in the number of bids, no one’s performed better than we have.” (link)

Tonight’s men’s basketball national championship is particularly meaningful for Houston AD Eddie Nuñez, who played college hoops at Florida. He tells SBJ’s Ben Portnoy; “Sure, I went to school there and I love the Gators. But let’s not make any mistake about it – come Monday, it’s all about the Cougs.” When former Gators HC Lon Krueger was replaced by Billy Donovan, Nuñez explains he decided to stick it out because “it was a place where I wanted to be. … Something told me to stay when I was about to transfer after my first year there. Things happen for a reason, and I wouldn’t be where I am today without Billy, without [then-Florida AD] Jeremy Foley, all those people there that basically gave me opportunities to learn this business. … [Donovan] was a 30-year-old, whatever he was, he was going into practice with us. That’s what people don’t understand, [now-Dayton HC] Anthony Grant, [former Arkansas HC] John Pelphrey and Billy Donovan would practice with us. We didn’t have enough guys. It was absurd. And you know what? They were better than three-fourths of the team.” Nuñez goes on to explain that “Coach Donovan is a mentor, a friend. Man, I love the guy. He’s been there every time I needed him, from when my dad passed away to helping me get into this profession. … Who else better than somebody who’s seen it at a high level?” (link)

VCU AD Ed McLaughlin sits down with AthleticDirectorU’s Steph Garcia Cichosz to offer insight into the Rams’ decision to announce plans to share revenue and explains that “it was important for us to get out in front of it. … I thought it was important for our program to be bold…and light people’s fires of looking at us and saying, ‘VCU’s for real on this.’ We look at ourselves as a program that should be a top 25 program in men’s basketball and women’s basketball and the only way to get there in the future is to make sure you have revenue sharing that matches your aspirations.” McLaughlin and Garcia Cichosz also discuss recent changes announced at the NCAA Convention, including the approval of women’s basketball units, the impact of sports wagering, and issues related to the transfer portal. McLaughlin goes on to reflect on the role of the NCAA and how DI institutions manage and allocate their resources in a future professionalized model and posits that “amateur athletics at the college level is dead. It’s completely dead. If we're compensating them for their name, image and likeness and sharing revenue with them based on that versus pay-for-play, I can get with that. But the reality is this is [how] we're going forward. So, how do we provide an environment where we have terms set on these different things? And my greater concern is the kids who are transferring multiple times without a path to a degree or they’re being promised something and they go there and it doesn’t happen that way.” In the end, McLaughlin believes DI will not look the same. “There are a bunch of schools who will be competing as one subset and schools that have resources competing as another subset…but we’re all still going to play each other and as long as we ensure access to championships, the NCAA can do that and run championships.” More on ADU. South Carolina Women’s Basketball HC Dawn Staley this weekend said she hopes new WBCA President/USF HC Jose Fernandez can secure a separate media rights deal for women’s hoops: “I don't know if he can get that – open up negotiations for a new television deal. Would be nice. We need our own television deal so we can understand what our worth is. I think he also needs to fight for more revenue-share dollars when it comes to women’s basketball because we can’t forget when this case was brought up it was football, it was men’s basketball and it was women’s basketball. So, any percentage that’s less than what we deserve needs to be addressed if we’re not getting it across the board.” Meanwhile, Wasserman agent Emily Jo Roberts tells Front Office Sports’ Colin Salao: “There’s the very old, antiquated idea that you give money to football and men’s basketball because that’s what’s ‘making you money’ and you just kind of throw what’s left to women’s basketball or other women’s sports. I just think that that is an antiquated way to look at this now that we really should be operating much more like a business as opposed to athletic departments.” (link); Connecticut HC Geno Auriemma this weekend added: “For years and years and years we’ve been packaged with all the other Olympic sports, so to speak, in one big chunk. The Men’s Basketball Final Four averaged 15.3M viewers on CBS, making it the most-watched since 2017. Viewership peaked at 20.4M, but those figures are expected to increase when the final data is made available on Tuesday. Front Office Sports’ Amanda Christovich notes total viewership (for the entire tournament, presumably) has averaged 9.9M viewers, up 2% YoY. (link, link)

On3’s Pete Nakos cites a “range of sources” who say Duke will have roughly $8-10M available for next year’s men’s basketball roster. Nakos adds: “One source described the NIL war chest as ‘unlimited.’ … As another source told On3, the Blue Devils have rarely lost out on a recruit or transfer target because of dollars since the collective was founded.” (link)

Speaking of which, the benefactor(s) paying for Duke’s men's basketball roster remains a mystery, according to the Wall Street Journal’s Andrew Beaton, who writes: “In a move that’s highly unusual for a major college program, there’s virtually no online footprint for Duke basketball’s booster collective. That’s not because the Blue Devils have somehow managed to construct a star-studded team without gobs of cash lining players’ pockets, though. Instead, Duke is in a position to compete for its sixth national championship thanks to a group of high net worth donors who have chosen to operate in a way that makes them unique in the braggadocious world of college sports—by conducting their business from the shadows. People involved with the operation say the group’s silence is intentional.” The organization and its founders do have names, however, as Beaton reports three Duke alumni in 2023 “incorporated a non-profit in Delaware. With an address listed as an office building in Arkansas, they called it ‘One Vision Futures Fund’ and applied to do business in North Carolina, according to state records. The address of OVFF, as it’s known, belongs to the office of Duke alum Jeff Fox, the CEO and founder of the investment firm Circumference Group.
