Eastern Washington’s AD search is down to three finalists in former Illinois-Springfield (DII) AD Sarrá, Fresno State Senior Assoc. AD for Development Collins, and Valparaiso Executive Assoc. AD/SWA Jarnigan, who was previously AD at Southern Illinois. Campus visits are set for each candidate between May 25 and June 5. (link)

The Hawaii Board of Regents approved Long Island Senior Deputy AD Angelos as the Rainbow Warriors’ next AD. The Honolulu Star Advertiser’s Reardon reports the vote was eight in favor, two against and one abstention. Several regents described “robust discussion” ahead of the vote with regent Haning saying: “No rubber-stamping here.” (link)

The NLRB yesterday issued a complaint against the NCAA, Pac-12 and USC, alleging they have unlawfully misclassified college athletes as student-athletes rather than employees in football, men’s basketball and women’s basketball, according to USA Today’s Berkowitz and several other outlets. The three entities will go before an administrative law judge on November 7. At that hearing, Berkowitz reports the “NLRB’s general counsel Jennifer Abruzzo will be seeking an order requiring those three entities to ‘reclassify the Players as employees rather than as ‘student-athletes’ in their files, including, but not limited to, their handbooks and rules, and notify all current Players that they have done so,’” according to the complaint. More from Berkowitz. (link); Tulane Sports Law Director Feldman adds more context: “The complaint also states USC, Pac-12, & NCAA are joint employers of the college athletes. This is significant because the NLRA only applies to private employers. But if athletes at public schools are jointly employed by the conference and NCAA, then the NLRA would apply to all. To be clear, this formal complaint was inevitable once the Regional NLRB Director found merit to the unfair labor practice charge back in December. West Virginia AD Baker comments on the revenue gap between the Big Ten and SEC and everyone else: “I think if you are going to thrive in today's environment, and you are not in the SEC or Big Ten, you are going to have to find a way to make a dollar every time you can make a dollar. That's not meant to sound greedy or to take advantage of anything, that's just to point out that our coaches and staff here at WVU, and our league, have fared very well with less money, and you must do everything you can for that gap not to continue to increase.” Lots more. FIU AD Carr says he’s learned a lot about himself and the university during his first 18 months on the job. “I’ve learned that the moment’s not too big. There’s a lot of tough decisions that have to be made, but so many mentors, so many experiences in my past prepared me to make those decisions.” Carr acknowledges there is a lot of work to be done at FIU, but “that’s what excites me. I live for building — not just facilities but building a program.” To do so, Carr believes the Panthers’ 275K living alumni and 56K students will play a major role. “We have power in numbers. We’re in a great city. We just know that there is no ceiling for FIU and we can be anything we put our mind to. That’s what we’re striving to be. … We’re going to be bold and aggressive. Those are two good words to use when we talk about UCF and that’s who we are and what we’re going to be at FIU.” (link)

+ William & Mary has appointed Women’s Basketball DOBO Perkins to the newly created position of Asst. AD for Student-Athlete Development. In the role, Perkins will be responsible for developing partnerships across campus and throughout the alumni and fan base, focusing on three main areas: career preparation, leadership development, and community service. To that end, Perkins will also be responsible for the launch and oversight of a new program called EXCEL, which will be focused entirely on the holistic development of our student-athletes. (link)

Crakes Media’s namesake contends there “won't be a need to resolve anything with Pay TV distributors as any direct-to-consumer (DTC) ESPN service will be offered at the unbundled price which will be very high...It will not be a bargain & it will be priced so that it's not competitive with the bundled ESPN price within Pay TV bundles.” (link); Crakes also disagrees with The Athletic’s Staples, who submits that leagues adopting their own DTC platforms will eventually make more money than by selling rights fees. “Strategic problem is they cannot. For years T1 properties received full (or near full) reach & top rights fees thx to bundled distribution that levered natural monopoly economics to enable scale at bundled prices. Any unbundled DTC service will neither scale nor be affordable. … If there’s one thing we’ve learned over the past year from all the incorrect media driven steaming narratives of the past five years it’s that universal league based exclusive DTC will most likely never be the most profitable distribution route…Yet that idea persists.” (link)

Texas A&M announces ticket price increases for the 2023-24 men’s basketball season. “Ticket price increases range from 21% in the balcony and prime balcony, 24% in the prime sideline and sideline/corner court, 27% on the baseline and 31% for floor and courtside. Annual seat contributions through the 12th Man Foundation will remain the same.” (link)

Oklahoma State’s investment in softball features a differentiator that few – if any – other programs have: a full-time strength and conditioning coach dedicated to the sport. Cowgirls HC Gajewski: “I think we’re the only team in the country, to be honest, in softball. It’s something I’ve wanted from Day One. And I’m a little bit surprised that we have it, but I’m thankful. … That’s one of the things I sold [Alabama transfer] Lexi [Kilfoyl] on in the recruiting process. I told her, I think you can get better, I think you can get more fit. That’s only going to help you stay healthy. We’ve got a guy that you can go see all day long. Whatever fits your schedule, he’s softball only.” (link)

+ Women Leaders in College Sports announces that applications are open for the Pioli Family Endowed HBCU Scholarships, which will double to 13 this year thanks to the Pioli family doubling its endowment in 2022. The scholarships will be awarded to 13 women working in athletics at an HBCU or who graduated from an HBCU. Each woman must demonstrate their commitment to intercollegiate athletics and have a desire to advance in athletic administration. The scholarship provides a one-year Women Leaders in College Sports membership. (link)
+ Minnesota House Speaker Hortman says legislation that would legalize sports gambling is unlikely to make it to the floor for a vote this session. “I think we are probably out of time.” Hortman notes the bill would still have to pass through “two or three committees” before receiving a floor vote. ACC Commissioner Phillips sounds off on the need for a federal NIL standard: “As it relates to name, image and likeness, there has to be agent registration. There has to be a standardized contract. There has to be a registry. And then four there has to be education on campus. And that should just be open, that should be — that should be available for schools to see. Each other, etc. And I think it allows at least a little bit of disclosure that we’re not seeing in that space. The standardized contract, again, just everybody fills out the same thing whether it’s a $500 name, image and likeness opportunity or a $500K name, image and likeness opportunity. So, that’s part of it.” Phillips adds: “Student athletes should absolutely be able to monetize their [NIL]. But at the end of the day, if you’re going to have intra and interstate competition, there has to be some level playing fields on that.” On the tampering that has reportedly pervaded the space, Phillips remarks: “We all know that [NIL] was never meant to be an inducement. It was really meant to be a serious and an honest way for young people that have great talents and a likeness and an image, that they could monetize it. That they’d be able to do that. But the two have been connected like a magnet, which is disappointing. And so that’s going on all across the country.” (link)

Arizona State AD Anderson reiterates his expectation that a media rights deal will be signed this summer: “We tried to get in front of the Big 12 with the momentum of the Big Ten, it made sense to go out there and try in advance, even more than a year, to get a deal done. That risk in doing it was people thinking this was the normal time sequence and when you don’t get it done and it's four months, five months, they think you’re stumbling all over the place." Regarding the value of the deal, Anderson suggests the $40M-per-school range might be a tad optimistic. “You have to be honest about the reality of the market and what with companies struggling and cutting back, it’s probably not going to hit the vision some of the folks may have had earlier. Some of those things might have been a little pie in the sky based on what the Big Ten was doing and what other conferences had going. … As long as we are able to get up toward the higher 30s we will be able to compete, stay together and maybe reduce the gap between us and the others through other things that make our conference special.” (link)

The Athletic’s Auerbach and Olson report there is skepticism among those in the AAC and Big East that Connecticut has Big 12 ambitions, noting that “one of UConn’s biggest frustrations as a member of the AAC was the disjointed and spread-out nature of the conference, as well as the loss of traditional basketball rivals in the Northeast.” One Big East source observes: “They just worked so hard to get out of a league that required them to go play UCF just to go back to a league where they’ll have to go play UCF? I don’t see it.” Meanwhile, Huskies AD Benedict says: “At this point in time, I’m not aware of a decision in front of me that I have to make. So what’s going to happen two days from now, two weeks from now, a month from now, six months from now, is anyone’s guess. There’s a lot of posturing that’s going on around the country…but ultimately, until you have to make a decision, you don’t know and that’s not where we currently are.” Looking at the bigger picture, Auerbach and Olson report there is a belief among administrators inside and outside the Big 12 that Commissioner Yormark is attempting to position the league to be the eventual landing spot for all teams who don’t wind up in the SEC and Big Ten, making the Big 12 the de facto third and final power conference. LEARFIELD has renegotiated terms with six of its multimedia rights partners as the company deals with $1.1B in debt maturing this year, according to Sportico’s Caron. LEARFIELD CEO Gahagan: “The schools that we approached recently were strictly those under legacy deals that yielded significant losses. When we sat down with our partners, our number one focus was both flexibility and ensuring that we could put the best possible partnership in place for those schools.” Gahagan further insists there is “absolutely no reason for any school partner, brand partner, licensee, retailer, any Learfield partner or stakeholder to be concerned. Learfield is not a retailer in existential threat. Learfield is a market-leading, highly profitable, innovative company that will be in a significantly healthier position on the other side of this process. Auburn AD Cohen talks about renovations to Jordan Hare Stadium, saying: “Everything's been on the table in terms of facility updates, and the north end zone is something that has come up conversationally between myself and [President] Roberts. I'd say we're just very much in the research phase of that, looking at the history of that. I do think that there are many parts of Jordan-Hare that can be updated, worked on. It's one of the great, if not the best, game day atmosphere in college football, but you're always looking to improve the experience for the fan. … Obviously our student section is tremendous, and we want to accentuate that. We want to accentuate the premium opportunities. There have been some things that have happened around the country in terms of making upper decks and seating better for the fans, and we're going to look into that, as well.” (link); The Tigers are also conducting research on a potential new apparel partner, according to Cohen, who notes the exclusive negotiating window with Under Armour expires September 1, at which point “we're allowed to speak openly about this subject. … And I have had some discussions with Under Armour. Virginia Tech AD Babcock covers several topics with the Richmond Times-Dipsatch’s Teel, including the Triumph NIL’s acquisition of Commonwealth NIL, about which Babcock observes: “When you can aggregate all your student-athletes under one umbrella, you’ve got strength in numbers, some critical mass for advertisers. I think that’s the natural evolution of collectives.” As far as whether NIL-related donations are interfering with dollars that would have previously gone to the athletic department, Babcock says it’s too early to tell. “But I’m sure it will pull slightly away from our fundraising. NIL isn’t for every donor. ... We want to be competitive in the NIL space, but I don’t think you have to be at the top. We are still finding in the NIL area that, yes, that’s a piece of it. But there is still a driving force of where do they want to go to school and the relationship with the coach.” Meanwhile, Teel points out Virginia Tech increased football support staff investment by nearly 80%, from $1.9M to $3.4M in FY22, while Football AC compensation increased by 33%, from $4.2M to $5.6M. Babcock says the ACC has been “helpful in that regard with the revenue that’s come in from the network. That didn’t exist a few years ago.” More. (link)

Utah State Interim AD Bovee talks with KSL about the current state of the Aggies and acknowledges that when it comes to NIL, “I don’t think, at our level here in Logan, we can compete with the Power 5s. The pricing at the collegiate level is starting to happen like it is in the pro market. Every position has its own dollar figure. We’re not going to be in that situation.” Bovee also talks about the philosophy of managing programs, saying: “You hear leaders say, ‘I do a once-a-year evaluation.’ Well, that’s a faulty way to go. You should be evaluating every day. If you’re doing that right, then there’s not going to be a surprise at the end.” On conference realignment, Bovee observes: “At that point, it’s where do you get better value. Is it better to jump into a conference that potentially could be imploding? Or, is it better to stay with the group that you are solidified with and invite a couple of others to join you?” (link)

ESPN is actively preparing to stream the network with a project internally titled “Flagship,” the Wall Street Journal’s Toonkel and Krouse report, noting there is no concrete timeline for the shift and that ESPN would continue to offer the TV channel after launching a streaming option. Toonkel and Krouse also report ESPN has begun “securing flexibility in its deals with cable providers to offer the channel directly to consumers. … The financial terms of those deals couldn’t be learned. The company is having similar discussions with pro sports leagues as those rights deals come up and has secured the same flexibility from at least two major leagues.” (link)

The Pac-12 Board of Directors has approved a series of football broadcast initiatives to increase pregame and in-game access to student-athletes and coaches. The initiatives include in-game head coach interviews; pre-game and halftime locker room camera access; coaches and select student-athletes wired on-field pre-game; cameras in the coaches’ booth without sound; and extended handheld camera permission. U.S. District Judge Morgan has ruled that former LSU Football HC Miles, several LSU Board of Supervisors members and two attorneys who previously represented the university can all be forced to give depositions in an ongoing lawsuit involving former Tigers Assoc. AD Lewis. Morgan also ruled that the LSU Board of Supervisors must also provide Lewis with unredacted billing records and other documents related to Miles’ settlement agreement with a former student who accused him of sexual harassment. Miles is no longer a defendant in the case, but Miles’ attorneys want to depose Miles about whether he retaliated against her and created a hostile environment between 2012 and 2016; she also wants to question him about the alleged concealment of his prior sexual harassment allegations.
