The NCAA’s national office exceeded its financial goals for the fiscal year, and $55M of the resulting budget surplus will be used to offset payments for damages in the House settlement. Doing so would reduce back damages for each conference this upcoming fiscal year by 33%. The NCAA explains this decision to “direct the surplus to reduce the cost burden was made in consultation with South Dakota Attorney General Marty Jackley, who raised financial concerns of some schools that are not in autonomy conferences.” NCAA President Charlie Baker: "Thanks to financial reforms at the NCAA, the national office will be able to cover a larger share of the back damages, resulting in significant savings for our schools in this first year. After discussing the cost implications with many schools in DI, and after productive discussions on the matter with Attorney General Jackley, we are pleased to invest these surplus funds back into DI athletic departments." (link); The agreement is part of a settlement with South Dakota and Jackley, and Sportico’s Daniel Libit reports: “According to Jackley, the agreement also grants the attorney general the opportunity to collaborate with the NCAA on potential future reductions, while insuring that monies the schools receive from the newly established DI women’s basketball fund would remain untouched. Additionally, the NCAA has committed to continuing to host championship events in South Dakota.” (link)

Montana State AD Leon Costello says of how the department will operate under the House settlement: “We’re never going to be able to offer millions of dollars. That’s just not in our cards. But, I think we can make a compelling argument why people still want to come to MSU.” Montana AD Kent Haslam says he’s frustrated by the back pay component of the settlement: “It’s not fair, obviously, that the University of Montana is going to pay $2.4M over 10 years to pay back damages to student athletes who never participated here.” Haslam also indicates the Griz won’t opt in until 2026 at the earliest. (link)

North Carolina AD Bubba Cunningham says the Tar Heels have sold out of its football season ticket allotment and are now selling single-game tickets. WRAL’s Brian Murphy notes that comes after raising prices on season tickets in the wake of HC Bill Belichick’s hire. Meanwhile, UNC Chancellor Lee Roberts says the 2026 football opener against TCU in Ireland is an example of the kind of profile and opportunities "we're hoping to have through our investment in football." The South Carolina Supreme Court has issued a ruling regarding JMI's attempt to sue Clemson for damages over their discontinued multimedia rights contract. Clemson can now pursue the millions of dollars it says JMI never paid, according to the Post & Courier’s Jon Blau. From the ruling: “We AFFIRM as modified herein the circuit court's dismissal of Appellants' declaratory judgment actions. The legal right Appellants assert is at stake is the right to have a court of the unified judicial system decide their contract claims. They have legally and knowingly waived this right in their respective contracts with the Respondents. Therefore, there are no legal rights at issue and the legal question presented is a purely academic exercise that is not justiciable.” (link)

SBJ’s Ben Portnoy takes a look at Washington’s new 12-year deal with Learfield and notes that “Learfield highlighted its links with high-exposure brands through varying national campaigns as part of its pitch. That largely fell in line with what Washington has striven to do during [Huskies AD Pat] Chun’s brief tenure in creating more business opportunities for the Huskies. For example, UW announced in October the creation of ‘Dawgs Unleashed,’ an NIL arm designed to integrate with its multimedia rights partner in securing marketing and brand deals for athletes and capitalize on business opportunities in Seattle.” Chun: “Part of the tactic was now you throw Learfield’s arsenal on top of that (Dawgs Unleashed) and then that allows us this two-pronged approach where we will work together to try to accumulate a portfolio of opportunities for current and future student athlete endorsements. … We believe that at Washington the opportunities that we’re going to [have to] be able to create real NIL [deals] for our student athletes is going to be a differentiator for recruiting.” (link)

CBS’ Brandon Marcello reports that NIL contracts with the Arkansas-focused Arkansas Edge collective “commonly include language requiring players to reimburse 50% of the money remaining on their deal should they leave for another school,” and former QB Madden Iamaleava “had roughly eight months remaining on his contract, meaning the collective expects a six-figure buyout.” Marcello subsequently observes that “one NIL contract dispute will not bankrupt a multimillion-dollar NIL collective, but multiple players departing without paying buyouts could erode the school's negotiating power with future players. … In a 2023 amendment, the Arkansas Publicity Rights Act gave the University of Arkansas the power to sue agents, coaches and other third parties who "give or promise compensation" for the use of a player's NIL if that player has already signed an enrollment contract at a university in Arkansas. Arkansas has not yet pursued such a case, but now that [AD Hunter] Yurachek is speaking up on improprieties, nothing seems off the table.” (link)

Oklahoma Softball HC Patty Gasso admits to feeling some disappointment when seeing Cal and Stanford set an all-time attendance record at Stanford Stadium over the weekend: “We like to claim big moments, so when I saw that I was like, ‘Oh,’ and then I’m like, ‘But, yeah.’ Because that’s pretty cool.” The previous overall record was set in Oklahoma City on the first day of the 2024 Women’s College World Series between Oklahoma and Oklahoma State when 12,566 fans packed into Devon Park. Gasso also notes it may be time for the Sooners to play a game in Gaylord Family Oklahoma Memorial Stadium: “I know [OU AD] Joe [Castiglione] was talking about we’re making changes in the football stadium and we could nudge a little here and there and maybe create that. That was a long time ago, so I probably need to revisit that. … I think it would be amazing to see a full football stadium. ... I need to make that phone call.” (link)
|
Clemson’s “optimistic projection” is to bring in roughly $250K from the sold-out Savannah Bananas game at Memorial Stadium on Saturday. Libit: “Under terms of the event agreement obtained by Sportico, the university will retain all the net ticket revenue for premium and club seats for the Bananas game, while the Bananas keep all net ticket revenue from the stadium’s general seating sections. The Bananas’ share, however, excludes 500 complimentary general admissions tickets that the university can use for students or other parties. … A ‘responsibility matrix’ attached to the event agreement outlines a clear division of labor and revenue: Clemson will assume both the costs and revenues associated with concessions—including beer and wine sales and suite catering—parking, and any Tigers merchandise sold on the day of the event. On the operations side, Clemson is responsible for event security, custodial services and traffic staff, while the Bananas will manage ticketing and host a fan fest.” Additionally, the university will provide police, fire, and medical personnel, including two advanced life support ambulances – one designated for the teams and one for fans. St. Bonaventure is preparing to upgrade Handler Park at McGraw-Jennings Field, home of the Bonnies’ baseball team. Beginning in May, construction will begin on a new backstop and netting system extending down the third base line; bleacher seating with backrests for over 400 fans; ADA accessible seating behind home plate; a two-story press box with enhanced broadcast and media capabilities and updated sound system. The project is expected to be completed this fall. (link)

More Legal Matters…
+ U.S. District Judge M. Casey Rogers has set a two-week trial for July 20, 2026, in the case of former Georgia QB Jaden Rashada v. Florida Football HC Billy Napier, et al.. Rogers: “I am not deciding any issues related to NIL laws. There is no insurance coverage involved and Univ. of Florida nor NCAA are parties. This is not a complex case.” When acknowledging how busy the parties are in scheduling depositions, Rogers stated: “It’s always football” and offered to accommodate schedules but imposed a strict deadline of October 1 to take party depositions, including those of Rashada and Napier. (link)
+ Former New Mexico men’s basketball student-athlete Shane Douma-Sanchez, who claims he was assaulted by former teammate Tru Washington, is attempting to amend his lawsuit against the school to include Washington as a defendant. Sportico’s Daniel Libit explains: “At the same time, Shane Douma-Sanchez is attempting to highlight what he contends are the broader dangers of the current name, image and likeness system in college sports. But before he can make that larger case, Douma-Sanchez must first see whether his unconventional litigation, which seeks to leverage New Mexico’s plaintiff-friendly laws, can survive dismissal on multiple grounds. Douma-Sanchez, a Native American player who asserts his ethnic identity played a role in his mistreatment, originally filed suit in December against UNM and former head basketball coach Richard Pitino. … The lawsuit, filed in New Mexico district court, alleges violations of the state’s civil rights and tort statutes.” The complaint also characterizes the situation as a byproduct of the current NIL system, arguing that it promotes a mercenary mentality, erodes accountability and creates an environment where misconduct by talented players goes unchecked. SEC Commissioner Greg Sankey spoke during the CAA World Congress of Sports yesterday in Nashville and said the House settlement is “not the end of the story. It is a chapter. It’s a necessary chapter. And one of the realities around other ideas related to college sports is they have started at a point ignoring what we have to deal with from the past. … The coping that you hear is we’re trying to figure out what we have to deal with from our past. That’s the chapter we’re in right now.” Regarding the clearinghouse component of the settlement, Sankey remarked: “That’s sensible. That’s not taking away opportunities. That’s supporting healthy opportunities. ... Part of the challenge is there’s really not a model that exists for that in the professional world because I can walk down the grocery store aisle in Skaneateles, New York, at Top Supermarket and Josh Allen has a breakfast cereal for sale. That’s pretty cool. Doesn’t have any logos. Doesn’t have any marks, but that’s name, image and likeness activity. If some young college person wants to market a breakfast cereal, knock yourself out. That’s what it was supposed to be, and we’ve lost sight of that reality.” Also from Sankey: “Not that anyone listens to my football media days speeches, but in 2019, the line was, ‘When you change the economics of college sports, you alter the Olympic development program in this country.’ Part of the Congressional conversation [around standardized NIL legislation] is that recognition.” (link)

Ohio State AD Ross Bjork is calling for changes to the college football calendar, including the College Football Playoff and the transfer portal. “We've had so many disruptions over the last five-plus years that I think the time is now to not be reactive, be proactive. When we had this setting here with the commissioners, our job was to provide feedback on what it was like to go through the 12-team playoff…but it all gets impacted by the calendar. I felt it was important to lay that out with everyone in the room to say, separate from the CFP process, if we don't fix our calendar as an industry, then we're going to continue to have unintended consequences.” Bjork also noted that because OSU started its spring semester on January 6, the Buckeyes had to apply for waivers around countable athletically-related activities in the CFP. Texas, on the other hand, did not have to apply for such waivers because UT starts classes later. "When you don't have class, there is no limit to CARA hours. It created some disadvantages. It all goes back to what's countable CARA hours, NCAA structure. The portal is the next big conversation after the House case and truly what kind of rules can we set? Will we have the authority around transfer rules to set some parameters?" Regarding the transfer portal window, Bjork would like to move to a 10-day period in May for all fall sports, telling ESPN this will align with revenue-sharing if the House settlement is approved because he expects most student-athletes to sign their rev-share agreements in June. (link)

Cal Poly AD Don Oberhelman says of the decision to discontinue swimming and diving: “It’s painful. It causes anger and a lot of misdirected rage and things like that. It’s an awful situation to go through, but we didn’t go into it lightly.” Oberhleman cited multiple issues, including budget reduction, the House settlement and Cal Poly’s large number of sports offerings, as factors in the decision. “We’re really, really large and we’re trying to hold on. What it’s starting to do is impact the student-athlete experience.” Oberhelman indicated that the 8% budget cuts to California State universities are impacting athletics, and that’s on top of the $550K the House settlement will cost the Mustangs each year for the next 12 years. “We have to start tightening our belts and figure out how we can function in this new reality without further cuts. … This is just the beginning rather than the end of what these new realities are going to look like for us. We’re doing exactly what we’re supposed to do, which is prepare for those realities, uncomfortable and painful as they may be. We have to make sure our sports are primed for success, and we were just too big at that point in time.” (link)

North Carolina Superior Court Judge Matthew T. Houston declined to grant Duke football student-athletes Ryan Smith, Tre'Shon Devones and Cam Bergeron and North Carolina football student-athlete JJ Jones a preliminary injunction for an extra year of eligibility and explained that “I think the evidence and record at this point is not sufficient to support a finding that there is a likelihood of prevailing on the merits and it's largely an issue of what the record supports. … I don't think, at this point, that there's sufficient, adequate information in the record to support a finding…as to an unreasonable restraint of trade." Diana Florence, an attorney for the players: “It just seems incomprehensible that one more year for various reasons that each of them deserves that they shouldn’t be granted that, and we’re hopeful that as we can fully present our case that we will be able to prove that.” (link)

San Diego unveiled its new $35M Basketball Performance Center, which features a full-length court with a viewing terrace, an additional shooting court, sport-specific strength and conditioning room, sports medicine and hydrotherapy facilities, team locker rooms and lounges, a film room, and men’s and women’s basketball staff offices. Men’s Basketball HC Steve Lavin: “In a sense, this is a re-launch. We’re in a revolutionary era in college athletics, and it’s the first time since I’ve been here where we’ve had alignment with roster space, funding with NIL and revenue-share, and a state-of-the-art facility. When you put those three together — with USD’s tradition, being a world-class academic institution, and our location in San Diego — it’s a pretty difficult situation to not be impressed with if you’re a student-athlete or parents of a prospect. So, it does lift us. It elevates our programs, respectively, in terms of the competitive landscape that we’re in.” (link)
|
The NCAA found that Fordham “failed to monitor its men's basketball program when eight prospects were provided impermissible benefits during official visits and the program violated publicity-before-signing rules with 24 prospects. As a result, Trevonn Morton, director of men's basketball operations, and Keith Urgo, then the men's basketball head coach, violated ethical conduct rules, and Urgo violated head coach responsibility rules. Additional violations occurred when Fordham football assistant coach James Lenahan engaged in sports betting activities. Lenahan's case was resolved separately via negotiated resolution in December 2024.” Penalties include, but are not limited to, a $35,000 fine plus 2% of the men's basketball program budget, a two-year show-cause for Urgo, including a suspension from 12% of the men's basketball regular-season contests, a one-year show-cause for former AD/current St. John’s AD Ed Kull, a three-year show-cause order for Morton, and a vacation of team wins and records over the course of the two seasons in which the ineligible players competed. The NCAA said U.S. Supreme Court precedent should excuse it from a suit by three former swimming student-athletes over a transgender athlete’s participation in a 2022 competition at Harvard. More behind the Law360 paywall. (link)

Disney CEO Bob Iger during the CAA World Congress of Sports remarked that the launch of ESPN’s DTC Flagship product “might be the biggest move since getting the full season of the NFL. … One of the things I love about the product to come, that you’re developing, is that we will build into that elements that will be tailormade for young generations of sports fans. They like multiscreen experiences.” Iger added that “I know how important exposure, distribution and access to consumers is, and that doesn’t come cheaply, and it doesn’t come easily. It’s not always about if you build it, they will come. You have to build it, and you have to figure out a means of delivering it to consumers that are both very pro-consumer and pro-sports, meaning the organization, and obviously pro the business that is covering those sports. … Technology is a sports fan’s heaven in many respects. We’re now entering a new age where the technology side of our business has actually risen to a level that is almost equal to the entertainment side -- but probably an unbelievable partner to entertainment -- more so than ever before. And to me, that’s very exciting. And also, the ability to package, which we’ve done with our entertainment offerings with our sports offerings, whether we were dealing with multichannel operators or whether we’re dealing with consumers that want to buy streaming services, I think has real value both for us as distributors and also for consumers.” (link)

The Athletic’s Chris Vannini and Scott Dochterman report that the Rose Bowl kickoff change is “expected to be a permanent one: Although the [College Football Playoff] bowl contract for 2026 and beyond has not yet been finalized, Rose Bowl officials said they’re planning for this kickoff time to remain in place. For years in which the Rose Bowl would be a semifinal in the expanded CFP, game officials have told the CFP they would rather remain a quarterfinal with their typical New Year’s Day slot.” Rose Bowl Chief Administrative Officer Kevin Ash: “We’ve thought it through. We’ve known this could be coming. Basically, we’ll sit there in the third quarter and play things out, see how they’ll play out later in the game. There are some advantages. A quick game, you may get people out of there during sunlight and into their cars. There are some positives.” (link)

The IRS last week denied another NIL collective 501(c)(3) status, and James Moore & Co. Partner Katie Davis notes: “The IRS might be under-resourced, but they’re still denying 501(c)(3) status to NIL collectives. This is your friendly reminder that student-athletes are not a charitable class and payments are considered non-incidental private benefits.” The name of the collective has been redacted. (link)
