SBJ’s Ben Portnoy asks Boise State professor Sam Ehrlich, Kennyhertz Perry attorney Mit Winter and Church Church Hittle & Antrim Partner Kelleigh Irwin Fagan what happens if the House settlement doesn’t go through, and Winter says: “We’ll see many schools just move ahead with paying their athletes this summer regardless of whether the House settlement receives final approval. … Many state laws or executive orders already contradict NCAA rules and allow schools to directly pay. And even in states without a law like that, there’s really little to no risk of an NCAA compliance issue…when other schools are doing the same. Where things would get interesting is with the salary cap, the restrictions on collectives, and the roster limits. Some conferences might decide they’re going to implement those things at the conference level, where there’s less risk of having antitrust issues. But if they do that, then they run the risk of putting their schools at a disadvantage in recruiting if other conferences don’t impose the same limits and restrictions. And if all conferences, or even just the P4, put in the same limits and restrictions without the protection of the House settlement’s release of claims, then the conferences will likely find themselves involved in another antitrust lawsuit.” Fagan adds: “I don’t know how you peel back so many things that have happened in terms of direct payments to student athletes, decisions made on roster limits and scholarships. If I’m guessing, there has to be some sort of temporary or interim legislation from an NCAA standpoint that makes some of this permissive.” (link)

Sportico’s Michael McCann unpacks U.S. District Court Judge Paul A. Engelmayer’s dismissal of an antitrust lawsuit brought by former Kansas men’s basketball standout Mario Chalmers and 15 other former players over the use of their NIL. McCann points out that Engelmayer agreed with several of the NCAA’s defenses, including that the claims are time-barred, and “stressed that the alleged wrongful acts occurred in the 2000s and 2010s, when the players agreed to follow amateurism rules as a condition of eligibility. Even if the NCAA continues to benefit from NIL related to the plaintiffs in historical videos and other promotions, Engelmayer said the relevant legal question is when they accepted the rules.” From Engelmayer’s ruling: “The use by the NCAA or a conference defendant of a plaintiff’s NIL acquired in the 1990s or early 2000s is a continuing effect – a consequence – an outgrowth of the alleged anticompetitive conduct. It is not a part of it.” Chalmers can appeal the decision to the U.S. Court of Appeals for the Second Circuit. (link)

Utah will discontinue its beach volleyball program at the end of the academic year. Utes AD Mark Harlan: "This was an extremely difficult decision, and we did not arrive at this conclusion without a significant and appropriate amount of thought, consideration and consultation. We looked at the landscape of intercollegiate beach volleyball and the future opportunities of our student-athletes. Currently, there are only 12 beach volleyball programs among power conference institutions, with little evidence of the sport expanding at this time. With the sport's growth stunted, and without the home facilities with amenities that allow us to host championship-level events, we are not providing the world-class experience that we seek to provide to our student-athletes." Clemson AD Graham Neff describes Saturday’s visit by the Savannah Bananas to SBJ’s Ben Portnoy: “It was a different vibe than a football Saturday. Namely, because about 40% of the ticket buyers were from out-of-state, we don’t have the exact customer data. The Savannah Bananas own that. But generally, it was a lot of first-time-to-Clemson, first-time-to-Memorial-Stadium folks.” Neff estimated the school would bring in somewhere between $400K and $600K in gross take from the game, though exact figures have yet to be determined. The Bananas received revenues from ticket sales and merchandise, while Clemson took in parking, premium sales and F&B, which included beer and wine, and Neff explains: “This was a big opportunity for that from a revenue standpoint, sure, but as much or more so from operations, management and mitigation efforts in the stadium. [At the] spring game we announced 35K [fans]. Obviously, baseball and softball are on a lesser scale. So, as we point toward fall football and Week 1 for us being LSU, we used this as a huge opportunity to run through our alcohol points of sale and distribution plans in an 80,000-[person] scale event.” (link)

Sacramento State AD Mark Orr explains that Hornets Men’s Basketball HC Mike Bibby reached out to Shaquille O’Neal about the GM position and notes that Shaq’s role first and foremost will be as a role model for student-athletes. “Not only was Shaq one of the greatest basketball players the world has ever seen, he's also been successful off of the court. Obviously a successful businessman, entrepreneur, and there's so much that our student-athletes can learn from him. … With today’s NCAA, [NIL] opportunities for Sacramento State to generate revenue not only for our athletic program and our university, but also for our student-athletes is another area that I think Shaq can add a lot.” (link)

On3’s Andy Staples submits that the future of the SEC’s football schedule may be a function of the College Football Playoff format for 2026 and beyond: “Automatic bids in the next CFP format would be more likely to prompt the SEC to move to nine conference games. If the CFP leaves the choice of the teams mostly in the hands of the selection committee, a nine-game conference schedule becomes a much tougher sell – even to schools that previously supported adding the ninth game.” While SEC Commissioner Greg Sankey has said previously he’d like the scheduling issue to be resolved before spring meetings later this month, Staples notes that some of the coaches, ADs and presidents “would like to know the next CFP format before they make any decisions.” Staples also points out that “now it seems that a ninth game probably will result in more revenue for SEC schools, provided they don’t water down their non-conference schedules in exchange. But even officials at schools who once stumped for a nine-game schedule want to know whether the SEC will have guaranteed spots in the CFP before they commit to the extra conference game.” One AD says: “It’s probably more important than the revenue piece.” (link)

With the Pac-12’s 2025 media rights deal set, The Mercury News’ Jon Wilner wonders whether the CW, CBS and ESPN should be considered the leading candidates for a long-term deal when new members come aboard in 2026. Short answer: “Not necessarily.” Wilner notes that “although The CW, CBS and ESPN could be involved in the multiyear agreement, neither Fox or Warner Bros. Discovery (TNT and TBS) should be ruled out as possible partners once Boise State, Colorado State, Fresno State, San Diego State, Utah State, Gonzaga and at least one additional school join the conference.” Wilner also points out there’s an “added complication to the longer-term contract: football game inventory. The rebuilt Pac-12 is evaluating whether to play seven, eight or nine conference games – a process that depends, in part, on expansion decisions. At least one school must be added to comply with conference certification rules.” Wilner goes on to observe that the “lineup of partners for the 2025 agreement (The CW, CBS and ESPN) suggests the Pac-12 is prioritizing exposure on linear TV for its longer-term deal — a wise move given how the sport could bifurcate into upper and lower tiers in the 2030s. Many believe the Big Ten and SEC will expand again; others are convinced a super league will form. For schools in the rebuilt Pac-12, the rest of the decade could be tantamount to an audition for inclusion in whatever comes next.” (link)

+ LSU Executive Deputy AD/COO Keli Zinn has received a new five-year contract that started April 25, 2025, and ends June 30, 2030, according to CollegeAD, which reports Zinn’s base salary is set at $425K. Zinn will also have the chance to earn up to $90K in football-related bonuses, $15K each year the men’s or women’s basketball team participates in postseason play, 4% of her base salary if LSU teams have an APR of 940 or greater, 6% of her salary if the Tigers finish in the 11-20 range of the Learfield Directors’ Cup, and 8% if they finish in the top 10. Should LSU terminate the contract without cause, the Tigers would owe Zinn a buyout equal to 90% of any remaining salary due over the remainder of the agreement. (link)

Fanstake recently raised $6.25M in seed funding, and CEO Greg Glass tells Sportico’s Jacob Feldman he believes schools will need to find new revenue sources to pay players and fund their athletic departments regardless of changes to the industry. “The biggest thing for us was how do you expand that donor base? Because today it’s just the high net worth, affluent alumni that are contributing. Can you tap into the fanatical fan base beyond that?” Glass also notes that ~18K users have so far combined to offer nearly $500K and says the next phase of development will include gamification elements, such as rewards that accrue as users offer players more money. “We are focused on athletes getting fair market value as much as they possibly can get. Getting the fans the ability to participate in a way where it’s engaging and fun for them ends up helping the schools.” Feldman reports that Courtside Ventures led the latest funding round, with participation from Will Ventures, Susa Ventures, Scrum Ventures, Myriad Ventures, Alumni Ventures and others. Tennessee Tech AD Mark Wilson will resign at the end of this academic year after 21 years leading the Golden Eagles. Mark has been a beacon to the University and the Cookeville community, ushering in new levels of athletic, academic, and community success. Rutgers has retained TurnkeyZRG to assist the newly formed advisory committee on the school’s AD search. The committee consists of Senior Advisor to the Rutgers University Foundation President Marco Battaglia; Rutgers Business School Professor and Board of Advisors Chair Arthur Certosimo; Field Hockey HC Meredith Civico; Rutgers Board of Governors member Hollis Copeland; Rutgers Board of Trustees member Robert H. Friedman; Academic Athletics Oversight Committee Faculty Representative/School of Environmental and Biological Sciences Dean of Academic Programs Ann Gould, BOG member Gary B. Taffet; SVP for Strategy/Chief of Staff Brian Ballentine; and EVP/CFO J. Michael Gower. President Jonathan Holloway will work with the group and, when named, his successor as university president to select the finalist. Interim AD Ryan Pisarri said earlier this year that he “hopes to be part of the process” when the university began looking for candidates to fill the role full time. (link, link)

While nothing has been finalized, Yahoo’s Ross Dellenger reports that a “proposal to phase in the new roster limits [for the House settlement] has emerged.” Dellenger adds that “such a move – the grandfathering-in of roster positions – comes with a bevy of questions, concerns and uncertainties. Will schools be mandated to grandfather-in roster positions? Or will it be voluntary? What of players who have already transferred elsewhere? What happens to recruits who signed with other schools because their original commitment wasn’t honored? And, most notably, how exactly will the judge react to whatever proposal is put forward?” Baylor AD Mack Rhoades told Dellenger last week that “it makes it difficult because there are institutions – including ourselves – that have already had conversations with head coaches about roster limits and some of those coaches have already had conversations with those particular individual student-athletes. How do you go back to do that? What will be interesting moving forward is, is this a mandated grandfather-in or is it optional and each school will choose how to do that? If it’s mandated, there’s some work to do. There are schools, programs and coaches and ADs who are going to have to undo some of those conversations.” Michigan AD Warde Manuel last week also indicated the Wolverines have made decisions based on the settlement but believes in grandfathering in the roster limits. “This is what we should be doing. … It was wrong for us to go to the (roster) number in just one year.” While details of the proposal remain unclear, Dellenger notes the “current belief among multiple college administrators is that the brief will permit schools, at their own discretion, to protect or grandfather in any current player on a roster and those cut this year due to roster limits. A school would be expected to track their protected roster spots with a rolling list of exceptions. Those protected athletes would presumably roll off the exception list as their eligibility expires.” (link)

The Pac-12 has finalized its TV partnerships for the 2025 season, with The CW, ESPN and CBS combining to show the 13 home games involving Oregon State and Washington State. Commissioner Teresa Gould: "Having Pac-12 football featured across three leading broadcasters in CBS, The CW and ESPN in 2025 will provide tremendous exposure to showcase Oregon State, Washington State and our brand in the Pac-12's final season before expansion. We are thrilled to continue our partnership with The CW, to welcome a new partner in CBS Sports and to see a return of Pac-12 football on ESPN." ESPN’s Kyle Bonagura notes that “The CW, which had the rights to all the home games for OSU and WSU last season, will retain most of the 13-game allotment with nine games on its air, with the other four split between CBS and ESPN.” The announcement did not include terms of the current agreement or details about 2026 and beyond. Northwestern announces a partnership with Legends and JMI Sports for a new multi-year multimedia rights partnership supporting the new Ryan Field, Northwestern Athletics and the broader Northwestern campus. Legends and JMI will begin their multimedia rights efforts with the launch of a Founding Partnership plan for Ryan Field. Their full complement of multimedia rights efforts for Northwestern Athletics and Northwestern University's campus will begin in July of 2026. (link)

The USF Board of Trustees has approved the updated plan for the Bulls’ new football stadium. The plan presented by USF leadership includes a project cost of $348.5M, which has been revised from what was approved by the board in June 2023. Since that time USF has added to the project’s scope, including design and structural upgrades for potential future stadium expansion beyond the current expected seating capacity of approximately 35,000, a build-out of academic space in the facility, vertical expansion of the Tampa General Hospital Center for Athletic Excellence, and enhanced locker room amenities. The funds added to the project will come from interest earnings on the $200M in financing previously issued by the USF Financing Corp. The project team will now move forward with additional clearing at the site in May with full construction set to pick up shortly after. The stadium is expected to be able to host events beginning in the fall of 2027. (link)

Boise State inks Football HC Spencer Danielson to a contract extension through the 2029 season. According to ESPN’s Pete Thamel, the five-year contract doubles his salary, “as he'll average $2.2M over the course of the deal.” Specifically, Thamel notes Danielson's deal will “start at $2M per year this season and increase by $100K over the course of the five years. The total deal will end up at nearly $11M over the five years. He is expected to be the second-highest paid coach in the Mountain West behind UNLV's Dan Mullen, who is set to make $3.5M this year. Utah State's Bronco Mendenhall is also set to make $2M next year.” (link, link)

For the third consecutive year, Tennessee has sold out its season football tickets. With all 70,500 tickets sold, the Vols experienced a 97.8% renewal rate and have a current season ticket interest list of 23,755 as of April 29. (link)

Oklahoma Softball HC Patty Gasso is all for playing Texas in the Cotton Bowl and says she recently received a text from Ohio State HC Kirin Kumar about a Sooners-Buckeyes showdown at Ohio Stadium. “The Shoe? Is that what you call it? I don’t know the dimensions or anything but we would do it in a heartbeat. We would love to do it here but I know that it does take some work to make that happen, just doesn’t fit right. But if we could do the Cotton Bowl, we could go to Ohio State, we could do wherever if it is going to help this sport grow.” Texas HC Mike White says playing in the Cotton Bowl is a “possibility,” adding: “Obviously, the growth of the game is big right now and we want to showcase it.” (link)

According to ESPN’s Jonathan Givony, just 106 early entrants entered the 2025 NBA Draft. “That's the lowest number of early-entrants since 2015, down from a peak of 363 in 2021, just before the NCAA's NIL era officially started. The number of early-entrants spiked starting in 2016, as the NCAA instituted sweeping new rules allowing players to ‘test the waters,’ while maintaining their eligibility. The advent of the two-way contract in 2017 also opened up 60 NBA roster spots that didn't exist previously. With hundreds of college basketball players now making over $1M per season (far more than a two-way contract, valued around 600K, but non-guaranteed), it makes sense that so many players are forgoing the NBA draft. Will NCAA salaries end up stabilizing? We'll see.” (link)
