USA Today’s Berkowitz reports the U.S. House of Representatives is set to discuss a college sports bill this week that centers on NIL. Details of the bill include the creation of a new entity to monitor & enforce NIL, student-athlete safeguards of institutional retaliation, as well as “a provision ‘clarifying that student-athletes are not eligible for employee status.’” The bill is what many are calling the “skinny” approach to federal NIL legislation. From The Action Network’s McMurphy: “Washington State president Kirk Schulz says WSU athletics will have ‘temporary freeze on all current & future vacant positions until further review, as well as a pause on non-essential travel, purchases & new professional development’ because of ‘significant decrease in Pac-12 revenue distribution as result of overpayments from one of the conference media partners that must be resolved. Relocation of the Pac‑12 headquarters out of San Francisco exceeded budget projections as well. Additionally, WSU projects that Cougar Athletics exceeded its expenditures for the year due to inadequate documentation of revenues and expenses.’” (link)

Nebraska AD Alberts acknowledges the Big Ten is in a “period of uncertainty” when it comes to its media rights situation but says he’s confident in Commissioner Petitti. “I’ve been really impressed with him as the commissioner and I think it’s really important for him to get a clearer understanding of where we are in our television contracts. Certain leagues have one television partner. We’re talking about three elite linear television networks. This was always the vision — to try to own Saturdays in college football as the Big Ten.” Alberts also says NU doesn’t share the concern of Michigan, Ohio State, Penn State and others about playing primetime games in November. “I’ll put my hand up every day and twice on Saturdays because we think playing in primetime is a great opportunity to showcase the state, the University of Nebraska and the football team.” Also from Alberts: The athletic department plans to send a report on Memorial Stadium renovations to President Carter and the NU Board of Regents by the end of summer or early fall. Texas A&M AD Bjork joins the Yell & Review to discuss a myriad of summer topics, including updates on several facilities projects. Bjork notes the playing surface at Kyle Field is being replaced and the second floor of the Slocum-Bright Football Complex is being renovated and will feature breakout rooms for each position. “We'll have an individual team meeting room for offense and another team meeting room for defense, and then we'll have a walk-through room for offense and defense that'll attach to all of those breakout rooms.” That should be completed by August 1. Additionally, “vertical construction” on the new Adam Sinn Academic and Wellness Center will begin in August or September, and it is slated to be open by the start of the 2024-25 academic year. Nicholls State AD Terrell sits down with AthleticDirectorU’s Brown to talk about the formation of the Huddle Up Club, a sport-specific booster club for football, and his work leading the department with a fundraising mindset. Terrell also discusses his “worker bee” leadership style and how his time working in sales solidified his belief that building relationships and establishing trust are the keys to departmental success. Terrell: “I think one of the biggest things I’ve learned is you have to be where your feet are and accept that you always want bigger and better. How do you go about doing it? When you know what you’re getting into, how do you want to advance and be impactful?” Regarding the Huddle Up Club specifically, Terrell says he wanted to “get a bunch of worker bees” to put on as many events as possible to help fund the department. “At the end of the day, it’s about relationships. People buy from people they like and trust. … I think the biggest step for us was the simple fact that we had people that trusted us. Syracuse is set to begin construction on the new Football Operations Center and the "One Team" Olympic Sports Center, the latter of which will become home to all Syracuse student-athletes, as part of the renovations to the John A. Lally Athletics Complex. The Football Operations Center will feature increased sports medicine space and student-athlete recovery rooms, a new and expanded team cafeteria and nutrition space, and a new locker room, position meeting rooms and coaches' offices, among other amenities. Stanford sophomore student-athlete Zhang became the first person to win back-to-back individual NCAA Women’s Golf titles, shooting a bogey-free 4-under 68 yesterday to seal the victory by a shot. She also set a new record for lowest scoring average in a single season in NCAA history, coming in at 68.81, beating her 69.68 record from a year ago. The win was her 12th at Stanford, topping the record of 11 held by three former Cardinal men’s golf members, including Tiger Woods. Stanford HC Walker: “I kind of felt like she was already solidified as the best amateur of all time, and what she did today, that’s just the period on the end of the sentence.” (link)

WMT has created software called "The Six," which uses ChatGPT to “potentially clone sportswriters,” per SBJ’s Wilson, who adds: “Beta-tested so far with Arkansas, Clemson and Vanderbilt, WMT uses machine learning to automate game recaps in a writing style preferred by the school and potentially based off any sportswriter, dead or alive, reports Tom Friend (who’s very much alive). Specifically, the proprietary technology developed by WMT founder and managing director Andres Focil can ingest a simple box score for various sports and spit out an automated game recap -- if programmed correctly -- to mirror the writer of their choice. … Down the road, WMT also hopes to develop automated stories for golf, lacrosse and tennis, which don’t have traditional box scores.” (link)

LEAD1 General Counsel/COO Lambergman in an op-ed for SBJ contends the Office of Civil Rights (OCR) “should look to some of the traditional legal principles of corporate separateness that courts have used for hundreds of years” when assessing whether NIL could implicate schools under Title IX. “In that regard, courts have applied various tests to determine whether to ‘pierce the corporate veil,’ or hold a parent company liable, for the wrongful actions of their subsidiary companies. Some of the relevant principles that courts have analyzed include whether the assets of the parent company and its subsidiary are commingled, whether the day-to-day operational activities of the parent company and subsidiary overlap, and whether third parties could reasonably view the parent and subsidiary as separate entities. Factors that could indicate whether the day-to-day operational activities of the institution and NIL collective overlap may include whether an institution engages with the NIL collective to administer a marketplace, provides athlete contact information to the NIL collective, encourages donors to provide funds to the NIL collective, or facilitates meetings among athletes, donors, and the NIL collective.” Full op-ed. Miami (FL) AD Radakovich Q&As with the Miami Herald’s Jackson and Degnan and says he expects and approves of an unequal ACC revenue distribution model. “The presidents have a committee that they’re working through. I think there’s a lot of unanimity amongst the athletic directors that some type of success initiatives, success distribution should occur. … I think it’s been shown previously that there are three or four schools — Florida State, Clemson, North Carolina, Miami — who really kind of move the brand awareness of the ACC forward over time and for different reasons. You could throw Duke in there for basketball for whatever the basketball number is akin to these days.” Asked directly if the U’s interest would be piqued by an SEC or Big Ten invitation, Radakovich replies: “I’m not gonna comment on that. We’re here to make the ACC as good as we can make it. That’s our charge. And that’s where we want to get to.” Lots more in the full interview, including a football season ticket renewal rate of 70 to 75 percent, which amounts to being behind by 3,000 to 4,000 tickets compared to last year. North Carolina AD Cunningham agrees that coaches are underrepresented in the decision-making process, telling SiriusXM College Sports: “We have a representative governance structure at the NCAA level. I don't think it's very efficient. I don't think it's working very well. We don't elect our representatives. They're somewhat appointed or nominated through different committees. … So I do think that that's one of the charges for Charlie Baker. I think the vast majority of the membership is dissatisfied with our governance structure. And I think the outcomes that we have delivered through this structure over the last five to 10 years has set us back quite a bit. I think that's a lot of the reasons we have the lawsuits that we have. I think that we've been advised by attorneys that a committee will make decisions. And right or wrong, that's where we are.” Cunningham says one lesson learned from the Magnificent Seven has been to ensure all future meetings include everyone. “It may be an uncomfortable conversation, but we've decided we're better off having uncomfortable conversations as a group than trying to have a smaller group have one then try to bring in a couple more and a couple more and a couple more.” (link)

Auburn AD Cohen, noting that Tigers Men’s Basketball HC Pearl recently pumped the brakes on his desire for a new hoops facility in favor of directing funding toward NIL, points out that "Name, image and likeness funding comes from a very similar source of facility funding. I mean, that's the reality of it. It's not a secret. … So, we have to go into this with our eyes open, and we have to make priority decisions in terms of the flow of funding for priority. I don't think it's any secret that name, image, and likeness opportunities for student-athletes has become a priority around the country, and we have to be competitive in that area. And thank goodness we have groups of folks who believe that as well. Those two things have to balance out − future facility opportunities, along with opportunities for our student-athletes." Cohen expects other facilities upgrades, including $30M in upgrades to Plainsman Park, to be ready for the start of early next season, while still others won’t be completed until 2024. "When you look at these facility updates, you're asking yourself: What's our goal here? … Are we trying to make this a better experience for the fan? Are we trying to make it better for the student-athlete? What's the goal here? And we want to do both. We want to make a better experience for the fan. We want to have a better home-field advantage.” (link)

Western Illinois’ departure from the Summit League has “not been met with many tears from their peers,” according to the Mitchell Republic’s Zimmer; however, the Leathernecks were the longest-tenured league member and their exit leaves the Summit with nine teams. Regarding whether the league is pursuing expansion to add a tenth member, Commissioner Fenton tells Zimmer: “There's no doubt there's a benefit to having an even number but that isn't to say you can't work with an odd number. We're going to determine what is in the best interests of the league overall to maximize value of the membership. … We're going to continue to have discussions about whether there's an option out there to potentially enhance that value, and if that means we're at nine teams or 10 or 11 or 12 then so be it." One “obvious” candidate for expansion is Augustana, according to Zimmer, who cites the Vikings’ location and facilities as plusses while acknowledging that schools like Oral Roberts or Denver may not be fond of adding another school from the Dakotas. In fact, Zimmer submits that “adding Augustana might just be the final straw in pushing Denver or Oral Roberts to look to leave.” Other potential options include Northern Colorado and Northern Iowa along with the Minnesota schools in the NSIC. Nebraska will name Southern Miss President Bennett as chancellor of the flagship Lincoln campus, pending a 30-day vetting period. The Athletic’s Sherman notes Bennett served as president at Southern Miss from 2013 until the expiration of his contract this year and would become UNL’s first Black chancellor. On what the hire means for Huskers athletics, Sherman notes: “Bennett was appointed by Carter, who was key in the hiring of coach Matt Rhule after last football season. Alignment from Rhule, who signed an eight-year, $72 million contract, to Alberts, the new chancellor and Carter is essential for Nebraska to compete in this era of rising stakes in the Big Ten and around college sports.” (link)

ESPN’s move to direct-to-consumer (DTC) is expected to occur in two to three years, according to the New York Post’s Marchand. Key thoughts: “I’m really starting to think when ESPN moves to direct-to-consumer, it won’t mean the end of cable. The cable bundle is going in the wrong direction, but the big argument against ESPN for years has been that the viewer who doesn’t care about sports is paying for ESPN. At this point, a cable or YouTube TV bundle may start to look more appealing, even with a pure DTC option. Plus, with cable, you can toggle between channels much more easily than with apps. … There will be folks who drop cable for ESPN DTC. But how many? I really think the total demise of cable TV may not happen even in a couple of years when ESPN does make the move.” (link)

Texas House Bill 2804 is “expected to quickly land on Gov. Greg Abbott’s desk” after passing the Senate and being sent back to the House for a few “minor changes,” per On3’s Crabtree. As reported previously, the bill prohibits the NCAA, conferences or other athletic associations from enforcing rules prohibiting schools from assisting with student-athletes’ NIL efforts. Oklahoma State professor Holden: “If this bill gets signed it could signal a tipping point. The Texas Tech-focused Matador Club is increasing the number of deals it has with football walk-ons. The collective now distributes $25K per year to 105 players, and Red Raiders HC McGuire says: “We're so lucky that the [Matador Club board members] Cody Campbells of the world, the Tim Culps of the world, that they understand this — being able to recruit high-quality walk-ons, and one reason you can is because they are going to be able to be a part of the Matador Club. … You're almost, really, on scholarship whenever you're talking about the price of coming to school here at Texas Tech and being able to get guys like that."
