Sportico’s Michael McCann writes on how a potential Trump administration executive order on college athletics could face a bevy of legal pushback: “For starters, an executive order can’t conflict with a federal statute. If a court finds that college athletes are employees within the meaning of the National Labor Relations Act or the Fair Labor Standards Act, they will be employees. If a court finds they aren’t employees under those laws, then they aren’t employees. Then there are state laws governing labor and employment. An executive order can’t compel a state to interpret its own laws a certain way. [...] Trump might decree that antitrust law be interpreted a certain way in relation to eligibility claims. That type of decree would impact how the Department of Justice, the Federal Trade Commission and other federal agencies interpret antitrust law in the context of college sports, but it wouldn’t stop athletes from continuing to bring private antitrust actions against the NCAA. [...] It could run afoul of Equal Protection if college athletes are denied the same rights, including for employment and other economic opportunities, that their classmates enjoy. An executive order might also run afoul of the First Amendment to the extent it limits how college athletes express themselves.” More. (link)

Late last month, Iowa State AD Jamie Pollard was a guest on Spotlight with Elijah Moore as the pair touched on a number of items impacting the Cyclones & college athletics overall. Pollard on some of the implications of the House settlement: “Because of tremendous financial discipline and everything we’ve worked on over the last 20 years our athletic department had pretty substantial cash reserve that we built up and we used that reserve during COVID so we didn’t cost Iowa State, we didn’t cost the student body, we didn’t cost the Board of Regents a dime to get through COVID. The University of Iowa got a $60M loan from the university. The athletic department did. Now, they haven’t paid a dime of that back, but they got a $60M loan. We did not take a loan, we funded it from our reserve. We can’t fund the $20M or in about two years we’ll be out of the reserve. So, Iowa State University will be faced with an athletics program with a huge annual deficit if it wants to stay in the Big 12 and if it wants to have a P4 athletics program. Now, we can decide we just want to have an athletic department like Northern Iowa, but that’s going to have a huge economic impact on the state, on central Iowa, on the city of Ames and on this institution. So, that’s the problem that we’re staring at. [...] Arizona State has put $50M into the athletics program on an annualized basis. You pick the program, I can tell you what the number is. Iowa State is zero, because that’s what the Board of Regents policy is. So how would you feel as a fellow student if Iowa State did what Virginia Tech just did? Virginia Tech just implemented a student fee that’s generating close to $20M a year and they’re going to use that fee to pay their student-athletes. So, would you pay a bigger fee, Elijah, to go to school here so that a member of our Men’s Basketball team could get paid a million and a half dollars in addition to their scholarship, room and board? That’s the fundamental question we’re going to have to ask ourselves because if we don’t do that, then what we’re saying is that we’re not going to have the athletics department that we’re currently having.” Lots more. James Madison AD Matt Roan on if he accomplished his year one goals? Roan: “One of the things that was important for me was a seamless transition. That’s on other people to decide, but I think that we’ve accomplished that.” On the Dukes’ position: “I think we’re positioned well. With respect to the House settlement and this notion of revenue sharing or enhancing one scholarship. One of the things that we have taken pride in, is that none of our programs are taking a step backward. We wanted everything to be additive. We wanted to be aggressive in our approach. For us, what does that mean? We have to be aggressive in our pursuit of revenues. We also have to be strategic in how we operate.” On student-athletes transferring: “Everybody is dealing with it. I think you’re just seeing incredible movement, incredible mobility. It’s how well you adapt and how well you embrace that era is largely going to depend upon how successful you can be. … Whether it’s a collective bargaining, union or some sort of antitrust exception, I would like to see us be able to have some type of system in place that is not restrictive, but perhaps allows for a little bit more continuity in what it is that we’re trying to do here inside of college athletics.” (link)

Texas Men’s Basketball HC Sean Miller’s contract must still be formally approved by the UT Board of Trustees on Wednesday but calls for Miller to be paid $31.8M over the next six seasons. Year one starts at $4.8M, with $200K bumps annually. He can earn an additional $100K for any of the following: regular season conference championship, conference tournament championship or participation in the NCAA Tournament. The later, would be replaced by the best of the following: Round of 32 appearance ($150K), Sweet 16 appearance ($200K), Elite 8 appearance ($250K), Final Four trip ($300K) title game appearance ($350K) or national championship win ($500K). National CoY could earn him $100K while conference COY could bring in another $50K. (link)

Sticking with coaching compensation, Ohio State will pay its football assistants nearly $12M this year, with four making seven figures. DC Matt Patricia leads the group ($2.5M), followed by OC Brian Hartline ($2M), Co-DC Tim Walton ($1.8M), DL AC Larry Johnson ($1.4M), OL AC/Run Game Coordinator Tyler Bowen and Pass Game Coordinator Matt Guerrieri (both at $900K), RB AC Carlos Locklyn ($650K), LB AC James Laurinaitis ($500K) and QB AC Billy Fessler ($475K). Connect’s Kristen Eargle caught up with The Wall Street Journal’s Rachel Bachman to dive deeper into Bachman’s reporting of financial challenges for U.S.A Track & Field & the impact NGB’s may have on college athletics in the future given a changing landscape. Bachman on how NGBs could add value to the collegiate ecosystem: “One thing that some people have talked about is trying to cooperate more. Colleges have something enormously valuable and that’s their brands. There’s been a lot of upstart professional sports in recent years, like lacrosse, but they have a huge disadvantage and that’s they don’t have known brands. They don’t have known school names, logos, conference affiliations, history. College Sports has all those things so that’s a massive, massive advantage. One option would be, where possible, for NGBs and colleges to hold events together. Track & Field already does this in some ways, like the meet in New York has professional athletes and high school athletes at the same event. Different races, same event, so they can draw a wider swath of fans. I think colleges can do that. They already have meets that draw their own fanbases, but maybe adding more professionals to the mix. By the same token, I think the governing bodies could look at forming alliances with the colleges and in turn could even join forces on facilities.” Lots more. (link)

Texas A&M will pay $335K this year to continue advertising in motorsports, doubling down on a marketing strategy it launched late last year. The Aggies recently signed a $275K commitment to NASCAR’s Haas Factory Team and a $60K commitment to IndyCar’s Felix Rosenqvist. In return, TAMU will receive a wide range of deliverables, including advertising on cars and driver apparel, VIP hospitality and social media promotion. Last October the school agreed to pay $160K to be the primary sponsor of Stewart-Haas Racing cars at two NASCAR tracks. (link)

The Athletic’s Chris Vannini & Ralph Russo dive into reports of the Trump administration exploring an executive order that could impact NIL & college athletics overall. From Vannini & Russo: “A congressional aide told The Athletic that an executive order might not stabilize the college sports system, which requires legal certainty and a limited safe harbor from litigation. Legal protections and the pre-empting of state NIL laws can only be addressed through congressional legislation.” Tulane sports law professor Gabe Feldman: “The challenge with any ruling or order is that there are multiple levels that would need to be addressed. This is not just an antitrust issue; it’s also a labor and employment issue. It’s also a Title IX issue. There’s also contract issues, right of publicity issues. There’s a lot in there.” (link)

MLive’s Matt Wenzel on the Michigan State AD opening: “Michigan State wants an individual who can strengthen relationships with big-money donors. College athletics change seemingly by the hour and cash is needed to be a real player, especially in football and men’s basketball. [...] Acquiring players requires more money from donors, who are also being asked to shell out for facility upgrades, and the university needs to replace the $20 million or so annually that will go to the athletes in revenue sharing. The status quo – as much as that could exist right now – is a model that may be unsustainable. Athletic directors are stuck attempting to fuse a long-time funding model with something completely new.” (link)

Earlier in the week on the Carolina Insider podcast, North Carolina AD Bubba Cunningham voiced support for collective bargaining with student-athletes: “To me, I think we have to have a plan to get to collective bargaining. And I know that can be heresy for some. But I don't think you need to have to be an employee, and I don't think we should collectively bargain by school. It should either be by sport or by conference or by national governing body. But if I looked over the next 10 years of where I think we're going to be, we're going to be in some space like that. Because this is not sustainable. Although I don't think we're going to get enough traction in Congress right now. Right now the students are getting paid, the coaches are getting paid. Our facilities are full. Our media rights continue to increase. So if you ask the general public what is the problem, it's hard to define the problem. 'Well, we don't like it. We don't like the ability that these people get to move and do these other things.' So that's not compelling enough to me if I were in Congress to say, ‘OK, I'm going to change it and give you something that will protect what I'm not sure of.’” More. (link)

IU Indy AD Luke Bosso joins AthleticDirectorU’s Tai M. Brown for a wide-ranging conversation, including analysis of Bosso’s first year in the chair from the perspective of a problem-solving mindset. Bosso, who has a background in economic and workforce development having most recently served as the managing director of government advisory with Katz, Sapper & Miller, believes “The only difference between athletics and politics is the name. You’re trying to win over constituent groups, you know if you win or lose, and everybody thinks that they can do the job better than you.” Bosso provided 30 minutes, and no more, for candidates interested in the Jags men’s basketball opening last year, noting: “I told our staff that we’re going to do 30-minute conversations with them and if they can’t convince us in 30 minutes that they’re the right person then we’re not going to carry on with them. … I’m big on self reflection, so we asked every candidate ‘how could someone else beat you?’ and ‘what would the biggest detractors say about you?’ The way you answered those questions was really important. If you can’t be honest during the interview process, then we don't want you.” Lots more. (link)

Recruiting violations occurred in Cal’s football program when several staff members arranged and conducted a Zoom call with three former players - a then-NFL coach, current NFL player and former NFL player, all three of whom are considered boosters - and 44 prospects (and 80 of their family members) during the program’s Junior Day. Additional violations occurred when the former director of player development engaged impermissible recruiting contacts and communications with several prospects and their families. The football staff involved in the violation included Marshall Cherrington, director of player personnel; Andrew McGraw, football chief of staff; and Benji Palu, director of recruiting. The program has received one year of probation, a $25K fine, a two-week prohibition on official visits during the 2025 season, a three-week ban on recruiting communications during the current academic year, a reduction in the number of recruiting-person days for this year by seven, a two-week ban on unofficial visits , a 16-day ban for HC Justin Wilcox from any off-campus recruiting activities (served January and February 2025) and several other penalties. UT Martin had violations within its women’s soccer and softball programs when players who received midyear scholarship increases were required by coaches to return those funds or reimburse teammates for donations. Additional violations occurred in softball. In women’s soccer, the parties agreed that former women’s soccer HC Philip McNamara and former women’s soccer AC Leslie Gillies instructed every member of the team to donate $300 to the Captain’s Challenge, the fundraising effort for the school’s foundation. The penalties include: One year of probation; a fine of $25,000; a reduction of one women’s soccer scholarship or one roster spot for the 2025-26 academic year; a two-week ban on softball recruiting activities during the 2024-25 academic year; a two-year show-cause order for former Softball HC Brian Dunn, during which any employing member school must restrict him from all athletically related activities. Coinciding with the launch of the Anti-Doping and Medication Control (ADMC) Program in 2023, Horseracing Integrity & Welfare Unit (HIWU) partnered with RealResponse to make misconduct reporting more accessible and scalable. For HIWU Director of Investigative Operations Shawn Loehr, having a system that supported two-way communication between his team and whistleblowers was critical. Loehr: “The ability for somebody to make a tip anonymously is great. But what’s unique is that we have the ability to communicate back and forth with that person to get more information. … Our ability to gather more information has led us to fruitful investigations that we may not have pursued otherwise. … We can see the peaks and valleys of the types of tips we’re getting (e.g., if there are a lot related to one racetrack, one trainer or one horse). It gives us the ability to pull data, determine our investigative strategy and be able to report out on what we’re finding.” At least two HIWU employees monitor the RealResponse-powered tip line daily (including weekends and holidays). With a centralized reporting platform, Loehr’s team has been able to respond to every single tip within 24 hours—regardless of when it comes through.
