CBS’ Brandon Marcello explains there was some “confusion” regarding House (settlement) plaintiffs’ attorney Steve Berman’s remarks to The AP yesterday about who will be grandfathered in with the new roster limits. Berman explains the proposal in question “covers all who are designated student athletes – anyone who lost a roster spot, not just objectors. The chart is just to show how it works.” Marcello adds: “House v. NCAA plaintiffs have requested grandfather protection for all athletes who lost spots because of roster limits. As of 3 p.m. ET, plaintiffs still await a final agreement from the NCAA and the power conferences (defendants).” Meanwhile, Yahoo’s Ross Dellenger reports that “conference officials are sharing with members and gaining approval of a revision to House roster limits to grant schools the option to grandfather athletes. In a new concept, it also permits athletes, who leave/not retained by current school, to keep [grandfather] status at a new school.” (link, link, link)

New Haven (DII) will jump up to DI and join the NEC starting July 1. The Chargers are set to become full DI members by 2028-29. Big 12 Commissioner Brett Yormark has agreed to a three-year extension through 2030. Yormark: "We have made great progress over the last three years, and our best days are ahead. I am thrilled to continue to work alongside our member schools as we grow and strengthen the Big 12 into a Conference that is innovative and prepared for what the future may hold." (link); The San Jose Mercury News’ Jon Wilner points out that the timing of this extension “allows Yormark to negotiate the Big 12's next media contract. Speaking of media deals, in a hearing about professional sports broadcasting deals in Congress this morning, Senator Ted Cruz (R-TX) suggested he was open to giving college sports an antitrust exemption similar to that which allows leagues like the NFL to negotiate their TV deals as one large group. Cruz: “The SBA (Sports Broadcasting Act) was intended to ensure that the needs of all sports fans were being met. I think it’s important to regularly revisit and consider whether our laws, like the Sports Broadcasting Act, are fulfilling their intended goals. And if the leagues can show how the SBA continues to benefit fans today, it may be worth exploring whether to give a similar exemption to college sports whose broadcasting rights have no antitrust protection. One growing concern is that the NFL has used its special exemption in the SBA to the frustration of college and high school football schedulers. For example, the SBA explicitly excludes antitrust protection for the NFL if broadcasting a game on a Friday night or a Saturday between mid-September to mid-December. That’s to protect the interests of high school and college football, and ultimately, their fans who are no doubt also followers of the NFL. The NFL has tiptoed up to this rule, now putting a game on streaming on Black Friday afternoon, which used to be a slot reserved for prominent college football rivalries, including in some years, Texas and Texas A&M. There are millions of sports fans who like being able to follow high school, college, and professional football without having to choose amongst them. And it’s partly why Congress wrote the SBA in the manner it did.” (link, link – full remarks from Cruz)

Arizona State AD Graham Rossini late last month remarked that the Sun Devils were close to finalizing the percentage breakdown for each sport in the new revenue-sharing agreement and noted: “We want to resource all of our programs to win at a high level. You’re seeing a lot of schools that are picking a couple of sports they’re adding scholarships to, sometimes at the expense of other sports. We want to invest heavily in football and basketball. We need to do that to be successful, but we want all 26 to have a chance to be successful at a high level. … You’ve already seen UTEP discontinue women’s tennis a couple of weeks ago, Cal Poly’s eliminated swimming. Sadly, I think you’re going to see more of that happen at Olympic sports.” Rossini went on to point out that “we’re adding 225 scholarships. We’re trying to go the opposite direction. It probably hasn’t been since after World War II, where the land-grant schools made this investment into collegiate athletics, that there’s been this kind of seismic shift in the landscape of college sports. We think this is another iteration. … We’re having a lot of success in our Olympic sports. This is a moment to resource, to get them ahead and stay ahead. We want to be prepared to do that. We had a heartbreaker earlier. Beach volleyball took TCU to a fifth set, an overtime heartbreaker for what would have been our fifth Big 12 championship. It’s important that beach volleyball is resourced and is successful at ASU. This is a sport that’s gaining Olympic momentum.” (link)

Clemson and Notre Dame are set to announce a 12-year football scheduling agreement through 2038, according to ESPN’s David Hale, who observes that the agreement “offers some scheduling flexibility and insurance for both schools as the SEC continues to discuss moving to a nine-game conference slate. The Tigers play South Carolina annually in a rivalry game, but they also have future home-and-home series scheduled against LSU (2025 and 2026), Georgia (2029, 2030, 2032 and 2033), and Oklahoma (2035 and 2036). A nine-game SEC slate could put some of those future matchups in jeopardy – though multiple sources told ESPN they do not see annual SEC-ACC rivalry games such as Clemson-South Carolina being canceled – but even if all currently scheduled games remain on the docket, these matchups figure to help with playoff résumés.” Hale also notes that the two teams were already scheduled to play in 2027, 2028, 2031, 2034 and 2037, and a “source confirmed the annual games will also count toward Notre Dame's required five games vs. ACC opponents.” Clemson AD Graham Neff adds: "This locks in a huge rivalry for us with a nonconference opponent that's going to be strong year in and year out. The association of national brands like Clemson and Notre Dame create a great fan experience, strong viewership and the value of that is obviously a fundamental component." (link)

The Athletic’s Scott Dochterman chronicles Iowa State’s journey from “running annual deficits” and enduring a 17-year bowl drought in 1995 to its strong positioning today. To get where they are today, Dochterman notes, the “Cyclones hired a change agent, organically built relationships throughout the state and worked diligently to field competitive programs in college sports’ ever-changing arms race.” Said change agent, Cyclones AD Jamie Pollard, took over in 2005 and catalogued what needed to change. He tells Dochterman: “This place was underfunded, so under-resourced, understaffed and (lacked) facilities. But I thought this place had good bones. Like the fans, they were loyal. They wanted to support; they just hadn’t been given something to capture their imagination.” One decision involved ending the annual golf outings coaches had with fans, which Pollard viewed as inefficient, and instead began a caravan approach whereby coaches and administrators spent two weeks on the road. Pollard: “We described it as this: Let’s plant the seeds and fertilize it and water them and grow our own fans. In theory, Iowa State probably lost two generations of fans when they lost, what, 15 games in a row to Iowa (from 1983 to 1997)? During that time, it probably wasn’t really fun to be in the stadium. Students weren’t coming to the games. Then they graduate, and they’re not programmed to come to games. They go out into the workforce, they have children, they’re not coming to the games. ECU AD Jon Gilbert, in a letter to fans, explains that there’s not a “one-size-fits-all” model for revenue-sharing, adding: “We understand where we fit, what we can do with the continued support of campus, and how to build a plan that works for us. We're also collaborating with an external consultant with deep expertise in collegiate athletics to ensure our model is efficient and aligned with today's landscape. Make no mistake – ECU will need to be aggressive in our approach. When you look at the realities of the House settlement, you are dealing with new, unbudgeted expenses. This means we must make thoughtful and sometimes difficult decisions. We must prioritize as we plan for a sustainable path forward.” Gilbert goes on to explain that “our revenue-share model will correlate to the talent on our respective rosters. Football is going to be a central part of our revenue-sharing strategy. We know how vital a strong football program is to the health of our department and this community. … As part of the settlement, new roster caps will be instituted, while increasing scholarship limits across sports. Stetson AD Ricky Ray announces the creation of the Athletic Strategic Impact Fund, which will address the department's most pressing needs, including funding for crucial projects, expenses related to postseason travel and more. Maryland and Blueprint Sports have named Athletes First Director of Collegiate Partnerships Mandy Allendorfer as the new Executive Director of One Maryland, the official collective supporting Terps student-athletes. UMD and Blueprint Sports also announce a multiyear partnership extension that establishes Blueprint as the internal NIL marketing agency for the Terps. (link)

Cal has begun construction on the Banatao Family Beach Volleyball Stadium. The renovation is expected to take 16-18 months to complete and will include five sand volleyball courts designed for NCAA competition, a building with team rooms, locker rooms, restrooms, coaches' offices and storage, and enhanced amenities such as lighting, a scoreboard, public address system and an area for spectators. The Ball State Board of Trustees has approved the budget and scope for an $8.8M project to build new clubhouses for the Cardinals’ baseball and softball teams. Each clubhouse will be approximately 6,000 gross square feet and located adjacent to their respective home dugouts at Shebek Stadium and the Ball State Softball Stadium. Features of the facilities include locker rooms, team meeting areas, restrooms, showers, athlete lounges and nutrition spaces, equipment rooms, coaches' locker rooms, satellite training and physical therapy rooms and other support spaces. Construction is slated to begin in the fall and expected to wrap up in the summer of 2026. (link)

House settlement plaintiffs’ attorney Steve Berman tells The AP that everything is on track to file paperwork by Wednesday’s deadline to address roster limit concerns. Berman says he created a chart listing the several dozen athletes who lodged objections to the agreement based on roster limits and that he thinks almost every one will be offered a solution. "We're still negotiating, and I'm confident that everyone who lost a roster spot will have a chance to get a spot back.” Berman did not go into detail about whether those spots would be on their previous teams or new ones but acknowledged that the objectors likely wouldn't approve of the new deal being worked on, adding: "But I don't think it's going to be a big deal” because it is designed to find roster spots for virtually all the individual athletes who objected. According to Inside MD Sports’ Jeff Ermann, two names “seem to be off the list” to become Maryland’s next AD, including CarrSports Consulting Co-Owner/Managing Partner/former multistop AD Jeff Hathaway and Charlotte FC President Joe LaBue. Ermann notes the latter “has grassroots support but doesn't appear to be getting an interview. He's a name to keep in mind for the associate AD job vacated by Brian Ullmann.” Ermann adds: “Meanwhile, a familiar name from the past has popped up. I'm told Debbie Yow has been weighing in with some members of the selection committee. Why? She's supporting a protégé – Maryland alum and George Washington AD Michael Lipitz, who worked for her at NC State and Maryland. The deadline to submit materials to Parker Executive Search for Hawaii’s AD opening was yesterday, according to CollegeAD, which reports: “Once Hawaii has selected the field of candidates they'd like to speak to, sources say the plan is to hold a round of virtual interviews starting the week of May 19. Nebraska AD Troy Dannen remarked during an interview with the Huskers Radio Network’s Sports Nightly last week that flag football is on NU’s radar: “Flag football is really being pushed by the NFL. And a lot of states have sanctioned it at the high school level. Eventually we’re going to have another women’s sport here at Nebraska from a Title IX standpoint, and I think women’s flag football is one of those sports that — I wanted to see it live myself. And we had a lot of fans come and watch it. I think it’s something we should all keep a close eye on with women’s flag football.” SB Nation’s Mitchell Northam notes that “as part of its new Husker Games — an event to replace the spring football game — Nebraska hosted an exhibition flag football contest with some of its student-athletes taking on Midland University, an NAIA school with a varsity program.” (link)

Disney and ESPN “see college sports as a key area in advertising attention and investment, accounting for nearly 40% of total sports ad revenue,” according to SBJ’s Mollie Cahillane, who points out that’s “42% year-over-year growth, and up 50% from 2023.” Disney Advertising SVP for Revenue and Yield Management, Sports and Entertainment Jim Minnich: “It really all starts with college football; we’re stoked about the season coming up, but we more than sprinkle in a significant portion of women’s and men’s sports. Close to 80% of our advertisers buy college, and it really makes a big difference in our portfolio.” Minnich views softball as the next breakthrough property for Disney/ESPN, noting it has the second largest women’s sports viewership behind only basketball. “There are so [many] untapped resources there from an advertising standpoint. It’s been undertapped, and there’s a lot of upside.” Cahillane also reports that advertising sales for college baseball and softball “are pacing up 11%” YoY. (link)

Former IRS Commissioner/Chamberlain Hrdlicka shareholder Charles P. Rettig and Chamberlain Hrdlicka associate Andrew Mullendore explain in an SBJ op-ed that the IRS has “identified tax-exempt (NIL) collectives as a targeted enforcement priority and has rejected four different applications by NIL collectives for tax-exempt status” pursuant to memorandum AM 2023-004. Now with the House settlement possibly changing the nature of collectives, Rettig and Mullendore note that collectives can help to fill in the fundraising gap needed to share revenue. “The challenge is doing that in the most tax-efficient, compliant way. The collective could change its model from supporting student-athlete compensation to supporting the operations of athletics departments. A collective that donates funds to support an athletics department’s operations gives the department flexibility to use those funds however it wishes – to support nonrevenue-generating sports, devote additional assets to its compliance and administrative operations or compensate student athletes for their NIL. In effect, by donating funds to the athletics department, a collective frees athletics department funds that it would have used for some other purpose to put toward the 22% compensation cap.” Operating this way “would help a collective qualify as a charitable organization and obtain tax-exempt status. … Another option for collectives is to establish scholarships for economically disadvantaged student-athletes. Section 501(c)(3) and the associated Treasury regulations allow for ‘charitable’ activities, including aiding the disadvantaged. By establishing these scholarships, collectives ensure that these student athletes attend their chosen universities free of charge and allow universities and athletics departments to devote the scholarships and the funds required to support them for other purposes, such as supporting student athletes in nonrevenue-generating sports. When establishing a scholarship program, collectives must ensure that they do not fall victim to a technical foot fault by directing the scholarship toward a predetermined group of student athletes, such as football or basketball players.” Full op-ed. Supporters looking to save Cal Poly’s swimming & diving team were given a deadline to raise $10M by April 15 as a part of a $25M endowment to sustain the program. President Jeffrey Armstrong has subsequently extended the deadline to June 4, by which date the team must raise $20M. To date, the program has raised $7.5M. (link)

The five independent college hockey teams – Alaska, Alaska Anchorage, Lindenwood, Long Island and Stonehill – will hold the inaugural United Collegiate Hockey Cup from March 5-7, 2026, according to College Hockey Insider’s Mike McMahon, who notes the winner will not receive an NCAA Tournament AQ. The event will be played at Lindenwood's Centene Community Ice Center, and Lions AD Jason Coomer says: "We are thrilled to bring this tournament to the St. Louis market. This event not only provides a competitive platform for our student-athletes but also showcases the growth and quality of independent NCAA hockey programs on a national stage." (link)

Former NC State soccer student-athlete Benjamin Locke can move forward with his sexual harassment lawsuit against the university, according to a unanimous decision by the 4th U.S. Circuit Court of Appeals. The Carolina Journal reports the decision “arrived nearly four months after the court revived a similar lawsuit. A former NCSU athlete identified in court records as John Doe 2 had gone to court after Locke filed suit. A federal trial judge had dismissed the complaints against the university from Locke and John Doe 2, along with a third suit from a plaintiff listed as John Doe.” From the decision: “On January 7, 2025, this Court issued a decision in Doe finding that the plaintiff had sufficiently pled facts to show that NCSU had adequate notice of the alleged sexual harassment. Locke now moves for summary reversal of the district court’s order based on Doe. Because the question here is materially indistinguishable from that decided in Doe, we grant Locke’s motion for summary reversal and remand the case to the district court for further proceedings.” Locke’s case stems from allegations made against former NC State Director of Sports Medicine Robert Murphy. MoffettNathanson Senior Analyst Robert Fishman tells The Athletic’s Andrew Marchand that “we think Netflix is going to keep getting bigger and better in sports, and we think it’s only natural that they continue to lean in on this new premium content for them. We’ve said over the years that you always look at what Netflix is doing, not what they're saying, and they're already getting into sports with some of the most recent transactions that they've made. Obviously with the Christmas [NFL] games, but you look at the World Cup for the Women's World Cup rights that they got, you can classify WWE as sports even though they like to say that it's not, and so you just look at what they're doing and we think ultimately they will end up with an NFL package when this comes due.” Fishman goes on to note that if Netflix “is interested in sports and the NFL opts out, which we’re all expecting is what will happen after ‘29, why won't the NFL try to redo some of their packages so that the NFL can still say that they're going for the premium package that the most eventized type of package but just looks different than what we know today? So it's not just the holiday package, but maybe it's the best games every week and that doesn't necessarily have to be a certain day or night, but it can be almost like the Premier League where they get the premium teams. And then think about who else is going to be left over for the broadcast networks and the traditional media guys to compete and fight over that type of package.” (link)
