The Executive Order…
+ The Athletic’s Chris Vannini & Ralph Russo dive into reports of the Trump administration exploring an executive order that could impact NIL & college athletics overall. From Vannini & Russo: “A congressional aide told The Athletic that an executive order might not stabilize the college sports system, which requires legal certainty and a limited safe harbor from litigation. Legal protections and the pre-empting of state NIL laws can only be addressed through congressional legislation.” Tulane (DI) sports law professor Gabe Feldman: “The challenge with any ruling or order is that there are multiple levels that would need to be addressed. This is not just an antitrust issue; it’s also a labor and employment issue. It’s also a Title IX issue. There’s also contract issues, right of publicity issues. There’s a lot in there.” (link)
+ Sportico’s Michael McCann writes on how a potential Trump administration executive order on college athletics could face a bevy of legal pushback: “For starters, an executive order can’t conflict with a federal statute. If a court finds that college athletes are employees within the meaning of the National Labor Relations Act or the Fair Labor Standards Act, they will be employees. If a court finds they aren’t employees under those laws, then they aren’t employees. Then there are state laws governing labor and employment. An executive order can’t compel a state to interpret its own laws a certain way. [...] Trump might decree that antitrust law be interpreted a certain way in relation to eligibility claims. That type of decree would impact how the Department of Justice, the Federal Trade Commission and other federal agencies interpret antitrust law in the context of college sports, but it wouldn’t stop athletes from continuing to bring private antitrust actions against the NCAA. [...] It could run afoul of Equal Protection if college athletes are denied the same rights, including for employment and other economic opportunities, that their classmates enjoy. An executive order might also run afoul of the First Amendment to the extent it limits how college athletes express themselves.” More. (link)
+ Attorneys at Hagens Berman, who are representing a class of hundreds of thousands of current and former college athletes in the House settlement, assert that “talk of an executive order and eleventh-hour self-importance from University of Alabama’s ex-football coach, Nick Saban, is unmerited and unhelpful.” Co-Founder/Managing Partner Steve Berman: “While he was a coach, Saban initially opposed NIL payments to athletes, pushing to add restrictions and red-tape through national legislation to add ‘some sort of control.’ During his time scrutinizing the athlete pay structure, he made tens of millions of dollars and was previously the highest-paid coach in college football.” Berman adds that “Coach Saban and Trump’s eleventh-hour talks of executive orders and other meddling are just more unneeded self-involvement. College athletes are spearheading historic changes and benefitting massively from NIL deals. They don’t need this unmerited interference from a coach only seeking to protect the system that made him tens of millions.” (link)

“I look for kids that have Division I ability. The majority of Division I teams are East Coast, so they’re going to recruit in their own backyard. It’s taking a risk to some degree when you’re recruiting from Minnesota. But I love the athleticism. I love kids that play multiple sports.” That’s Rockhurst Men’s Lacrosse HC Kevin Kelley on his recruiting approach as nearly half of the Hawks’ roster comes from Minnesota. With no ties to the North Star State, Kelly was drawn to the state as a recruiting pipeline due to the “blue-collar mindset,” adding: “In my 2017 class, I had a whole slew of Minnesota kids I started getting. It showed me how tough these kids were. They’re great players, but they’re kind of unique in how they go about things. I quickly found out that their mindset is a type of mindset that I have.” (link)

The NCAA Men's Wrestling Rules Committee proposed modifications to the matside video review process for the 2025-26 season, recommending to allow third-party reviewers to be able to consult with the referee about pertinent information on a coach's video review challenge. Additionally, committee members recommended allowing coaches to retain their video challenge if there is obstruction in any part of the video sequence that is being challenged. Coaches also would retain their challenge if the action that is being questioned is not in the frame of the video. The committee also recommended making mouthguards required for competition, starting next season. Several other rules recommendations were proposed, as well. Next step is the June 10 discussion by the NCAA Playing Rules Oversight Panel. (link)

JohnWallStreet breaks down the ways President Trump’s tariffs could impact construction costs, and Goldman Sachs Managing Director/Head of Global Sports Finance Stacy Sonnenberg explains: “Sports team owners and municipalities are facing two cost risks when it comes to stadium and arena projects under development–interest rates and tariffs. Higher interest rates would increase interest costs during construction that are typically capitalized as well as the ongoing interest expense once the project is operational.” JWS points out the 10-year treasury yield was 3.86% on April 4 and rose to 4.4% as of the following Monday morning. Further, the cost of hard materials could increase by upwards of 5%, and JWS observes: “As we saw with COVID, moments of inflation are rarely offset. It’s worth noting Trump stated that he does not want U.S. Steel to ‘go to Japan’. That declaration came just days after the President ordered a new review on Nippon Steel’s proposed acquisition of the company. On a related note, [Trump] has threatened to eliminate ‘special tax breaks for billionaire team owners,’ potentially impacting the ability for stadiums and arenas to receive public monies from the sale of tax-exempt bonds.” While some franchises are likely willing to wait a few months for clarity, New York Jets Senior Advisor Neil Glat notes: “For each year that projects are delayed, costs can increase significantly due to inflation and other factors. And very possibly, in total dollar amounts that exceed the impact of potential tariffs.” (link)

+ A quarter of bachelor’s degree students have considered withdrawing from their academic program, according to the Lumina Foundation-Gallup 2025 State of Higher Education Study, with emotional stress (49%) and mental health (41%) serving as the top reasons for those considerations. Notably, the cost of attendance declined as a reason for consideration from 31% last year to 24% this year. Among all degree types, Hispanic students were the most likely to consider withdrawing at 42%, followed by Black students at 35%. (link)
