Here’s Molo Laken’s objection filing to the latest House settlement developments as Venable LLP Partner Philip Sheng points out: “Very interesting the brief mentions that objectors agreed for schools to maintain discretion to cut athletes for reasons such as conduct violations, performance, and academics. Likely this was tied to an athlete being able to use the existing arbitration process if they believed they were really cut due to roster limits. Footnote 1 is relevant here. Objectors do NOT seek ‘guaranteed’ roster spots, which has been argued by the Defendants and is one of the main criticisms I’ve seen of mandatory grandfathering.” More. (link)

Maryland’s AD search is winding down, according to Inside MD Sports’ Jeff Ermann, who notes TurnkeyZRG facilitated between six and eight candidate interviews. Among those that interviewed is Terps alum and Roc Nation Sports International Sports Marketing President Michael Yormark, who is the twin brother to Big 12 Commissioner Brett Yormark. Ermann: “I'm told Maryland football coach Mike Locksley, mindful of the fast-changing DNA of college sports -- and its effect on Maryland, which lagged behind the pack under its previous regime – has supported him as a candidate since early in the search. His connection to the music world could also bring Maryland increased credibility with recruits.” More on Yormark’s background. (link)

Forbes contributor/Penn adjunct professor Karen Weaver joins the Inside Higher Ed’s The Key podcast to discuss how changes in college athletics will impact the overall higher ed landscape. Weaver notes that “college athletics have played a critical role in higher education for over 100 years. The problem is that the money that has come into so much of college athletics at the highest level is just astronomical.” With coaching salaries well into the millions and eight-figure investments into athletics facilities, the campus starts to look and feel different, and Weaver believes “that has an impact on everybody.” Additionally, Weaver contends that ensuring athletes have academic success is further complicated when they can change institutions to pursue more lucrative deals. “The transfer portal has created an enormous burden on academic counselors and faculty when athletes are supposed to make normal progress toward a degree—all of that is very confusing now.” Weaver suggests collective bargaining would be a more comprehensive solution to the legal and financial complexities of the current state of affairs but acknowledges: “I understand collective bargaining with students is tough, I get that, and it’s messy…but it’s still a legitimate outlet to try to address all of these issues and it needs to be talked about more.” Full podcast. WRAL’s Brian Murphy acquired hundreds of pages of emails sent to North Carolina/NCAA Men’s Basketball Tournament Selection Committee Chair AD Bubba Cunningham after the Tar Heels were one of the last teams into March Madness. With West Virginia left on the wrong side of the bubble, you can imagine the tenor from some Mountaineers fans: “You stole from kids who devoted their lives and earned the right to a last chance. They’ll literally carry that weight and dream about not having that opportunity for the rest of their lives and you get to continue to sleep well at 62. Shame on you. Shame on you Bubba. You’re better than this.” Some Louisville & Michigan fans were also upset about seeding decisions with the subject of one email reading: “You failed America.” Lots more. (link)

Pathway Sports and Entertainment Founder Casey Schwab joins Tulane Sports Law Director Gabe Feldman to discuss the goals and functions of Pathway and cover several group licensing topics in general. With no union in college sports, Schwab explains: “What we’re doing at Pathway is creating a commercial group licensing entity that is only a commercial group licensing identity. We don't have a shareholder that happens to be a union. We're not partnered with a union nor do we have any plans to become a union.” Absent a union, Schwab notes there is no “pull-you-up mentality that comes with a CBA” that provides a non-economic reason for star NFL players to accept the same slice of licensing as others. “As we’ve talked to college football players over the last three months, we've talked about that in light of the sum of all of the Division I FBS players together having the rights in a single place, negotiating with potential licensees, having that effect, having that byproduct for the players who aren't getting the $1M, $2M deals for the rev-share deal like some of the top players are. And that's been actually really impactful to the top players that I personally had conversations with.” Furthermore, there is an economic reason for star players to agree to split licensing evenly, as Schwab explains: “That’s how you get the jerseys out. The top player is going to make a lot of money through his jersey. Historically, all of group licensing for a single group of athletes that play the same sport has been handled by a commercial entity or commercial arm of the union. So, if you’re not in it for video games, you’re not going to be in it for trading cards, you’re not going to be in it for jerseys.” Such a mechanism doesn’t exist in college, and Schwab notes: “I would argue it doesn’t have to always be that way.” Full pod. While many, if not most, football coaches are in favor of shortening and/or eliminating the spring transfer portal, On3’s Pete Nakos observes the path to get there remains obscure. A Power 4 GM believes there will eventually be just one portal in January: “As far as I know, that’s what everyone wants. That’s just common sense. When you get your team in the spring, you want that team to be the one you got. That only makes sense. All this, ‘We’ve got to wait for the spring window to close.’ And ‘Oh, someone is trying to get one of my guys.’ The odds are higher in January. But I say that everyone is pushing for January, so the NCAA is probably going to do the opposite. January is the best for football, for the sport. Do it from January 7 to January 17. Get everyone on campus, do what you’ve got to do. Everyone is locked in from there.” (link)

Houston is talking to the NCAA about foregoing its duties as an NCAA Men’s Basketball Tournament host next year as the Cougars would rather have the opportunity to play in the Toyota Center for the event’s Sweet 16 & Elite Eight rounds. Cougars AD Eddie Nuñez: “If they officially tell us we cannot be the host… if it’s official, we’ll take the next step with somebody to figure out who wants to be the host.” The Houston Chronicle’s Joseph Duarte: “The most likely scenario would involve at least one, and likely more, of the area’s other Division I schools — Rice, Texas Southern, Houston Christian, Prairie View A&M, Lamar and Sam Houston — replacing UH as host. The Big 12 Conference is not expected to be an option, a source said.” (link)

The NCAA Women’s Basketball Rules Committee met this week in Indianapolis and on Friday announced that they are recommending adding a coach’s video review challenge for the upcoming season. To be enacted, the proposal has to be approved by the NCAA Playing Rules Oversight Panel, which meets on June 10. Should the rule change be approved, coaches will be able to challenge out-of-bounds violations, backcourt violations, whether a change in team possession occurred before the ruling of a foul where free throws would be involved, and whether a foul was assessed to the correct player. With the exception of whether a foul was assessed to the correct player, referees would not be able to initiate reviews on these calls, only coaches. To make a challenge call, coaches do not need a timeout to spare. However, if the coach loses the challenge call with no timeouts left, their team will be given an “administrative technical foul for an excessive timeout.” (link)

Korn Ferry examines the phenomenon of replacing iconic CEOs such as Berkshire Hathaways’ Warren Buffett, and Korn Ferry Board and CEO Services Vice Chair Alan Guarino notes that any CEO departure is a shock to the system, and it’s only exacerbated when the CEO is replacing a founder or a longstanding iconic boss. “You can’t expect the new CEO to come in, walk through the door, and expect business as usual.” That’s partly because a company’s brand and an iconic CEO often become intertwined, and Guarino explains that to get around that, some successors ignore the organization’s processes and impose their personal stamp on it, often with negative results. Having a strategic, planned succession—first to identify the new CEO, then to help them in their first year—can help reduce risks and accelerate positive results. Additionally, before the new boss can figure out whether to significantly change the business strategy and culture created by the long-serving predecessor, they have to establish relations with the remaining executives, many of whom will wonder whether they have a future at the firm. In fact, experts say that listening to executives and other employees is one of the best things a successor can do. Korn Ferry Advisory Senior Client Partner Jonathan Wildman suggests the new CEO follow a “listening plan” for their first three months. Not only can doing so build relations and trust, it can also help identify what needs to change. Wildman: “You’re basically creating a blueprint for what you want to continue.” (link)

The NCAA is considering removing its prohibition on betting on professional sports, according to Sports Illustrated’s Pat Forde, who explains that if the DI Council supports the idea, it could be fast-tracked into existence by late June. MB Sports Consulting Founder Matt Banker tells Forde: “This is a cultural and philosophical recalibration for college athletics—both in terms of priorities and resources. The world of sports wagering looks far different in 2025 than it did even ten years ago, as it's now legal in almost 80% of the United States. From a resource standpoint, if the NCAA national office’s only function was to monitor all three NCAA divisions’ hundreds of thousands of athletes, coaches, and staff for all iterations of sports wagering—including pro-sports wagering—that could be the full-time job for everyone in the building. … At a macro level, the biggest risk to college sports is point shaving and prop bets and the integrity of its competitions being called into question. It’s not whether a college athlete or coach bets on the Super Bowl or WNBA Finals. Is it risky to gamble on an individual level? Of course. Is pro sports gambling by a college athlete or coach the biggest threat to college athletics? It’s not.” Sources confirm to Forde that prohibitions against gambling on college sports would remain in place. (link)

Florida State AD Michael Alford talks about the success initiatives in the ACC and explains that “if you have success, you should earn it. Same as what the media contract is. Those who are driving the media contract on an annual basis should be able to earn more out of that media contract. So that's something that we push for, so I'm excited about where we're positioned. We have some big games. We've always performed well – I might tout that every once in a while that we do do well. Brands matter. I’m going to discuss that, and we’re going to continue to play big brands. You’ve read I want to play Notre Dame more. We already play them more often than anyone in the conference, we play Miami every year, we play Clemson every year, we're going to play Alabama, we’ve got Georgia coming up on the schedule, we play Florida every year – you know this is the Florida State way. We're going to go out and compete against the very best, and as we continue to do that, it is also going to draw great ratings on TV.” (link)

Northwestern AD Mark Jackson joins the Medill School of Journalism’s SportsNight program to discuss all things Wildcats athletics and says of the reconstruction of Ryan Field: “A true game changer. This is the college game day experience reimagined. There’s nothing else in the country that will compare when all’s said and done. … We’ve obviously thought through every element of the fan experience. We want it to be a unique opportunity; we want people to fear that they’re really missing out on something special and I think they will. The proximity of the sight lines, the intimacy of the stadium, the energy, the student plaza – all of it has been really really thought through.” Jackson adds: “We really want to draw in Chicago. We believe strongly we’re Chicago’s Big Ten team. How can we build bridges to the Chicago community, the Big Ten community, make it just a world class experience for everybody.” Regarding the House settlement, Jackson believes there are natural partnerships with corporate partners in Chicago and beyond to “hopefully elevate both institutional spend and NIL spend to put us in a really strategic advantage.” (link)

How would ETSU AD Richard Sander describe college athletics right now? “I think we’re basically running two distinct athletic departments for all intents and purposes. We’re operating one that is the revenue generators where you're going to have to compensate student-athletes. I mean, that's just the world you're in, particularly men's basketball is the one that kind of has got way out in front of that. At our level at FCS football it’s a factor, it’s not the key factor, where in men’s basketball it is. In women’s basketball, that’s probably somewhere in between men’s basketball and football. But we’re seeing women’s basketball starting to take off from a standpoint of having to compensate student-athletes.” Asked whether he feels ETSU can compete financially with its Southern Conference peers in revenue-sharing, Sander explains: “That’s one of the problems. We think we are. We think the amount of resources that we’re going to share will allow us to compete for championships in the SoCon, but there is no way of knowing for sure what’s out there. There are so many rumors, so many false statements about who’s getting what. We really don’t know. … One of the frustrations is when you recruit players, you never know what anyone else is offering them.” More from Sander. (link)

Akron President R.J. Nemer indicates that "an action plan is in place to monitor the continuous academic improvement of the football program" after the Zips were ruled ineligible for postseason play for the upcoming season. Nemer adds that "the administration is committed to implementing a sustained solution." Nemer in an email to the campus community: “As president, I want to ensure the campus that we prioritize the academic performance of our entire student body and likewise champion the learning of all student-athletes. Failing to do so would simply be unacceptable. … Unfortunately, during the 2021-2022 academic year, with a coaching change and necessary roster adjustments, UA Football's APR dipped to an outlier score that irreparably damaged the four-year average for the most recent review period. While the team has dramatically improved its academic performance since AY 2021-2022, the aggregated score has led to the mandatory imposition of the bowl ban." Incoming AD Andrew Goodrich, Nemer continues, is “aware of this situation and will immediately prioritize the academic performance of UA Football, while continuing to maintain the high standards set by the rest of the teams that have achieved adequate in-class performance." The Men’s Basketball Rules Committee made several recommendations for the 2025-26 season, including a coach's challenge at any point in a game to review out-of-bounds calls, basket interference/goaltending and whether a secondary defender was in the restricted-area arc. Committee members also recommended modifications to the rule on continuous motion on field goal attempts. Other enhancements to help with the flow of the game include new emphasis for the basketball officials for 2025-26, including directives to address delay-of-game tactics, limit time spent at the monitor, improve game administration efficiency and reduce physicality. Teams must have a timeout for the coach to use a challenge, and if the instant replay review is successful, teams would be allowed one additional video review challenge for the rest of the game, including overtime. If unsuccessful, the team loses the ability to challenge the rest of the game. Officials could initiate video reviews on basket interference/goaltending and restricted arc plays in the last two minutes of the game and into overtime. The challenge does not impact officials’ voluntary use of replay for timing mistakes, scoring errors, shot clock violations, 2-point versus 3-point field goal attempts, flagrant fouls, etc. Other proposals include giving officials the option to call a Flagrant 1 foul when a player is contacted to the groin, if a player uses the rim to gain an advantage, it would be a basket interference violation, and if one of the shot clocks becomes inoperable, the shot clock at the other basket would be allowed to remain on. Currently, both clocks would be shut off until both are operable. (link)

The Women's Basketball Rules Committee recommended implementing a coach’s video review challenge for the 2025-26 season. Challengeable plays would include out-of-bounds violations, ruled backcourt violations, whether a change in team possession occurred before the ruling of a foul where free throws would be involved, and whether a foul was assessed to the correct player. Officials could not initiate reviews on these calls with the exception of whether a foul was assessed to the correct player. Other rules proposals include setting the shot clock to 20 seconds when, following a dead ball, the offense is awarded the ball in its front court, eliminating the rule that jerseys need to be tucked in, and using excessive timeouts or playing with six players when the ball becomes live will become team technical fouls, allowing players to complete a jump stop when their feet land approximately at the same time without being called for traveling, and allowing defenders multiple one-hand (hot stove) touches on stationary players holding the ball or on a dribbler. Sacramento State Men’s Basketball HC Mike Bibby will make a total of $521K per year, including $300K in base salary, $200K in supplement compensation and talent fees, and a $21K yearly retention bonus, according to Sportico’s Daniel Libit, who notes Bibby will also be able to earn up to $335K in performance and academic bonuses. Libit also points out the total compensation is higher than the $470K stipulated in the offer letter sent to Bibby in March due to “negotiations after the initial offer.” If Bibby leaves before the end of the contract term, he would owe the school liquidated damages equal to 50% of his remaining base salary. If the school prematurely terminates Bibby, it would owe him 75% of his remaining base salary. Alternately, the school can reassign Bibby to a new position at half his current base salary. (link)

Jordon Hudson, the 24-year-old girlfriend of North Carolina Football HC Bill Belichick, has reportedly not been banned from the team’s facility per The Athletic’s David Ubben, contradicting an earlier report from ESPN’s Pablo Torre as part of his "Pablo Torre Finds Out” podcast. “While Jordon Hudson is not an employee at the University or Carolina athletics, she is welcome to the Carolina football facilities,” an athletic department spokesperson said in a statement, noting there were “false reports” about her role. “Jordon will continue to manage all activities related to Coach Belichick’s personal brand outside of his responsibilities for Carolina football and the university.” On X, Torre stood by his reporting citing that his information came via the highest levels of the football program. “UNC can now choose to describe or change its position on Jordon Hudson’s involvement however it wishes, following the publication of our episode. We requested comment and filed dozens of FOIA requests that were not satisfied.” Hudson’s role has been under increasing scrutiny since her recent involvement surrounding a CBS Sunday Morning interview with Belichick promoting his new book, "The Art of Winning." A new Arizona NIL law recently signed by Gov. Katie Hobbs expands one of the country’s “more dated NIL laws to a robust policy that hits on new issues and House settlement-related framework,” according to Opendorse Director of Collegiate Services & Insights Braly Keller. Per the bill, schools can now provide direct payments to student-athletes and utilize third-party marketing arms, student-athletes may not be classified as employees solely on the basis of participation in an athletic program or through receipt of compensation, information on payments to student-athletes won’t be accessible through FOIA and the bill also prevents NCAA & governing body enforcement. ESPN is naming its upcoming all-access flagship streaming app ‘ESPN’ according to CNBC media and sports reporter Alex Sherman. ESPN Chairman Jimmy Pitaro reportedly settled on the ESPN moniker to “simplify what has become a cluttered streaming world, filled with different media products that can be bundled with other services at different price points.” Pricing for the new service set to debut in the fall is expected to be released next week, but previous reporting put the expected cost at either $25 or $30 a month.
