House Settlement Updates…
+ According to a filing made Wednesday, House attorneys have agreed that schools will be permitted to grandfather in a range of athletes, according to Yahoo’s Ross Dellenger, who notes those athletes include: (1) those currently on a roster; (2) those athletes who have already been cut this year; and (3) those high school recruits who enrolled at a school after committing to a roster position only to see it eliminated.” Dellenger adds that, as he reported last week, the revision is “not mandatory but is at each school’s discretion — a move that is seen as a compromise from the power leagues to the judge’s wishes.” As part of the settlement revision, schools would be “expected to track their protected/grandfathered-in roster spots with a rolling list of exceptions. Those protected athletes would presumably roll off the exception list as their eligibility expires. These exceptions would permit a school to exceed roster limits tied to the settlement.” Meanwhile, U.S. District Judge Claudia Wilken said she would allow objectors to file responses to the revision by May 13. The plaintiffs and the NCAA would then have three days to respond. (link)
+ Attorney Steve Molo, who represents a group of objectors, has already voiced opposition to the revision: "While the NCAA and Class Counsel have acknowledged our objection to roster caps is valid, their proposed mushy modification doesn't go far enough. Many, many student athletes have had something taken away from them. The fight will continue." + More from USA Today’s Steve Berkowitz, who drills down into some of the finer points, noting that the revision “does not remove the roster limits from the settlement. And this would not require schools to keep all of their current athletes on their rosters. However, it would give schools the option to keep any athlete who was on a roster in 2024-25 and who has been or would have been removed for 2025-26 because of the limits. It also lets schools accommodate any high school senior who was ‘recruited to be, or was assured they would be’ on a Division I school's roster for the 2025-26 school year. Lawyers for the NCAA wrote that ‘there are no guarantees’ that these athletes ‘will get or maintain roster spots. But that does not adversely affect any athlete, the NCAA said, because athletes' roster spots always have been ‘at the discretion of the coach’ and the school.” Berkowitz adds that lawyers for the NCAA, in apparent anticipation of objections, wrote: ‘To the extent the Objectors want more, e.g., guaranteed roster spots or years of delay in imposing roster limits, Defendants respectfully submit they are overreaching’ and they provided a series of arguments defending the new proposal. Some were based on legal reasoning connected to the antitrust standard that a settlement must be fair, reasonable and adequate. Others were based on athletic department operational issues.” (link)
+ Sportico’s Daniel Libit and Michael McCann lay out “the big picture: Athletes at schools that invoke the grandfathering position will have a chance to keep their spot. That is true of incoming athletes who have been told by a college they have a roster spot. It also means current and incoming athletes at schools declining to invoke that term will still lose their spot if Wilken approves the settlement, though such players could seek to transfer. The revision is intended to persuade Wilken that class members who are cut on account of roster limits will be in the same position they were in before the limits. Both before and after limits, college athletes have an opportunity to compete and are not guaranteed roster spots. The modification allows coaches, assuming a school uses this new discretion, to bring back onto rosters players who were or would be cut. The revision also calls for schools to prepare lists of players cut on account of roster limits. … Whether this revised arrangement sufficiently assuages Wilken remains to be seen.” (link)

The NCAA DI Decision-Making Group has released an update on its draft conceptual framework for a new governance structure and notes that current challenges in the decision-making include having over 80 committees, hundreds of committee members, difficulty in moving decisions quickly through the structure, and a lack of accessibility for those who are not entrenched in the structure day-to-day. The new framework identifies categories that should be consistent for all of DI and those that can be bifurcated as part of an effort to decentralize rules. DI-specific issues include minimum academic standards, athletics eligibility rules, compliance with recruiting calendars, regular season end dates, national championships administration, minimum membership requirements, institutional control and ethical conduct. Bifurcated elements that could be managed at the subdivisional, school or conference level include in-season competitions, out-of-season competition, playing and practice schedules, number and responsibility of staff, and others as deemed appropriate by unified governance to comply with settlement or future litigation. The framework would also reduce the number of DI Board of Directors voting members from 24 to 13; however, the board would still have 24 votes, as each of the Power 4 conferences “has a guaranteed seat on the board with a voting weight of 4.1. The additional representatives to the board are three student-athletes, two FBS non-autonomy or Group of 6 representatives, two representatives from the CCA22 grouping, as well as an additional representative from FCS and one from Division I. Each of those representatives has a voting weight of one. In addition, the working group is exploring including the NCAA president as an ex officio non-voting member of the board.” Additionally, the DI Council would be replaced by a DI Administrative Group with 24 voting members and 41.1 total votes. The nine P4 representatives’ votes would carry a weight of 2.9 while all others would carry a weight of one. Lots more. (link)

Former Alabama Football HC Nick Saban and Texas Tech University System Board of Trustees Chair/Double Eagle Energy Holdings CEO Cody Campbell will help lead President Donald Trump’s presidential commission on college athletics, per Yahoo’s Ross Dellenger. (link); The Athletic’s Ralph Russo cites a source who says Trump is expected to be “very engaged” with the commission. Former LEAD1 CEO Tom McMillen also weighs in: “I give President Trump a lot of credit. This is a time to bring the best minds in college sports together, in higher education, and figure a model out. He’s always had a big interest in sports. It really fits his kind of whole M.O.” McMillen adds that a commission on college sports could help lead to long-term reform without interrupting what is already in motion. “Not gonna be overnight, but it could be very, very symbolic and very significant for higher ed and college sports, and for America.” (link)

ESPN is open to increasing its payment to the SEC if the conference adds a ninth game to its football schedule, according to The Athletic’s Seth Emerson and Andrew Marchand. While there is no formal offer and the exact amount still needs to be fully negotiated. Emerson and Marchand report the “additional money would likely be in the range of $50-80M annually on top of the current deal, in which ESPN pays the conference $811M per year.” They also point out that the “main hurdle to expanding the league schedule may be the future College Football Playoff format, which isn’t likely to be determined until at least June. That makes it less likely — though not impossible — that the SEC makes a decision on a schedule format at its spring meetings later this month in Destin.” (link)

The Pac-12 and Mountain West will engage in mediation beginning May 19, according to The Mercury News’ Jon Wilner, who notes a mediator has yet to be named and there is no date listed for the mediation to conclude on legal filings with the Northern District of California. “However, the conferences have requested a 60-day extension on the current stay of the poaching penalty lawsuit,” which was set to expire on May 16. Wilner is told the Mountain West initiated the conversation about mediation, and a statement from the Pac-12 reads: “The Pac-12 Conference (Pac-12) and the Mountain West Conference (MWC) have submitted a joint filing indicating they will try to mediate their dispute. … It is important to note that the Pac-12 initiated this legal action in September 2024, in response to the MWC’s attempt to impose unlawful ‘poaching penalties’ which were designed to hinder our ability to act in the best interests of our student-athletes and member institutions. While the Pac-12 is committed to engaging in mediation in good faith, we remain confident in the strength of our position and are fully prepared to move forward with our case if we cannot reach an acceptable resolution. Our priority continues to be the well-being and fair treatment of our student-athletes.” (link)

On Montlake’s Christian Caple unpacks Washington’s new 12-year multimedia rights deal with Learfield, noting it guarantees the school a minimum average of more than $14M per year, nearly double UW’s royalty payment of $7.15M for the current fiscal year. Caple explains the Huskies will receive $11.8M in cash in Year 1 and that figure gradually increases to about $16M by Year 12 “and is structured in a way that could make it even more profitable for UW. The agreement also calls for Learfield to purchase a suite at Husky Stadium each season for $150K, and Learfield is responsible for securing $400K per year in UW-approved trade. I didn’t include either figure in my cash calculations. Unlike UW’s current MMR deal, the annual payout amount on the new deal isn’t fixed, so the school could make more money if Learfield’s UW property achieves certain adjusted gross revenue thresholds.” For example, if Learfield “leverages UW’s multimedia rights to gross revenue exceeding an amount equal to 72% of the guarantee, it will pay 72% of the total to the school. If Learfield’s UW-related revenue exceeds $20M, the school’s cut would be 68% of anything Learfield generates above that number (i.e. an adjusted gross revenue total of $30M would mean a $21.2M payout to the school, because 72% of $20M is $14.4M, and 68% of $10M is $6.8 million).” (link)

ESPN’s domestic revenue rose 7% to $4.2B during the company’s fiscal Q2, but operating income fell 17% to $648M. Front Office Sports’ Eric Fisher, David Rumsey and Colin Salao note the earnings were “particularly hit by increased rights and production costs for the newly expanded College Football Playoff, as well as the timing of the 2024 NFL regular-season schedule. The network additionally took a write-down in the quarter related to the shuttering of Venu Sports in January.” ESPN+ ended the quarter with 24.1M paid subscribers, down 3% from the end of 2024 and equal to the level it reached in mid-2022. Fisher, et al. point out that “ESPN+ has been essentially flat in subscribers since then, suggesting it may have hit a ceiling as more sports content shows up in Disney+. The advertising market there, and on the other Disney streaming services, also faces greater competition, though ESPN overall saw a 29% bump in domestic ad sales during the quarter.” (link)

A new Division I governance model is being shared with executives, according to Yahoo’s Ross Dellenger, who explains the “ proposed model streamlines NCAA committees – shrinks them, eliminates some, etc. - but, most notably, grants the four power conferences 51% & as much as 65% weighted voting privileges.” (link)

President Donald Trump is making plans to create a presidential commission on college athletics, and Yahoo’s Ross Dellenger explains: “Multiple sources, both in Congress and within college sports, spoke to Yahoo Sports under condition of anonymity as they were not authorized to speak about Trump’s plan. Many college sports stakeholders have been briefed on the matter. It is unclear when an announcement could come. … Details of the commission are for now being kept private, but the group is expected to feature college sports stakeholders, prominent businesspeople with deep connections to college football and, perhaps, even a former coach and administrator. The commission is expected to deeply examine the unwieldy landscape of college sports, including the frequency of player movement in the transfer portal, the unregulated booster compensation paid to athletes, the debate of college athlete employment, preserving the Olympic sport structure, the application of Title IX to school revenue-share payments and, even, conference membership makeup and conference television contracts.” Dellenger adds that former Alabama Football HC Nick Saban is “expected to be integral to the commission’s work” and notes Trump and Saban met about college sports legislation while Trump was in Tuscaloosa to deliver UA’s commencement address last week. The Pac-12 and Mountain West have yet to begin mediation, according to JohnCanzano.com’s eponymous publisher, who reports the leagues are “expected to ask the judge for an extension of the stay in the next 72 hours, per sources. A date for a one-day mediation session will be set. A retired federal judge is the likely mediator. I’m told if the first session goes well, the sides will schedule a second one. If not, it’s off to court for a trial.” One source tells Canzano: “It could get real ugly real fast.” The lawsuit filed separately against the Mountain West by Colorado State, Boise State, and Utah State could also be settled via the same mediation session. On the expansion front, Canzano notes a “faction of Pac-12 schools prefer to add UNLV, I’m told by a source. The geography makes sense. Las Vegas is an emerging and ambitious city. There are lingering questions about campus leadership, alignment of vision, and a willingness to invest in football, but the Rebels still have traction in the Pac-12 room.” Meanwhile, “some in UNLV’s camp are holding out hope that the Big 12 will call with an invitation. Or at least they’re posturing and whispering about it. Does Commissioner Brett Yormark’s conference need UNLV to get its toe into Las Vegas? Or can it just hold some high-profile events there? You tell me. But ‘we’ve got a plan and it involves the Big 12’ came off the lips of a source in the Rebels’ inner circle last week.” Additionally, some in the Pac-12 “love the idea of recruiting in Texas,” but Canzano notes the league’s “highly concentrated geographical footprint” is a concern. Also: “Memphis and Tulane are still out there, but it would surprise me if the Pac-12 took them as ‘all-sports’ options.” (link)

Marquette is adding women’s swimming as its 17th varsity sport with competition to begin as early as the 2025-26 season. The program will compete in the Big East but will not include a diving team. Golden Eagles AD Mike Broeker: “Adding women's swimming will improve gender equity in athletics and provide a revenue generation opportunity for the university, while offering a competitive Division I experience for our student-athletes. The ACC is moving back to an 18-game basketball conference schedule for the 2025-26 season and beyond, according to CBS’ Matt Norlander, who points out that “some upper-echelon [men’s] programs — Duke chief among them — wanted to drop two games from the league schedule in an effort to avoid dead weight dragging down NCAA Tournament résumés.” Still, one source tells Norlander that "you aren't going to fix the problem by going from 20 to 18. The problem for the ACC is, a lot of these teams just haven't been good." To that end, Norlander notes the ACC “now wants to empower its coaches an opportunity to effectively swap out two conference games (whose résumé value is now unknowable) for two nonleague contests that could mean more, statistically. Not every ACC team will win all of these games, of course, but the idea is to have ACC schools build up a stronger out-of-conference schedule and increase their chances of earning at-large bids to the NCAA Tournament. As for the 18-game league schedule, sources said the ACC is planning to have every team's intra-conference slate involve two home-and-homes, 14 single-game matchups and one ‘zero-play,’ meaning every ACC team will play 16 opponents each season moving forward instead of all 17.” (link)

ESPN’s Jake Trotter and Max Olson note that during February’s NFL Combine, more than 300 people, including 15 NFL GMs and player personnel directors and recruiting staffers from 34 college football programs, “crowded into a corner room on the second floor of the Indianapolis Convention Center. There, they unpacked the forces driving college football's newest arms race: the rise of the general manager and expanding front offices.” Texas Tech GM James Blanchard was one of the attendees and says: "It's (the GM role) the fastest growing industry in college football. We're hitting the golden age of the personnel world, as far as college football goes." Blanchard believes many of the recent GM hires could outlast their head coaches and expects college GMs to match coordinator salaries – and face similar pressure. "That's the way it's trending. The NFL has been doing business at a high level for a long time. ... But now, college is catching up – and it's catching up like Usain Bolt on the fourth leg of a relay." Former Nebraska Director of Football Relations CJ Cavazos, who is now a consultant and agent, adds: “They're doing more than just putting together a team – they're wearing a lot of different caps…like a head coach because they're in charge of the roster, the [salary] cap, incoming freshmen and portal players. Half of college football general managers will be making close to a million dollars. That's where the market is taking them." Lots more. (link)

Maryland Eastern Shore will opt into the House settlement’s revenue-sharing component. Hawks AD Tara Owens: "The decision to opt in to the settlement allows for financial support and revenue sharing to give student-athletes a real opportunity to earn income while acknowledging the time, talent and energy student-athletes bring to UMES. We are continuing to explore all avenues in order to establish and maintain competitive teams while providing an optimal collegiate experience for our student-athletes. The decision will not increase the financial investment the university makes in the Department of Athletics. More on the Big Ten’s tax return from Sportico’s Daniel Libit, who notes the league’s $928M in FY24 revenue was against $942M in expenses, and member school distributions ranged from $61.5M to $63.6M. Libit also reports General Counsel Anil Gollahalli was the conference’s highest-paid non-commissioner or former commissioner earning $517,907. “In addition to Gollahalli, the Big Ten spent heavily on outside legal services last fiscal year—one marked by widespread litigation in college sports—paying a total of $7.02M. Howard Industries has provided the lead naming gift for Mississippi State’s new football indoor practice facility. The Billy W. Howard Sr. Indoor Practice Facility, named after the 1946 football, basketball and track and field alumnus, will include a 110K square-foot indoor training facility as well as dedicated areas for sports science for enhanced work in injury prevention and recovery. There will also be renovations and expansions of the sports medicine, nutrition, and locker room areas within the current Leo Seal Jr. Football Complex. (link)

Rather than sending cushioned, chairback seats to college football programs who then rent them out to fans via a revenue-sharing model with the seat provider, 4Topps “wants to upend that model by selling its mesh seats to schools, which would then rent them directly to fans,” according to SBJ’s Bret McCormick, who notes: “Schools can charge more for the mesh seat…and can cut out the middleman in the process by buying or financing the seats from 4Topps. McCormick reports that Florida State was the first to buy seats (14K outright) directly from 4Topps last fall, and this year, Oklahoma State is following suit with an 11K-seat purchase that the Cowboys will finance over two years. OSU, McCormick adds, “plans to raise its season-long seat license price from $55 to $75, while charging $20 to those that ordered in advance or $25 (at the gate) for single-game rentals. The Cowboys traditionally brought in between $270K and $300K per season through chairback rentals from Learfield’s Amplify, a deal that was separate from OSU’s multimedia rights agreement with Learfield. But under the new deal structure with 4Topps, OSU Asst. AD for Ticket and Revenue Generation Logan Hofferber expects the seat license program to break even in Year 2, generate $455K in Year 3, $686K in Year 4 (following a potential projected price change to $85 per season) and $730K in the fifth year. The expectation is for the seats to last at least seven years before some will need swapping out, meaning the third through seventh years represent pure profit for the athletic department.” (link)
