Mississippi State AD Zac Selmon is in favor of College Football Playoff expansion, specifically play-in opportunities for potentially guaranteed spots. Selmon: “Exciting competition is exciting competition, and I’ve always been a fan for access, but also for the fan bases, more play-ins. You look at what the NBA has done and other leagues — having hope, having excitement late in the season — I love the concepts of just having more opportunities and also having some more things on the line. … I think [from a mental standpoint] it helps the student-athlete having more things to play for late in the season. ” (link)

Nevada AD Stephanie Rempe joined the Talking Pack podcast to discuss the Grand Sierra Resort (GSR) Arena project and the use of public funding. Rempe notes that GSR owner/former Arizona Coyotes owner Alex Meruelo approached UNR 12-18 months ago about investing in a property, which has been part of a redevelopment area since 2005. Redevelopment areas (RDAs) designated as such are able to receive tax-increment financing (TIF), and Rempe explains that GSR is slated to pay around $785M in property taxes, 26% of which will be paid to, in this case, RDA 2. “And then businesses that qualify for TIF funding, when they invest, they can go ask for money from that. So, that 26% of the property taxes paid by the businesses in RDA 2 cannot go to offset the city budget. … It goes to future development opportunities that are in RDA 2. That said, they set whatever the property taxes are today for the GSR property – right now that number is $785M – into Phase 1.” Consequently, those property taxes go up, and of the property taxes that the GSR is expected to pay between when it opens and 2035 when the RDA ends, “$68M of the property taxes that they pay would go back to the GSR. So, again, the GSR is paying that money in property tax; a portion of that 26% goes back to offset this, which is $68M to go towards that $785M. The rest of that still goes back to the [county and state]. All of that, so everything above that 26% is still going back. If they don’t invest anything, there is zero dollars going back to any of those places.” Rempe also notes that an analysis found a $150M gap in funding without TIF funding. “So, this $68M that they’re projecting from the 26% of the property tax would go towards that $150M. It’s still a negative loss for Alex Meruelo, who is putting in his own money. … If he took that same $785M and invested it into [some other investment], the return is so much higher than it will be on this property.” Full podcast. Southern Miss Senior Deputy AD/COO Shawn Jones discusses several topics on Super Talk Eagle Hour, including renovations to Reed Green Coliseum, about which he acknowledges there have been times in the past where there was talk of upgrades but nothing came to fruition. “It is in progress, it is going to happen. It's different when you're trying to stay in a facility over a two-year phase of construction you know if we could move out of the building and move into another facility here in Hattiesburg and practice and play and have commencements, you can move it a little bit different speed but you know there's so many things behind the walls that have to remain intact when you’re going through construction to be able to use the facility – not only from having electricity, having heat and air, but from a health and safety perspective.” Currently, the Golden Eagles are “putting every single detail to paper to match up with the finances that are available for the project,” Jones adds before noting there have been “some tweaks here and there because, like always in these projects, there are a few things here and there that have to be removed when you get to that point. Nothing alarming. I would tell folks we're going to have a great facility.” Jones also says there have been no discussions about downsizing M.M. Roberts Stadium to make tickets more of a premium, noting there are “still two things that bring people out, and it’s really simple. You can do all the studies you want, but it’s winning and it’s weather. You get good winning and you get good weather, folks are gonna come.” More from Jones. (link)

Since beginning alcohol sales on April 5, Clemson has generated $470,927 in gross revenue and sold 39,392 units over 15 events. For the sold out Savannah Bananas event at Memorial Stadium, Clemson sold 27,181 units to make $346,684 in gross revenue. The football spring game did $35,174 in gross revenue on 3,394 units sold. Net totals have not yet been determined. (link)

Transfer portal windows, financial literacy and agent certification were among the key topics discussed during the National Football Operations Organization meetings in Dallas last week, where one speaker remarked: "We have no certification process whatsoever for agents in college repping these NIL kids. You've got some (agents) getting as much as 25% of the deals. If someone tells a kid he can double his money elsewhere, they’re gone." Football Scoop’s John Brice notes that the “supermajority of DFOs in the room for the panel meetings agree[d] almost unanimously in favor of an NCAA program moving forward to mandate representatives of student-athletes at the college level go through a certification process with the NCAA.” One NCAA representative noted that the NFL requires player agents to be certified; however, another pointed out that the “NFL has collective bargaining.” Brice also notes that a panelist remarked that "there’s a 45% increase in agent activities this year in terms of student-athletes in the portal with agents. [The mindset is] like, 'I gotta have an agent to do my dirty work.' We (at the NCAA) saw agents sending out lists to staff before the season even ended. A lot of the tampering is coming from that area. ... Agents are dictating this market." More from Brice. (link)

That’s Shaquille O’Neal, he can do what he wants. If he wants to sit there and just watch, he can sit there and watch. UAB Football HC Trent Dilfer breaks down how NIL dictates the offensive and defensive schemes programs can run and explains: "There's Bill Clark's defense, which was awesome. Mint defense. 2-gap. Punch and hold up. It's a great way to play defense. It's a problem to play against. I love that system. I hate playing against it. But they were recruiting a different...it's a different era now. Those guys are very expensive. To run that defense right now is probably about $2M and we have $1M for the entire team. So I would challenge any Mint defensive coach, I would ask 'How are you going to pay for it? How are you going to find the 4i's? How are you going to find the Jack? The Jack position alone is a $750K player right now. In our conference, he's a 6'5”+, 34-inch arms, 265-280 pounds, and can run, can cover, and can drop. Like he is a draftable player. That's a $750K player in our conference. He's $1.5M in the Power Fours. So yeah, it's one thing as a fan to say 'Why aren't they playing Mint? Why are they a four-down team?' Well, we all love Mint. I'd love to play that defense. I can't afford that defense. What we can afford is a four-down structure of eight or nine twitchy, explosive get-off guys that can slice-and-dice, create havoc in the backfield, create negative plays. Are we going to hold up like a brick wall in the run game? No. We're not built to hold up like a brick wall in the run game, so you've got to stop the run in different ways." (link)

North Carolina Football General Manager Michael Lombardi last week on the ACC Network: “The most disappointing thing about the college game that I've experienced is that the players don't view the contracts as binding. I come from a league where the contracts are binding. We've had four or five players we signed in in December, before we got here, that have left already without any hesitation. They're free to do that because the contracts are loosely written based on NIL. We, as a league, the NCAA, and all these conferences have to make players honor a contract when they put their John Hancock on it. Just like I have to honor my contract. That's part of life. That's the only disappointing thing.” (link)

EvanMiya publisher Evan Miyakawa shares the results of a four-year study on the construction of mid-major basketball rosters. The three main takeaways include retaining key talent as much as possible, looking for down-transfers from higher levels and limiting reliance on freshmen. Miyakawa points out that “teams that played in March Madness were much more reliant on returning players, especially at the expense of freshmen. Over 64% of the minutes on tourney-teams went to players on the roster the previous season, almost 10% higher than teams that missed the dance (55%). Meanwhile, just 11% of the minutes for tourney-teams were allocated to incoming freshmen, a much lower mark than for all other teams. The level of experience on the roster was also higher for teams that played in March Madness, at 1.99 average years of D1 experience, compared to 1.66 for all other teams. Notably, there wasn’t a significant difference in the importance of transfers to these two groups of teams.” In parsing where the star players on mid-major teams come from, Miyakawa explains that that 50% were recruited by that mid-major school out of high school and stayed for multiple years. “So many of the best mid-major players were developed the old-fashioned way: staying with the same team and improving year after year.” As for finding the best players in the portal, Miyakawa found that a “majority of the best transfers to the mid-major level have come from high-major schools (13 out of the 25), and just three of the transfers came from a true mid-major or non-DI school. This shows that the most reliable transfers are players who are down-transferring or staying at the same level of competition.” More. (link)

Here’s Molo Laken’s objection filing to the latest House settlement developments as Venable LLP Partner Philip Sheng points out: “Very interesting the brief mentions that objectors agreed for schools to maintain discretion to cut athletes for reasons such as conduct violations, performance, and academics. Likely this was tied to an athlete being able to use the existing arbitration process if they believed they were really cut due to roster limits. Footnote 1 is relevant here. Objectors do NOT seek ‘guaranteed’ roster spots, which has been argued by the Defendants and is one of the main criticisms I’ve seen of mandatory grandfathering.” More. (link)

Maryland’s AD search is winding down, according to Inside MD Sports’ Jeff Ermann, who notes TurnkeyZRG facilitated between six and eight candidate interviews. Among those that interviewed is Terps alum and Roc Nation Sports International Sports Marketing President Michael Yormark, who is the twin brother to Big 12 Commissioner Brett Yormark. Ermann: “I'm told Maryland football coach Mike Locksley, mindful of the fast-changing DNA of college sports -- and its effect on Maryland, which lagged behind the pack under its previous regime – has supported him as a candidate since early in the search. Forbes contributor/Penn adjunct professor Karen Weaver joins the Inside Higher Ed’s The Key podcast to discuss how changes in college athletics will impact the overall higher ed landscape. Weaver notes that “college athletics have played a critical role in higher education for over 100 years. The problem is that the money that has come into so much of college athletics at the highest level is just astronomical.” With coaching salaries well into the millions and eight-figure investments into athletics facilities, the campus starts to look and feel different, and Weaver believes “that has an impact on everybody.” Additionally, Weaver contends that ensuring athletes have academic success is further complicated when they can change institutions to pursue more lucrative deals. “The transfer portal has created an enormous burden on academic counselors and faculty when athletes are supposed to make normal progress toward a degree—all of that is very confusing now.” Weaver suggests collective bargaining would be a more comprehensive solution to the legal and financial complexities of the current state of affairs but acknowledges: “I understand collective bargaining with students is tough, I get that, and it’s messy…but it’s still a legitimate outlet to try to address all of these issues and it needs to be talked about more.” Full podcast. WRAL’s Brian Murphy acquired hundreds of pages of emails sent to North Carolina/NCAA Men’s Basketball Tournament Selection Committee Chair AD Bubba Cunningham after the Tar Heels were one of the last teams into March Madness. With West Virginia left on the wrong side of the bubble, you can imagine the tenor from some Mountaineers fans: “You stole from kids who devoted their lives and earned the right to a last chance. They’ll literally carry that weight and dream about not having that opportunity for the rest of their lives and you get to continue to sleep well at 62. Shame on you. Shame on you Bubba. You’re better than this.” Some Louisville & Michigan fans were also upset about seeding decisions with the subject of one email reading: “You failed America.” Lots more. (link)

Pathway Sports and Entertainment Founder Casey Schwab joins Tulane Sports Law Director Gabe Feldman to discuss the goals and functions of Pathway and cover several group licensing topics in general. With no union in college sports, Schwab explains: “What we’re doing at Pathway is creating a commercial group licensing entity that is only a commercial group licensing identity. We don't have a shareholder that happens to be a union. We're not partnered with a union nor do we have any plans to become a union.” Absent a union, Schwab notes there is no “pull-you-up mentality that comes with a CBA” that provides a non-economic reason for star NFL players to accept the same slice of licensing as others. “As we’ve talked to college football players over the last three months, we've talked about that in light of the sum of all of the Division I FBS players together having the rights in a single place, negotiating with potential licensees, having that effect, having that byproduct for the players who aren't getting the $1M, $2M deals for the rev-share deal like some of the top players are. And that's been actually really impactful to the top players that I personally had conversations with.” Furthermore, there is an economic reason for star players to agree to split licensing evenly, as Schwab explains: “That’s how you get the jerseys out. The top player is going to make a lot of money through his jersey. Historically, all of group licensing for a single group of athletes that play the same sport has been handled by a commercial entity or commercial arm of the union. So, if you’re not in it for video games, you’re not going to be in it for trading cards, you’re not going to be in it for jerseys.” Such a mechanism doesn’t exist in college, and Schwab notes: “I would argue it doesn’t have to always be that way.” Full pod. While many, if not most, football coaches are in favor of shortening and/or eliminating the spring transfer portal, On3’s Pete Nakos observes the path to get there remains obscure. A Power 4 GM believes there will eventually be just one portal in January: “As far as I know, that’s what everyone wants. That’s just common sense. When you get your team in the spring, you want that team to be the one you got. That only makes sense. All this, ‘We’ve got to wait for the spring window to close.’ And ‘Oh, someone is trying to get one of my guys.’ The odds are higher in January. But I say that everyone is pushing for January, so the NCAA is probably going to do the opposite. January is the best for football, for the sport. Do it from January 7 to January 17. Get everyone on campus, do what you’ve got to do. Everyone is locked in from there.” (link)

Houston is talking to the NCAA about foregoing its duties as an NCAA Men’s Basketball Tournament host next year as the Cougars would rather have the opportunity to play in the Toyota Center for the event’s Sweet 16 & Elite Eight rounds. Cougars AD Eddie Nuñez: “If they officially tell us we cannot be the host… if it’s official, we’ll take the next step with somebody to figure out who wants to be the host.” The Houston Chronicle’s Joseph Duarte: “The most likely scenario would involve at least one, and likely more, of the area’s other Division I schools — Rice, Texas Southern, Houston Christian, Prairie View A&M, Lamar and Sam Houston — replacing UH as host. The Big 12 Conference is not expected to be an option, a source said.” (link)

The NCAA Women’s Basketball Rules Committee met this week in Indianapolis and on Friday announced that they are recommending adding a coach’s video review challenge for the upcoming season. To be enacted, the proposal has to be approved by the NCAA Playing Rules Oversight Panel, which meets on June 10. Should the rule change be approved, coaches will be able to challenge out-of-bounds violations, backcourt violations, whether a change in team possession occurred before the ruling of a foul where free throws would be involved, and whether a foul was assessed to the correct player. With the exception of whether a foul was assessed to the correct player, referees would not be able to initiate reviews on these calls, only coaches. To make a challenge call, coaches do not need a timeout to spare. However, if the coach loses the challenge call with no timeouts left, their team will be given an “administrative technical foul for an excessive timeout.” (link)

A group of college tennis players are “again seeking class certification in their lawsuit against the NCAA over its prize money restrictions, pushing back on the organization's arguments that the case is too flimsy and anecdotal,” according to Law360, which has more behind its paywall. (link)

Korn Ferry examines the phenomenon of replacing iconic CEOs such as Berkshire Hathaways’ Warren Buffett, and Korn Ferry Board and CEO Services Vice Chair Alan Guarino notes that any CEO departure is a shock to the system, and it’s only exacerbated when the CEO is replacing a founder or a longstanding iconic boss. “You can’t expect the new CEO to come in, walk through the door, and expect business as usual.” That’s partly because a company’s brand and an iconic CEO often become intertwined, and Guarino explains that to get around that, some successors ignore the organization’s processes and impose their personal stamp on it, often with negative results. Having a strategic, planned succession—first to identify the new CEO, then to help them in their first year—can help reduce risks and accelerate positive results. Additionally, before the new boss can figure out whether to significantly change the business strategy and culture created by the long-serving predecessor, they have to establish relations with the remaining executives, many of whom will wonder whether they have a future at the firm. In fact, experts say that listening to executives and other employees is one of the best things a successor can do. Korn Ferry Advisory Senior Client Partner Jonathan Wildman suggests the new CEO follow a “listening plan” for their first three months. Not only can doing so build relations and trust, it can also help identify what needs to change. Wildman: “You’re basically creating a blueprint for what you want to continue.” (link)
