I'm up for anything that can help us get somewhere." Commissioner Jim Phillips remarked on ACC Network that “I think [Congress] can help us. I really do. We have been very bold in the desire for a national standard when it comes to name, image and likeness. We need to make sure that we have something that comes out of Washington that connects all 50 of the states because we've had a piecemeal project and it's really undermined college sports. It's been a race to the bottom. So that's one. Two is we need some legal protection. We cannot sustain one legal case after another legal case after another legal case. A reaffirmation that these are student-athletes. Those three things to me will be very important to see if that can come out of the commission." When asked whether he felt the creation of a commission would enhance the NCAA's chances at legislative relief, Baker replied: “I don't have a crystal ball on that one. I don't know. I do think, though, that it's quite clear at this point that there are a lot of people interested in college sports, and we do need some help at some point to create some clarity around some of these issues in Washington. Creating clarity one lawsuit at a time is just a really bad way to try to move forward." (link)

House settlement plaintiffs’ attorney Steve Berman joins Tulane Sports Law Director Gabe Feldman to discuss the revised House settlement and explains that allowing designated student-athletes to be grandfathered in and not count against roster limits for the duration of their eligibility was done because “we just wanted to make sure that we went overboard to satisfy the judge. But you got it right that once you’re back you can’t be eliminated the following year because of the roster limit. … Now, let’s be clear though. You still can be cut. It just can’t be because you’re over the roster limit.” Berman characterizes the plaintiffs’ current relationship with the NCAA as something similar to “frenemies” and adds: “I will say that several times we told the NCAA to go pound sand. We were done if they didn’t do something that we wanted. And they came back, so it got a little contentious.” Regarding the objectors’ role in the process of drafting the revision, Berman explains that “we conferred with the objectors, the mediator conferred with the objectors, the NCAA conferred with objectors. I can't go into details, but I will say that the objectors' demands were unreasonable, without any legal or factual foundation. And so I don't think the judge is going to buy into their proposal.” Asked what his level of confidence is that the settlement will be approved with the latest revision, Berman says: “I have 95% confidence.” Why the 5% of doubt? “Because you just can’t ever know what a judge is going to do 100%, but I think we’ve more than satisfied what the judge wanted. I think the judge will put this in context of the strength of these roster claims because that’s one of the things that you’re supposed to be doing. Since she approved that there can be roster limits, I think there’s just nothing that’s going to trouble her.” Regarding Judge Claudia Wilken’s dissection of certain elements of the proposal, Berman explains: “I think she’s being very careful to create a record on appeal, that she went overboard on every single issue.” In the likely event there is an appeal, the damages portion of the settlement will be stayed, but the revenue-sharing component will not, meaning athletic departments can implement the new model. James Moore & Co. Partner Katie Davis notes the House Ways & Means Committee released a 389-page draft proposal on tax reform as key provisions of Tax Cuts & Jobs Act of 2017 are set to sunset at the end of 2025 and highlights the proposal’s potential impacts on higher ed. First, Davis points out that “this could be relevant for college athletes: Form 1099 reporting threshold could increase from $600 to $2000 indexed to inflation starting in 2026.” Also: “Specific to college athletics, the largest impacts will be the broadened tax on compensation over $1M (especially if/when athletes become employees) and the tax on royalty income from names/logos. We will continue to provide updates as the bill is nearing finalization.” Davis goes on to explain: “Potential amendment of the section 4960 excise tax on compensation over $1M (and on excess parachute payments) to apply to ALL employees rather than to the five highest compensated employees, effective FY27. Proposed amendment of section 4968 endowment tax to make several changes, including a tiered rate structure; may have exceptions for public intuitions and private religious based institutions, not sure what it means for private with no religious affiliation. VCU is partnering with ASM Global to begin renting out the Siegel Center for concerts and events in an effort to generate revenue for student-athletes. According to the Richmond Times-Dispatch’s Eric Kolenich, VCU expects to spend $5M compensating athletes beginning next year, and Rams AD Ed McLaughlin notes: “There’s no one source where the revenue is coming from. We had one of our best sales years ever this year.” Kolenich notes VCU has raised the $5M it needs for the coming school year and is working to raise funds for future years, adding: “In the immediate future, VCU will not charge season ticket holders a license for their seats. Earlier this year, the University of Virginia said it would eventually require donations – some exceeding $100,000 – to guarantee a season ticket holder will keep his or her seats. VCU also will not increase the fee students pay toward athletics to cover the cost of revenue sharing, McLaughlin added. Altogether, the VCU athletics department will increase its budget from about $45M annually to $50M.” (link)

Michigan sold nearly $5M in alcohol at its sporting venues last year, including $4.6M at Michigan Stadium alone, while Michigan State logged about $1.8M, according to the Detroit Free Press’ John Wisely, who notes Coors Light was the bestseller at both schools. Western Michigan sold about $273K in alcohol – Miller Lite was the favorite there – and Northern Michigan recorded about $148K in sales, but the school didn't have a breakdown by brand. FloSports announced the closure of its Series D investment round on April 1, during which it raised a “high eight-figure number,” according to JohnWallStreet, who notes: "The core premise behind Flo’s business is simple. Avid fans, regardless of the sport, consider live games/events ‘must see’ content and will pay a premium to consume them. So, it rolled up the broadcast rights to more than 40,000 events across 20 verticals over the last decade (some deals include production, others focus exclusively on distribution). The company’s thesis has played as expected.” Causeway Media Partners Managing Partner Mark Wan: “When [Causeway initially invested in March 2015], Flo had 7,000 subscribers. We're more than a 100x that today. … We [will] have 800 viewers show up for some of our live events. But they're [each] paying $30 a month because they can't get that content anywhere else.” JWS notes that Flo currently has over 1M paying subscribers, and as the company looks to grow, could expand its portfolio from 25 sports to 125 or more. Wan: “We don't see any near-term limits on what we can do or how we can grow this business. … As we get more [content within] each vertical, the retention numbers get better and better. People, Wan adds, “subscribe [once] and they stay around for years. … There’s no single contract [amongst its ~15,000] that represents a significant portion of [the subscriber base]. So, to come in and disrupt our business, or even to replicate it, is really hard.” More. (link)

The Mercury News’ Jon Wilner joins D1.ticker’s Kristen Eargle to dig in further on Stanford’s AD opening and says that “from a positioning standpoint it doesn’t look good. The big picture stuff doesn’t look great for them financially, competitively in the ACC, transfer portal, NIL, all those – revenue-sharing. But…there's almost no place to go but up. I think it is kind of like Stanford recruiting itself. There is an appeal to a certain segment of the candidate pool and for that segment there’s an incredible amount of appeal. For many others, probably not interested. It’s a great job for some and probably not a good job at all for many, and the question is whether they can figure out who those some are really. But I think it’s a place that’s got a ton of potential if it’s managed properly not only within athletics, but also the top of campus, which is a huge question.” Wilner estimates the Cardinal will have an AD in place by the end of July or early August. “That’s my guess. [...] [President] Jonathan Levin has got a lot going on right now. He’s dealing with the potential for billions in federal funding cuts, so there’s a lot of issues for the campus over and above athletics but it does kind of tell you where things stand that it took them a month to appoint an interim.” Where could a great AD take Stanford in the next five years? “To the Big Ten. Or to the Super League. Or to the top tier of whatever college football’s going to look like. … If we kind of figure there’s going to be a restructuring around regional lines [in Olympic sports] and you’re just focusing on football, I think the right AD with the right support…could have Stanford positioned to be whatever comes next.” Lots more from Wilner. Akron officially introduced AD Andrew Goodrich, who emphasized in a Q&A with the Akron Beacon Journal that he “genuinely believe that if we manage this situation well and we’re able to identify, recruit and retain some of the best student-athletes, especially those from our region, then we’re going to have incredible programs. It’s going to improve the brand. We’re going to have a lot of pride and it becomes a self-fulfilling cycle where now more people want to get more involved and get more invested.” Goodrich also submits that “while resources are important, they can be, at times, overrated. We’ve seen this all throughout sports. You have a team with an incredible salary, but they don’t win championships. So we have to be just as focused on building a culture of competitive excellence in addition to supporting name, image and likeness so we have two sides of the same coin and we’re truly effective.” Goodrich goes on to note the Zips have already put a process in place and APR scores have improved the last two years. “But the way the APR is designed, it looks backward for a period of four years. So that process is already happening. Picture a flower growing. It’s planted, it’s under the ground, you can’t see it at the beginning, but it’s growing underneath and soon that’s going to sprout and you’re going to see the positive effects of the last two years.” (link, link)

Sportico’s Daniel Libit reports on the state of foreign travel in college sports and observes that demand was high in the years after the pandemic, “fueling a wave of summer college team travel over three consecutive offseasons. But that momentum now appears to be tapering off. Among other factors, a mix of shifting player priorities and growing financial constraints within athletic departments has contributed to the decline in foreign travel plans – particularly among Division I basketball teams. Industry insiders are now wondering whether this is more than a temporary pause.” Basketball Travelers Inc. Co-Founder/Executive Director Nels Hawkinson tells Libit that just before COVID his company was facilitating around 30 summer tours a year. Last year, they did seven. One MTE facing the changing dynamics is the Battle 4 Atlantis, which now faces competition from tournaments like the Players Era Festival that offer NIL payments, too. Sports agent Daniel Poneman: “Why spend $150K on a tour or a Caribbean MTE when you can give that money directly to the players? Programs used to use these trips as recruiting tools, but now the most powerful tool is cash.” Still, Anthony Travel Founder/CEO John Anthony remains confident in the future of international trips and, per Libit, “attributes the dip not to any long-term waning interest, but to the NCAA’s once-in-four rule, which has been on the books since the 1970s. As more programs become eligible again, Anthony expects international travel to rebound. In fact, he believes recent shifts in college athletics are increasing demand for overseas trips, especially as schools look for opportunities to develop chemistry for teams increasingly composed of new transfers. Texas A&M’s 12th Man Foundation saw its annual revenue drop by more than $25M from FY23 to FY24, according to Sportico’s Daniel Libit, who notes the foundation “reported bringing in $95.7M in FY24, set off against $116M in expenditures. It brought in $121M in total revenue for FY23, according to its previous IRS filings. The latest returns show the foundation’s overall reported shortfall owed primarily to a decrease in contributions and grants, which went from $113M in FY23 to $85M in FY24. During that same span, Texas A&M’s athletic department expenditures jumped nearly $50M, according to the school’s NCAA financial disclosures, from $194.6M in FY23 to $243.8M in FY24—the fourth-highest increase among FBS public universities.” Libit also notes that “in addition to supplementing the Aggies’ athletics department with tens of millions of dollars to fund scholarships, programs and facilities, the 12th Man is also partially on the hook for paying former football coach [Jimbo] Fisher’s record-setting, $77M buyout. Through the fiscal year 2024, Fisher was due $26.7M of the liquidated damages. [Then-] Texas A&M athletic director Ross Bjork previously said that the 12th Man Foundation would apply unrestricted funds to cover the initial $19.4M Fisher was due within 60 days of his firing. That payout is not individually identified on the return. The 12th Man Foundation ended the past fiscal year with $216M in net assets or fund balances, according to its tax return, down from $231.3M at the start of the cycle.” (link)

Ohio State Women’s Basketball HC Kevin McGuff was charged with operating a vehicle impaired last week after he allegedly hit several curbs and drove through someone’s yard, according to NBC4 in Columbus. An OSU spokesperson says the department “is in communication with Coach McGuff and monitoring the situation closely. This is an ongoing, personal legal matter, and the department will share additional information at the appropriate time.” (link)

Eastern Illinois has eliminated its men’s and women’s tennis programs. President Jay Gatrell in an email to students explained that "you may have heard recent news that relates to the competitive and economic environment of the NCAA and OVC, including developments in the House v. NCAA settlement. Because of these developments, EIU leadership has been exploring strategies to ensure high-quality competitive student-athlete experiences across all sports. Unfortunately, this settlement is expected to drastically reduce NCAA distributions to member schools, including EIU. … Simply put, the cost structure and demands associated with competing in two different conferences (the Horizon League for men’s tennis and the OVC for women’s tennis) are no longer sustainable. Additionally, recruiting tennis student-athletes in the Midwest has proven more cost-prohibitive and challenging by the year.” (link)

Sports Media Watch’s Jon Lewis submits that the sports media rights market is still split into two tiers: “The networks will find the money necessary to renew with the NFL at all costs, and to secure programming that they believe can drive subscriptions, maintain subscriber fees, or build a sports brand where none previously existed. But it is not the case that just any property can simply come to the market [and] pronounce itself worth double the previous rights fee.” Formula 1, the USGA and, to an extent, MLB, are all facing a colder market this cycle, and Lewis observes: “For as much as the networks tout ‘sports’ as a genre, there has always been a tendency toward being selective. Even when it seems as if there is a sports rights arms race and a bottomless pit of money to fund it, there is still some strategy at play. ESPN paying nearly $200M/year for LaLiga was not something out of the plot of Brewster’s Millions, but part of a broader acquisition strategy for ESPN+.” Crakes Media Principal Patrick Crakes also weighs in: “The secular decline of PayTV plus streaming challenges is forcing media co’s to allocate more resources to top T1 sports at expense of others. Given new digital only companies are not investing at level predicted some T1 sports are facing a more complicated rights environment.” (link, link)

The GOP-led House Ways and Means Committee reportedly plans to unveil changes next week that will increase endowment tax rates and include more colleges, according to Inside Higher Ed’s Josh Moody, who notes the committee is expected to propose raising endowment excise taxes 1.4% to up to 21%, depending on endowment value per student. The proposed endowment tax would only apply to private institutions, as it does currently. Moody: “Under the proposed formula, institutions with endowments of $750K to $1.25M per student would reportedly be hit with 7% excise tax. That number would climb to a 14% tax for colleges with endowments valued at $1.25 to $2M per student. Colleges at the highest level with endowments of $2M or more per student would pay 21%.” Moody notes, however, that the specifics of the tax increase are not final and could change before the committee’s hearing Tuesday.
