Yahoo’s Ross Dellenger reports that “in a meeting with Deloitte officials at ACC spring meetings, the company shared with ADs/coaches interesting figures on the NIL clearinghouse. 70% of past deals from booster collectives would have been denied. 90% of deals from public companies would have been approved.” (link)

The Mercury News’ Jon Wilner observes that the House settlement’s clearinghouse component appears to exclude deals with publicly traded companies from its purview, which is good news for Oregon. “Nike is a publicly traded corporation with $92B in market capitalization, meaning NIL deals between the company and college athletes — at Oregon or elsewhere — are exempt from fair-market-value assessments by the new clearinghouse.” Tulane Sports Law Director Gabe Feldman tells Wilner the advantage is likely to be small, but Wilner points out: “In theory, Nike could offer Oregon’s starting quarterback $1M for a single public appearance, with no threat of oversight or enforcement.” Boise State professor Sam Ehrlich subsequently notes: “And that would be an advantage to Oregon. But they do have shareholders to report to.” Feldman adds: “Why would a company allow the owner to benefit his or her alma mater if it’s not going to help the company? You’re talking about federal laws.” Furthermore, Wilner is told by a source that, per the specifics of the clearinghouse’s marching orders, there will be “a lot of focus on companies like Nike and Adidas.” (link)

In a presentation to the University of California Board Regents’ special committee on athletics, UCLA AD Martin Jarmond said Big Ten travel "was not an issue" per exit interviews with athletes. The Mercury News’ Jon Wilner with more from the meeting: “CFO Steve Agostini acknowledges financial challenges but says those are not unique to UCLA. Bruins reported $119M in revenue and $171M in expenses in FY24. Jarmond says the Bruins budgeted a $5M increase in travel costs and ‘will come in under that.’” Wilner also notes that Agostini referenced “competing against the Big Ten's richest schools, Michigan specifically but also [Ohio State, Penn State, etc.]. Agostini: ‘When you have [those] kinds of behemoths in the room, it makes it tough.’" Jarmond also noted the Bruins are looking into the lack of premium suites and club seats in Pauley Pavilion. Pittsburgh Football HC Pat Narduzzi tells CBS’ Brandon Marcello the Panthers plan to participate in grandfathering in players if the House settlement allows. Narduzzi says that would lead to about 115 or 116 players on the roster next fall. (link)

Florida State AD Michael Alford says the Seminoles have yet to make a decision about whether to grandfather in players, explaining that "you're running so many different trap doors right now because you're working on so many different fronts. My budgets were due three weeks ago. I'm running three different budgets depending on how House goes. … You've run all these scenarios, and then you're looking at rosters with your coaching staffs, and you're trying to prepare for that – running different scenarios on the 'grandfathered in' clause, what the roster limit means. So right now, you're just doing triple, quadruple the work going into the school year, because you don't know the final answer. You can predict and get decision trees made, but you have a lot of decision trees as you go through this process." (link)

Alford: “We’ve always had a great relationship. You’ve heard me since we started this that Jim (Commissioner Jim Phillips) and I have always communicated – communicated our thoughts, communicated our feelings about the direction of the ACC. I will continue to communicate about the direction of the ACC. But we’re really excited this is now put behind us. We have a path going forward. Arkansas AD Hunter Yurachek explains how newly appointed GM Remy Cofield will first approach the role: “We won’t touch all 19 sports out of the gate, but I wanted someone who could see the whole big picture and not just say, ‘Hey, here’s your chunk for football, here’s your chunk for men’s basketball, women’s basketball, baseball,’ whatever the case may be. He can see the whole picture and there may be a year when we need a little bit more for men’s basketball and a little bit less for football because he’s done a really good job negotiating contracts.” Yurachek also notes the Razorbacks made some reductions to expenses as part of the department’s preparations for revenue-sharing: “I feel like I’m the least-liked person probably across our department because we’re having to fix a $21M problem, so we’re doing that by reducing expenses. We’re making some sacrifices internally, so you can tell by making those sacrifices internally, maybe my staff’s not as happy as they normally would be with that.” Yurachek adds that “if we want to remain competitive in the SEC, we’ve got to share the $20.5M in revenue just like everyone else in the league is. If we fall short of that, we’re going to be fighting an uphill battle to remain competitive in our sports.” (link)

Coaches Corner…
+ Illinois has extended Football HC Bret Bielema and Men’s Basketball HC Brad Underwood through 2030 and 2031, respectively. Bielema's annual salary starts at $7.7M, while Underwood's would start at $4.4M. Both coaches would be eligible for four one-year extensions if performance benchmarks are met, as well as annual retention incentives starting next July 1. For Bielema, retention incentives would start at $700K and increase each year. For Underwood, they would begin at $1.15M. (link)
+ More on IU Indianapolis’ decision to part ways with Men’s Basketball HC Paul Corsaro from the Indianapolis Star’s Kevin Neddenriep, who reports that six families of players who transferred from the team following last season submitted a formal complaint to the university citing “deep concerns regarding the culture and treatment of student-athletes” under Corsaro. From the complaint: “Our concerns regarding the IU Indianapolis men’s basketball program extend far beyond the normal challenges or demands of student-athlete life and into abuse both physically, emotionally, and an environment of intimidation, bullying, retaliation, and fear.” (link)

Yahoo’s Ross Dellenger reports that a proposal for a remade spring calendar has been shared with coaches at ACC spring meetings that includes the addition of six contactless OTA-style practices, likely in May-June. “However, depending on what version of the proposal is approved, coaches may have flexibility to spread the 21 practices over two five-week periods in spring (February-April) and summer (late May-June). Any approval from an NCAA/P4 committee wouldn’t come until after a decision is made on timing of a single transfer portal window, which won’t happen until House settlement approval. Discussion on when to have the single portal is focused, for now, on January, March and April.” (link)

We have to install a culture of belief. It's often the hardest step, right? Because you have to believe without having the evidence that you can do great things. What we want to be able to do is have a culture where we believe that anything is possible. Let's start with it internally. Once we have that belief, it'll change the behaviors. Once we change behaviors, you're going to see different results. Once we see those different results, then again it becomes a catalyst and we continue to repeat those and we get better." Goodrich also says he has yet to receive and assess all the facts regarding Women’s Soccer HC Jen Simonetti being placed on administrative leave but says it’s “really important for our student-athletes. Louisiana Governor Jeff Landry has signed an executive order that purports to prohibit the NCAA, an athletic conference or another organization with oversight of college athletics from taking action against Louisiana schools that directly compensate student-athletes, pay them for use of their NIL or facilitate NIL deals for the athletes. LSU AD Scott Woodward is among those to praise the executive order: “This will afford all higher education institutions in the state of Louisiana the ability to remain nimble and at the forefront of the ever-changing college athletics landscape.” (link); Full EO. ESPN’s new standalone streaming service will cost $30 per month, according to Business Insider’s Peter Kafka, who notes that Disney “has to maintain in public that it's really interested” in targeting consumers who don’t pay for cable TV but love sports. “But the truth is that both ESPN and the rest of the TV industry know there are people who might stop getting cable TV once they can just get ESPN. Which means they know the new service could help speed up the erosion of the cable TV industry. And that also explains why this launch announcement — the service itself will come online sometime in late summer, in time for the NFL season — is taking place in 2025. Even though there's been intense speculation for a decade about a streaming-only version of ESPN. That's because Disney, along with other TV network operators, has spent years trying to keep a foot in each canoe: offering some of its best programming on digital-only services like Disney+ and ESPN+, while keeping other core offerings on its traditional networks, like ABC and ESPN.” Kafka also points out that the question remains whether consumers are willing to pay $30 per month for a service that has a lot of sports, but not all of the sports. “So on the one hand, the future we were thinking about 10 years ago is finally here: You are going to have lots of ways to pay for sports without having to sign up for a cable TV bundle. On the other hand: Now that we've got it, we have no idea how many people are going to want it.” (link)

More from NCAA President Charlie Baker at the ACC spring meetings on President Donald Trump’s college sports commission: "I think the fact that there's an interest on the executive side on this, I think it speaks to the fact that everybody is paying a lot of attention right now to what's going on in college sports. I'm up for anything that can help us get somewhere." Commissioner Jim Phillips remarked on ACC Network that “I think [Congress] can help us. I really do. We have been very bold in the desire for a national standard when it comes to name, image and likeness. We need to make sure that we have something that comes out of Washington that connects all 50 of the states because we've had a piecemeal project and it's really undermined college sports. It's been a race to the bottom. So that's one. Two is we need some legal protection. We cannot sustain one legal case after another legal case after another legal case. A reaffirmation that these are student-athletes. Those three things to me will be very important to see if that can come out of the commission." When asked whether he felt the creation of a commission would enhance the NCAA's chances at legislative relief, Baker replied: “I don't have a crystal ball on that one. I don't know. I do think, though, that it's quite clear at this point that there are a lot of people interested in college sports, and we do need some help at some point to create some clarity around some of these issues in Washington. Creating clarity one lawsuit at a time is just a really bad way to try to move forward." (link)

House settlement plaintiffs’ attorney Steve Berman joins Tulane Sports Law Director Gabe Feldman to discuss the revised House settlement and explains that allowing designated student-athletes to be grandfathered in and not count against roster limits for the duration of their eligibility was done because “we just wanted to make sure that we went overboard to satisfy the judge. But you got it right that once you’re back you can’t be eliminated the following year because of the roster limit. … Now, let’s be clear though. You still can be cut. It just can’t be because you’re over the roster limit.” Berman characterizes the plaintiffs’ current relationship with the NCAA as something similar to “frenemies” and adds: “I will say that several times we told the NCAA to go pound sand. We were done if they didn’t do something that we wanted. And they came back, so it got a little contentious.” Regarding the objectors’ role in the process of drafting the revision, Berman explains that “we conferred with the objectors, the mediator conferred with the objectors, the NCAA conferred with objectors. I can't go into details, but I will say that the objectors' demands were unreasonable, without any legal or factual foundation. And so I don't think the judge is going to buy into their proposal.” Asked what his level of confidence is that the settlement will be approved with the latest revision, Berman says: “I have 95% confidence.” Why the 5% of doubt? “Because you just can’t ever know what a judge is going to do 100%, but I think we’ve more than satisfied what the judge wanted. I think the judge will put this in context of the strength of these roster claims because that’s one of the things that you’re supposed to be doing. Since she approved that there can be roster limits, I think there’s just nothing that’s going to trouble her.” Regarding Judge Claudia Wilken’s dissection of certain elements of the proposal, Berman explains: “I think she’s being very careful to create a record on appeal, that she went overboard on every single issue.” In the likely event there is an appeal, the damages portion of the settlement will be stayed, but the revenue-sharing component will not, meaning athletic departments can implement the new model. James Moore & Co. Partner Katie Davis notes the House Ways & Means Committee released a 389-page draft proposal on tax reform as key provisions of Tax Cuts & Jobs Act of 2017 are set to sunset at the end of 2025 and highlights the proposal’s potential impacts on higher ed. First, Davis points out that “this could be relevant for college athletes: Form 1099 reporting threshold could increase from $600 to $2000 indexed to inflation starting in 2026.” Also: “Specific to college athletics, the largest impacts will be the broadened tax on compensation over $1M (especially if/when athletes become employees) and the tax on royalty income from names/logos. We will continue to provide updates as the bill is nearing finalization.” Davis goes on to explain: “Potential amendment of the section 4960 excise tax on compensation over $1M (and on excess parachute payments) to apply to ALL employees rather than to the five highest compensated employees, effective FY27. Proposed amendment of section 4968 endowment tax to make several changes, including a tiered rate structure; may have exceptions for public intuitions and private religious based institutions, not sure what it means for private with no religious affiliation. VCU is partnering with ASM Global to begin renting out the Siegel Center for concerts and events in an effort to generate revenue for student-athletes. According to the Richmond Times-Dispatch’s Eric Kolenich, VCU expects to spend $5M compensating athletes beginning next year, and Rams AD Ed McLaughlin notes: “There’s no one source where the revenue is coming from. We had one of our best sales years ever this year.” Kolenich notes VCU has raised the $5M it needs for the coming school year and is working to raise funds for future years, adding: “In the immediate future, VCU will not charge season ticket holders a license for their seats. Earlier this year, the University of Virginia said it would eventually require donations – some exceeding $100,000 – to guarantee a season ticket holder will keep his or her seats. VCU also will not increase the fee students pay toward athletics to cover the cost of revenue sharing, McLaughlin added. Altogether, the VCU athletics department will increase its budget from about $45M annually to $50M.” (link)

Michigan sold nearly $5M in alcohol at its sporting venues last year, including $4.6M at Michigan Stadium alone, while Michigan State logged about $1.8M, according to the Detroit Free Press’ John Wisely, who notes Coors Light was the bestseller at both schools. Western Michigan sold about $273K in alcohol – Miller Lite was the favorite there – and Northern Michigan recorded about $148K in sales, but the school didn't have a breakdown by brand. Daktronics has started the installation of an LED display in the north end zone of Auburn’s Jordan-Hare Stadium. The board will be 46 feet tall by 156 feet wide and will be completed by the start of the 2025 season. The project will cost around $25.7M. (link)

FloSports announced the closure of its Series D investment round on April 1, during which it raised a “high eight-figure number,” according to JohnWallStreet, who notes: "The core premise behind Flo’s business is simple. Avid fans, regardless of the sport, consider live games/events ‘must see’ content and will pay a premium to consume them. So, it rolled up the broadcast rights to more than 40,000 events across 20 verticals over the last decade (some deals include production, others focus exclusively on distribution). The company’s thesis has played as expected.” Causeway Media Partners Managing Partner Mark Wan: “When [Causeway initially invested in March 2015], Flo had 7,000 subscribers. We're more than a 100x that today. … We [will] have 800 viewers show up for some of our live events. But they're [each] paying $30 a month because they can't get that content anywhere else.” JWS notes that Flo currently has over 1M paying subscribers, and as the company looks to grow, could expand its portfolio from 25 sports to 125 or more. Wan: “We don't see any near-term limits on what we can do or how we can grow this business. … As we get more [content within] each vertical, the retention numbers get better and better. People, Wan adds, “subscribe [once] and they stay around for years. … There’s no single contract [amongst its ~15,000] that represents a significant portion of [the subscriber base]. So, to come in and disrupt our business, or even to replicate it, is really hard.” More. (link)
