NCAA President Charlie Baker confirms the NCAA will cede its enforcement authority of amateurism to the College Sports Commission, explaining in remarks made to the Knight Commission that “the power conferences’ response to [the House settlement] is to create an entity, the College Sports Commission. The point behind that was to have an entity that would see the cap management system and the third-party NIL system. Have rules associated with both. Create enforcement parameters for violating those rules under the rubric that would be the theoretical injunction.” Front Office Sports’ Amanda Christovich notes the NCAA will retain its enforcement of other concepts, “like academic eligibility, in-game sports rules, and sports betting. The governing body will also continue to run championships, and will pay for a significant amount of the House settlement damages.” (link)

SBJ’s Ben Portnoy shares more from Baker’s remarks, including this on the proposed new governance structure that gives the Power 4 more voting weight: "I think, generally speaking, the [P4], the scale and importance that they play in our ability to be successful, I do think they should have a bigger voice at the table, but I think the other voices matter, too. Part of what we're trying to figure out here is how to create a dynamic where if you're at that table, your voice matters and you're going to be accountable for the decisions that you make, because the ability of everybody to just hide in the crowd over history is really unhealthy." On the overall state of the college sports climate, Baker noted: "Settling as much of the legal stuff as we possibly can, I think, is really important. Some of that I'm hoping we'll be able to do through the courts. I hope we can deal with some of the other issues at the federal level. We'll see about that." (link)

Yahoo’s Ross Dellenger points out that an interesting proposal to preserve Olympic sports was submitted at the Knight Commission meeting today. Specifically, “Olympic coaches associations are pushing for a law to (1) codify NCAA sport minimum (16 for FBS) and (2) require schools maintain current average resource allocations for non-FB/BSK sports.” AVCA CEO Jaime Gordon shared more on the required allocation, pointing out to Dellenger that FBS schools allocate 65% of their budget to football and basketball and 35% on other sports. Under the proposal, that funding level would be maintained in perpetuity. Dellenger adds that “Gordon told the Knight Commission that 32 Olympic sports programs in Division I have been cut since the announcement of the House settlement – a loss of 966 roster spots. That does not include Saint Francis moving all 22 programs to Division III.” (link)

While speaking Tuesday at his Nick's Kids golf tournament in Birmingham, former Alabama Football HC Nick Saban reiterates: "I know there's been a lot of stuff out there about some commission or whatever. I don't think we need a commission. I've said that before. I think we need – we know what the issues are, we just have to have people who are willing to move those and solve those and create some solutions for some of those issues. I'm all for being a consultant to anybody who would think that my experience would be beneficial to helping create some of those solutions. … I know President Trump is very interested in athletics. He's very interested in college athletics. He's very interested in maintaining the idea that people go to college to create value for the future in terms of how they develop as people, students, graduation rate as well as having a balanced, competitive playing field. If I can be a consultant to anyone who might be able to help the future of college athletics, I would be more than happy to do that." (link)

North Carolina AD Bubba Cunningham and Western Michigan AD Dan Bartholomae are two of the names being talked about in Michigan State’s “inner circles” as the Spartans continue to search for a new AD, according to The Detroit News’ Tony Paul. In regards to Bartholomae, Paul acknowledges that “Michigan State fans might not be instantly enamored with the idea of bringing in an athletic director from the MAC, but [President Kevin] Guskiewicz will have to ask himself if he cares more about optics or getting the right person for the job. The two ideas often clash. Fans might believe MSU can do better than an AD from the MAC. That, of course, is an absurd thought. Once upon a time, Michigan football hired its football coach from the MAC. His name was Bo Schembechler. In Bartholomae, MSU would be getting an athletic director who varies greatly from [former AD Alan] Haller, mainly in his outgoing personality. Bartholomae is a relentless hand-shaker who can connect with anyone: coaches, athletes, donors, business leaders, everyone. On the donor front, he was a key player in getting shovels in the ground on a $300 million (privately funded) arena that will house WMU's basketball and hockey teams, beginning in 2027, at a time when, it's worth noting, MSU has struggled to meet receipts for already completed athletic facility upgrades (including at Munn Ice Arena).” (link)

Iowa State AD Jamie Pollard submits that when it comes to NIL and revenue-sharing, the state, region, university and board of regents need to assess “what’s the value of athletics to all of those entities. In the past, we really didn't have to ask that question because athletics was self-sustaining, but it's impossible for that to be the case going forward at any institution, let alone Iowa State. So there's going to be a lot of levers that are going to have to be looked at. Whether you want to pull them or not is too early to say, but we’re going to have to put together a comprehensive plan that gets everybody at the table. And it starts with what's the value of college athletics to Central Iowa and to the state of Iowa because if we lose it, we'll never get it back." (link)

A bill has been introduced in New Jersey to repeal the New Jersey Fair Play Act. Of importance, the bill would provide colleges legal remedies if they face penalties or threats from the NCAA for participating in NIL activities that are permitted under the bill. NIL attorney Daniel Greene adds that the bill would also “(1) allow schools to directly compensate athletes for their NIL; (2) make NIL contracts exempt from public disclosure; and (3) prohibit the NCAA from penalizing schools due to a violation of their NIL rules.” (link)

Former ESPN President John Skipper weighs in on ESPN’s new DTC service and notes that while he believes the app will ultimately work, he’s skeptical of the “bells and whistles” as a differentiator. “You’ll be able to sync up your bets you’ve made on this game and see on the screen whether you’re winning or not. That is of fairly minimal interest to most sports fans. Again, people have been talking about camera angles [and] special megacasts for a long time, and mostly people care about the game as it is played and produced on a linear network.” Ultimately, Skipper believes the app will have “at least three to five years” of runway before needing to show the Disney board that it’s working. James Moore & Co. Partner Katie Davis shares updates on the One Big Beautiful Bill and impacts on higher ed taxation and explains the “tax on royalties for use of an organization's name and logo has been removed from the bill. This will be a huge win for tax-exempt entities who rely on these passive income streams. Reinstatement of the loophole on the executive compensation excise tax that some public institutions have been following. While the first draft seemed to close that loophole, that has been reversed by striking ‘any related...governmental entity.’ Public institutions who determined they were not exempt from the 4960 exec comp excise tax may want to reevaluate this stance given the inconsistent application of the current law & significant impact on budgets – a competitive disadvantage for those who have been paying the tax. Note: it is possible these provisions could be added back as they continue to make amendments to the bill.” (link)

Yahoo’s Ross Dellenger reports power conferences are working on a contract for those schools opting into the House settlement “as a way to bind the group and provide stability around the enforcement of rules. That includes, most notably, decisions from the new Deloitte-run NIL clearinghouse, dubbed ‘NIL Go,’ an entity expected to more strictly enforce booster pay. The consequence for not signing the agreement is steep: a school risks the loss of conference membership and participation against other power league programs.” The “membership agreement” also exempts the new College Sports Commission from legal action by member institutions over enforcement decisions, offering a way for schools to pursue arbitration. As one AD puts it: “You have to sign it or we don’t play you.” Tulane Sports Law Professor Gabe Feldman on the latter: “Arbitration itself isn’t surprising but saying that you agree not to follow your state law … that may or may not be enforceable. No matter what the sides do, they’re going to be sued. This is an effort to rein in the lawsuits. It’s just not clear how enforceable all these provisions will be.” (link)

On3’s Andy Staples on the affiliation agreement: “Let's just say that I doubt certain schools and states will capitulate as easily as the conferences are hoping.” Tennessee AD Danny White tells Staples that “Tennessee has every intention to follow whatever rules we all decide on in this new structure. We haven’t decided what that looks like yet or the new enforcement arm or how it fits within the NCAA.” White also indicates the next wave of antitrust suits should be the larger concern for schools that the state’s recently passed NIL law “isn’t an effort by us to skirt the rules. This is an effort — and I’m appreciative of our legislature for thinking of our best interest — to deal with the legal uncertainties and the litigious risk that we could be in depending on which way the settlement goes and beyond that.” Staples: “If the association threatens penalties or expulsion for ignoring the rules, it could set up a showdown between the association and a state attorney general. Because while the loyalty oath the conferences are considering requiring could ban the schools from suing the CSC, it can’t keep the states (or anyone else) from suing the entity. If the SEC tried to expel Tennessee, the first thing Tennessee’s attorney general would do is drag the SEC and CSC into federal court. Current Tennessee AG Jonathan Skrmetti sued the NCAA in 2024 when the organization tried to investigate Tennessee-attached collective Spyre Sports’ deal with then-Volunteers QB Nico Iamaleava. The result? The NCAA had to abandon essentially all its NIL rules after a judge hinted that the rules wouldn’t pass antitrust scrutiny.” More. (link, link)

ESPN’s Pete Thamel reports the CEO of the College Sports Commission “will have the final say in doling out punishments and deciding when rules have been violated, according to sources, a level of singular power that never existed during the NCAA's era of struggling to enforce its rules.” Thamel adds that the “CEO's hire is expected to come quickly after the House settlement is finalized” and the “hiring of a new CEO of the College Sports Commission already is deep in the process, per ESPN sources. The conducting of the search process before the job can officially be created is indicative of how quickly the entire billion-dollar industry will have to transform before games are played again in August. Nothing can happen formally until the judge's decision, but the process is well underway.” As for the CSC’s makeup, Thamel notes the CEO is expected to report to a board that includes the power conference commissioners. He also points out that “Congress is expected to still be needed to help create a legal framework for the new system to function without being tripped up by the current patchwork of state laws.” (link)

Among the takeaways from Rutgers’ selection of LSU President William Tate IV for the same role is that the school should now be able to move swiftly in its search for a new AD. To that end, NJ.com’s Steve Politi writes: “Tate might be a package deal. Rutgers officials waited to hire a new athletic director because they understood that the best candidates would want to know their boss before taking the job. It also stands to reason that the new president will have an opinion – perhaps a strong one – about who fills this important, high-profile job. … It is possible that the university will land on someone like former Pittsburgh AD Heather Lyke or Northern Illinois’ Sean Frazier in the coming weeks, or that it will follow the national trend and hire a non-traditional candidate for the job like Maryland. It is also possible that Rutgers will allow Tate to steer the process. If that‘s the case, a strong candidate from the LSU staff could be Keli Zinn, who has served as Executive Deputy Director of Athletics and Chief Operating Officer for LSU since 2022 after a stint at West Virginia.” (link)

Georgia Tech AD J Batt last week said of the House settlement: “From a macro perspective, we’re gonna get a system that’s fair, that’s transparent. We’re gonna get a system that is much more, I would think, kind of balanced across the board. I think that if we zoom all the way out, that’s what everyone wants to look for, something that is sustainable over time that certainly drives more revenue for student-athletes. That, at the end of the day, is a goal we’ve all been working toward and feel like this would put it into place, but also creates some of that structure, some of that transparency, some of that systematic approach to the NIL and revenue sharing going forward.” As far as how the Yellow Jackets will distribute revenue per sport, Batt explained: “I would tell you that we’re really transparent with our coaches. We’ve got great buy-in across the board. We’ve been planning on how does this happen, what does it look like, for well over a year at this point in time. We’ve been working toward not only how we might fund it, how we might deploy it, what internal resources you need. We just did up a whole different vertical with our de facto general manager and enhanced legal team (and) finance to take care of rev share payments.” (link)

Charlotte has launched 49ers Ventures, an in-house sponsorship and media sales company that will play a role in student-athlete endorsements, according to Charlotte Business Journal’s Erik Spanberg, who notes the 49ers have hired Clemson Sports Properties President Kyle Caddell to lead the venture as President/CRO. 49ers AD Mike Hill tells Spanberg: “It’s a huge move for us. The thinking behind it is that to meet the challenge in today’s environment of college athletics, this gives us the best chance to generate incremental income and integrate NIL into our partnerships the way that is difficult to do otherwise.” Charlotte’s current agreement with Learfield ends June 30, and Hill estimates annual sponsorship and media revenue will double under Caddell and 49ers Ventures within five years. Caddell tells Spanberg that “being your own rights-holder gives you more control, it gives you the opportunity to work across campus and to provide opportunities to brands. The professional (sports) model makes a ton of sense.” (link)

Notre Dame Men’s Basketball HC Micah Shrewsberry earned $3.26M in his first year leading the program, according to The Inside Zone’s Matt Fortuna, who notes Shrewsberry’s compensation was the third-highest pay listed at the university behind Football HC Marcus Freeman ($7.4M) and VP/CIO Michael Donovan, who earned more than $3.9M during the reporting period, which covers July 1, 2023 through June 30, 2024. Former Men’s Basketball HC Mike Brey was credited with $2.896M in his final season leading the program. Fortuna also reports former Fighting Irish AD Jack Swarbrick earned $1.917M in his final year as AD, and the “only other athletic department employee listed on the forms is defensive coordinator Al Golden, who earned $1,667,335 in 2023-24.” Additionally, Fortuna notes the tax docs state that “head coaches, football and basketball, are permitted to receive compensation from external sources with prior written approval from the University. However, the University is not a party to any agreements between the coaches and any third party for the payment of compensation to the coaches, and the coaches do not provide services to the University as a result of any such agreements.” (link)

Pacific, starting in the 2025-26 academic year, will add men’s cross country and men’s track and field, revive the men’s and women’s diving programs and expand women’s field events. Tigers AD Adam Tschuor: “We owe it to our student-athletes, campus and community to come up with a way to navigate these changes [in the industry] not by cutting, but by growing. These sports additions are the first step in a plan of growth that will transform Pacific for the better – in enrollment, campus life, engagement and competitive success.” Men’s cross country and men’s track and field will operate alongside existing women’s programs under HC Josh Jones. UNLV will receive $1.2M in compensation from the Las Vegas Stadium Authority for missing a revenue mark set for football games played at Allegiant Stadium. The Las Vegas Review-Journal’s Mick Akers reports the payment will come from a “waterfall fund set up by the stadium authority that pays UNLV up to $3.5M per year for revenue falling under $5M in a season for the first 10 years the school plays at Allegiant Stadium. The Rebels received nearly $3.8M in revenue from football games at Allegiant Stadium during the 2024 season,” and Akers notes the “stadium authority approved a payout of almost $2.4M in August after the Rebels drew $2.6M in revenue during the 2023 football season.” (link)

Toledo has hired an architect to design the Champions Complex, a shared space between student-athletes and ROTC students, Rockets AD Bryan Blair announced. The Champions Complex will be in the university’s Health Education Building, a facility ROTC students are currently using, and Blair remarked: “We’re looking at some ways we can grow forward with ROTC and us, cohabitate and really bring that building into the modern era but also check a bunch of boxes including getting baseball [and] softball to campus, doubling the size of our academic study area, and give us a training table where we can give our student-athletes high-caliber nutrition, and a place to be around each other as iron sharpens iron.” (link)

Cal Poly has launched the Players Trust, an initiative aimed at helping to attract and retain student-athletes through the support of alumni, parents and friends. Specifically, the Players Trust will allow alumni and boosters to personally invest in ensuring the future success of their favorite teams by helping fund scholarships, Alston awards, and incentive-based scholarship supplements specific to each athletic program and where supporters want to invest.
