After narrowing down its list of AD candidates last week, Arkansas State is expected to begin its interview process this week, according to CollegeAD, which reports: “Sources say the Red Wolves plan to hold a virtual round of interviews this week. From there, sources say that if things remain on schedule, the plan calls for a final round of in-person interviews next week. Former Michigan State AD Alan Haller reflects on his career as a student-athlete and administrator at MSU, writing in a post on LinkedIn: “I’m reminded that who we become is often shaped by the voices that speak into us early on. Two coaches, in particular, left lasting imprints on my life. Their words became the pillars of my leadership. Coach Jim Bibbs, my college track coach, taught me Focus. … Coach George Perles, my college football coach, taught me Accountability and Responsibility. He had a rule: no playing basketball during or near the start of football season. I broke that rule, just before the start of my sophomore season, I played a pickup game of basketball, and injured my ankle. While the trainers examined me, Coach Perles burst into the room and said, ‘You’re selfish. You let your team down. When people are counting on you, you have to make decisions differently!’ Those words were tough to hear—but they’ve stayed with me. They shaped how I think, how I lead, and how I live. Leadership isn’t about perfection. It’s about being accountable, being vulnerable, being present, and admitting mistakes. It’s about making people-centered decisions. It’s about saying ‘yes’ when ‘no’ would be easier—and trusting God to go where He leads, even when the road is uncertain. We don’t always get to choose how a chapter ends. But if you can look back and say, I would walk that same path again—every lesson, every challenge, every step—then you know it was worth it.” (link)

In regards to the recently reported affiliation agreements being circulated among Power 4 schools, Sportico’s Michael McCann explains that a contract like this is called a “contract of adhesion or, more colloquially, a take-it-or-leave-it deal. Contracts of adhesion are sometimes seen as oppressive, especially in the consumer context, but courts often regard them as enforceable. That is especially likely of universities that have sophisticated legal counsel and easy access to law firms. But one factor is that these member schools are already in a contractual relationship with their conference. Whether schools can be effectively forced to sign or else face expulsion might prove problematic with their membership rights and established norms. Power conferences are aware of that risk.” For example, McCann cites litigation between the 10 schools that left the Pac-12 and Washington State and Oregon State. Furthermore, McCann explains the CSC presents potential legal issues. Part of the reason for this is “because [student-athletes] can’t be union members since they’re not employees, there is no labor agreement governing their contractual rights. They are students who will have an academic and non-employment but nonetheless commercial relationship with their school.” Lots more. (link)

Tennessee men’s basketball standout Zakai Zeigler has filed an eligibility lawsuit against the NCAA, and Boise State assistant professor Sam Ehrlich notes: “This is something of a twist from the formula: Zeigler, who has played at UT since his true freshman year in 2021, seeks a fifth year within his eligibility window. So unlike the other cases we've seen, Zeigler is not seeking to not count a JUCO year, or a DII year, etc. He wants a straight five years of play in five years of eligibility. As a result – and as you may imagine – his complaint largely centers around the redshirt rule. … The most interesting part of this particular case: attacking the NCAA's procompetitive justifications. What will the procompetitive justifications be for only allowing four seasons in five years? As the complaint argues, it can't be academics since they allow five years anyway.” (link); Full complaint. Learfield CEO Cole Gahagan joins Bloomberg’s Open Interest to discuss the NIL era and says of the potential for future NIL growth: “When NIL first launched in 2021, the year that followed, the deals that we were tracking – to put it into context, Learfield by far and away does more deals in college athletics for athletes and for brands than any other business. This year alone we've done over $140M worth of deals that included NIL opportunities for athletes. That’s up from $69M in the last fiscal year. Quite literally, we’re seeing exponential growth of these opportunities. Now within that dealmaking ecosystem, when we first launched three years ago with NIL, the ratios of deals that were being done for male athletes over female athletes was about 60/40. … Last year we saw that start to balance a little bit more at 43% for women and 57% for men. This year we've seen almost a complete balancing of it at 51% for men athletes and 49% for female. So we’re starting to see not just growth in ticket sales, in activity, in sponsorship involvement with women’s sports, we’re also starting to see a balancing of female athletes involved in NIL campaigns as well.” (link)

Grayson Law Firm founder/The Philanthropist Handbook: Finding Meaning In The Endowment Of Humanity author Clay Grayson analyzes Kentucky’s formation of Champions Blue LLC and points out that “the state of Kentucky is somewhat unique because its laws allow governmental universities to own for-profit companies. These laws gave the University of Kentucky the prior experience of owning its own hospitals through a for-profit structure. Most state laws prohibit this. However, in those states, there’s a workaround. A governmental university may use an affiliate nonprofit to own the for-profit LLC for the benefit of the university. That creates the same effect as in Kentucky.” Grayson points out that establishing a “for-profit LLC positions Kentucky to raise capital in novel ways. As a for-profit LLC, Kentucky may sell interests in Champions Blue to others, including private equity and venture capital firms. Even with outside investment, Kentucky can design the LLC with its athletic director retaining complete control over all LLC operations.” Also of particular note, Grayson explains that “with the newfound ability of schools to engage student-athletes directly post-House, these for-profit LLCs can function like NIL collectives. These for-profit LLCs can employ student-athletes to pay them fair market value for NIL engagements. These payments would be in addition to any revenue-sharing permitted under the new NCAA rules. Coaches’ salaries can be run through this type of LLC without any governmental or nonprofit cap on compensation. The same is true for athletic directors and other highly compensated athletic positions. Big moneyball can get bigger as privatization emerges in the collegiate landscape.” Full op-ed. (link)

Georgia AD Josh Brooks weighs in on whether UGA needs a GM for football and tells Dawg Nation that “I think first of all, you have to know the term gets thrown around a lot, and it means different things at different places, so there’s not just one cookie cutter way to do it. … We have a highly intelligent, highly involved head football coach. We have a great support staff underneath him, and I think we have a phenomenal executive staff when you talk about the people on my staff that work directly with him.” Furthermore, Brooks points out that “we’ve been together a long time – I’ve been working with Coach Smart now nine years, and now I’m a fifth-year AD with him. [He] has staff members who have been with him four, five or six years. So there’s a lot of great continuity there, so I don’t think any of us want to just bring someone in from the outside and say, ‘You’re the GM, lead us.’ … We’ll take [Smart’s] lead on that and see how he wants to evolve and how different staff members’ responsibilities may evolve, but I feel real good about our working relationship with him.” (link)

UCF AD Terry Mohajir hired Football HC Scott Frost because, as he told the Orlando Sentinel’s Mike Bianchi, “ego is not your amigo.” Bianchi observes that “Mohajir — a man who didn’t hire Frost the first time, who has lived in the shadow of former UCF athletic director Danny White, and who had every reason to seek his own ‘guy’ — decided to hand the keys to the program back to the prodigal son.” Mohajir tells Bianchi that it’s “never been about ego for me. For me, it’s always been about hiring the right coach for the job, and I truly believe Scott Frost is the right coach for this job.” Bianchi goes on to observe that “to this day, every big decision [Mohajir] makes is filtered through [the lens of] is he living up to White? Do his hires stack up? Can he create his own moment of magic? Even though there were some UCF bigwigs who lobbied for Frost, Mohajir could have vetoed the idea.” Regarding Frost’s tenure at Nebraska, Mohajir points out that “we all have unsuccessful moments. The people I love are the people who have unsuccessful moments and learn and grow from them. Scott is a very smart guy. He’s evolved and reflected and thought about how he wants to coach the game moving forward.” (link)

When NC State added a non-conference home-and-home football series with Virginia for the next two seasons last spring, it led the Wolfpack to move their 2025 road trip to Appalachian State to the 2028 season. While the Wolfpack paid the Mountaineers $300K to move that game three years down the road, On3’s Noah Fleischman notes there’s a “chance that game in Boone might not actually ever happen.” Fleischman cites recent remarks by Wolfpack HC Dave Doeren, who told TheWolfpacker.com: “We don’t want to play that game on the road. The conference doesn’t want us to play G5 road games. That was out of the commissioner’s mouth. And, so, unfortunately a contract was signed when it shouldn’t have been. That’s just the way it is. … I don’t know if the game’s going to happen there or not going to happen.” Doeren went on to ask: “Where’s the value in the game as a program? I understand it helps them, but you’re not in the business to help the other school. You’re in the business to help your school. Any road win against another opponent shouldn’t hurt you in the rankings, and it did hurt [North Carolina who outlasted App State 63-61 in Boone in 2022]. To me, I don’t understand. From an argument standpoint, how can you say it’s the wrong move to not play there if you have living proof that another team suffered winning there. It’s one thing to lose there, but to win there and go down in the rankings, that shouldn’t happen.” Canceling the 2028 game against App State would cost NC State $2.5M. (link)

NCAA President Charlie Baker confirms the NCAA will cede its enforcement authority of amateurism to the College Sports Commission, explaining in remarks made to the Knight Commission that “the power conferences’ response to [the House settlement] is to create an entity, the College Sports Commission. The point behind that was to have an entity that would see the cap management system and the third-party NIL system. Have rules associated with both. Create enforcement parameters for violating those rules under the rubric that would be the theoretical injunction.” Front Office Sports’ Amanda Christovich notes the NCAA will retain its enforcement of other concepts, “like academic eligibility, in-game sports rules, and sports betting. The governing body will also continue to run championships, and will pay for a significant amount of the House settlement damages.” (link)

SBJ’s Ben Portnoy shares more from Baker’s remarks, including this on the proposed new governance structure that gives the Power 4 more voting weight: "I think, generally speaking, the [P4], the scale and importance that they play in our ability to be successful, I do think they should have a bigger voice at the table, but I think the other voices matter, too. Part of what we're trying to figure out here is how to create a dynamic where if you're at that table, your voice matters and you're going to be accountable for the decisions that you make, because the ability of everybody to just hide in the crowd over history is really unhealthy." On the overall state of the college sports climate, Baker noted: "Settling as much of the legal stuff as we possibly can, I think, is really important. Some of that I'm hoping we'll be able to do through the courts. I hope we can deal with some of the other issues at the federal level. We'll see about that." (link)

Yahoo’s Ross Dellenger points out that an interesting proposal to preserve Olympic sports was submitted at the Knight Commission meeting today. Specifically, “Olympic coaches associations are pushing for a law to (1) codify NCAA sport minimum (16 for FBS) and (2) require schools maintain current average resource allocations for non-FB/BSK sports.” AVCA CEO Jaime Gordon shared more on the required allocation, pointing out to Dellenger that FBS schools allocate 65% of their budget to football and basketball and 35% on other sports. Under the proposal, that funding level would be maintained in perpetuity. Dellenger adds that “Gordon told the Knight Commission that 32 Olympic sports programs in Division I have been cut since the announcement of the House settlement – a loss of 966 roster spots. That does not include Saint Francis moving all 22 programs to Division III.” (link)

While speaking Tuesday at his Nick's Kids golf tournament in Birmingham, former Alabama Football HC Nick Saban reiterates: "I know there's been a lot of stuff out there about some commission or whatever. I don't think we need a commission. I've said that before. I think we need – we know what the issues are, we just have to have people who are willing to move those and solve those and create some solutions for some of those issues. I'm all for being a consultant to anybody who would think that my experience would be beneficial to helping create some of those solutions. … I know President Trump is very interested in athletics. He's very interested in college athletics. He's very interested in maintaining the idea that people go to college to create value for the future in terms of how they develop as people, students, graduation rate as well as having a balanced, competitive playing field. If I can be a consultant to anyone who might be able to help the future of college athletics, I would be more than happy to do that." (link)

North Carolina AD Bubba Cunningham and Western Michigan AD Dan Bartholomae are two of the names being talked about in Michigan State’s “inner circles” as the Spartans continue to search for a new AD, according to The Detroit News’ Tony Paul. In regards to Bartholomae, Paul acknowledges that “Michigan State fans might not be instantly enamored with the idea of bringing in an athletic director from the MAC, but [President Kevin] Guskiewicz will have to ask himself if he cares more about optics or getting the right person for the job. The two ideas often clash. Fans might believe MSU can do better than an AD from the MAC. That, of course, is an absurd thought. Once upon a time, Michigan football hired its football coach from the MAC. His name was Bo Schembechler. In Bartholomae, MSU would be getting an athletic director who varies greatly from [former AD Alan] Haller, mainly in his outgoing personality. Bartholomae is a relentless hand-shaker who can connect with anyone: coaches, athletes, donors, business leaders, everyone. On the donor front, he was a key player in getting shovels in the ground on a $300 million (privately funded) arena that will house WMU's basketball and hockey teams, beginning in 2027, at a time when, it's worth noting, MSU has struggled to meet receipts for already completed athletic facility upgrades (including at Munn Ice Arena).” (link)

Iowa State AD Jamie Pollard submits that when it comes to NIL and revenue-sharing, the state, region, university and board of regents need to assess “what’s the value of athletics to all of those entities. In the past, we really didn't have to ask that question because athletics was self-sustaining, but it's impossible for that to be the case going forward at any institution, let alone Iowa State. So there's going to be a lot of levers that are going to have to be looked at. Whether you want to pull them or not is too early to say, but we’re going to have to put together a comprehensive plan that gets everybody at the table. And it starts with what's the value of college athletics to Central Iowa and to the state of Iowa because if we lose it, we'll never get it back." (link)

A bill has been introduced in New Jersey to repeal the New Jersey Fair Play Act. Of importance, the bill would provide colleges legal remedies if they face penalties or threats from the NCAA for participating in NIL activities that are permitted under the bill. NIL attorney Daniel Greene adds that the bill would also “(1) allow schools to directly compensate athletes for their NIL; (2) make NIL contracts exempt from public disclosure; and (3) prohibit the NCAA from penalizing schools due to a violation of their NIL rules.” (link)

Former ESPN President John Skipper weighs in on ESPN’s new DTC service and notes that while he believes the app will ultimately work, he’s skeptical of the “bells and whistles” as a differentiator. “You’ll be able to sync up your bets you’ve made on this game and see on the screen whether you’re winning or not. That is of fairly minimal interest to most sports fans. Again, people have been talking about camera angles [and] special megacasts for a long time, and mostly people care about the game as it is played and produced on a linear network.” Ultimately, Skipper believes the app will have “at least three to five years” of runway before needing to show the Disney board that it’s working. James Moore & Co. Partner Katie Davis shares updates on the One Big Beautiful Bill and impacts on higher ed taxation and explains the “tax on royalties for use of an organization's name and logo has been removed from the bill. This will be a huge win for tax-exempt entities who rely on these passive income streams. Reinstatement of the loophole on the executive compensation excise tax that some public institutions have been following. While the first draft seemed to close that loophole, that has been reversed by striking ‘any related...governmental entity.’ Public institutions who determined they were not exempt from the 4960 exec comp excise tax may want to reevaluate this stance given the inconsistent application of the current law & significant impact on budgets – a competitive disadvantage for those who have been paying the tax. Note: it is possible these provisions could be added back as they continue to make amendments to the bill.” (link)
