As SEC leaders gather in Destin for spring meetings, Yahoo’s Ross Dellenger observes this week will be different than many, if not most, of its antecedents: “Back in the day, this thing was four days of mostly monotonous legislative meetings. Lots of golf. Plenty of poolside cocktails. And bunches of beach time. … Nowadays, SEC meetings are three days of intense policy-making discussions oozing with heavy subject matter. There is little to no golf. Few cocktails. And an absence of beach time.” With topics ranging from the College Football Playoff to the House settlement, Dellenger adds that “SEC old-timers believe it to be the most consequential gathering in the history of the conference.” During its meetings last week in Los Angeles, Big Ten administrators solidified their support for the so-called "4-4-2-2-1" CFP format, and the SEC this week has a chance to do the same. And what if they do? “I guess we’re going to war,” says one Big 12 AD. The SEC this week is also expected to discuss the “governance proposal and the possibility of separating football completely out from under the NCAA,” and Dellenger points out that “in an unreported and little-known fact, SEC presidents in March quietly authorized their commissioner, [Greg] Sankey, to split from the NCAA if he deems that the right move.” In examining the future of college sports more broadly, Dellenger asks whether athletic departments will remain under the $20.5M rev-share cap. “Or will they support their booster collectives in flooding the new Deloitte-run NIL clearinghouse with multi-million dollar deals for their athletes as a way to circumvent the cap? Illinois AD Josh Whitman notes: “We have to decide if we want to be governed.” Baylor AD Mack Rhoades adds: “I’ll say this, it has to work. For this to be a good settlement, that component has to work and I think it is the most important.” (link)

Southern Conference Commissioner Michael Cross talks with SBJ’s Ben Portnoy about his recent position paper on the future of college sports governance. Cross explains his proposal is built on three key themes: 1) Freedom for the conferences or schools to create rules previously attributed to the national office; 2) A narrow segment of regulation that is centrally governed; and 3) Aligning commensurate responsibility to those granted authority. Cross: “Every single rule that we create [at a national level], the first reflexive action from the coaches and administrators is, ‘How do I work around this rule?’ The easiest way to work around the rule is stop making rules.” Issues that should be centrally governed would include revenue and championship access – Cross tells Portnoy he’s “open to a discussion” about how revenue is distributed. Eligibility, financial aid and other issues could then be left up to the conferences and schools. On the issue of eligibility, Cross notes: “Villanova this year, I believe, is going to have a 32-year-old punter on its roster. The quarterback from Louisville who was just drafted [Tyler Shough] was 26 or 27. You’ll have people who say, ‘Oh gosh, are we really going to have people who are these different ages competing against each other?’ We already do. I understand it intellectually, but we’ve got so many waivers and processes in place, and the pattern repeats itself over and over and over: We pass a rule. Rule doesn’t fit every set of circumstances. School submits waiver on behalf of student-athlete. NCAA denies waiver. Public and media get inflamed and call NCAA ‘heartless administrators.’ Student-athlete lawyers up, finds other student-athletes who have similar circumstances and also lawyer up, and we’re back into this phase.” (link)

Sticking to Baseball, last week Florida State AD Michael Alford, who is the incoming chair of the Baseball Committee, says he plans to work with umpires on utilizing analytics as a teaching tool “because we’ve gotten to the spot in that sport where we have those metrics. Memphis men’s basketball student-athlete PJ Haggerty has withdrawn his name from the NBA Draft and will transfer to Kansas State, according to hoops insider/New York Times contributor Adam Zagoria, who cites a source as indicating that “Haggerty is getting $2M base guaranteed NIL at K-State plus another $500K in incentives for a total value of $2.5M.” (link, link)

New Haven President Jens Frederiksen talks with the Hartford Courant’s Dom Amore about the move to Division I and insists UNH was ready to begin the process: “There’s a huge difference between being ready and getting ready. You make a decision and you lay out plans and then you have to adjust on the fly. For as many moves as we’ve made, the bumps have been relatively small and we’ve proven we will make adjustments to the bumps very quickly. That was to be expected, but we were absolutely as ready as we could have been. Sometimes you uncover things in the act of getting ready. There is a timeline, there’s excitement, then there’s, ‘Oh, I can’t believe that happened.’ There is going to be ‘Have they thought of this?’ … I feel very comfortable saying all of this is going to be allayed very quickly.” Many of the school’s athletic facilities have been updated in recent years, and Frederiksen maintains the Chargers are not undertaking projects without firm financial backing. “I’m generally very conservative, fiscally, I don’t come across that way. There are some schools that want things to happen so badly, so they build a stadium and say ‘The donors will come.’ Schools like ours can’t afford to be in that position. … With athletics, I went through a full-fledged cost analysis very quickly. I put the numbers together, not based on ‘three years from now we might get this.’ That’s how people get themselves in trouble. I’ve had the modicum of success that I’ve had because I do treat it like a midsized business.” Frederiksen also explains his vision for the integration of athletics and academics: “I would like to see that our athletes receive the same kind of academic outcome as our other students. I want it to feel vibrant, successful. You want to win, but I want it to be a department much like the culture, all-hands-on, can-do, really pushing the envelope. Let’s be bold.” (link)

New Mexico Attorney General Raúl Torrez commends New Mexico State for its “valiant efforts to confront and eliminate hazing on campus. In response to our report...NMSU has taken swift and decisive action, completing nearly two-thirds of the 35 recommendations outlined by our office and making substantial progress on the rest. I encourage every university in New Mexico to review this report and adopt similar reforms to foster safer, more supportive environments for their students." Acting Aggies AD Amber Burdge indicated in a statement that the state DOJ report “provided a valuable opportunity for reflection, and more importantly, further action. We've taken meaningful steps over the past two years – from enhancing our exit survey processes and increasing communication with Title IX to department-wide training and prevention programming – to build a stronger, safer athletics environment. This work is ongoing, and I remain committed to leading with clarity, consistency and care as we move forward." NMSU says it has satisfied 21 of the 35 recommendations while the other 14 are in progress/process. President Valerio Ferme: “There's still work to be done to ensure our campuses are places where everyone, especially students, can safely pursue their educational and professional goals. We have an incredibly devoted group of leaders who are committed to making us better, and we will continue to dedicate time and resources to address hazing and harassment to the best of our abilities.” (link)

VH Consulting Founder and multi-stop administrator Shoshanna Engel Lewis sat down with AthleticDirectorU’s Steph Garcia Cichosz to discuss the transition from athletics to entrepreneurship and offer insight into strategic thinking and leadership development. Engel Lewis reflects on her career and how she recognized and developed her collection of “superpowers” throughout her various stops. Those superpowers – the ability to create authentic connection quickly and support others as they seek to solve problems – led to the moment when “circumstance met opportunity” in her career path, spurring the creation of a consulting firm that allowed her to blend those strengths to serve needs that leaders were facing in a changing industry. Engel Lewis also acknowledges that hearing “no” at times provided an opportunity for self-reflection and creative thinking. Engel Lewis notes that she did not get into compliance in college athletics “because I loved the rules. … I view it as a puzzle to solve. How can we leverage the rules to get us where we’re trying to go? So, I at least wanted to mention that because I saw it differently. I saw it as an opportunity to not get pigeon-holed, which is very contrary to what most people say about compliance.” In fact, Engel Lewis explains she chose compliance as an initial career path “not because I love the rules, not because I love spreadsheets and organizing information. … I did it because I thought, ‘Wow,’ I can get to know who everyone in our athletics department is, what their jobs are, and what those jobs mean to college athletics and what they mean to the university.’ So it was a really strategic move to leverage connecting, the ability to understand, develop authentic relationships and then keep in touch with so many of those folks to this day.” Full Q&A on ADU. While undergraduate enrollment remains slightly below 2020 levels, college enrollment as a whole is making a steady recovery, driven in part by growth in certificate programs and at two-year public institutions, according to new data from the National Student Clearinghouse Research Center, whose latest report shows 18.4M students were enrolled in higher education this spring, a 3.2% YoY increase. Specifically, undergraduate enrollment rose 3.5% from spring 2024 but remains down 2.4% from 2020. Similarly, graduate enrollment grew 1.5 % to 3.1M students over spring 2024, marking a 7.2% uptick from 2020. The report also shows that young adults are enrolling in higher education at greater rates with a 3.2% increase among 21- to 24-year-olds compared to last spring, and a 5.9% increase among 25- to 29-year-olds. This spring is the first time since 2020 that 20-somethings have seen year-over-year growth. Public four-year colleges saw a 2.5% increase in enrollment, bringing the total number of students to 7.4M, slightly higher than the pre-pandemic level. Private four-year nonprofit institutions saw a 5.3% increase while for-profit institutions a 1.4% gain. (link)

Congratulations to North Carolina’s women’s lacrosse team on capturing the program’s fourth national championship. Tar Heels AD Bubba Cunningham on the value UNC derives regardless of whether the sport made money this season: “The real benefit is building upon the brand of the University of North Carolina. With our Olympic sports, particularly our women’s sports, it shows that this is a great place to come and play. The more you win, in all our sports, the better our recruiting is top to bottom.” The title also helps fundraising efforts at a time when athletic departments need to energize their donor bases. As such, Cunningham adds: “There’s more of an indirect payoff for winning championships.” (link); The tournament finale drew an attendance of 14,423, breaking the all-time record for a national championship. SEC Commissioner Greg Sankey weighed in on the league’s football scheduling strategy while in Hoover for the conference baseball championship and explained: “[It’s] a lot of numbers, a lot of opinions, a lot of conversations, a lot of looking back and looking forward, thinking about how really the College Football Playoff selection process currently governs schedule decision-making. I think the most recent example was Nebraska discontinuing a planned series with Tennessee in football and citing the CFP selection process, and it won’t hurt us if we don’t play that game. I understand why they did it, so it’s not about a particular university. That’s not healthy for college football in the big picture.” (link)

Oregon AD Rob Mullens Q&As with JohnCanzano.com’s namesake and explains that when it comes to adhering to the institution’s core values during a period of change, “one of the things that we’re very proud of here, and it’s been a pillar for us, is that we want to provide an exceptional student-athlete experience for all 500 student-athletes and give our 20 sports a chance to compete at a high level. … I’m glad student-athletes are benefiting from name, image, likeness. But the reality is that for many of our student-athletes, this will be the highest level they play. The experience is important. The degree is paramount, and we still need to make sure that we’re providing that experience.” Mullens also points out that “we’re not going to have to go backwards with any team. So the funding is going to stay in place. Resource allocation has always been one of the most difficult parts of this job. Because you want to give everything to everybody. But that’s just not reality, particularly when you look at the economics in our asset base. So we’re going to have to make strategic investments and strategic allocation. And that starts with football. Football generates 80% of our resources. We have to be successful in football to generate the resources to help fund the other 19 sports. And so then we’ll study the marketplace, the landscape, obviously, where we have a rich history and tradition. … And then we’re also going to make an investment in the new roster limit scholarship pieces in almost every one of our women’s sports to allow them to remain competitive. As you were noting off the top here in the spring, when you look at what women’s golf has done, what softball has done, what women’s track has done, we want to continue to excel in those sports.” (link)

Extra Points publisher Matt Brown catches up with Pacific AD Adam Tschuor to discuss the Tigers’ decision to add more sports as other departments are eliminating programs. Tschour explains that Pacific “knew we needed to opt into the (House) settlement” to remain relevant in men’s and women’s basketball while at the same time not chasing away tuition-paying student-athletes in other sports. “We must have looked at a thousand different scenarios and modeled over a dozen different potential sports. … College sports is a business, sure, but it’s also supposed to be co-curricular. Expanding athletic opportunities fits with what we’re trying to do as a university. We’re a growing school.” Brown adds that Pacific needed to find solutions that wouldn’t require massive capital investments, would make sure the school would comply with Title IX, would have enough local schools to play against, and would make sense financially. Looking toward the future, Tschour says there are plans to continue expanding, and Brown notes: “Two potential candidates in the near future? Restoring field hockey and men’s volleyball, two sports that Pacific previously offered. The department also considered potential club sport offerings, like women’s flag football (attractive, given the depth of high school participation, but with concerns over a lack of local opponents), other varsity sports (women’s golf?)…and yes, even the return of football (which uh, doesn’t make sense unless you’re interested in writing Pacific an $80M dollar check).” (link)

Texas AD Chris Del Conte talks about the challenges of fighting for entertainment dollars in the city of Austin: "I don’t think that there is this ‘unlimited economics’ in Austin. It’s very small, and for as big as a city it is – our region is what, three or four million people – you’re hoping to get a little sliver of that, but they’re not all sports fans. A lot of our fans are entertainment fans. They love the music industry. They love what Austin offers." To that end. Del Conte notes UT continues to improve the gameday experience on the 40 Acres, with efforts including "launching a food truck section, improving premier seating options, hosting music festivals, running drone shows and more." Nearly 18K fans showed up to Toledo’s Glass Bowl over the weekend for a concert featuring the Zac Brown Band, and Rockets AD Bryan Blair tells the Toledo Blade’s Dave Briggs: “My heart is just overjoyed, and not for me, but for Toledo. For our campus to see an event like that come to life, it was really, really cool. When Zac took the stage, I stood in the back corner just to try to take it all in. This has been over two-and-a-half years in the making, and I'm not sure most people realize all that it took to get it to this point — all the doubt, all the ‘nos’, all the different hesitation points.” From a facilities standpoint, Briggs points out that “while the crowds at football games are predominantly male, the more 50-50 gender split – and the nature of a concert (the stadium almost ran out of beer) – strained the infrastructure. UT plans to add more portable restrooms next time.” As for whether this could be an annual event on Memorial Day weekend, Blair remarks: “There's something to be said for every year, everybody in northwest Ohio knows Memorial Day weekend there will be a big-time event at the Glass Bowl and you have to make a decision on whether that’s big enough to keep you in town or not. At the same time, it is a time of the year where there’s a lot of demands for your attention.” Blair says to expect an announcement about a future event sometime in the fall, adding: “This was the first, but certainly not the last. The response has been really, really positive, and it tells me we’re on the trail of something that could be massive.” (link)

Penry Advisors Founder Jason Penry shares with AthleticDirectorU some insights from top NIL supporters at the Group of 5 level and is told by one: “From my perspective it is a no-win situation. It starts when I give money to NIL. The coach uses it to pay better players. The coach then leaves for a pay raise and takes all the players with him, and you have nothing to show for it. I would rather just give money to the university. … Do not BS me with this ‘student-athlete thing’ anymore.” To get a better understanding of donor motivation, Penry sent a flash survey to 15 of the top NIL investors from a total of 11 G5 programs and notes that “each of the 15 individuals polled are among the top five NIL donors at their related institution. Each of the 15 individuals were asked one question: ‘What is your biggest motivator to invest in NIL at the highest level?’ The donors had six options to answer the question: A) I want to help athletes; B) I want to help the coach(es); C) I want to help the athletic department and AD; D) I want to help the university; E) I want to win; and F) all the above.” Perhaps unsurprisingly, F was the most popular answer followed by E. Meanwhile, one donor explains: “Honestly, all except A (‘I want to help athletes’) for me. I agree with that statement, but it is for sure last on the list. Purely from a financial standpoint, all students – athlete or not – need to use college to figure their sh*t out. I do not believe anyone should have that financial burden or pressure to help that kid except for themselves and their family. NIL is a handout, probably more so at the top end. Easy money now, but (what) does it teach (about) work ethic? If an athlete wants to go out to book appearances and market for a brand, I am all for that, but I believe it should be independent of the school. I understand why we got here, and I hate it.” (link)

O’Melveny & Myers Entertainment, Sports and Media litigation partner Tim Heafner, along with O’Melveny litigation counsel Max Rothman and litigation associate Ethan Hicks, explain in an SBJ op-ed that although the House settlement “provides little guidance on how the new [fair market value] test will be implemented,” the entertainment industry could provide some guidance on benchmarking. “Much like the proposed terms of the settlement here, many studios have standards addressing and defining how to evaluate affiliated transactions. While these provisions vary by studio, they often examine the terms of similar, unaffiliated transactions that the studio enters — i.e., the terms of an affiliated transaction may be compared to the terms of unaffiliated transactions that the studio enters. A studio thus can look at its own universe of unaffiliated agreements to help evaluate the terms of an affiliated transaction. The settlement’s mandatory reporting requirement for any deal over $600 will help Deloitte build a repository to evaluate the terms of affiliated NIL deals. But it will be in the best interests of the schools and their athletes to track what is happening in the market to mitigate any risk of penalties for non-compliance with the so-called ‘fair market value test,’ especially given recent reports that Deloitte has indicated that 70% of all prior NIL deals with affiliated entities would have been denied under the new standard. The more data and NIL deals schools and their affiliated entities have access to, the better. And if schools can point to similar deals their athletes have entered with unaffiliated parties, that may prove helpful in demonstrating the value of an affiliated NIL deal under the new test.” (link)

On Montlake’s Christian Caple offers a tour of Washington’s new student-athlete dining hall, the $5M Don James Center, and notes that “lunch is served Monday through Friday from 11 a.m. to 2 p.m., and dinner is served Monday through Thursday from 4:30 to 8 p.m. Football and men’s and women’s basketball players also have access for breakfast from 7 to 9:30 a.m., with features like a made-to-order scramble station, pancakes, french toast, a waffle machine and a panini maker. The space can be used for pre-game meals, too. … It’s unclear how the impending House v. NCAA settlement might affect certain benefits for some of UW’s teams next school year, but I’m told all athletes will continue to have access to the DJC in some capacity.” Huskies Senior Assoc. AD for Health and Performance Mike Dillon tells Caple that “we’re still working. This is not a fully done system.” For instance, UW has plans to add an outdoor grill downstairs and another on the Off-Leash Deck inside the stadium. The center is staffed by 28 full-time employees, plus 15 shifts per day for a rotating crew of about 60 student employees, and Director of Football Performance Nutrition Tanner Graves explains: “We’re there at every meal for them, to be a resource to help them understand what they’re eating, how much they need to eat. … A lot of guys come in here and think carbs are bad for you, carbs are going to make you fat. We’re an anaerobic sport. We really rely on carbohydrates as a fuel source for these guys, so that’s the majority of their diet. You need that to recover and to be ready to go for the next day, the next lift group.” Lots more. (link)
