Venable LLP Partner Philip Sheng recently noted that, according to U.S. District Court Judge Claudia Wilken’s April 23 Scheduling Order, the parties in the House settlement had summary judgement and Daubert briefing due on June 6. In an update Sheng points out that the parties have moved for an extension of upcoming deadlines, which Wilken has granted. (link, link)

I have been saying it will be during NACDA week, as Judge Wilken knows when major NCAA events are being conducted. Georgia AD Josh Brooks talks more about the College Football Playoff format, explaining on SiriusXM that “if we were to go to 16, there’s arguments we made about four-four this and that, but then you look at and go 5 and 11, we’ve had a glut of teams in that 13 and 16 range. If we trust the committee to hold true, and historically you look at the top 16 over the last 10 years and say, ‘Man, we’d be averaging five or six a year, we’d be in good shape.’ But you would ask the committee that, okay, now that it’s 16 for ranking, don’t start having new criteria. … You want to hold true to that. But I think what we’ve got to fix first before we talk about nine games, eight games, or 4-4-3-2-1, whatever, we’ve got to get down to the root of the problem and really talk about how we’re going to decide whether it’s 12 teams, 14, teams, how are we deciding?” As far as the methodology for picking the CFP field, Brooks remarks: “It’s hard in football because there aren’t as many data points. That’s hard, but there are things like RPI and things we can look at, to really look at a combination of the metric score that we can bring to the committee and say, ‘These are the best teams. But can you do that from a conference room watching football games? Do you need to go to some games in person? Do you need people that live and breathe and see it every day? I don’t know what that right makeup is.” (link)

LSU Executive Deputy AD/COO Keli Zinn joins Connect's Kristen Eargle on the latest episode of The Career Hustle to reflect on her path to Baton Rouge, which has included being the first woman to lead the athletics department of West Virginia when she was named interim AD. Zinn also discusses some of the unique projects she's worked on, including securing the Amazon Prime series, "The Money Game,” and helping to provide support and infrastructure to LSU's women's gymnastics team, which celebrated its first national title. In reflecting on her career path, Zinn acknowledges she doesn’t know if she had the “foresight or even the strategy at the time, but I think a difference-maker for me was really finding myself in positions where I had people above me who both had the capability, but also the willingness to give me opportunity. I think we all have the pleasure of working for a lot of great folks, but maybe they don’t always have the authority to open up some of those doors or give you extra added duties, and I was fortunate to have both.” Check out the full Q&A on Connect. With viewership metrics now factoring into the ACC’s revenue distribution, The Virginian-Pilot’s David Teel notes Virginia Tech’s football opener against South Carolina presents a potential “ratings windfall,” but the next two contests – Vanderbilt and Old Dominion – offer less promise due to their airing on the ACC Network. Hokies AD Whit Babcock: “We’re supposed to get weekly (ratings) updates, so yeah, that will be bizarre. Tell all Hokie fans to turn their TVs on before they leave for the game.” Babcock also tells Teel he’s evaluating every future non-conference series the Hokies have scheduled. “We will take some action on that this summer. It’s a new world and a new way of distributing revenue, and it’s sent us back to put a magnifying glass on the schedule. … When we perform well, we are one of the top-tier brands in the league from a viewership standpoint. The last three years, we’ve certainly come back to the middle of the pack, but the ACC needs Virginia Tech to be great again, and there’s nothing I want more than that.” The Hokies stand “ninth or 10th” in ACC viewership over the past four years, Babcock said, numbers that are already baked into the five-year, rolling average for 2025-26, “and that’s not good enough.” (link)

UCF AD Terry Mohajir believes that even in the NIL era, money is not the only animating factor for some student-athletes. “Some of the kids that came in, one of the things I asked them was, why did you leave your school? The interesting thing is that one of them told me that in this new era of NIL transfers, coaches are afraid to coach them hard. He felt that he could be pushed a little bit more; ‘I’m just a pretty good player, so I needed to find someone I was going to get pushed by, not based on what I was getting paid, instead help develop me.’ That was the theme I heard from our players: they are being developed in a different manner than at their previous school. So that was really cool.” (link)

Iowa State Senior Assoc. AD/SWA Calli Sanders has agreed to remain in her role rather than begin a phased retirement on July 1, according to Cyclones AD Jamie Pollard, who says: "I am very pleased that Calli has decided to postpone her retirement plans for at least another year and continue in her current role with the Cyclones. Calli has been an integral part of our administrative team for more than 20 years and having her stay will provide tremendous continuity within our department as we navigate these challenging times in intercollegiate athletics." Florida AD Scott Stricklin and Baseball HC Kevin O’Sullivan have released statements regarding O’Sullivan’s actions during last weekend’s NCAA Regional at Coastal Carolina. Stricklin: “This afternoon I met with Kevin O'Sullivan and told him that his actions prior to yesterday's NCAA Tournament game fell well short of expectations of how Gators treat people. One of our department's core values is respect, and Coach O'Sullivan's unacceptable actions failed to demonstrate that. On behalf of Florida Athletics, I want to personally apologize to everyone impacted - including NCAA representatives, Coastal Carolina and their staff, East Carolina and their team – as well as to Gator Nation.” O’Sullivan: “Prior to yesterday's NCAA Tournament game against East Carolina, I let my emotions get the best of me and channeled that energy in a way I should not have. I want to sincerely apologize for my actions and behavior to the entire NCAA Regional field of Coastal Carolina, East Carolina and Fairfield, the NCAA – including site representatives Rick French and Mark Scalf – as well as all of Gator Nation. I did not represent the University of Florida to the appropriate standard yesterday and take full responsibility for that, and promise to learn from this experience and be better moving forward. I appreciate all of the tireless efforts on behalf of host Coastal Carolina, their Tournament Director Bryan Stiles, and the NCAA over the course of NCAA Regionals, and am sorry for allowing this instance to get in the way of an otherwise great weekend of postseason baseball.” (link)

The Mountain West, WCC and WAC have all released their 2025 volleyball schedules, and Grand Canyon was listed on none of them, according to Nevada SportsNet’s Chris Murray, who notes: “That's important because Grand Canyon was a member of the WAC in 2024-25; was scheduled to be a member of the WCC in 2025-26; and will be a member of the MW in 2026-27. But where Grand Canyon will play next athletic season is unknown.” As for whether the Antelopes could possibly join the Mountain West early, Murray points out that there are only seven voting members in the league until July 1, 2026. “Those schools include Nevada, UNLV, Air Force, New Mexico, San Jose State, Wyoming and Hawaii. If those seven schools want to add Grand Canyon for the 2025-26 season, one year before UC Davis and UTEP join – as well as Northern Illinois in football only – they can vote to make that a reality regardless of the feelings of the five departing schools, who are required to play whatever conference schedule the MW offers them. … One additional complicating factor would be conference distribution in 2025-26, including media-right money. But there's a real chance the Antelopes would forgo its conference money for 2025-26 to simply have a home for next season before becoming a full-revenue member in 2026-27.” (link)

The New York Post’s Kirsten Fleming shares some stories from stakeholders about how NIL has changed college sports, and ESPN college hoops analyst Fran Frischilla says: “I had a referee recently text me. He said, ‘I did games this year where I could tell the coach was afraid to yell at the players because he was worried the kid might get mad and transfer.’ … There are teams that, when you watch games, you think, ‘How the hell are they losing with all that talent?’ And you find out one guy is jealous of another guy because he’s getting more money.” Fleming also points out there are several individuals dedicated to helping student-athletes manage their money wisely, and Scout Founder Michael Haddix Jr. tells Fleming: “I’ve heard examples where players were going through money and not paying their taxes and jumping into the transfer portal, asking the new coaches for an advance so they can clean up their financial mess.” Poneman & Naiditch Representation Co-Founder Daniel Poneman explains that his agency will be trying to forestall scenarios like this by hosting clients in Scottsdale for a two-week offseason training. “It’s like a boot camp, where we’re bringing in tax experts, financial advisors and spiritual teachers. We’re saying, ‘Look, the money you’re making is not for you to go crazy and buy bottle service on your college campus. This is to put in your Roth IRA and into a diversified portfolio. This is life-changing money if you allow it to change your life positively.” (link)

Tulane Sports Law Director Gabe Feldman sits down with Steve Molo, the lead counsel for over 100 objectors to the House settlement, to discuss the nature of objectors’ issues with the settlement, and Molo identifies a key issue as it relates to roster limits: “It’s discretionary. The schools don’t have to do that, they don’t have to live by that. If they had to live by that, it would go a long way to resolving the issues caused by the roster caps. But it really doesn't, it's illusory, it's not really relief. It’s something that might happen; athletes are entitled to something that should happen and will happen and should not be harmed as a result of the settlement and that's what's happening still. … To adopt this whole concept of the designated student, that is still discretionary with the schools. They’re not required to do that, and many student-athletes are left in this situation where they've been cut from teams or told that they're not going to be invited back, however you want to phrase that. They’ve entered the transfer portal, which is clogged. The estimate that I've read in the media – and it's hard to get a hard count on this – but the estimate I’ve read is there are more than 25,000 students. These students face additional out-of-pocket costs having to look for a new school, they face interruption to their academic careers going to another school that may have different academic requirements – the credits might not transfer.” Molo goes on to point out that roster limits were a late addition to the settlement and argues they have nothing to do with the issues that were raised in the first instance. “This is something that the NCAA has interjected as a way to save money for the schools and get a release for it. They’re getting a release here. If they had the ability to do this before – which, schools could eliminate teams, they could cut players, whatever – they faced potential legal consequences for that. Here, they’re shielding themselves with the release of the settlement and trying to do the same thing. It’s just not fair.” Full podcast. (link)

SEC Commissioner Greg Sankey re-emphasized on the Dan Patrick Show his “longtime personal opinion on a playoff format: A bracket of the top 12+ ranked teams with no automatic qualifiers,” according to Yahoo’s Ross Dellenger. Sankey: “I’d give no allocation (AQs). When we get into rooms, we make political compromises.” Dellenger also notes that “Sankey again suggested that the CFP selection criteria needs to change to incentivize the scheduling of highly competitive non-conference games. Asked directly about universal scheduling, Sankey said he’d be ‘happy for a coordinated conversation to try to get scheduling right.’” Sankey also noted the Power 4 commissioners are scheduled to discuss next CFP format steps on a call tomorrow, adding: “Disagreements are fine and make us better. We have a responsibility to work together.” (link)

The Detroit News’ Connor Earegood points out that new Michigan State AD J Batt, a former soccer student-athlete at North Carolina, has a connection to MSU via President Kevin Guskiewicz, who worked in sports medicine for the Tar Heels during Batt’s playing days. Guskiewicz tells Earegood: “I had a pretty good suspicion that he was going to have great success. I'm just thrilled that we're going to be reunited, and I think he'll, again, take Spartan athletics to the next level. … I said from the outset that I wanted to hire an athletics director that could run a major corporation, and J Batt I am convinced will, in fact, do that. He's done it at Georgia Tech for the past 3½ years. He's been at several other Power Five schools, and he understands the business side, which is really important.” Guskiewicz adds: “I'm going to hand the keys over to J Batt to run the athletics department, and he's going to have full responsibility to run it.” The Spartans also received some input from former Football HC Nick Saban, with whom Batt developed a close relationship at Alabama, and Guskiewicz explains: “We heard loud and clear from Coach Saban that J Batt is a superstar and somebody who will relate to coaches really well. But he'll also develop a strategy for fundraising.” (link)

Clemson AD Graham Neff joins the Gramlich and Mac Lain podcast to discuss several topics, including the Tigers’ football scheduling philosophy and notes: “We’ve been really consistent with playing 10 of the 12 games are Power 5 games. We’ve got our eight ACC games, we’ve got South Carolina, that’s nine, and we’ve got this extra one that we’ve scheduled. And that’s been Georgia and Texas A&M and LSU this year and Notre Dame when they've been on the schedule and off. So, we're going to absolutely, at a minimum, continue that type of methodology. Now, as strength-of-schedule value continues to take shape – and I hope, I think there's some some momentum towards strength-of-schedule becoming even more prominent as it relates to evaluating resumes and College Football Playoff expanding – so it’s not as much sorted just by win-loss record, but there’s more of a total evaluation of resume. That has good tailwinds of being good for fans because it would purport to stronger schedules and maybe instead of playing nine or 10 Power 5 games, schools are playing 10 or 11.” When it comes to generating new revenue via jersey patches and/or on-field signage, Neff notes one difference between college and pro sports is that, in Clemson’s case, there are 28K students in the 18-22-year old demographic. “So our ability to be really integrated throughout campus…that type of synergy and connectivity from a total campus standpoint to present and connect with potential partners for activation and partnership, that’s where there’s great value and great partnership, which goes well beyond whatever logo is painted on the football field.” Full podcast. AthleticDirectorU Co-Founder Jason Belzer breaks down what athletic departments should consider when figuring out how to pay student-athletes and posits: “Let’s disabuse ourselves of the notion that this is simply about wiring money. Revenue share distribution is a deeply complex financial undertaking with implications across legal compliance, taxation, technology, and athlete welfare. Here are the foundational components that must be in place: IRS compliance & tax infrastructure, custom payment structuring, regulatory and Title IX tracking, financial forecasting and cap management and cybersecurity and data protection.” One Power 4 CFO tells Belzer: “We’ve never had to build a payroll infrastructure for a population this young, this transient, and this decentralized. We’re essentially being asked to stand up a mini-financial institution inside an athletics department, and the exposure is enormous if we get it wrong—even once.” Belzer also points out that rev-share systems could possibly do more than simply pay athletes. “Imagine a feature that allows athletes to voluntarily donate a portion of their earnings back to the program, campus initiatives, or charitable causes. Not only could this reduce tax liabilities, but it would reframe athletes as philanthropic stakeholders. It also unlocks a future fundraising model rooted in shared value and long-term affinity.” Lots more. (link)

The Big East last week concluded its spring meetings, which included discussions on the House settlement, NCAA governance, future television and digital coverage plans, and strategies to maintain the conference’s national successes in basketball. During the meeting, conference presidents elected St. John’s President Rev. Brian J. Shanley to a two-year term as Chair of the Big East Board of Directors. He will begin his term on June 30, 2025. Attendees included NCAA President Charlie Baker, Fox Sports EVP Jordan Bazant and Marquee Events VP Joel Fisher, among others. Commissioner Val Ackerman: “This year's meetings allowed us to reflect on the successes of the past year, take stock of fast-moving currents in the college sports world, and identify priorities as we plan for next year and beyond. We believe our basketball focus, broad national television reach, the stature of our coaches, the appeal of our conference tournaments, our brand strength and our unified strategic outlook will create advantages for our schools as we look to maintain our future stability and standing.” (link)

As part of an infractions settlement with the NCAA, Florida Gulf Coast is vacating 82 wins across several sports. According to the Fort Myers News-Press’ Alex Martin and Ed Reed, the “hardest hit was softball, which had to vacate 31 wins, and its 2024 Atlantic Sun Conference Tournament championship, along with an NCAA Tournament win over Florida Atlantic. The ruling dropped longtime coach Dave Deiros, who retired following the 2025 season, from 810 career wins to 779. Baseball lost 22 games, including their ASUN regular season co-championship from the 2024 season and a win over No. 16 Florida State on March 4. They also forfeited three wins to Central Arkansas during the 2024 season.” Men’s basketball lost nine wins, while women’s hoops lost six. Men’s soccer lost seven. (link)

Duke Baseball HC Chris Pollard shares his disappointment with the ejection of standout student-athlete AJ Gracia during the weekend’s regional final against Oklahoma State. After hitting a home run that brought the Blue Devils back to within one, Gracia returned to the dugout where his teammates placed a hard hat on his head, as they’ve done all year. Later in the inning when Duke came back to take the lead, Gracia excitedly took a couple steps out of the dugout, thereby breaking the rule about home run props, and was ejected. Pollard: “He took two steps out of our dugout not to show anybody up, not to be disrespectful of the game, not to disrespect Oklahoma State, [but] to cheer on his teammate. … This rule and this type of action by the umpire are why people get so frustrated with the NCAA. I’m disappointed for AJ Gracia that he won’t play in one of the biggest games of his life when we start the super regional. I'm disappointed for Duke baseball, and I’m disappointed for college baseball. I want to get that off my chest, and if I get fined, I get fined.” (link)

The renovations include a new backstop and netting system extending down the third base line; bleacher seating with backrests for over 400 fans; ADA-accessible seating behind home plate; a two-story press box with enhanced broadcast and media capabilities and updated sound system.
