NCAA President Charlie Baker tells Yahoo’s Ross Dellenger the NCAA is prepared to make its first payment to former athletes as required by the House settlement. Dellenger reports the organization has $285M sitting in escrow awaiting the court’s permission to distribute. Baker also tells Dellenger he did not attend the two-day Michigan infractions hearing last week but received a report. “It was a thorough hearing of the issues, and everybody that wanted to speak their piece, for the most part, got it.” He expects a ruling in 30-90 days. Additionally, Baker says the NCAA believes that international college athletes can receive revenue-share from their schools in the new era, though the organization “still has some work to do” on assuring this is the case. A group of eight women filed an appeal of the House settlement on Wednesday, arguing that it violates Title IX, according to Front Office Sports’ Amanda Christovich, who notes the appeal “only challenged the back damages portion of the settlement. … The law firm Hutchinson Black and Cook, which filed the appeal on behalf of the athletes, also filed one of many objections to the settlement during its approval process. But now, the firm is making another attempt. The eight athletes are a mix of track, soccer, and volleyball players: Kacie Breeding from Vanderbilt; Lexi Drumm, Emma Appleman, Emmie Wannemacher, Riley Hass, Savannah Baron, and Elizabeth Arnold from the College of Charleston, and Kate Johnson from the University of Virginia.” Attorney Ashlyn Hare: “Paying out the money as proposed would be a massive error that would cause irreparable harm to women’s sports. The settlement suggests schools would have paid male athletes over 90% of their revenue over the past six years as though Title IX didn’t apply. If Nike wants to do that, that is their choice. If the school, or a conference acting on the school’s behalf tries to do that, they are violating the law. They can either pay the athletes proportionately, or they can return all of their federal funds. But they can’t do both.” (link)

ESPN’s Dan Murphy notes the appeal “won't stop college teams from paying current athletes starting July 1, but it will pause the NCAA's plans to begin paying former athletes.” Attorney John Clune, who also represents the student-athletes, explains: "We support a settlement of the case, just not an inaccurate one that violates federal law. The calculation of damages is based on an error to the tune of $1.1B. Paying out the money as proposed would be a massive error that would cause irreparable harm to women's sports. … Title IX was deliberately ignored. The parties and court acted like it was already addressed when it clearly was not. Complying with Title IX was a problem in this settlement, so they just chose to ignore it. That can't stand." (link)

House Decisions?...
+ The deadline for schools to decide whether they’re opting into the House settlement has been pushed back from June 15 to June 30, according to Yahoo’s Ross Dellenger, who adds: “DI schools are afforded the choice to opt into the settlement or not. Those choosing not to opt in are not permitted to share revenue but do not have to adhere to new roster limits. Opt-outs, however, are required to submit NIL deals through the new clearinghouse.” (link)
+ North Dakota AD Bill Chaves said last week before the settlement was approved that "given what's transpired and what the judge said regarding rosters, we're leaning on the opt-in side. That's where I think we're going to land unless something radically changes." Chaves explained that one hang-up from officially declaring UND's intent to opt in is a promised, lengthy document from the NCAA that answers some frequently asked questions on the topic. "We don't have that FAQ document yet to see what grandfathering-in actually means. … My (original) concern was roster sizes and what that means for Title IX. When the judge was first looking at it, there was a hard cap cut to roster sizes, where if you opted out, you had more of a runway to manage it. Now, it's kind of flipped and the grandfathering-in will be for the opt-ins. That's why we were waiting to see what the judge was going to say." + UNC Asheville AD Janet Cone indicates the Bulldogs plan to opt out of the House settlement for 2025-26 and will “continue to assess the situation as it develops." (link)

Oregon State AD Scott Barnes tells The Oregonian’s Ryan Clarke that “we have no plans to make cuts of sports. Our sports offerings are set. We have the NCAA minimum 16 championship sports, plus men’s rowing. No plans to cut as it relates to scholarships, no plans to cut the number of scholarships we offer, either.” Regarding how much revenue the Beavers will share, Barnes says: “Our intent is to be really competitive in our league, and those we’ve recruited against and will continue to recruit against. The actual number, we’re building the plane as it leaves the tarmac in terms of the dollars. But we’ll be competitive with those we’ve typically recruited against. … Never has our university been in a position, nor will we ever be, nor do we need to be in a position to compete with the top of the Power 5 in terms of budget and resources. We will find a way to compete on the field through competition, as we always do. We’ll punch above our weight, undaunted, and we don’t back down. But as it relates to resources, we’ve never had resources when people talk about the Texas, the Oklahoma, the Ohio States of the world in terms of payrolls.” (link)

Louisiana AD Bryan Maggard doesn’t see the House settlement as strictly a win for Power 4 schools, submitting that “I don’t think it’s a bad thing for anybody. I think it’s an opportunity to provide some level of guardrails within our industry – create some balance at least of a competitive playing field. Although that’s going to be segmented by the levels. … The Power 4s are going to operate with that $20.5M cap and the Group of 5, I think, we’re all going to float within that $1M-3M gap initially. It allows us to strive to adjust and reevaluate how we’re spending current dollars and do some money allocation to start providing some financial support to our student-athletes.” Maggard goes on to remark that “what remains to be seen is the legitimacy and the accuracy of the (NIL Go) clearinghouse. I know a lot of smart people have worked very hard on trying to create a platform that will make this something that’s doable. Like anything in our society, I think the first time a deal is denied, there’s going to be a lawsuit. We should all anticipate that and it’ll be interesting to see how that all plays out.” (link)

Coastal Carolina Executive Advisor to the President Joe Moglia argues the House settlement brings more questions than answers, particularly as they relate to employment and fair market value. However, Moglia contends the crux of the matter remains money, which is why several schools have vetted the possibility of tapping private equity sources. Moglia: “Private equity may be the right strategy for some institutions, but private equity is smart. They’re not investing for kicks and will expect a significant return on their investment. All the while, smaller schools will struggle to put together the funds needed to be competitive. Leaders at those institutions need to think carefully about whether it makes sense for them to even be in DI football or basketball. Perhaps a few Group of Five (G5) schools will be able to compete because they already have strong programs, but virtually none of them will be able to compete financially.” Beyond PE, Moglia notes some schools are “considering adding more student fees to pay athletes. Is it right for all students to pay more for an education so a select few can earn thousands or even millions of dollars? Other institutions will be tempted to put smaller, non-revenue Olympic sports on the chopping block. This could harm our nation’s performance in the Olympics. And would it stop there? If you’re willing to cut women’s tennis or your swim team, what about the philosophy department? How much are administrators willing to give up just to afford football and basketball? Despite the resolution of the House case, college sports remain broken. Leaders need to step up and force meaningful and clear change, instead of waiting while lawyers and D.C. politicians run up the tab.” (link)

Texas is unlikely to go the private equity route, one major donor tells the Houston Chronicle’s Kirk Bohls, because “we are the most recognizable brand in the world of college sports, and we don’t need to generate more revenue to cut costs for revenue-share.” Bohls notes that the Longhorns want to “rely on corporations and businesses to pay individual athletes through NIL because it can’t pool the money through collectives. It is expected Texas will absorb the Texas One Fund and use that to solicit merit-based NIL.” (link)

Cincinnati will officially open the $134M Sheakley Indoor Practice Facility and Athletic Performance Center today. Designed by Gensler and MSA Sport, the 180K-sq-ft complex includes a 120-yard football field, offices for the football program, a dining hall, a weight room, a training room, recovery spaces including hydrotherapy, a new football locker room and training spaces for all student-athletes. Bearcats Senior Deputy AD/COO John Daniel: "If you look at it through the eyes of prospective student athletes who go visit these established historic programs with facilities built decades ago, renovated multiple times over, and expanded, you'll see that UC, frankly, was not on a level playing field. Chief U.S. District Court Judge Matthew W. Brann dismissed a defamation lawsuit brought by former Penn State men’s basketball captain Kanye Clary against the school and HC Mike Rhoades. According to Brann, Clary failed to “identify the audience of the allegedly defamatory statements” and failed to include dates for some statements. Other statements weren’t identified as false or were “too vague” to support a viable claim, Brann wrote. Clary has until June 24 to file an amended complaint. (link)

NCAA President Charlie Baker took the stage at the 2025 NACDA Convention and remarked that “no one in this room needs to hear me say that this is one of the biggest changes ever in college sports. I hope you also understand that it's a far better future than virtually every other alternative that could have been in front of us. Blame whoever you wish to blame. But the simple truth is clear: College sports' collective inability or unwillingness to change years ago put the entire enterprise at risk. Is the settlement disruptive? Very much so. But it is an opportunity for the Division I community to pay for back damages over 10 years, instead [of] triple that amount all at once. And it creates a future that comes with choices, instead of bankruptcy." Asked about schools having to make financial decisions like cutting staff, Baker said: "I've talked to a lot of schools in DI, at every level. They all get the fact that it's better to be able to make choices than to have choices made for you, which is kind of what the alternative was.” He also noted the Power 4 conferences, for the most part, have said they have no current plans to eliminate sports, and believes the elimination of scholarship limits is a positive. "A lot of the people who are predicting what's going to happen here, good for them, but the bottom line is, we don't know. And, and I think it's important to let this play out and then make adjustments if people need to." (link)

NCAA President Charlie Baker also says the power conferences are exploring the possibility of moving back the deadline for other DI schools to opt into the settlement from June 15 to July 1, according to Yahoo’s Ross Dellenger, who adds that it’s “just talk for now.” Hero Sports’ Sam Herder notes that a “pushed back House settlement approval, plus the grandfathering in of roster spots, has seen notable schools like [North Dakota State] and South Dakota give more consideration of opting in compared to a few months ago. The MVFC ADs still haven’t formalized whether to set scholarship caps for teams that opt in. They meet next week.” (link)

NCAA lead outside counsel Rakesh Kilaru joins Tulane Sports Law Director Gabe Feldman to discuss the House settlement and explains that if objectors choose to appeal the settlement, it won’t stop the injunction, revenue-sharing and roster limits from going into effect “unless they try to get some sort of emergency order from the court, which thus far they haven’t done. But it could take months, could take years – I would bet on years – for that settlement to resolve itself because the Ninth Circuit is a pretty slow court in terms of moving. In the meantime, the injunction will happen. I think the kind of new world order will take effect to some degree. But if they do object, then the damages payments will be delayed, so I think that's something that has to be weighed on that side.” Kilaru believes there are two main sources of potential litigation. “One is: Are schools, institutions, states, student-athletes, are they going to be willing to be bound by this new system? Are they going to be willing to follow the rules? And you started to see, I would say, some cracks in that towards the end of the pre-House era – for example, the Tennessee and Virginia state AG lawsuit. … There’s a little bit of [a question of] do people, do institutions, do schools actually want to be bound by these rules? And when the rules are enforced against them as opposed to others, are they going to say, ‘Okay I stand by that?’ [...] The other main potential litigation source involves potential agreements with the (NIL Go) clearinghouse, but Kilaru is hopeful that type of litigation will be limited based “on the theory that a lot of the types of payments that should be happening are now allowed, and the sort of small set that aren’t, people will restructure and find out a better [way] to make it work because it would probably be better for everyone to work out a functional NIL arrangement that has a complicated legal process that results in potentially the student or an institution not being able to put their best foot forward on the field.” Lots more. TurnkeyZRG Chairman/CEO Len Perna talks with Puck’s John Ourand about several topics, including the changes in college athletics and admits he was three to five years too early with his proposal to create a single college football league. Perna also outlines one of the challenges college football will have with collective bargaining. “The schools in the SEC have a lot of politics wrapped around not bargaining with a union of student athletes. There’s a lot of history around right-to-work states and the boards of those SEC schools. I don’t think that the SEC will ever really be comfortable with collective bargaining with college football players. But I am very confident that schools in the Northeast, the Midwest, all throughout the Big Ten region and out West, will land on collective bargaining as a way to create a package of work rules that govern the transfer of talent—the transfer portal, a salary floor, a salary cap—all the things that create competitive balance in pro sports. I think that schools in the Northeast, the Midwest, and the West will wind up playing in one league that has collective bargaining, and schools in the South will play in a separate league that won’t have collective bargaining.” Perna went on to note that “ultimately, they’re going to have different cost structures because the schools with collective bargaining will be able to budget plan and predict their costs. And the schools in the South that don’t have collective bargaining will be in a perpetual free agent marketplace being driven by college football agents that will be driving up the cost every year. Those two leagues will look so different that I think the wedge issue is not a media issue. I think it’s a collectively bargained issue.” Lots more. (link)

Former Florida A&M football student-athlete Vaughn Wilson, who currently serves as president of the Eddie Jackson 220 Quarterback Club, the independent fundraising arm for FAMU athletics, says FAMU supporters are concerned by Suggs' arrest and the athletic department's unsettled situation. Wilson adds: “The only real stability in FAMU athletics over the last four decades was the service of Alvin Hollins in sports information and Veronica Wiggins in softball, and both have moved on. Other than that, the department has unfortunately been a revolving door, especially at the director position. There is no way for a department to be stable and to grow without a long-term plan and a good leader to see it through." (link)

Alabama AD Greg Byrne on McElroy and Cubelic in the Morning said of the NIL Go clearinghouse: “They have a formula that basically will say, ‘Yeah, this thing passes the smell test’ or, ‘No, this thing doesn’t.’ The formula is not going to be released because everybody will try to figure out how to get around it if it’s released. So young men and young women that have legitimate opportunities for name, image and likeness deals will be able to submit those, and if they pass – and private donations ones are going to struggle on that side – but legitimate business opportunities will be OK. Now you’re not going to get a half-million dollars for showing up at an ice cream shop and putting it out on Instagram anymore. … From listening to football coaches in the SEC, my peers at the other SEC institutions, there is a real desire to make this work. And there is arbitration on things that we wouldn’t be able to arbitrate before, so that’ll give both sides an opportunity to be heard when there are challenges that arise. It’s not perfect, but it’s a heck of a lot better than where we were.” (link)

The NCAA Playing Rules Oversight Panel on Tuesday approved changes aimed at helping the flow of the game in men's basketball for the 2025-26 season. “Changes include a coach's challenge at any point in a game to review out-of-bounds calls, basket interference/goaltending and whether a secondary defender was in the restricted-area arc. The panel also approved modifications to the rule on continuous motion on field goal attempts. Other enhancements to help with the flow of the game focus on the points of emphasis for officials for 2025-26. … [including] directives to address delay-of-game tactics, limit time spent at the monitor, improve game administration efficiency and reduce physicality. Under the coach's challenge rule, teams must have a timeout to request an instant replay review challenge. If the instant replay review challenge is successful, teams will be allowed to have one additional video review challenge for the rest of the game, including overtime. If the first video review challenge is unsuccessful, the team loses the ability to challenge the rest of the game. Officials can initiate video reviews on basket interference/goaltending and restricted arc plays in the last two minutes of the game and into overtime. … NCAA Men's Basketball Rules Committee members think the coach's challenge will have a significant impact on the flow of the game. Officials cannot conduct video review on out-of-bounds calls unless through a coach's challenge.” Other rule changes approved by the PROP: “Officials will have the option to call a Flagrant 1 foul when a player is contacted to the groin. A Flagrant 1 foul results in two free throws for the offended team and possession of the ball. … If a player uses the rim to gain an advantage, it will be a basket interference violation. If one of the shot clocks becomes inoperable, the shot clock at the other basket will remain on.” (link)

The Playing Rules Oversight Panel approved a new coach's video review challenge in women's basketball. Under the rule change, the following plays can be challenged at any point during the game: ruled out-of-bounds violations; ruled backcourt violations; whether a change in team possession occurred before the ruling of a foul where free throws would be involved; and whether a foul was assessed to the correct player. Officials cannot initiate reviews on these calls, with the exception of whether a foul was assessed to the correct player; teams will not be required to have a timeout to make a video review challenge; however, a failed challenge will result in a technical foul for an excessive timeout. The panel also approved an experimental rule in exhibition games for the 2025-26 season to allow coaches to make video review challenges on a foul charged to their team at any time during the game. Other rules changes include: setting the shot clock to 20 seconds when, following a dead ball, the offense is awarded the ball in its frontcourt; eliminating the rule that jerseys need to be tucked in; and using excessive timeouts or playing with six players when the ball becomes live will become team technical fouls. These violations will count toward team fouls, and the team will be awarded possession at half-court following the free throws. (link)

The NCAA Playing Rules Oversight Panel also approved modifications to the matside video review process in men's wrestling for the 2025-26 season. “Third-party reviewers will be allowed to consult with the referee about pertinent information on a coach's video review challenge. Previously, third-party reviewers looked at the sequence being challenged without any consultation with the mat referee. Additionally, coaches will retain their video challenge if there is obstruction in any part of the video sequence that is being challenged. Coaches also will retain their challenge if the action being questioned is not in the frame of the video. Previously, in these scenarios, coaches lost their challenge if the video wasn't determined to show indisputable evidence that the original call should be overturned. Another approved rule change is if the video review system fails, video review will not be used for the remainder of that match/bout.” Other changes include: “eliminating the interlocking fingers penalty because it is virtually impossible for referees to determine who created the violation; no longer requiring the referee to say ‘set’ from all three starting positions; and stopping the riding time when the offensive wrestler, in rear standing position, is going to be called for stalling.” Full rundown.
