#5: Young Harris urged the Georgia Court of Appeals on Tuesday to toss out an early decision in a contract battle with the Peach Belt Athletic Conference (PBAC) over the Mountain Lions’ departure at the end of the 2022-23 academic year arguing that the “enforceability is doubtful” of $240K in damages the league imposed on the school over its withdrawal. The PBAC originally filed a lawsuit back in January 2023 citing that Young Harris was required to “provide written notification of withdrawal at least two calendar years in advance of its effective date,” while failing to do so would result in an exit fee equal to twice the member initiation fee. Per a previous league release, Young Harris provided less than a year’s notice of its withdrawal, necessitating the $240K charge. More behind the Law360 paywall. (link)
