House plaintiffs attorneys have sent a letter to NCAA and power conference leaders calling for a retraction of the College Sports Commission's guidance on NIL collective deals issued earlier this week, per Yahoo's Ross Dellenger. Jeffrey Kessler and Steve Berman plan to bring the issue before Federal Magistrate Judge Nathanael Cousins, who has been appointed to resolve settlement disputes, writing: “There is nothing in the Settlement Agreement to permit (NCAA and conference) or the CSC, acting on their behalf, to decide that it would not be a valid business purpose for a school’s collective to engage in for-profit promotions of goods or services using paid-for student-athlete NIL. To the extent the NIL payment is for the promotion of a valid business purpose, it is irrelevant whether that payment comes from a NIL collective or any other third party.” A CSC spokesperson responded to Dellenger, stating: “The guidance issued by the College Sports Commission yesterday is entirely consistent with the House settlement and the rules that have been agreed upon with class counsel. The defendants have been in close coordination with class counsel on the key provisions in the memo and will continue to work with them to resolve any concerns they may have.” (link)

All signs point to the Sun Belt adding Louisiana Tech as league Presidents are set to meet on Monday. The Daily News-Record’s Shane Mettlen: “Unlikely they'd vote if the answer is no. Time for both sides to do their lobbying over the weekend, I suppose. But smart money would be on LT becoming the 14th member of the Sun Belt.” (link)

UCF AD Terry Mohajir Q&As with the Orlando Sentinel’s Matt Murschel as Mohajir confirms the Knights are sharing the max $20.5M this year with plans to do so again next year at a 4% increase. NIL Go experience thus far: “We’ve already put five deals through there. Four have been approved and one is pending. The range has been $600 to $10,000 and we’ve had a $10,000 deal go through so far. It’s working [the process] and it’s doing what it’s supposed to do, that’s why I’ve been so optimistic about this new age of college athletics and this new age of college sports. The College Sports Commission that we have, I think it’s working. So, we’ll see. We’re doing it the right way and hopefully everybody continues to do so and follows the terms of this House settlement.” Of note on the facilities front: “We hired a company to do a master plan for us for athletics to reimagine the whole athletics village area. That’s everything from baseball to softball, the whole space.” Lastly, Mohajir says he’s all about the Knights participating in international games, as Big 12 Commissioner Brett Yormark has promoted, just as long as it doesn’t reduce UCF’s number of home games. San Diego State AD JD Wicker & UTEP boss Jim Senter sat down with College.town’s Kristen Eargle last month at the 2025 NACDA Convention. Senter talks about his experience on the DI Council: “I really haven't been on a lot of NCAA committees, so it's been fairly eye opening to see the process and listen and weigh in on things that I think I might have some insight on or to say something about. But it's been very, very apparent that in my mind that we have not really marched forward making a whole bunch of changes because we've been waiting to make sure that the House settlement happens. So you don't want to get out in front of the House settlement. The other piece of this, the other big elephant in the room is really the CFP, which is an amazing organization. Group of 5 universities like San Diego State and UTEP receive a fair share of revenue from that, and our conferences do. But at the end of the day, no one wants to get out in front of anything that CFP is doing because that's a big chunk of the revenue stream that comes into all of us. So, they have to figure out what they're going to do with the number of teams and the format that will then probably allow some other things to happen like the entire calendar. So right now, we're at odds. All of us are at odds with the calendar because the CFP has moved into another semester, and so it's disrupted everything. So it's almost like you got to push the restart button and say, okay, well let's figure out what you're doing so then we can work our way backwards and get to something that makes sense with the transfer portals, with the recruiting windows, the evaluation, quiet periods, dead periods, contact periods, all those things have got to be readdressed. And so I think a lot of the folks on the Football Oversight Committee, and there's the FBS one and the FCS one, they're trying to work as closely as they can together.” Wicker: “I continue to keep telling our coaches that everything can't be the number one priority. So, if you keep telling me that providing name, image and likeness opportunities for our student-athletes is number one, then something's going to become number two. It used to be facilities was number one, so they both can't be number one. So pick it and then we will reorganize and reallocate resources to the best of our ability. With that being said, even if you can pay players, whatever you can afford to pay 'em, if they go into a locker room that is a dump or a weight room that is 50 years old, they're going to notice it.” More on Collegiate Sports Connect. Tulane Sports Law Director Gabe Feldman chats with AVCA CEO Jaime Gordon as rapid change to college athletics impacts Olympic sports of all shapes & sizes. Gordon on the idea some schools have discussed of tiering sports: “...what we've seen historically is you do go to this defunding model and you cut off the oxygen for the most part, and then maybe it's two or three or four years later, you look at that program and you say, ‘this doesn't represent what we're trying to do as our institution. This doesn't reflect what it means to be a then plug in your mascot and hey, it's time to move on.’ It does become a process that winds up ending in elimination, but I also don't want to be ignorant to the need to tier programs. Yes, this is going to sport athletics are going to look different. I don't think that there's anything you can do to not or to protect all sports and say, ‘Hey, we're not going to have any casualties in this space.’ But when it looks at tiering, maybe instead of having two tiers of football and basketball and everyone else that ‘hey, maybe we have three tiers or four tiers within an athletics department, and hey, we don't want to get rid of, and I'll just say men's volleyball for there, we don't want to eliminate those opportunities, but in the current landscape, we can't fund them at the same level that maybe we even fund our women's volleyball program.’” Gordon also commented on scale comparatives of where departments may be looking to save money: “Yeah, if you were to cut men's volleyball, you're saving less than a million dollars. And that would be at some of our higher funded institutions. Some of that is dependent…Stanford is going to be where you have more expensive scholarships and stuff. So some things are dependent, but yeah, you're talking hundreds of thousands of dollars versus millions and millions of dollars. And, I would say on the volleyball side of things, it's a two, three million overall budget for women's volleyball and right now, that is a sport that's showing revenue potential. And it's actually, there is one women's sports program in the country that actually operates in a positive, and that's Nebraska volleyball. There's no women's basketball that operates positive. There's no soccer or softball even within that. It's not, it's a small, I won't say drop in the bucket, but it's not a big piece of the pie.” Lots more. (link)

The Big Ten tackles the oft-asked query of “why is the Big Ten still called the Big Ten” since the league has expanded over time to actually include 18 schools. The short answer: “the name isn’t a headcount. Keeping it maintains tradition, and it’s smart business.” That’s not to say the Big Ten hasn’t thought about changing it before. Back in 1993, when Penn State joined as the 11th school, newly-appointed Commissioner Jim Delany considered making a change, but there was loud and immediate backlash to the idea. As to why the name has continued on over the years despite even more additions, the Big Ten highlights factors that include the importance of maintaining consistency during conference realignment, the standard the Big Ten name has secured throughout the sports industry, what the conference name means traditionally to its fans as well as the perceived lack of importance in across-the-board numerical accuracy when not every league sport has 18 participating programs. With the Women’s final later this morning, Sportico’s Brendan Coffey digs into revenue generation numbers surrounding Wimbledon, highlighting that the tennis event will likely generate more than a half a billion dollars over its fortnight run that ends Sunday. The 2024 tournament brought in £409M ($555M), up 7% from the previous year, while boasting 162% growth from a decade ago per reports from tournament and playing grounds operator The All England Lawn Tennis & Croquet Club. The majority of the revenue comes from media contracts “which account for just under half of the total – mainly from ABC and ESPN parent Walt Disney Co. in the U.S. and the BBC in the U.K.” That broadcast revenue will likely help the event continue its exponential growth with UK rights up for bid after 2027 and the fact that the BBC noted there were 225M total hours of Wimbledon watched during the two-week 2024 event. NCAA President Charlie Baker releases a letter outlining the need for staff reductions and reassignments within the Association, as well as the consolidation of regulatory affairs and governance into a single operating unit as a result of the House settlement. Baker writes that with the transfer of enforcement and regulatory activity away from the NCAA to the College Sports Commission, the newly-combined “governance and policy” group will be guided temporarily by Senior VP of Governance Kevin Lennon in the role of Acting Senior VP of Regulatory Affairs while a search is conducted. Moving forward, “AMA and governance teams will reorganize under one leadership team and align by division. Enforcement and the Eligibility Center will continue to be separate teams but will now report to the senior vice president of governance and policy. Hearing operations will continue to report to legal affairs. Additionally, many communications, information technology and human resource functions that currently operate out of regulatory affairs and governance will move into the NCAA’s enterprise-wide, functional departments that handle these issues.” Baker goes on to note that a combination of not backfilling open positions, transferring functions and a voluntary separation program will result in 20-30 fewer full-time employees throughout regulatory affairs and that all other national department offices won’t be impacted. USA Today’s Steve Berkowitz reports that U.S. District Court Judge Claudia Wilken on Friday awarded House settlement plaintiffs’ lawyers more than $520M in legal fees and costs. That figure could eventually climb north of $750M as Wilken also granted the lawyers’ right to apply annually for an award of fees and costs based on a small percentage of school student-athlete benefit and compensation spending “for work in monitoring and enforcing compliance [of] the settlement, which is set to last 10 years.” Per Berkowitz, Wilken noted that “the fees-and-costs award is ‘well below’ local judicial benchmarks that allow fees-and-costs awards of 25% of a damages pool.” The settlement calls for a combined total of nearly $2.8M in damages to be paid over a 10-year period. More from Berkowitz. (link)

Weatherford Capital founder Drew Weatherford tells Front Office Sports’ Amanda Christovich that private capital has been slow to come into college athletics because leaders weren’t completely certain the House settlement would come to fruition. Now that it has, Weatherford says his College Athletics Solutions joint venture with RedBird Capital Partners has conversations “underway” with schools, though there’s no indication on a potential timeline of any deals closing. More from Weatherford: “All of these institutions have pulled every lever that they can. Then the next question is if there is a need, are they going to solve that question with private capital.” (link)

Houston AD Eddie Nuñez pens a letter to fans highlighting the Cougars’ successes this past year, including a record $9M+ raised for the Cougar Pride Annual Fund and over 160 major gifts which is a 97% year-over-year increase. Nuñez adds: “Looking ahead to the 2025-26 year, we are embracing the new era of college athletics with a positive mindset of bold ambition, strategic investment, and relentless pursuit of excellence. We are not just keeping pace with change; we are setting the standard. Whether it's pushing boundaries in performance, academic success, or community engagement, our standard is simple: excellence in everything we do.” On Men’s Basketball’s run to the national title game: “The National Championship Game drew 21.1 million viewers, the most viewed basketball game (college or professional basketball) this past year, creating an estimated $6.1 billion in free advertising for the University.” (link)

The DI Women’s Basketball Committee approved a number of championship and selection enhancements, reviewed tournament format and met with 2026 Women's Final Four organizers during this week’s summer meetings in Philadelphia. From a selection standpoint, the group affirmed that the 2026 championship would feature an automatic qualifier from each of the 31 conferences in addition to 37 at-large teams as determined by the committee. While possible bracket expansion was discussed, no recommendation came out of the meeting. The tournament’s top 16 seeds will be announced the day before Selection Sunday in order to provide 2026 hosts with more prep time. The committee also voted to add the Wins Above Bubble (WAB) evaluation metric to provide a “resume-based metric that shows how many more, or fewer, wins a team has against its schedule versus what a bubble team would expect to have against the same schedule.” Already utilized by the DI Men’s Basketball Committee, the WAB uses NET as its opponent strength metric and will be made public on respective team sheets each day beginning Dec. 1. CBS’ Richard Johnson, John Talty and Brandon Marcello have filed over a dozen freedom of information requests seeking revenue-sharing agreements with student-athletes and all responses to date have been denied. Responses vary from the agreements being proprietary (Clemson) to documents not existing (Alabama) to citing state laws (Florida and Colorado) and to Family Education Rights and Privacy Act, aka FERPA, which protects a student’s educational record. As for whether that definition for FERPA is too broad, St. John’s professor Robert Romano states: “That'd be up to a judge to decide whether or not it is or it isn't. As of right now, they're using it and are using it successfully. I think what they're scared of is if they release this information and the judge or the Department of Education finds out they did it in violation of the FERPA rules and regulations, they can risk federal funding. And I think that's the issue right now. All the schools are scrambling. With everything that's happening in this new administration, with regards to federal funding, they want to make sure that they're not doing anything that steps over the line or could expose them to the possibility of losing any additional funding that the federal government provides, and if they release some information that could be interpreted as in violation of FERPA, well, they're exposing themselves.” (link)

Sportico’s Michael McCann details the potential for a legal challenge to the College Sports Commission’s rejection of NIL collective deals, noting: “Parties that submit NIL deals to NIL Go agree to an arbitration process that would preempt litigation until the arbitration is played out. […] The arbitration decision would be accorded high deference by a court in the event the losing party petitions the court to vacate the arbitration award. Even if arbitration could be overcome, the athlete/collective would only advance in an antitrust claim if they prove the CSC’s interpretation causes more harm than good to economic competition. […] Alternatively, the athlete/collective might argue the CSC’s interpretation violates one of the recent statutes and executive orders in Georgia, Virginia, Texas and other states that protect NIL rights in ways that might pose conflicts with the CSC. That type of dispute could spark an opportunity for the CSC to raise U.S. constitutional arguments against the state law, particularly claims based on the Constitution’s Commerce Clause and Contract Clause. These clauses forbid a state from adopting laws that unduly interfere with other states’ economies and impairing contracts, be they membership agreements or settlements. It’s also possible that some collectives might reorganize and expand their scope of operations to better comport with the CSC’s interpretation. Collectives that sell products or services to the general public for profit would appear more likely to meet the requirement.” (link)
