Settlement Within A Settlement…
+ House plaintiffs attorneys and NCAA and Power conference officials have reached an agreement to allow NIL collective deals to be treated in a similar fashion as other third-party deals, per Yahoo’s Ross Dellenger, who adds: “The resolution creates what administrators term more of a ‘soft cap’ as opposed to a hard cap, as SEC commissioner Greg Sankey described it last week in an interview with Yahoo Sports. The expectation is that collectives will create legal ways to provide additional compensation, as Big Ten commissioner Tony Petitti described Monday in an interview with Yahoo Sports. […] The change also, at least for now, prevents a legal challenge from leaders of a group of NIL collectives who began drafting a lawsuit against the CSC’s approach.” More: “The resolution may not completely end what will likely be continuous negotiations over particular enforcement rules between the power leagues controlling the CSC and the House plaintiff attorneys, who hold authority and veto powers over various aspects of the settlement. […] The guidance change may also not prevent future legal challenges over other enforcement aspects, including Deloitte’s compensation range concept or the appeals arbitration system that athletes can use for deals denied a second time.” (link)
+ The Athletic trio of Justin Williams, Stewart Mandel and Ralph Russo add that “the deal reached Tuesday avoids going to the magistrate. Instead, a clarification of the guidance is expected to be handed down by the CSC that clarifies collectives can offer goods and services for profit in the form of NIL payments, and they can send those deals through the clearinghouse for approval. … The collectives’ deals, as with all third-party businesses, will still be subject to a ‘range of compensation’ limit that will be evaluated through a service run by the accounting firm Deloitte.” (link)
+ Headlining attorney Tom Mars, who is representing collectives in a potential legal challenge against the CSC: “I'm glad to see the CSC decided to retract its guidance about collectives. The last thing college sports needed at this moment was a bare-knuckle, legal brawl between 70 collectives and the power league commissioners.” (link)

Sun Belt Commissioner Keith Gill in his State of the Conference address to kick off SBC Football Media Days highlighted the league’s growth. Specifically, the Sun Belt led the FBS with 12 bowl teams at the end of the 2023 season and, in each of the past three seasons, has had the most bowl-eligible teams among its peer conferences. Additionally, the Sun Belt holds 11 victories over autonomy conference foes over the last three years. Gill noted the major factors in the Sun Belt’s rise in football have been the increased emphasis and financial support from the league’s 14 members and the growth of the league’s agreement with its television partner ESPN. “To get to this place, time, energy and investments were required. Our members’ athletic budgets have on average tripled since the Sun Belt became a football conference. Assisting in these investments, conference revenue has grown by over 900% during this period and 65% over the last decade. And revenue from television has increased by a factor of 50 since the start of Sun Belt football.” (link)

Conference USA Commissioner Judy MacLeod covered several topics to kick off the league’s football media day, including current and future realignment, noting that “I do believe the FCS schools that we have brought in to transition have had a lot of success. I’m obviously biased, but I feel like we’ve made a lot of great choices. We have programs that have histories of success. A lot of times it’s a lot easier when you have a program that’s had success at other levels to transition that success forward, but our staff has done a great job with the administrations of each school and really tried to help them. Help them understand what that step is. I don’t know if that’s something we want to be known for – of transitioning schools, but we have had success and we’re excited with the new two that are coming aboard as well. As far as the future, we have membership on our board agenda every time we meet. We have a membership committee. It’s active. It’s always looking at different data and doing it for research about what may happen. We are really excited about the 10 we have moving forward. Unfortunately, I can’t predict things. I don’t think anything is going to happen in the time I’m sitting here, but you never know. I put my phone on silent so I wouldn’t get interrupted. Southern Conference Commissioner Michael Cross joins SoCon Assoc. Commissioner for Brand Strategy and Broadcast Dave Friedman and talks about the FCS rankings and notes that three years ago the preseason poll was 68% correct when compared to the end-of-season poll. Over the past two seasons, that has dropped to 52% and 36%, respectively, and Cross submits that “it’s difficult to move down. There’s a bias that comes into the equation right out of the gate, and if you started high there’s a reluctance on the part of voters to move people down after demonstrable losses or multiple losses. And there’s an anchoring bias that I think is very real there. And the ability to claw your way up those polls is even more difficult, and the statistics bear that out. We put that into artificial intelligence and it gave us all kinds of information related to what is actually happening with the polls. The polls aren’t official factors in the NCAA selection, but there aren’t a lot of data points within the ecosystem that we’re in where people are tracking what’s happening with FCS football. So you get some regional biases. There’s certainly a historical bias. … And there’s been a lagging recognition, if at all, about conference strength if people have moved from conference to conference or left FCS football entirely and gone to the FBS level. So all of those factors start to affect the decision- making process.” Full Q&A. (link)

SWAC Commissioner Charles McClelland answered several questions during the league’s football media day, including the rollout of SWAC TV, a free, high-definition video service set to officially launch August 1 on Roku and Apple devices. “We’re going to deliver 45 football games, and we’re going to have some Olympic sports as well. So, all championships, but what it does is it puts every football game that we play on some form of television. We kind of followed the model of the SEC and the Sun Belt. We kind of stole some of their ideas and technology. … Also, we think from a revenue standpoint it’s going to set us aside from everyone else.” With all 12 SWAC schools opting into revenue-sharing, McClelland notes that “adding sports, at this point, I don’t think is going to be at the forefront. But one thing that I can happily say here [is] none of our institutions to this date have decided to cut sports. There have been others, even at the highest level. With all of this change our institutions are dedicated to the 18 sports we currently offer. I think it’s going to be difficult to get a 19th sport added as a conference sport, but each individual institution will make that determination.” (link)

The USOPC has “effectively barred transgender women from competing in women's sports, telling the federations overseeing swimming, athletics and other sports it has an ‘obligation to comply’ with an executive order previously issued by President Donald Trump,” according to the AP. USOPC CEO Sarah Hirshland and President Gene Sykes explain in a letter that “as a federally chartered organization, we have an obligation to comply with federal expectations. Our revised policy emphasizes the importance of ensuring fair and safe competition environments for women. All National Governing Bodies are required to update their applicable policies in alignment." (link)

With a final membership tally of 2,679, Western Carolina has unlocked a $1M challenge gift from football alumnus and Phillips Infrastructure Holdings CEO Teddy Phillips Jr. to support upgrades to E.J. Whitmire Stadium. The membership total, which represents a YoY increase of more than 54%, includes 123 members of the newly revived Student Cat Club. Nearly 63% of the previous year’s membership has been renewed for 2025-2026. Catamount Club members contributed more than $4.7M in support for WCU athletics in 2024-2025, including more than $2.75M toward facilities renovations and nearly $300K in additional scholarships for student-athletes. ACC Supervisor of Officials Al Riveron says the league will increase its level of transparency on official video reviews this football season: “The ACC is the only league in the country this year where you’re going to have not only whoever’s doing the game the audio and the video to see what’s going on and a look into the command center, which we had last year. We’re going to go one step further. Last year we provided the network analyst…the audio. They could hear us in Charlotte having a conversation with the referee and the replay official. This year they’re going to see the video too. … So, this year, all bets are off, the curtain is pulled back 100%. What are we trying to accomplish there? Transparency number one. We’re going to show you how we get to that final ruling, for lack of a better term. All we want you to see is they did their due diligence. And then we go back and apply the rule correctly." (link)

Former Oak View Group CEO Tim Leiweke was arraigned Monday in the U.S. District Court in Austin and pleaded not guilty to one count of felony conspiracy to restrain trade. SBJ’s Bret McCormick: “After being processed, Leiweke…was then released on an unsecured $1M bond. His travel is restricted to the continental U.S., with any overseas travel requiring prior court approval. It’s not clear when Leiweke might next appear in court.” A spokesperson for Leiweke says: “Tim and his team built (Texas) a great arena – and saved the university millions of dollars in the process. They did that by competition, not crime, and Tim is innocent of these charges.” (link)

Big Ten Media Day… + Commissioner Tony Petitti weighs in on whether the SEC and Big Ten can agree on a future CFP model: “We're obviously not in the same place on these discussions. I think the goal would be to bring people back together. ... Every time the two leagues have come together good things have happened. … We are open to considering any format ideas that come from our colleagues or the CFP staff, but to be clear, formats that increase the discretion and role of the CFP selection committee will have a difficult time getting support from the Big Ten.” (link, link) + On CFP automatic qualifying bids: “We feel very strongly, providing games that are do or die (at end of season) will increase fan interest. Talking to those involved in our league, championship games & play in games are not bad for college football.” (link) + On the 4-4-2-2-1 playoff format: “We want to better connect the regular season and the post-season. A critical goal of any post-season format, regardless of sport, is to keep as many teams alive as deep into the season as possible. We want more conference games to matter in November. Also, the playoff format should not function as a disincentive to schedule tough, nonconference games. As we said throughout this process, we are open to considering any format ideas that come from our colleagues or the CFP staff, but to be clear, formats that increase the discretion and role of the CFP Selection Committee will have a difficult time getting support from the Big Ten.” (link) + Petitti also disagrees with those who contend that his preferred CFP model de-emphasizes the importance of non-conference games: “At the end of the day, you are still playing for seeding and straight seeding. If you had a system where you are qualifying off your conference record, winning or losing a tough nonconference game could affect seeding. Plus, the models we're talking about, there's still some at-large picks left. I think we’ve got to focus on the right incentive. You're starting to see games being dropped. I think there's a running concern among coaches, and you'll hear from our guys, whether they cover this or not, is does winning a big nonconference game help you more than losing a nonconference game hurts you? That's the sentiment. What's the right way to measure that? Also, a lot of these games tend to be played early in the season. You don't quite know who your team is at that point. Teams move up and down across the season. Some teams are unhealthy or unlucky. It really depends. I focus more on let's create an incentive to schedule more of them naturally. I don't think we need rules to do it.” (link) + In regards to ongoing discussions about the CSC’s guidance on ensuring NIL deals have a “valid business purpose,” Petitti remarks: “I don't think it's unpredictable, but there will be some moments like this where whether it's guidance or interpretation of rules, there's some discrepancy, but I think what's happened over the last few days, based on talking to our general counsel and others, that they're working together to try to get to the right resolution on this and then to move forward. I don't think it will be the last time that there's some issue that comes up in the process. Again, I think people have to be patient when it comes to the CSC. The settlement, frankly, came later than we expected in terms of its approval. We're grateful that Judge Wilken chose to approve it, but it did compress the time period.” (link) + Petitti also confirms he sent a letter to the NCAA in relation to the sign-stealing controversy involving former Michigan staffer Conor Stalions but declines to comment on the letter’s contents. “Because it's an ongoing process, I don't think it's appropriate for me to comment about whether it's enough or not while there are individuals deliberating. I don't think that's the right thing to do in the process. … This is a system we have now. It's been in place for a long time. It functions the way it was built, but I do think there's this consensus among our colleagues that whatever we are building for the enforcement piece that's going to live inside the CSC, that's got to be still there. It's difficult to still be talking about this almost two seasons after. I think everybody agrees that part of the process should change.” (link)

ACC Media Day…
+ ACC Commissioner Jim Phillips comments on some financial changes the league has made following recent settlements with Florida State and Clemson. “The settlement provides long-term stability for the league with the potential for all members to benefit from additional revenue opportunities. Leading in the distribution of revenue based on success and now with an additional revenue district distribution model that is based on viewership, the ACC has been innovative in its approach to conference revenues. As part of the modernization of college athletics, these new models allow us to maintain distributions for all ACC members that are above most other conferences while also providing flexibility for competition at the highest level of revenue. […] We had the highest gross revenue ever reported for the league at over $711 million. Over the last five years, our overall revenue is up 56%, and has more than tripled in the last 13. We delivered an average of $45 million to each school, also a league record. Once again, we are in the top three in both overall revenues generated and per school distribution, and we fully expect that to continue as we look ahead.” (link) + Regarding possible NCAA Tournament expansion and its potential as a "bargaining chip” to be utilized with other leagues relating to the College Football Playoff and other issues, SBJ’s Ben Portnoy reports Phillips “said the league's men's basketball coaches are more open to expansion, the women's coaches are less supportive.” Phillips continues on to say that “basketball is the crown jewel of all of our championships. … The CFP certainly is really important, draws an awful lot and ends up being a financial engine for all of us, but I think the country really enjoys March like nothing else, so we have a responsibility and obligation to protect it. … I always like additional access for teams and schools when it’s the right time and when it’s the right tournament and format.” (link) + On the CFP format: “We all recognize the importance of coming together to find a solution that is truly best for all of college football. Fairness and access are paramount, just as they are in all other college sports postseasons.” Phillips also stated he is open to a 5+9 or 5+11 model. (link) + Also of note: “Phillips announces player availability reports will be required in football, men's and women's basketball and baseball in conference games. In football, reports will be issued two days before games, with updates one day before and game day.” (link) + Phillips talking student-athlete employment: “One of the major facets that we're looking at in the SCORE Act is this reaffirmation that these are student athletes, that these aren't employees, along with a national standard & legal protection from the onslaught of lawsuits. […] I haven't had one student-athlete come up to me and say they want to be an employee.” (link) + On moving forward with the College Sports Commission: “When I said earlier with the emphasis on restraint, I meant it. We can't help ourselves sometimes. People know what the rules are relative to $20.5M. They know what legitimate NIL is. You can play in that gray area if you want, but all that does is undermine a new structure. I really like where we're going. It's not going to be perfect. It shouldn't be expected to be perfect. … Just so you know a little bit about NIL Go, who's registered, let me give you these numbers. Student-athletes: 15,519. Reps and agents: 1,970. Average daily logins: about 600 student-athletes a day are getting on NIL Go. Approved deals, I don't have that number. Anyway, so it’s moving. … We fought hard for the things I just mentioned, and we'd be well-served to just kind of relax and let this thing settle in.” (link) + On the matter of field/court storming, WDRB’s Eric Crawford mentions: “ACC to implement a fine structure of $50K (first offense), $100K and $200K for court and field storming. … Haven’t yet seen this actual rule, but sounds like there will be a vehicle to still allow this, but only after visiting team has exited the field or court.” (link) + On conference scheduling: “If the SEC ends up going to nine (conference games), maybe we end up going to nine.” (link)

The Wall Street Journal’s Rachel Bachman and Laine Higgins tackle what they call “the billion-dollar question looming over college sports.” Do collectives count as businesses? With a battle currently raging over whether booster collectives can still raise money from fans and steer those funds to student-athletes in exchange for promotional or charity work, the author questions whether boosters will actually go along with recent College Sports Commission guidance effectively denying collective NIL deals. Iowa-focused Swarm Collective CEO Brad Heinrichs: “One thing I know about people who are wealthy is that they’re going to do what they want. Telling a wealthy person who owns a business that they can’t pay a student-athlete $25,000 for advertising because some other third party tells him that he’s overpaying and the student-athlete is only worth $10,000, you know, that just doesn’t feel appropriate to me, personally.” With institutions now able to share revenue with student-athletes up to $20.5M per school, and no collective bargaining agreement in place, Bachman and Higgins note it’s likely that unless they play football or basketball, most won’t see any of that money. Over recent years, it’s been collectives helping pay student-athletes from non-revenue sports, but the new rules seemingly threaten that tenuous arrangement. Labor economist Andy Schwarz argues that “it’s pretty much anti-American. The question comes down to: Is it reasonable to say it’s OK for an athlete to get paid $1 million by his school, but it’s not OK for a group of community leaders to supplement that income?” (link)

Dollars and Cents… + Penn launches The Penn Wrestling Lasting Legacy of Excellence Campaign initiative to raise $34M, while also announcing a landmark $20M gift from former University Trustee and wrestling/football student-athlete Dave Pottruck. The centerpiece of the new initiative is a planned 13K sq-ft. renovation to Weightman Hall Gymnasium that will be named the Pottruck-Reina Wrestling Center and include state-of-the-art training facilities and modern locker rooms. (link) + UNC Wilmington and its Seahawk Club raised a record $8.05M during FY25 from a combination of annual fund gifts, multi-year major gift commitments, event revenue and planned club giving, more than doubling its previous record of $4.02M set the previous fiscal year. (link) + UNC Asheville highlights a record $3.5M in annual giving during the 2024-25 academic year from just over 2K total gifts, noting that the amount only includes cash gifts, surpasses last year’s fundraising total by nearly $1.2M and marks the first time the department has exceeded the $3M threshold. The sport-specific giving total also increased with the University’s 16 teams reaping a total of almost $620K, nearly doubling the amount received back in 2022-23.
