Two U.S. House of Representatives committees voted to advance the SCORE Act, making it the “most comprehensive measure connected to the industry set to reach the chamber’s floor in decades,” according to USA Today’s Steve Berkowitz, who reports: “After considering nearly a dozen amendments, the Energy and Commerce Committee ultimately voted 30-23 to send the bill to the House floor. It was a straight party line vote in which one vote was not recorded. The Education and Workforce Committee also signed off on the bill later in the afternoon by a margin of 18-17. Barring last-minute intervention from another committee, the bill could receive a vote in September, perhaps within the first two weeks after the House is scheduled to return Sept. 2 from a summer recess that is expected to begin at the close of business July 23.” Senate approval, however, remains unlikely, as Congressman Frank Pallone (D-NJ) notes that Senator Cory Booker (D-NJ) will “never support this.” He adds that if it passes the House “it’s dead” in the Senate where it would need 60 votes to avoid a filibuster. Berkowitz notes that a number of changes were made during today’s markup session, including a requirement that the NCAA, and potentially the College Sports Commission, “establish a council to serve as the primary deliberative body” that is “composed of individuals who represent each conference that is a member” of the association. Berkowitz also provides a rundown of the amendments that were rejected or withdrawn, including those seeking to strip out antitrust language and compel universities to reimburse service academies in the event student-athletes transfer. As the SCORE Act also goes through two House committees, Yahoo’s Ross Dellenger reports that a second and very different bill is being introduced by two House Democrats, one that would “affirm and expand college athletes’ rights to organize, form unions and collectively bargain with their universities and/or conferences.” Both bills face major political obstacles, and while this one is a longshot, it “serves as a reminder of what could transpire in the future as the college sports industry barrels toward a more professionalized model” after the House settlement. Dellenger has more details on opposition to the SCORE Act, with Washington Sen. Maria Cantwell calling it “a power grab by the two biggest conferences that will leave athletes, coaches and small and mid-sized institutions behind.” (link)

The attorneys general from Tennessee, Washington, D.C., New York, Florida and Ohio have sent a letter to the chairs and ranking members of the House Education and Workforce, Judiciary, and Energy and Commerce committees detailing their opposition to the SCORE Act. They write, in part: “Simply put, the SCORE Act consolidates too much power in the hands of the NCAA. The NCAA is a cartel that has consistently abused its monopolistic control even in the absence of a legislative blank check to do so. The Founders of our great nation recognized that the concentration of power inevitably corrupts and that only a system constrained by checks and balances and accountable to the people can endure over time. By eliminating any serious checks on NCAA authority, we expect the SCORE Act will ultimately deliver arbitrary and unaccountable enforcement by an NCAA fully empowered to be more overbearing than it has ever been before. … In addition to statutorily blessing the NCAA’s monopolistic abuses and anticompetitive behavior, the SCORE Act would federalize the NCAA’s private, non-transparent rulemaking process, giving legal imprimatur to rules drafted in the shadows by stakeholders whose primary interest is preserving control. This would freeze in place a governance structure that does not work; it has historically produced irrational policies such as the nutrition restrictions that left college athletes starving and a notoriously ticky-tack enforcement regime. Worse, the NCAA could continue modifying these rules behind closed doors, now backed by federal preemption and beyond the reach of state reform or meaningful judicial review. The Act would subject student-athletes, schools, and even state legislatures to a rigid, top-down framework administered by an unaccountable private cartel.” Full letter. (link)

Pacific AD Adam Tschuor called out the NCAA and Charlie Baker on X, writing that a legal resolution over how the College Sports Commission handles collectives makes the House settlement “a false bill of sale.” Tschuor wrote that Baker and NCAA Senior VP Tim Buckley “both sold us and every member institution of the 28 ‘other’ conferences on the House settlement and its parameters and then changed the game … once again. If we can just up and change wholesale parameters of this settlement, I do not see any reason why we should be on the hook for a dime of the settlement damages … the terms changed without any consultation (not like any of us had any to begin with) so to[o] should our obligations.” (link)

Settlement Within A Settlement…
+ House plaintiffs attorneys and NCAA and Power conference officials have reached an agreement to allow NIL collective deals to be treated in a similar fashion as other third-party deals, per Yahoo’s Ross Dellenger, who adds: “The resolution creates what administrators term more of a ‘soft cap’ as opposed to a hard cap, as SEC commissioner Greg Sankey described it last week in an interview with Yahoo Sports. The expectation is that collectives will create legal ways to provide additional compensation, as Big Ten commissioner Tony Petitti described Monday in an interview with Yahoo Sports. […] The change also, at least for now, prevents a legal challenge from leaders of a group of NIL collectives who began drafting a lawsuit against the CSC’s approach.” More: “The resolution may not completely end what will likely be continuous negotiations over particular enforcement rules between the power leagues controlling the CSC and the House plaintiff attorneys, who hold authority and veto powers over various aspects of the settlement. […] The guidance change may also not prevent future legal challenges over other enforcement aspects, including Deloitte’s compensation range concept or the appeals arbitration system that athletes can use for deals denied a second time.” (link)
+ The Athletic trio of Justin Williams, Stewart Mandel and Ralph Russo add that “the deal reached Tuesday avoids going to the magistrate. Instead, a clarification of the guidance is expected to be handed down by the CSC that clarifies collectives can offer goods and services for profit in the form of NIL payments, and they can send those deals through the clearinghouse for approval. … The collectives’ deals, as with all third-party businesses, will still be subject to a ‘range of compensation’ limit that will be evaluated through a service run by the accounting firm Deloitte.” (link)
+ Headlining attorney Tom Mars, who is representing collectives in a potential legal challenge against the CSC: “I'm glad to see the CSC decided to retract its guidance about collectives. The last thing college sports needed at this moment was a bare-knuckle, legal brawl between 70 collectives and the power league commissioners.” (link)
+ Meanwhile, Sports Illustrated’s Pat Forde writes on X: “Not so fast, my friend? Per CSC spokesperson, conversations between the CSC/defendant conferences and class counsel ‘remain ongoing. A formal statement will be issued when the issue has been resolved.’” (link)

Sun Belt Commissioner Keith Gill in his State of the Conference address to kick off SBC Football Media Days highlighted the league’s growth. Specifically, the Sun Belt led the FBS with 12 bowl teams at the end of the 2023 season and, in each of the past three seasons, has had the most bowl-eligible teams among its peer conferences. Additionally, the Sun Belt holds 11 victories over autonomy conference foes over the last three years. Gill noted the major factors in the Sun Belt’s rise in football have been the increased emphasis and financial support from the league’s 14 members and the growth of the league’s agreement with its television partner ESPN. “To get to this place, time, energy and investments were required. Our members’ athletic budgets have on average tripled since the Sun Belt became a football conference. Assisting in these investments, conference revenue has grown by over 900% during this period and 65% over the last decade. And revenue from television has increased by a factor of 50 since the start of Sun Belt football.” (link)

Conference USA Commissioner Judy MacLeod covered several topics to kick off the league’s football media day, including current and future realignment, noting that “I do believe the FCS schools that we have brought in to transition have had a lot of success. I’m obviously biased, but I feel like we’ve made a lot of great choices. We have programs that have histories of success. A lot of times it’s a lot easier when you have a program that’s had success at other levels to transition that success forward, but our staff has done a great job with the administrations of each school and really tried to help them. Help them understand what that step is. I don’t know if that’s something we want to be known for – of transitioning schools, but we have had success and we’re excited with the new two that are coming aboard as well. As far as the future, we have membership on our board agenda every time we meet. We have a membership committee. It’s active. It’s always looking at different data and doing it for research about what may happen. We are really excited about the 10 we have moving forward. Unfortunately, I can’t predict things. I don’t think anything is going to happen in the time I’m sitting here, but you never know. I put my phone on silent so I wouldn’t get interrupted. You never want to walk out and get surprised, but I do feel very good about our core schools and continuing to grow.” (link); More from MacLeod. (link, link)

Southern Conference Commissioner Michael Cross joins SoCon Assoc. Commissioner for Brand Strategy and Broadcast Dave Friedman and talks about the FCS rankings and notes that three years ago the preseason poll was 68% correct when compared to the end-of-season poll. Over the past two seasons, that has dropped to 52% and 36%, respectively, and Cross submits that “it’s difficult to move down. There’s a bias that comes into the equation right out of the gate, and if you started high there’s a reluctance on the part of voters to move people down after demonstrable losses or multiple losses. And there’s an anchoring bias that I think is very real there. And the ability to claw your way up those polls is even more difficult, and the statistics bear that out. We put that into artificial intelligence and it gave us all kinds of information related to what is actually happening with the polls. The polls aren’t official factors in the NCAA selection, but there aren’t a lot of data points within the ecosystem that we’re in where people are tracking what’s happening with FCS football. So you get some regional biases. There’s certainly a historical bias. … And there’s been a lagging recognition, if at all, about conference strength if people have moved from conference to conference or left FCS football entirely and gone to the FBS level. So all of those factors start to affect the decision- making process.” Full Q&A. (link)

SWAC Commissioner Charles McClelland answered several questions during the league’s football media day, including the rollout of SWAC TV, a free, high-definition video service set to officially launch August 1 on Roku and Apple devices. “We’re going to deliver 45 football games, and we’re going to have some Olympic sports as well. So, all championships, but what it does is it puts every football game that we play on some form of television. We kind of followed the model of the SEC and the Sun Belt. We kind of stole some of their ideas and technology. … Also, we think from a revenue standpoint it’s going to set us aside from everyone else.” With all 12 SWAC schools opting into revenue-sharing, McClelland notes that “adding sports, at this point, I don’t think is going to be at the forefront. But one thing that I can happily say here [is] none of our institutions to this date have decided to cut sports. There have been others, even at the highest level. With all of this change our institutions are dedicated to the 18 sports we currently offer. I think it’s going to be difficult to get a 19th sport added as a conference sport, but each individual institution will make that determination.” (link)

The USOPC has “effectively barred transgender women from competing in women's sports, telling the federations overseeing swimming, athletics and other sports it has an ‘obligation to comply’ with an executive order previously issued by President Donald Trump,” according to the AP. ACC Supervisor of Officials Al Riveron says the league will increase its level of transparency on official video reviews this football season: “The ACC is the only league in the country this year where you’re going to have not only whoever’s doing the game the audio and the video to see what’s going on and a look into the command center, which we had last year. We’re going to go one step further. Last year we provided the network analyst…the audio. They could hear us in Charlotte having a conversation with the referee and the replay official. This year they’re going to see the video too. … So, this year, all bets are off, the curtain is pulled back 100%. What are we trying to accomplish there? Transparency number one. We’re going to show you how we get to that final ruling, for lack of a better term. All we want you to see is they did their due diligence. And then we go back and apply the rule correctly." (link)

SBJ’s Bret McCormick: “After being processed, Leiweke…was then released on an unsecured $1M bond. His travel is restricted to the continental U.S., with any overseas travel requiring prior court approval.
