USA Today’s Steve Berkowitz reports that one “appeal of the ruling to approve the settlement of the House-NCAA cases has been voluntarily dismissed. This one likely would have been connected to how [the] College Football Playoff is connected to settlement. A motion by plaintiffs' lawyers to consolidate the 6 remaining appeals is pending.” (link)

The Rutgers Board of Governors is set to approve a five-year contract for LSU Executive Deputy AD/COO Keli Zinn on Wednesday to become the highest-paid AD in school history, per NJ Advance Media’s Steve Politi and Brian Fonseca. While it’s unclear what the incentive structure will be or if there is a buyout clause or any retention bonuses included as part of the deal, Zinn is set to make a base salary of $1.35M, which can be boosted through the athletic department achieving any of multiple included incentives. According to Politi and Fonseca, that base total “lags behind a majority of her Big Ten colleagues, particularly those who joined the league during this offseason,” including Maryland’s Jim Smith ($1.5M) and Michigan State’s J Batt ($1.85M). College Football Playoff Executive Director Rich Clark tells ESPN West Palm’s Theo Dorsey there are pros and cons to expanding the CFP. “Twelve works great and there’s no question that could be good, but 16 gives us more access. You get more teams in, and you never know when you get that team that strikes lightning in a bottle and they get that 16th seed, you never know. We love an underdog. We love somebody that comes in from the outside and makes it big. Fourteen might be the happy medium, so it’s hard to know. The commissioners are going through that right now though, and we’re having some pretty intense discussions about it, but they’re working through it and working together on it. Now, the other part I’ve got to bring up, there’s the automatic-qualifier format or the ranked-seeding format. Both of those have pros and cons. There’s a certainty when you have the automatic qualifiers. You know how many teams from a given conference are going to get in…but the straight ranking versus ranking-to-seeding, that gives you, I think, a little bit less certainty. But it rewards performance throughout the season rather than predetermining it before the season. You’re rewarding people during the season, and in the end, you get the best teams in. Both have merits.” Dorsey asks whether CFP leaders have discussed ranking the conferences each season, and Clark confirms it has been considered, “but there’s some drawbacks to that too. And one of the big ones is how do you rank the conferences? Do you rank them based on previous year’s performance? Do you rank them based on an accumulation of what they’ve done? How do you bake all that in? So when we talked about that, we got so wrapped around the axle on how do you actually rank the conferences that I think people kind of moved away from that.” Clark also comments on the access the CFP provides to service academies and notes that, as a former Air Force student-athlete, “even if we had played one round, that would’ve been historic. And you’ve got hope. You have a chance to go all the way. That’s what people want. America loves an underdog.” (link)

North Texas is reportedly less than $1M from reaching its $12M fundraising goal in an effort to expand its athletic center, according to the Denton Record-Chronicle’s Brett Vito. UNT has targeted the fall for achieving its objective ahead of going to its Board of Regents in November for approval of the project. AD Jared Mosley: “We still have a number of asks out there. The likelihood of us being able to get to the finish line is really, really good.” UNT is hoping to break ground on the project in spring 2025 with expansion set to occur in two phases. Per Vito, Mosley has mentioned that he would like to see baseball return to campus and that the first phase of athletic center expansion would be a “key step” toward that goal. Mosley: “We don’t have sufficient facilities in sports medicine, strength and conditioning or academic support. I have shared with the baseball group, both phase one and phase two are critical. We’ve got to have the infrastructure if we’re going to add programs. That’s important to keep in mind when you look at the significance of getting this project to the finish line. … We’ve had a handful of donors toward the AC expansion project that our first time to engage them was less than 24 months ago. We’re having seven-figure givers who are moving in with their first commitment to North Texas athletics.” According to Vito, the speed of phase one expansion fundraising has the school hoping it can soon move on to raising money for phase two. Omaha AD Adrian Dowell tells KETV’s Matt Sottile that strategic plans used to look upwards of 10 years into the future, but “that’s impossible in this landscape and the reality is even up to last week, especially with the impacts of the settlement, things are changing in real time. So, you have to have a plan, and yes, this is a three-year plan (to initially opt out of the House settlement while monitoring the landscape), but more importantly you have to be willing to pivot once more information becomes available to you and adjust quickly. The end goal – certainly we are educating our student-athletes and putting them in position to compete for championships, which they've been really successful at, but the way we get there is certainly having a strategy in place, staying up to date on what’s going on in the landscape and being ready and willing to pivot when necessary.” Dowell goes on to note that a “lot of the dust still needs to settle” with the settlement. “Even as of last week, rules surrounding NIL and translations, these are changing in real time, and these things will potentially impact our decision to opt in. And like I said, it’s not if, it’s just when. But more importantly, when we do, we want this integration to be efficient. But make no mistake about it, we’re going to do whatever we need to do to position these coaches and these student-athletes to be competitively successful resource-wise.” Full interview. (link)

Central Michigan has received a Notice of Allegations (NOA) from the NCAA as part of the Michigan/Connor Stalions sign-stealing investigation, according to the Detroit Free Press’ Tony Garcia. This development comes after Stalions was allegedly able to sneak onto the CMU sidelines in disguise for the Chippewas season-opening road match-up against Michigan State at Spartan Stadium back in August 2023. According to the NCAA’s Division I Infractions Dashboard, Central Michigan was served the NOA back on June 27, meaning the school has 90 days from that date to provide a formal response, which would be on or before Sept. 25. Per Garcia, a Tuesday e-mail requesting comment on the NOA was not immediately returned. (link)

According to Big West Commissioner Dan Butterly, the NCAA “has not conducted various DI governance meetings this month, as the NCAA Board of Directors will act upon the proposed new governance structure next week and NCAA staff has delayed various governance meetings until that action is taken. Unfortunately, if the new governance structure is approved, many conferences will not be ‘in the room where it happens.’ Those conferences not named to either the new DI Board of Directors or DI Administrative Committee will need to get their information from abbreviated NCAA updates or media reports after meetings. I have been vocal on this governance overhaul throughout the summer and will continue to be vocal in the time leading up to the vote. Representation is vital to protect the experience of student-athletes in The Big West, and to best inform our member institutions first-hand on what is happening in DI and how it may impact them. We have received a glimpse this summer of how future governance may work with the CFP-4 having 65% weighted voting and the NCAA handing many responsibilities to those four conferences. In summary, my earlier positions have not changed.” (link)

ACC Commissioner Jim Phillips Q&As with SB Nation’s Mitchell Northam and says the roster size component of the House settlement “will only provide more opportunities and provide more funding for our student-athletes in our Olympic sports. The rev share and the NIL piece of this thing, I don’t think anybody knows just yet. But what I would say, for our conference, I know that our schools are committed to continuing to support broad-based programming at an incredibly high level. This conference, for 73 years, has been a leader when it comes to opportunities for women and Title IX and broad-based programming. We have 15 women’s sports and 13 male sports. So, I think early signs are, with these changes and the roster limits and scholarships and some of those things, as well as some revenue now directly benefiting student athletes, we’ll be in a good place.” Phillips also comments on the NCAA championships media rights deal with ESPN and whether women’s basketball is valued appropriately within it: “I don’t think there’s ever a TV deal that you have, that you don’t go back and wish maybe you had a little bit more. I would think that as we watch what happens in the next couple years that [NCAA President] Charlie [Baker] would, you know, likely reengage with ESPN.” While the NCAA has made strides in directing more funding to women’s hoops, Phillips acknowledges that “we still have a ways to go, and we don’t want to just be complacent about it, or say that there’s not more work to be done, because there is.” (link)

More from The Athletic’s Scott Dochterman who digs into how Big Ten Commissioner Tony Petitti successfully secured support for the “4-4-2-2-1” College Football Playoff model within the league as Dochterman notes that ADs likely support Petitti’s plan because it increases late-season game value, which in turn boosts attendance. Illinois AD Josh Whitman: “It allows us, in an environment where, potentially, everybody’s not playing the same number of conference games, to make our conference games the determining factor in terms of how you access the postseason. It allows us to play more meaningful football games with more schools deep into November.“ With the ACC and Big 12 publicly backing a 5+11 model, a looming Dec. 1 deadline for the Big Ten and SEC to agree upon a CFP format to take effect in 2026 and the SEC lukewarm on Petitti’s plan, he remains committed. Petitti: “Your obligation is to give fans things that are meaningful. They care about the tradition of it and all that. But we’re also trying to get the next generation of fans to connect and have those moments, those opportunities. I think the players deserve it.” (link)

Pittsburgh AD Allen Greene tells Pitt Magazine that he believes Pitt is positioned to seize the opportunity provided by the industry’s new landscape, adding: “We must be both bold and strategic. We must double down on what makes Pitt special – world-class academics, a proud community and a tradition of grit and excellence. But it also means making smart investments: in our people, our infrastructure and in services that help student-athletes thrive. We also need to be future-focused. That includes enhancing our philanthropic efforts, growing revenues in innovative ways and aligning with corporate partners. Proudly, we’ve always punched above our weight class, and we are building this department to last all twelve rounds.” That said, Greene notes that “real NIL impacts only about 1% of our overall student-athlete population, concentrated in football and men’s basketball. We recognize that NIL quickly turned into the pay-for-play model that we’re experiencing today, which impacts additional student-athletes across those sports and more. But what hasn’t changed is that 100% of our student-athletes should be focused on their holistic development, and we have an obligation to accompany them on their journey.” (link)

Southern Illinois AD Tim Leonard and SIU Edwardsville AD Andrew Gavin join SIU System President Dan Mahony to discuss how they’re navigating the evolving ecosystem of college athletics, and Gavin explains the roster limit component was “not a significant factor in whether or not we were going to ultimately opt in or opt out” as an institution that doesn’t play football and doesn’t carry “significant rosters among our sports in general.” Leonard explains the decision to opt in was due to a desire to be “proactive, not reactive. Whether we like it or not, this is where college athletics is headed, and we’re committed to being a Division I athletics department. But most importantly, we’re committed to being a very competitive Division I athletics department. So we just felt like this is where it’s going. By opting in I think it’s easier to move forward in the new world with all the new rules and policies that’ll be put in place. So I think it’s going to be a smoother transition for us, not that any of this is smooth. … In the end this is about building a model for the future…and we just felt like opting in gave us that best opportunity.” Full conversation. A federal court in North Carolina has granted the plaintiffs' motion to certify an injunctive and damages class of Division I tennis players in Brantmeier v. NCAA, per Boise State assistant professor Sam Ehrlich. For us non-lawyers, Venable LLP Partner Philip Sheng explains the “judge in Reese Brantmeier’s lawsuit challenging the NCAA’s prize money rules has officially been certified as a class action.” Ehrlich notes that “this is a fascinating case – and one that threatens to take another brick out of the NCAA's amateurism definitions and eligibility systems. One to watch as it moves towards a potential trial.” (link, link)

A New Jersey federal district court has granted Seton Hall's motion for summary judgment against former basketball players Myles Powell and Jasmine Smith, dismissing their tort claims against the university. Boise State assistant professor Sam Ehrlich: “Both Powell and Smith had claimed that the university misdiagnosed serious injuries, allowing them to play on and aggravate them. Powell says he was told to play on a torn meniscus, tanking his NBA draft stock. Smith says her misdiagnosed knee damage ended her career. … The court found that the trainers satisfied their duty of care, which was only to refer the players to doctors for diagnosis and defer to those opinions.” (link); Full opinion. Now that the Skydance-Paramount deal is being finalized, CBS will likely invest in sports even further, per The Athletic’s Andrew Marchand, who notes: “CBS Sports, they’ve been a player, but they've kind of been somebody you look at who maintains. SBJ shares several takeaways from the SBJ Ticketing Roundtable discussion earlier this summer. Panelists included StubHub Head of Partnerships and Business Development Adam Budelli, New York Mets SVP of Ticketing and Premium Experience Jake Bye, SeatGeek Co-Founder/President of Supply Russ D’Souza, Kraft Analytics Group CEO Jessica Gelman, Comcast Spectacor Chief Revenue and Business Officer Todd Glickman, BSE Global EVP for Ticketing Paul Kavanaugh, Harris Blitzer Sports & Entertainment EVP for Ticketing and Premium Hospitality Brian Norman, Eventellect Co-Founder Patrick Ryan, New York City FC CEO Brad Sims and NBA EVP for Team Marketing and Business Operations Jonathan Tillman. Some highlights: Norman says of the biggest areas of opportunity in live sports ticketing that the conversation has shifted from how to get data on the fans who come to venues to “taking that data, and [asking]: ‘How are we speaking to our fans and our audiences in a more creative, personalized and tailored way?’ It’s a lot different from what we were doing even three, four or five years ago, pre-pandemic. At this point, we’re really looking at how we personalize that experience, and also then figuring out the right product fit. With the quantity of products and the vast amount of experiences we can provide, leveraging the data profiles we’ve built over the years with our friends at KAGR into a more modern outreach perspective, based on AI and automation, is something we’re spending a lot of time on.” Tillman adds: “The live-game sports product has never been better. It’s fed this insatiable demand for sports. The big question for all of us is: How do we sustain and keep this momentum going? Especially as we look at the changes we have in our consumer base, and the diversity of fans that require all these unique touch points.” (link)
