On the heels of the massive PGA Tour-LIV Golf merger announcement that would end litigation between the two and combine their commercial businesses and rights into a new, yet-to-be-named for-profit company, NBC anchor/play-by-play announcer Tirico says of future opportunities: “How do we not know the next step down the road isn't NIL and the SEC?” USA Today’s Wolken responds: “Maybe I’m wrong but I have a hard time seeing why this would interest the Saudis. Golf opens doors to multinational corporations with immense wealth, which is their wheelhouse. College sports just plays in a different space.” PGA Tour Commissioner Monahan: “There is much work to do to get us from a framework agreement to a definitive agreement, but one thing is obvious: through this transformational agreement and with PIF’s (Saudi Arabia Public Investment Fund) collaborative investment, the immeasurable strength of the PGA Tour’s history, legacy and pro-competitive model not only remains intact, but is supercharged for the future.” While terms of the deal were not disclosed, CNBC’s Faber reports the PIF is prepared to invest billions of dollars in new capital into the new entity. Speaking of mergers, the Atlantic Hockey Association and College Hockey America will merge operations beginning with the 2024-25 college hockey season. Commissioner Morgan explains: “Merging our two leagues gives us the opportunity to streamline our operations and build an enhanced brand in men’s and women’s ice hockey as a unified conference. Joining forces under one name provides a strong foundation for both leagues as we build a new experience for our current and future men’s and women’s student-athletes, coaches and fans.” The conferences will operate separately for the 2023-24 season. Realignment Rumblings…
+ The Colorado Board of Regents will meet in executive session today to discuss “legal advice” on an athletics matter as well as a “personnel matter at CU System.” (link)
+ In dissecting the Big 12’s pursuit of Gonzaga, CBS’ Dodd points out that Navigate pegs the Zags as fifth in its “TV power” metric, behind only Duke, Kentucky, North Carolina and Kansas, and ahead of Ohio State, Michigan, Michigan State, Arkansas and Tennessee. Connecticut, also rumored as a potential Big 12 target, is 38th on the list. Dodd notes that “Gonzaga has received a $15M annual valuation, per one industry source, should it join a Power Five conference for basketball,” and “sources tell CBS Sports that the money, at least for Gonzaga, would more than likely come from within the league. Schools might sacrifice some of their existing share to entice the Zags and/or Huskies. Plus, the Big 12 continues to sit on the $100M combined buyout it got from Texas and Oklahoma.” If men’s hoops accounts for 15-20% of a media rights deal’s value, each Big 12 member would have to forgo $1.25M for the Zags to reach that $15M valuation. Sportico’s McCann unpacks the defense laid out by the NCAA, Pac-12 and USC in a response to an NLRB complaint regarding the classification of college athletes as student-athletes rather than employees. The three argue that the NLRB should decline to exercise jurisdiction “because there have been no changed circumstances in the law sufficient to warrant the Board’s departure from its decision in Northwestern University.” Whether that assessment holds up, McCann says, is uncertain, as the “NLRB could find that state NIL statutes and the Supreme Court’s 2021 decision in NCAA v. Alston suggest the legal circumstances have changed.” Furthermore, McCann points out the NCAA, Pac-12 and USC argue that “employment recognition would “place the [NLRA] at odds with other existing” statutes, laws and policies, including Title IX, federal immigration laws, the federal tax code, state workers compensation laws and the Fair Labor Standards Act (FLSA). … This defense is vulnerable to a critique by a three-judge panel in a recent hearing at the U.S. Court of Appeals for the Third Circuit for Johnson v. NCAA. The panel suggested that if the NCAA feels it must violate Title IX to comply with the FLSA, or vice-versa, the NCAA should devise a system of rules that enables it to comply with all laws, all the time.” Lots more from McCann. Nieblas will oversee the Business Office and Human Resources staff in addition to serving on the Athletics' senior management team. She will also assist the Director of Athletics with the overall development and implementation of Athletics' central business operations, including operating budget, long-range capital and operations strategic planning, and human resources. + Florida A&M President Robinson and the FAMU Board of Trustees will vote on recommended name changes involving the Rattlers’ football and softball stadiums. If approved, the football field would be named in honor of NFL Hall of Famer and former Rattlers Football HC/AD Riley, and the softball stadium would be rechristened in honor of former HC Wiggins. Rattlers AD Sykes: “If approved, Rattlers will drive on Bob Hayes Lane, take their seats in Bragg Memorial Stadium and watch championship football on Ken Riley Field. Oklahoma QB Booty tells On3 during the INFLCR NIL Summit that OU players have been talking about what is a fair rate of compensation for EA Sports’ upcoming college football video game. “We’ve all talked about it because we want the game to come out, obviously. But we were saying if they come out and try to lowball and say we want to give everyone $200. Well, guys maybe like, like you mentioned Caleb Williams, may say no and then he’s not in the game. Then all the USC fans – who wants to buy the game and not play with him, you know? And then he does it, then someone else does it and then it’s a domino effect and then it’s ruined. So, I think that’s going to be very critical to how they put it together. They are going to have to have one price, and I say like $600 to $800 would get everyone in. But some of the big guys, you know, that deserve it, that have been playing, starting for a couple of years, put up the numbers, they may have to sit down and negotiate with them because that’s going to ruin the game if they don’t have some of these star guys in there.” Kansas QB Daniels and Stanford CB Williams both say they could see a mass holdout, and Booty believes $600 to $800 would get everyone in. Jayhawks RB Neal pegs the number at $500. There is agreement among the players, though, that they ultimately do want the game to come out, which EA could use as leverage when negotiating payouts. LONE STAR NIL, LLC announces its official launch as a first-of-its-kind NIL program established exclusively for Texas-based collegiate student-athletes enrolled at in-state universities and colleges. Former Southland Commissioner Burnett, who now serves as CEO of Southwest Sports Partners, which owns LONE STAR NIL: “While name, image and likeness opportunities have increased across the college sports landscape, most Texas student-athletes remain underserved by limited NIL options. We know many local students and parents want a better understanding of NIL, and at the same time, it’s clear that Texas businesses of all sizes could potentially benefit from getting more actively engaged in this exciting space. New Mexico and New Mexico State have exchanged game-day security and safety plans each has in place for upcoming basketball games. The Albuquerque Journal’s Grammer also notes UNM, as requested, sent NMSU its security plan for the football game between the two schools. “Barring any major problems or unforeseen circumstances, there would seemingly be nothing left in the way of the two schools eventually scheduling two men’s basketball games for this coming season – one at The Pit in Albuquerque, the other at the Pan American Center in Las Cruces.” (link)

LIU has agreed to keep its softball team in Brooklyn for two more years and build the program a field of its own. Some members of the team had filed a Title IX complaint accusing LIU of fraudulently misrepresenting that the program was to remain in Brooklyn and that a new softball complex would be completed. New York 4’s Cheng: “The female athletes committed to LIU Brooklyn because of its location; for the past four years they haven’t had a home field in Brooklyn, instead they have been traveling to Long Island to play home games.” Student-athlete Blanchard says the commute was negatively impacting their academic performance. “[It] was an hour there and sometimes 2-3 hours back because of Long Island traffic.” (link)

Manhattan over the course of four academic years improperly certified eligibility for 26 student-athletes across six sports, according to an agreement released by the Committee on Infractions. The NCAA also notes that “additional violations occurred in the softball program when a former assistant coach recruited prospects without completing a mandatory recruiting exam and later refused to cooperate with an investigation. Finally, because the head coach learned of the improper recruiting but did not address it, the head coach was found to have failed to set a proper tone of compliance.” Sports found to have committed infractions include baseball, softball, men's golf, men's track and field, men's basketball and men's soccer. Penalties include a suspension for the softball head coach from the first two nonconference home games of the 2024 season, a 16-day prohibition against all softball recruiting activities during the June/July 2023 contact period, and a five-year show-cause for the former assistant coach, among others.
