Utah State's AD search committee met last week to put together the pool of candidates the Aggies would like to interview, according to CollegeAD, which adds: “Sources say the committee recommended at least eight candidates move forward to interviews that got underway starting today. … Once this round is complete, the next steps would be inviting a smaller group to meet for in-person conversations. As we understand it, the pool consists of at least four sitting athletic directors, as well as Power 4 senior staffers.” (link)

Who owns the College Sports Commission? That’s the answer Grayson Law Firm Founder Clay Grayson seeks to find out, and he points to this passage from the CSC website’s terms of service: “All of the members of CSC are tax-exempt organizations under Section 501(c)(3) of the Internal Revenue Code, but CSC itself is not a tax-exempt organization. However, because of the tax-exempt status of its members, CSC will operate as a tax-exempt entity in furtherance of its member organizations’ exempt purposes.” Grayson explains: “That means this LLC is likely taxed as a partnership or a corporation. No matter what you might say, this LLC is for-profit. What other facts can we pull from this clue? We know the owners are ‘tax-exempt’ under section 501(c)(3). I’m going to postulate that our prime suspects are the power conferences’ nonprofit, tax-exempt, 501(c)(3) organizations — the ACC, Big Ten, Big 12, Pac-12 and the SEC. But why don’t they just say so on the site…or anywhere else online, for that matter? Maybe it’s not the P5? Who can know?” Grayson has other questions, such as: “Will the owners disclose the LLC’s tax return or expenditures, including payments to attorneys and staff? Heck, will the owners of the LLC disclose the identity of the owners of the LLC? As a for-profit, can the LLC engage in political speech? Would the owners sell interests in the LLC to others? Are CSC’s board minutes open to the public? How far can this for-profit joint venture regulate and interpret NCAA rules into an enforcement framework? Is there no transparent conflict of interest management in CSC? How can that be with an enforcement body?” Ultimately, Grayson concludes, for now, that it “seems to me NCAA enforcement has been privatized. I’ll leave it to you to consider what that means for the future. And if you have any leads on this mystery as to who owns the CSC, I’d be interested in talking.” (link)

Paciolan CRO Christian Lewis sat down with AthleticDirectorU’s Tai M. Brown to discuss new FTC rules, data advancements, COVID look-back & more. From a data standpoint, Lewis explains: “We have spent incredible amounts of time and resources to make sure that, one, we have the infrastructure in place to be able to capture all of that data [from individuals transferring tickets, for example], but more importantly, how do we act on it? Right? And that is where I would say the next wave of innovation has really taken place. So I'll use my ticket transfer example again. Alright. We now know you have two, two tickets to a game. You might be trying to transfer them to me. Maybe I saw the text come through and I was, I was busy doing something else. And I didn't hit the button or the link to say accept. You don't know whether I have or have not. But we know that because the data tells us what has or hasn't taken place. So instead of those two tickets kind of being stuck in limbo, and now I show up in an event thinking I had my tickets, but it's really stuck in a text message somewhere. … We now can look and see, you know what, let's look 24 hours before an event. Let's look 48 hours before an event. Let's identify every transfer that is pending that hasn't been accepted. And let's use that data point to actually take action.” Full interview on ADU. (link)

➤ ESPN has inked Pardon the Interruption hosts Tony Kornheiser and Michael Wilbon to new three-year contracts, and Puck’s John Ourand contextualizes the move: “Mike and Tony are, in their own way, needle-movers for the aging Gen Xers and older Millennials who came of age in the Patrick–Olbermann era. Even as ESPN changes – dispensing with second- and third-tier talent, capitalizing on internet-famous talent, and relying on a panoply of distribution deals – they are core to the proposition for what remains of the aging audience that fueled the network’s ascent.” ESPN President of Content Burke Magnus tells Ourand: “I look at them as the hosts of the original sports personality show. They’re still as relevant and as powerful as they’ve ever been. And, by the way, they also attract a very diverse audience. By no means are they weak in the young demographic. … There was never a moment when we weren’t completely committed to continuing PTI, frankly, for as long as they want to continue PTI.” (link)

College sports now account for 40% of ESPN’s total sports ad revenue, and “advertiser demand has soared across ESPN platforms,” according to SBJ’s Austin Karp. Disney Advertising SVP for Revenue and Yield Management, Sports and Entertainment Jim Minnich tells Karp: “We’re about 90%+ sold for the regular season and about 85% sold for CFP already. We’ve actually had folks come in and try to add money as well in certain pockets, certain windows. ... Football is really humming right now for us positively.” Minnich also notes there have been around 34 new advertisers for football season, up roughly 15% YoY, and says there are around five new categories, with toy stores and online currency/crypto among those returning strong. “Female-targeted brands have continued to come with high reach vehicles in college football.” For the most part, advertisers aren’t targeting specific windows, and Minnich explains: “They’re not just cherry-picking. They’re looking to honestly try and capture any of the storylines that are happening per day. You never know when a storyline hits, right? Who would’ve thought that Florida State would’ve dominated Alabama.” ESPN SVP of College Sports Programming and Acquisitions Nick Dawson says the company is investing more effort into Friday nights, “particularly with the ACC and Big 12,” adding: “[We] really felt like there was an opportunity as we start our new NBA deal. We don’t have Friday night windows in October/November with NBA on ESPN like we did in the past. So we felt like we could be way more consistent there from a college football perspective and really worked with the ACC and Big 12 at the beginning of their scheduling process to really embrace that with us.” (link)

While discussing last Saturday’s USF football victory over Florida on Yahoo Sports’ College Football Enquirer, Andy Staples, Ross Dellenger and Steven Godfrey briefly chatted about the USF AD opening. Godfrey: “[USF is] in the middle of an athletic director search that should be wrapped up this coming week. They’re trying to look for a new AD … almost certainly from outside of college sports, a business executive.” Staples: “Michael Kelly, their former AD, went to Navy from there, which I don’t know that people would consider [the move] a giant step up. It’s a tough job and you’ve got to get the stadium construction home. There’s a lot going on there.” Dellenger: “The young fundraiser archetype of AD would do very well to get that job in that place right now." (link)

Texas Tech Board of Regents chair Cody Campbell reacts to an SEC-sponsored ad that ran last weekend imploring Congress to pass the SCORE Act. Campbell: “The SEC ran this TV ad over the weekend that provides a link to a website. The ad and the website make many false claims, the most egregious being that the SCORE Act, in its current form, is supported by every D1 conference in America. This is NOT true. In fact, the large majority of conferences and their members (including many members of the Power 4) believe that the SCORE Act needs to be amended and modified so that women’s sports, Olympic sports, smaller schools, and the Student Athletes can be protected and represented in the final solution. Yes, the SCORE Act is a good start, and we are all grateful that DC is finally paying attention to the existential issues facing college sports, but we ALL need to come together (Big Schools, Small Schools, Women’s Sports, Olympic Sports AND the Student Athletes) to come up with a compromised and comprehensive solution that works for the betterment of the entire system - not just major college football. 500K student-athletes and hundreds of communities are depending on us! Deception and dishonesty, as displayed through this SEC ad, only drive a wedge between what we were hopeful was becoming a constructive and productive conversation. Let’s get this discussion back on track and work together to find the right solutions that will preserve the Great American Institution of College Athletics!!” (link)

Nike declined to match Adidas’ apparel offer to Penn State, according to the Centre Daily Times’ Jon Sauber, who notes the Nittany Lions’ linkup with Adidas marks the end of a relationship with the Swoosh that “had begun to sour.” Sauber adds: “The Nittany Lions, despite consistently competing for championships in several sports — and producing what has become a consistent top-10 program in football — did not feel like a priority to the company, according to multiple sources with knowledge of the situation. Penn State understood Oregon would be treated differently because Nike CEO and co-founder Phil Knight is an Oregon graduate whose family has donated billions to the school. But it was the preferential treatment of other programs within the Big Ten that became a much bigger issue. Multiple sources said Penn State felt it was beneath not just the Ducks, but also Ohio State and Michigan in the pecking order with Nike.” For example, Sauber reports that Penn State “requested to do multiple program-specific projects that Nike denied. Multiple sources said Penn State requested to wear the gold swoosh on their jerseys for the College Football Playoff semifinal against Notre Dame, much like Ohio State had, but it was denied. [...] Multiple sources also said the shoe giant hasn’t had any major representative on campus since Penn State made a change in athletic directors from Sandy Barbour to Pat Kraft in July 2022.” More. WBCA President/USF Women’s Basketball HC Jose Fernandez penned a letter to all Division I WBB HCs this week calling for more transparency regarding women’s basketball investment, writing: “What once was an enterprise slow to change is now evolving rapidly — largely at the behest of state legislatures and the courts, and beyond our control. It is unprecedented. There has never been a better time or greater need to advocate relentlessly for our sport … Will (revenue sharing) be our next problem or newest opportunity? That depends on how we approach it.” SB Nation’s Mitchell Northam reports that Fernandez “went on to offer some guidance on revenue sharing, advising coaches to educate themselves on their school’s policies regarding Title IX, NIL and agent interactions, and recommended that coaches engage in conversations with their athletic directors and other administrators to seek clarity.” Fernandez: “You have to know what you’re talking about when speaking with recruits, alumni, donors, etc. Encourage your institution’s leaders to be transparent with how they will calculate and distribute revenue share among all student-athletes in all sports so that both players and coaches understand who is receiving how much (money) and why. There should be a method of public transparency in what each institution is investing in its women’s basketball program.” (link)

On SI’s Lincoln Arneal goes straight to the source in finding out how the league’s volleyball coaches and student-athletes are approaching revenue sharing/NIL in their sport post-House settlement. On how the settlement impacts a head coach, Nebraska Volleyball HC Dani Busboom Kelly remarks: “Hopefully, we get a (general manager). As volleyball gets bigger and bigger, we'll probably have to where the coaches can be out of the money conversation. I hope we add one. I haven't even talked to (Nebraska athletic director) Troy (Dannen) about it, but it feels like sports are going to need one eventually.” USC HC Brad Keller adds: “It takes the majority of my day now. I've become a manager. You're trying to fill up every kid's basket as best you can. There's a lot to that, and it's not just volleyball anymore, and it's not just -- it's all these different components. It used to be you're recruiting, you're training, culture, there's certain things, but now you're adding a whole another level of agents and rev share and NIL opportunities and what does that look like. Honestly, one of the biggest things that we need to do is I'd like to get away from getting your bag or whatever. You get an NIL deal. This needs to be about brand building.” (link)

Fox CEO Lachlan Murdoch has completed an agreement to secure control of his family’s media empire for decades to come, according to the New York Times’ Jim Rutenberg and Jonathan Mahler. The deal, which is valued at $3.3B, ensures that the company’s various outlets, including Fox News, The New York Post and The Wall Street Journal, will remain conservative after his father Rupert’s death. Under the terms of the deal, Lachlan’s three oldest siblings will receive $1.1B each for all their shares in the company, which amounts to roughly 80% of the value of their stock at the close of trading Friday. Rutenberg and Mahler also note that “the agreement won’t result in any immediate change; Lachlan has already been running the Murdoch business for the past few years. But it does clear up the uncertainty around the company’s future by locking in his long-term leadership. The new trust will expire in 2050, and will ensure that Lachlan retains control of the empire at least until then.” (link)
