The National Labor Relations Board is shifting its focus on college athletics from the NCAA at large to USC FB and basketball student-athletes, per College Basketball Players Association Co-Founder Hsu, who told Sportico the NLRB has communicated it will focus on the NCPA’s charge while the NCAA charge is “in abeyance.” Sportico’s Libit adds context: “The NCPA’s charge included USC and the Pac-12 Conference, and specifically addressed the employee status of football and men’s and women’s basketball players. The charge alleged that by misclassifying them as ‘student-athletes,’ the school, conference and NCAA had ‘interfered with, restrained and coerced’ the exercise of those athletes’ collective bargaining rights. As a private university, USC falls within the purview of the NLRB, which oversees only private sector employees. The NCPA also filed an unfair labor practices charge on behalf of athletes at UCLA, a public university. However, that proceeding would rely on the joint employment doctrine, in which an individual is deemed to be employed by a secondary employer—in this case, the NCAA or Pac-12—if that entity wields significant power over the terms and conditions of the individual’s employment.” (link)

The FB members of the Atlantic Sun and WAC have agreed to form the foundation of a 10-member football-only conference, ESPN’s Thamel reports, noting the new consolidation intends to become the 11th FBS conference. The new league would include Stephen F. Austin, Abilene Christian, Utah Tech, Southern Utah, Tarleton State, Austin Peay, Eastern Kentucky, Central Arkansas and North Alabama. UTRGV is expected to join as the tenth team when its program launches in 2025. Thamel also reports the rationale for creating the league includes providing “greater certainty in scheduling and recruiting” as well as increasing revenue through a more lucrative media deal and higher guarantee-game paydays because, as an FBS conference, the games would count toward bowl eligibility. Despite a current moratorium on single-sport conferences, a source tells Thamel: “We feel very confident in talking to NCAA officials that they'd support this. There's no grounds for them to stand on to deny it." More from Thamel: “One of the manifestations of the new league's formation has already appeared publicly. Austin Peay outlined a plan to jump to the FBS by 2025 during a recent board of trustees meeting.” (link)

The Big West Board of Directors will continue with a 20-game MBB and WBB conference slate after the “Wild Card Week” initiative failed to come to fruition, starting next season. The conference will also add a six-team Volleyball championship in 2023 and a six-team Softball championship and Baseball championship in spring 2025. On NCAA transformation, the Board “reaffirmed its position that all Division I conferences shall be represented on the NCAA DI Board of Directors moving forward.” (link)

Many of the same challenges that college athletics faced going into 2022 remain at the forefront, SBJ’s Smith points out, including NIL, governance, the transfer portal and the overall business model. One AD compared college football to a rudderless ship during the SBJ IAF while Kansas State AD Taylor admitted that “we’re just not aligned.” Regarding NIL being used as a recruiting inducement, Arizona State EVP/COO Howard added: “Let’s be clear about it. It’s illegal, it’s wrong.” LEARFIELD EVP Wheeler identified NIL as the most-discussed subject of the IAF “because it is the single most-important challenge every athletic director faces when it comes to providing opportunities to the student athletes. NIL is the No. 1 subject, and there doesn’t appear to be a horizon on that.” On the governance front, outgoing President Emmert asserted that college sports does not need a czar in what is currently a model of shared governance. “Would it be easier to have a czar in charge? Yes, it would be easier. But it also would be woefully ineffective.” (link)

+ The Eastern Michigan Board of Regents approved a two-year contract extension for President Smith, who will reach the 10-year mark in the role by the extension’s end in 2026. (link)

+ The Florida Gulf Coast Board of Trustees voted to extend President Martin’s contract through June 30, 2023 or sooner “if a successor is selected,” as it restarts its search for the university’s next leader. Timeline for the search and who will serve on the presidential search committee are still TBD and trustees will put out an RFP for executive search firms even though the board is currently contracted with AGB Search. + New Louisville FB HC Brohm is set to earn $36M over his six year deal, with the ability to earn $42.5M over seven should he win seven games in any season or $49.5M over eight years should the Cards win 10 games in a season. Brohm’s assistant pool is $5.5M. Should he exit Derby City at any time, Brohm would owe $1M. If U of L parts with Brohm, he is owed the full remainder of his contract. Bonuses include $250K for an ACC title, $250K for making the CFP, $400K for a top 4 CFP seed and $750K for a national title. (link)

+ Sports Illustrated’s Forde: “A little additional detail on Jeff Brohm's six-year, $36M contract with Louisville: if he wins just seven games one time during those six years, it becomes a seven-year, $42.5M deal. If he wins 10 games, it becomes an eight-year, $49.5M deal.” (link)

Ohio State AD Smith in a letter to fans identifies three collectives to which fans can donate in Cohesion, The Foundation and the “O” Foundation and adds: “Recent guidance updates from the NCAA clarified how schools can be involved with Name, Image and Likeness (NIL) activities of student-athletes. Many of our Buckeyes are taking advantage of this, and we are committed to supporting our current and future student-athletes while building strong, competitive programs.” (link)

Florida AD Stricklin also encourages fans to donate to NIL endeavors via the Gator Collective, by purchasing personalized Fanatics apparel and NFTs through Campus, or by engaging INFLCR’s NIL exchange. UF has also set up GatorsNIL.com as a centralized location for those who wish to donate. (link); The Gator Collective CEO Rojas adds: "We're planning on offering NILs per sport. And what we're going to do is we're going to rope in former athletes in each sport that are going to run their own groups inside the Gator Collective. As an example, for the basketball team, we're starting 'Buzzer Beaters, and the 'Buzzer Beaters' are going to be all former Gator basketball players, NBA or career professionals. And they're going to have an opportunity to pool their resources together, knowing that 100% of their assets are going to the basketball NIL opportunity. … What we're doing here is we're going to create subsections of the Gator Collective to where not only the fans can get involved from a membership perspective, not only people like the Gator Guard and people like that can get involved from an elite revenue perspective, but also let's rope in those former athletes to come back and know that their dollars are going specifically to their alma mater, their letter-winning program. During a panel discussion about sports gambling at the SBJ IAF, Arizona Executive Senior Assoc. AD/SWA Barnes compared legal betting to the Wildcats’ introduction of beer sales during sporting events. There is the potential for problems, Barnes acknowledged, but if tested carefully and phased in slowly, it can work. LEARFIELD EVP Fulp, who moderated the conversation, agreed that as gambling becomes more ingrained, it would be important for universities to find partners who will create necessary safeguards. “Lean in, don’t put your head in the sand.” U.S. Integrity Founder Holt added that part of leaning in would include releasing injury reports indicating which players won’t be playing. Sportico’s Crupi pushes back on reports that Bally Sports properties are as far gone as reported earlier this week: “As onerous as Diamond’s debt load is, the Bally Sports properties are not at death’s door. Given some of the changes that have been carried out this week, it’s entirely plausible to assert that the RSNs haven’t even crossed over into death’s area code.” Crupi adds: “Among the most pressing concerns for RSNs is the rapid erosion of the traditional cable bundle; in the third quarter, 10% of bundled TV subscribers cut the cord, bringing the sector’s overall head count to 62.2 million homes, or just 50% of all U.S. TV households. In the last five years, 31 million subs have opted out of the cable/satellite/telco-TV bundle, which makes for a loss of one-third of the industry’s overall customer base.” More. (link)

The Dallas Cowboys are planning for up to $295M in upgrades to AT&T Stadium. The Cowboys will seek help paying for the project by asking the rest of the league for approval to withhold their normal contributions to shared gate revenue, a common method of paying for stadium upgrades, per SBJ’s Fischer.
