More from RMAC Interim Commissioner Lexie Vernon’s Small College Conversation on eligibility and transfers. On the five seasons of eligibility proposal: “I think the five-year proposal, which has been supported by the Management Council, is a way for us to definitively stand out as a division that truly values our mission, in the sense that we want to provide equal opportunity to all of our student-athletes and limit the amount of legal overlay that we've seen across the board. […] I think [it] is a good thing for the division in showing this flexibility. But also where I think where litigation has often come in is through this waiver process. That threat of litigation, if we remove the nuances and the possibility of being granted a waiver for one reason or another and leaving that in the hands of NCAA staff members or of a committee, leaves us open to litigation.” Vernon does believe there should be more structure and guidelines around the transfer portal and NIL. On the former, she points to the high likelihood of DII student-athletes who enter the portal to return to their school or go to another DII program, thus making the “NIL, earning potential, antitrust overlay” that has led to the deregulation of rules somewhat irrelevant. More from U.S. Congressman Russell Fry (R-SC) on the Next Up with Adam Breneman podcast as he advocates for implementation of the SCORE Act. An employment model, Fry contends, also means that for “state budgets that have workers’ compensation, if an athlete gets hurt, which inherently they do, state budgets are now dramatically impacted by the rising cost of workers’ compensation fees and and things that are paid out. So, you know, for us, I think the common sense approach is students don’t want this, coaches don’t want this, schools and conferences, nobody really wants this except a small minority of people. Let’s get it out. It doesn’t need to happen that way. People want to enjoy their college experience and not be considered an employee where presumably they could be fired if they were injured.” Fry on the NCAA: “They seem to be wanting to right the wrongs of the past. They want to get back to a governing style that works for the players, that works for the coaches and the schools. … We want that. We think that’s healthy overall for college athletics, but we also want to make sure that we’re checking their authority, too.” (link)

Young Harris has been ordered to pay the Peach Belt $240K plus interest after the Georgia Court of Appeals upheld that the PBC’s constitution and exit fee provision were valid. Young Harris informed the league in November 2022 it would withdraw with less than two years’ notice, meaning the school would owe $240K, which is two times the new member initiation fee as agreed upon in the 2020 amendment to the Peach Belt constitution. Notable development from DI: Investment firm Sequence Equity was the group behind a pitch made to FCS commissioners about a privatized FCS Playoff this week, according to Front Office Sports’ Amanda Christovich, who adds more, “According to the proposal, the new playoff would be run by a new private entity. FCS conferences would own the majority of the new entity, but Sequence Equity would take a minority stake and offer ‘tens of millions of dollars in investment,’ the source said. [...] It’s unclear when this entity could get up and running, as the concepts are still in the educational and discussion stages. But sending the proposal to the NCAA for discussion was described by the source as the next step.” (link)
