Front Office Sports’ Amanda Christovich reports “multiple major power conference collectives are giving up on trying to work through the NIL Go clearinghouse and within the bounds of the new rules set up by the House v. NCAA settlement.” She adds: “At least two collectives have begun to pay players before the submitted deals have been approved, and are aware of instances where players haven’t logged deals at all, sources tell FOS. The inefficiencies of the system have created an unsustainable landscape.” A source from an ACC collective notes they have “deep concerns as to the longevity of this system,” adding that many across the industry desperately wanted the system to work but now feel like they have no choice but to violate the rules. Specifically, Christovich reports that two SEC collectives “have begun to compensate players for NIL deals that have been submitted to NIL Go but not yet approved. … The source from the ACC NIL collective said that they were nearly ready to circumvent the NIL Go system and were preparing to pay players for deals that had been submitted but not approved.” The first SEC source indicates that out of nearly 70 agreements sent to football players in August, only about 20 had been submitted to NIL Go as of October 1. CUSA Commissioner Judy MacLeod visited with the CUSA Insider Podcast to reflect on her decade of leadership, while sharing her insights on the future of the league and how it continues to adapt and thrive in a changing athletics landscape. On CUSA’s identity through change, MacLeod remarked: “All the sacrifices, all the hard work that our young people do and our administrators and coaches and presidents and athletic directors and everything, I think it all comes down to people in the end. And the one thing I am really proud of is this conference has always been willing to embrace change and willing to find a way to adapt positively and grow and be resilient. I think we've become known for that. We take pride in that, because we're going to keep getting better. Circumstances are going to change, and we're going to have to change along with them. I think the other thing is we've never lost focus on why we do what we do. It's about the student-athletes. Ground has officially been broken on the 10K-seat arena at the Grand Sierra Resort in Reno, which will serve as the future home of Nevada Men’s Basketball, concerts and a community ice center. Per 2 News Nevada, Martin-Harris Construction will serve as general contractor for the arena project, which will serve as the first phase of a $1B total investment, with future phases set to include a new hotel tower and workforce housing as well as an ice rink and fan zone. The current U.S. government shutdown won’t impact the playing of college sports games at Air Force, Army and Navy, per The Athletic’s Chris Vannini, who notes that “Navy has always operated its athletic department as a nonprofit entity separate from the government, and Army did the same in 2017. Both academies were similarly not impacted during the 2018 shutdowns. An Army spokesperson stated that some government civilian workers involved in game-day logistics are affected, but larger aspects, such as travel and game competition, remain unaffected. Air Force, which more recently moved its athletic department fundraising into a similar non-government entity, briefly canceled some athletics competitions in January 2018 during that shutdown. That will not be the case this time.” (link)

The “NCAA’s appeal of the preliminary injunction that allowed (Vanderbilt football student-athlete) Diego Pavia to play this season was dismissed, with the court saying since the NCAA granted a waiver the appeal was moot,” per The Athletic’s Ralph Russo. (link)

Former San Jose State Volleyball AC Melissa Batie-Smoose has filed a lawsuit against the school in which she alleges she was fired in retaliation for filing a Title IX complaint about a transgender player on the team. From the suit: “Punishing coaches for raising concerns about the fairness and integrity of women’s sports not only harms the individual advocate but also undermines the enforcement of Title IX’s mandate and has a chilling effect on those who seek to protect sex equality in collegiate athletics, contrary to public policy and the statutory objectives of Title IX. … [The school’s] actions in suspending and terminating [Batie-Smoose] were not based on her job performance but were in direct retaliation for her opposition to sex discrimination and her advocacy for the fairness and equal access to programs, services, and activities for female athletes.” Batie-Smoose tells Fox News that “I’ve been a very successful coach and I’ve coached for a long time and I’m not even getting any looks for any coaching jobs.” The lawsuit also seeks injunctive relief that ensures biologically born female athletes won’t have to compete with or against transgender athletes. The Big South and ESPN have reached a six-year media rights extension through 2030-31 that will feature more than 800 conference events carried annually across ESPN networks. The extension provides continued linear coverage of the Big South’s basketball championship games, with the men’s championship game airing on either ESPN or ESPN2, while the women’s championship contest to be carried on ESPNU. In addition, ESPNU will televise six events per season, including a minimum of four men’s basketball “Wildcard” broadcasts and at least two additional linear opportunities on ESPNU or ESPNEWS. The agreement also allows the Big South to retain the rights to telecast up to 50 linear events per year locally in the Conference footprint, with those telecasts co-existing on ESPN+. Murray State closes out the first iteration of its three-year The Race Is On strategic plan that was originally launched in October 2022. Among the highlights are the largest one-year fundraising total in university history of $21.5M, over $30M raised and 160% growth in sponsorship revenue since Fall 2022 and a seven-year Nike/BSN Sports extension through 2032 that marks the most lucrative apparel deal in university history. Valparaiso reports notable growth in all aspects of revenue generation in FY25, including a 40% increase in sponsorship revenue, 27% growth in gameday revenue (from tickets, parking, hospitality and concessions) and a 9% jump in fundraising, while increasing its overall revenue generation total by 15%. In all, over 1K donors made gifts to Valpo Athletics with almost 400 new donors helping raise $230K during the department’s annual Valpo Day. The highlighted numbers also include the largest corporate sponsorship agreement in athletics history with UChicago Medicine. (link)

The College Sports Commission is creating an “anonymous reporting tip line” to share information about NIL rules violations, according to Front Office Sports’ Amanda Christovich, who notes that some in the industry are calling it a “snitch line.” Christovich adds: “NIL Go only has four full-time employees to manually scrutinize every deal. It’s unclear how the CSC would be able to uncover rules violations among schools, collectives or other NIL entities. Now, the CSC hopes to rely on the industry to partially police itself. The CSC spokesperson said more information would be available about the tip line in the coming weeks.” (link)

The Mountain West’s motion to dismiss the Pac-12 "poaching penalty" lawsuit has been denied. The Mercury News’ Jon Wilner: “Magistrate Judge Susan van Keulen of the Northern District of California denied all four causes of action in the motion and set a case management conference for Nov. 18.” In her ruling, van Keulen wrote: “The MWC’s arguments do not provide a basis for the Court to disregard the Complaint’s allegations of antitrust injury. Although the Pac-12 agreed to the terms of the Scheduling Agreement, it has alleged that it was ‘desperate’ and ‘had little leverage’ at the time it entered into the agreement. ‘To hold that a contract is exempt from antitrust scrutiny simply because one party ‘reluctant[ly]’ accepted its terms’ would be to misread section 1 of the Sherman Act, which reaches every contract’ that unreasonably restrains trade.” (link)

Atlantic 10 Commissioner Bernadette McGlade during yesterday’s hoops media day reiterated her support for expanding March Madness: “The opportunity for additional teams to have an opportunity for an at-large bid has been something that we have supported for literally the last year-and-a-half, two years that it’s been even talked about. There’s 360-plus schools in Division I, and a lot of our sport counterparts, whether it’s the College Football Playoff or professional sports, like the NBA, Major League Baseball, whatever, they seem to more routinely expand based on demand.” (link)

McGlade also joins The Field of 68 and emphasizes the importance of playing tournament-bound teams. “We’ve used the expression we’ll play anyone, anywhere, anytime. Because getting great nonconference opponents…that’s tough. You have to rely on MTEs, you have to go on the road oftentimes, but every school’s got to be able to build a quality nonconference schedule and at the end of the day you have to win games. There’s no fooling the committee. You have to win games and come out of nonconference with winning records against credible opponents. And then it depends on where you play them, where you get that win for how that kind of calculates into the mystical formula of the NET.” (link)

Texas Tech Board of Regents Chair Cody Campbell tells SBJ’s Ben Portnoy that he’s “encouraged by the SAFE Act. It’s a good step forward, and I’m glad to see that there are people who are actually digging in and looking at the root cause of the problems that we have in college athletics and not just the headlines because this has never really been about NIL or about the transfer portal or anything else. Those are really symptoms of a deeper problem. And those problems are economic problems and problems with the way that the sport is governed.” Campbell goes on to say: “You have schools that are dealing with just unbearable financial problems. They’re all faced with decisions around whether to cut sports or not to save money. … Our goal is to make sure that all the sports are preserved at all the schools. The only way you can do that is by getting more money into the system. Typically, you would think, ‘Well, that’s really hard. Making significantly more money is a difficult thing.’ But in this case, we have a lever that we can pull that we have proven through empirical data, through deep study, that we can add an extra $7B per year in revenue to the system -- and that solves all the problems. Unfortunately, however, we have some conference commissioners who just don’t want to give up control.” (link)

In parsing the section-by-section explanation of the SAFE Act, it appears one unreported provision of the bill includes this from Section 907: “Prohibits media rights contracts in existence as of October 1, 2025, between conferences, schools, and networks from being renegotiated or extended before the contracts expire.” There’s also this from Section 702: “Prohibits an association or conference from prohibiting sponsorship jersey patches on uniforms in any sport, provided that any institution deriving revenues from jersey patches preserves roster spots and scholarships for student athletes in non-revenue generating and women’s sports at levels comparable with the 2023-2024 year.” More for your perusal. Arizona State intends to build a new $35M football practice facility and renovate Desert Financial Arena at an estimated cost of $100M, with construction work on each project planned to begin in January 2027. The football practice facility will be adjacent to the north end of Mountain America Stadium, with an existing parking lot converted to a turf field to replace the Verde Dickie Dome bubble structure. It would also serve as a "Fan Zone" for pregame festivities and other events. The Sun Devils would like to take occupancy of the facility in February 2028. Renovations of Desert Financial Arena would include updating the arena's "existing life safety systems, concourse, concession stands and circulation experience, as well as upgrade the locker and restroom facilities while ensuring ADA compliance of the facility.” All costs would be funded by “system revenue bonds” according to filings with Arizona’s Board of Trustees. The new $515M Kalamazoo Event Center will serve as a “point of pride” for Western Michigan, according to WMU Women’s Basketball HC Kate Achter, who remarks: “It’s going to change the way we compete for championships. But this will not only be a point of pride in our community, the greater Kalamazoo area, but it will also be a point of pride and standard for what women’s athletics should look like across the country.” The 450K sq. ft. facility, which will house the Broncos' Men’s & Women’s Basketball and Men’s Hockey teams as well as the ECHL’s Kalamazoo Wings pro hockey squad, has long been part of AD Dan Bartholomae’s vision. Bartholomae: “In my interview, I told the committee that if I got the job, we would work every single day in pursuit of a vision of comprehensive excellence. But I also wanted to know about something big that we could dream up together and what the committee thinks is big. … I cannot think of a greater symbol of that shared vision than what is currently being built directly beneath our feet. This is not just a competition facility. It’s a facility that has carefully considered the student athlete experience, providing best in class training and recovery amenities that support peak mental and physical performance. … This is an opportunity for us to embrace community connection, break down silos, and seek new partnership strategies at a time when both higher education and divisional athletics is changing. And it’s a statement that we’re going to change with it. Our events will become can’t miss entertainment in Southwest Michigan, and it will elevate all 16 of our athletic programs.” More. (link)

Little Rock AD Frank Cuervo last week unveiled a program-wide fundraising campaign to support construction of an on-campus baseball facility, basketball operations center and an indoor golf training center. The basketball operations center would be built next to the Jack Stephens Center and feature new coaching offices, a war room and sports medicine resources. Money raised through the campaign would also go to support the Trojans rev-share efforts. As far as a timeline goes, Cuervo noted that “we’re not quite at that point yet to say, ‘Hey, Donor X, do you want to put your name on Area Y?’ … Now it’s about finding what each person’s passion point is. We’re going to have a lot of those discussions in the coming years.” (link)

Sportico’s Daniel Libit breaks down Blueprint Sports’ NIL consulting deal with Oregon State that included the purchase of the OSU-affiliated Dam Nation Collective. Blueprint CEO Rob Sine says the Oregon State contract follows a similar “template” to how his company engaged Maryland and is currently negotiating deals with dozens of other schools. Per Libit, “the OSU agreement calls for an annual management fee of about $284K by the school to Blueprint, and a profit-sharing arrangement based on a baseline fundraising target of $750K in year one, which increases 3% every year thereafter. The company gets to keep 75% of ‘net direct revenue’ between the baseline target and $1.15M, and 50% of net direct revenue above $1.15M. In addition, Blueprint is entitled to a ‘contract administration fee’ of 1.25% of all NIL compensation it administers.” Sine adds the business is about “building as big a [revenue] pie as possible. [...] I think the NCAA, the CSC and conferences have done a really nice job of concerning schools with their behavior toward NIL. Schools are wound a little tight. They are concerned, rightfully so, about what penalties could be, and so what we have to do is help them get comfortable with the idea that you can and should be able to have above-the-cap dollars, and an organization that continues to build out opportunities.” (link)

CollegeAD unpacks the terms of new UC San Diego AD Andy Fee’s five-year contract, which runs from September 15, 2025, through June 30, 2030. Fee is set to earn $340K in base pay with a 4% increase each year. In addition to his base pay, Fee will earn $10K in his first year as AD as part of a talent fee. That talent fee is set to increase by $5K annually. Additionally, Fee will earn a $100K signing bonus and can earn up to $30K this year in incentives. Fee’s bonus cap will grow by $5K each year. If UCSD opts to part ways with Fee without cause, he would be owed 50% of any remaining base pay due to him over the remainder of the term. Should Fee exit before June 30, 2027, he would owe UCSD a buyout equal to one year's base salary plus $200K. If he leaves before June 30, 2029, he would owe $200K and if he leaves before June 30, 2030, it drops to $100K. (link)
