NCAA SVP of External Affairs Tim Buckley participated in a discussion about federal legislation and college sports as part of the Knight Commission meeting last week. Key takeaways…
➤ Buckley reiterated the NCAA’s position that “student-athlete leaders at every level of the NCAA are opposed to becoming employees. They cite not wanting their coach to become a boss. They cite the tax implications that come with being an employee. Our schools at every single level, every single subdivision of Division I and across the association, are opposed to their student-athletes becoming employees. They cite the ruinous cost implications of such a change. … I don’t think there’s a school out there in the United States of America today that could afford to turn all of their student-athletes to employees, increase their FTE headcount by 10, 15, 20% overnight. There would be cuts.”
➤ For comparison, Buckley noted the House settlement is optional; therefore, “schools don’t have to participate in the House settlement. And even if they opt in, they can participate at any financial level they want. There’s no minimum. There is just the cap. Employment would not be optional.”
➤ Buckley also extolled the SCORE Act as the “first bipartisan bill that enshrines into federal law NIL rights for every student-athlete, health and mental health, and academic benefits.” He contrasts that with the SAFE Act, which he argues “appears to undo a lot of that authority that your smaller schools – and especially your Division II and Division III – now have in the process, and it would replace it with a government-appointed board that has tremendous authority to withhold media-rights revenue from schools if certain conditions aren’t met.” Buckley also noted: “Unfortunately, the SAFE Act does not address employment, but the SCORE Act does. That’s one of the central reasons we are advocating for it.”
➤ Finally, Buckley defended the NCAA’s revenue distribution and governance as “direct democracy” and points out that lawsuits and legal uncertainty stalled progress but are easing. Furthermore, he projects continued revenue growth and emphasizes that effective rule enforcement requires limited liability protections from Congress.

Big South Commissioner Sherika Montgomery joined The Field of 68’s Rob Dauster and Jeff Goodman today and had this to say on the transfer portal and its regulation: “We do need a level of regulation. … I transferred during a time when there were five sports that were treated differently, and for the entire time, and my background being compliance and governance, I’ve always been supportive of equality. Either we all have to sit out or we all have the same level of free agency. Now, we all have the same level of free agency, but how do we balance that and its impact on not only just having a successful athletic career but also academically. I do think we need to strike a balance of what that looks like. Obviously, we are having to grapple with litigation from an eligibility standpoint. Obviously, a myriad of things are going on on Capitol Hill. You do have some bills that include transfer legislation, but make no doubt about it, the 4-in-4, I do think we have to do something about that and what that looks like.” (link)

Will overindulgent coaching contracts with ridiculously large buyouts ever be curbed? That’s the query posed by The Athletic’s Chris Vannini, who notes the new NIL era could finally be what alters the math. Vannini: “Schools hope the balance may finally shift in this cycle: Instead of asking for so much guaranteed long-term money, put it into the roster and increase the performance incentives. … Another option could be shorter contracts like the NFL. [...] The agents have a different outlook. The problem for schools is that this carousel is expected to be one of the busiest ever. You need leverage in negotiations, and desirable coaches are about to have a ton of it, especially if a handful of SEC and Big Ten jobs open, as is expected. It will be harder to convince the coach to take that new progressive contract if someone else can land him by doing things the way they’ve always been done.” One agent tells Vannini: “There are a number of schools that will do it all and have the ability to do it all. There is a premium for top coaches, and schools will be willing to pay for top talent in all areas.” More. (link)

On3’s Pete Nakos provides details on new guidance surrounding recent changes to the college football transfer portal, writing: “On3 has learned the NCAA has sent guidance to schools that the portal window for when a new head coach is hired starts five days after the coach is hired, provided that occurs between January 2 and June 30. For example, if a CFB program hires a new head coach on Nov. 25, the portal would not open until Jan. 2. But if a program makes a coaching change in the spring and hires a new head coach, players will not be delayed as long as the hire is before June 30. Previous NCAA rules stated that a 30-day transfer portal window immediately opened after a coaching change. Now players have to wait until a new coach is hired, and in some situations, until January.” (link)

The Big 12 has “issued a public reprimand and fine of Texas Tech and fined Kansas following their football game Saturday. Per release, Texas Tech and Kansas are both fined $25K. Tech's fine is for repeated instances of objects being thrown onto the playing surface, while Kansas has been fined for disparaging comments about the Conference and a member institution, and an inaccurate statement regarding a pocketknife by HC Lance Leipold.” Big 12 Commissioner Brett Yormark: “After a formal review, Texas Tech did not take sufficient steps to prevent and deter the repeated throwing of objects onto the field and team bench areas. Coach Leipold's comments questioned the integrity and professionalism of both the Conference and a member institution. Both actions warranted a financial penalty. The Big 12 Conference prioritizes integrity and will have no further comment on the matter.” (link)

Whatever makes people happy. … We’re in the people business, and whether that’s student-athletes, whether that’s coaches, whether that’s administrative staff, I want all people to achieve their dreams. I think in this business, a lot of times, the networking piece is always front and center … but I think outperforming your current job is even more critically important to your growth because, at the end of the day, people are going to call your references. They’re going to call to see what kind of job you do. Loyola Maryland has received a $500K gift from Joan I. Skesavage and James S. Xavier and Cincinnati Beverage Company have announced the introduction of Muskie Lager, reintroducing one of Cincinnati’s most iconic brewing brands – Burger Beer – to support Musketeer student-athletes. Nike has renamed its 400-acre corporate headquarters in Beaverton, Ore., in honor of company co-founder Phil Knight. Per The Oregonian’s Matthew Kish, “the move comes as [Nike CEO Elliott] Hill continues to refocus the company on sports — one of Knight’s founding principles — and encourages employees to think more like entrepreneurs, one of Knight’s greatest strengths.” Hill: “This is more than a name change. It’s a tribute to the man whose vision created a global movement. And it’s a reminder — to every one of us who will walk these paths and run these fields — of what can happen when belief meets action. Every building, trail, creek and field was designed with intent – not as an office park, but as a campus that mirrors the soul of sport. Phil knew this company would need daily reminders of what makes it different. ESPN’s Dan Wetzel shares more from a call between Michigan and USC trustees who continue to discuss a potential Big Ten private equity deal: “The two schools discussed their shared skepticism during the call. One sticking point: The deal doesn't address the root issue – soaring costs – that has made the need for cash so imperative for athletic departments. Just providing short-term money, sources said, does not solve that issue. … Both Michigan and USC believe there are funding options that can provide superior terms and would like to slow the process and explore them, sources said. The goal, the meeting agreed, should be to help the Big Ten schools that need money but at the most favorable terms imaginable without giving up equity.” Wetzel also notes a conference-wide call with league presidents and ADs was “tentatively planned for Thursday, but there might be more work to be done before then if winning Michigan and USC over is possible. No official vote has been scheduled.” (link)

The Charlotte Business Journal’s Erik Spanberg examines how the ACC’s recent additions of CRO Anthony Macri, Chief Marketing and Brand Officer Marques Zak and VP of Sport Technology and Innovation Jay Sartori are helping the league boost more revenue and adapt to the changing environment. ACC Commissioner Jim Phillips says the “three positions were created to enhance the ongoing strategic priorities of our office, and each will bring exceptional experience to the ACC. … We have been in a little bit of a holding pattern (as it relates to the new hires and revenue strategy). I’ll just be very direct: With some of the lawsuits and legal issues that we’ve had, we have not been able to move forward in some areas that we needed to.” Since those suits have been settled, Phillips explains: “We’ve been freed up to have this massive reorganization that we went with in the spring time, but to add three additive positions, to have somebody every day looking at revenue, every day looking at branding and marketing, and every day from a sports tech, data, analytics perspective – to me, is game-changing for us.” (link)

Tennessee AD Danny White weighs in on how the Vols will approach potential jersey patch partnerships: "I think it just depends on the resource opportunity. It depends on the brand. Something that visible associated with something that's sacred to us, our uniform… it's a lot more delicate, kind of like Neyland Stadium. We didn't rename Neyland Stadium. We preserved it with the Pilot partnership. And I think that was a really good balance of honoring our tradition while also understanding the resources we need to be as competitive as we want to be." White also notes that "there’s never been this close of a relationship between winning and resources as there is right now in college sports. I think that the highest-resourced athletic departments are going to be the best. And we've been saying since day one, we want to be the best athletic department college sports has ever seen." As UT continues to look for new revenue streams, White says he wants to be conscious of the fans. "I don't want to gouge our fans. We pay a lot of attention to price points and making sure that we're not being unreasonable compared to what our peers are charging." (link)

More from Rutgers AD Keli Zinn on the newly unveiled R NIL initiative: “What has happened here historically is there has been an incredible amount of pressure on our coaches to support NIL efforts specifically to their sports. They’ve done as good of a job as they can navigating that space. But we have now alleviated that pressure and they will have a team surrounding them that are experts in this area and are expected to get those opportunities for their athletes. … NIL doesn’t equate exactly to winning. But what it does do is it certainly positions you for a greater likelihood of success. I do believe some of the deficiency we’ve had in that area over the years has likely caught up to us.” In reference to the football roster, Zinn explains: “One of the first items of business is to make sure none of those guys leave. And that they recognize the potential here and what our future is going to look like and then we package around them some really good talent around them coming from other areas in order to put together a product on the field for next season that’s really impressive.” (link)

UAB AD Mark Ingram this week was asked whether he takes responsibility for the disappointing trajectory of the football program after hiring former HC Trent Dilfer and responded: “Absolutely. We’ve hired, I don’t know the number, I think in my time here, we’ve hired maybe 25 head coaches, something like that. And have had great success. We didn’t have the success that we wanted to have with him. We knew that any hire has some amount of risk because these jobs are hard. These jobs are really hard. It’s not as simple as just X and O’s in football anymore. The totality of their job is enormous.” In response to a question about people calling for his job, Ingram remarked: “I’m in my 11th year here. With the support of our board and our president and our community, we’ve done some pretty incredible things. [...] What we’ve been able to do with our facilities and so forth to put us in a position to even get an invitation to the American was no small task. We’ll continue to do that. Our success is something we’re very proud of as a department. We’ve improved in a lot of areas – academically, we serve our community very well and we have won championships in more than one sport and have moved programs that used to be bottom feeders into the top 25. It’s like turning a battleship. It’s not something overnight that you just snap your finger and all the sudden you’re great. We are a lot better than what we used to be and we’re proud of that.” (link)

Yahoo Sports’ Ross Dellenger reports “the National Urban League and the National Basketball Retired Players Association sent a letter to the House and Senate Democratic Caucus yesterday against the SCORE Act, calling it ‘not a bill for fairness - it is a bill for the NCAA.’” Dellenger adds: “Lawmakers and their staffs continue to work on amendments to the SCORE Act for a potential re-introduction of the legislation later this fall - presumably after the government reopens. Learfield President of Brand Management and Marketing Cory Moss talks with SBJ’s Ben Portnoy about the company’s role in today’s ecosystem and explains: “Well, first [schools are] asking us to make more and more money. Obviously, that’s a key driver because there’s so much pressure on revenue right now. Budgets are expanding -- coaches, facilities, all the things are just more and more expensive. The budgets are ballooning, and so they have to uncover new revenue opportunities. We have to help them uncover new NIL opportunities for their student athletes, because that helps them retain and attract student athletes. ... When I talk about technology or the ground game – putting content people on campus to help produce some of these things – that’s really important. Puck’s John Ourand points out that the “biggest sports rights deal outside of the U.S. officially commenced this afternoon. UC3—the joint venture between UEFA and the European Football Clubs—and Relevent Football Partners, their commercial partner, launched a tender process that should lead to a deal for Champions League rights by the end of next month.” Ourand believes the bidding process will function as an inflection point “for this moment in both the sports rights marketplace and the final stages of the streaming wars. For starters, the Champions League features clubs from France, Germany, Italy, Spain, and the U.K. Second, past auctions have resulted in five separate deals for each territory. Now, UC3 and Relevent have an opportunity to sell universal deals to a global streamer like Netflix, Amazon, or YouTube. Relevent and UC3 also seem to comprehend their hand at the table. Whereas past deals had a three-year term, they are now accepting bids for four-year lockups. This process could also presage the future of NFL, college football, and NBA auctions—the next wave of negotiations that will cleave the haves of the business from the have-nots. The groups have another inducement for these hyper-streamers, too: The Champions League plans to hold the first match of the 2027 season, featuring the 2026 champion, as a stand-alone eventized game.” (link)
