Texas Governor Abbott has signed the state’s new NIL law, with On3’s Crabtree noting: “...the most notable change appears to provide cover for state schools from being punished by the NCAA for any NIL-related violations, including any committed by collectives that have been set up to support student-athletes through deal facilitation.” More key details: “Additionally, the legislation allows a college to establish agreements with a third-party entity to facilitate NIL activities on its behalf. [...] Texas A&M and Arkansas are believed to be the first schools whose booster organization also is directly fundraising for NIL opportunities for student-athletes. Other schools in the SEC footprint, especially in Missouri and Oklahoma, are also aggressively pursuing similar organizations.” The new law goes into effect on July 1. (link)

The San Jose Mercury News’ Wilner attempts to parse recent comments by Pac-12 CEOs to determine the status & potential outcome of the league’s media rights negotiations: “...if we combine (Arizona President) Robbins’ outlook for the Pac-12’s future with (Washington State President) Schulz’s revenue projections and the verbal agreement on the grant-of-rights contract, it’s reasonable to conclude that the process is nearing an end. That Kliavkoff has seen the numbers. That he has given the presidents enough details to give them confidence in the financials. And that the central decision-makers in this saga expect to stay together and agree to a media deal that will last the rest of the decade. + Cunningham on the potential for federal intervention on NIL: “I don’t know the answer to that. I’ve heard people say that our Congress is more interested now than they’ve ever been. I’ve heard others say, ‘No way. They’re not going to do that.’ So, I’m not sure which one’s right. And I’m not a DC expert.”
+ King on the value of athletics in Durham: “...what we add to the brand, I think, can’t be overstated. What’s interesting is we just had a trustee meeting and I presented and afterwards, they’re all buzzing about athletics, and they all want to talk about athletics, the good and the bad, and just, you know, peek behind the curtain and understand what’s going on, how we’re doing things at Duke. And then we talked about the hospital, but then they want to come back to athletics.“
+ Corrigan on the potential for a new NCAA organizational & leadership structure: “I think it’s a worthy exploration. And (having) a commissioner of football, a commissioner of basketball, commissioner of women’s basketball. ... It is really different. It’s a different way of looking at it. But my thought process at this point is that everything has changed so much. Why not continue to think differently? Because the traditional model is not what it was, I don’t know, five years ago. Much less 20 years. So why do we need to think about everything on the same plane that we always have, because that’s the way we always have. Ohio State will not play night football games at home after the first weekend in November past the 2023 season, according to Buckeyes AD Smith, who explains: “We might do it away. If a colleague calls from another school and said, 'Hey, would you be willing to play a night game at our place?' We have to make that call. Both athletic directors have to agree on that. And so usually I would talk to Ryan (Day) and see if we're interested in doing that and we will say yes or no. But it depends on who it is, where it is or what time our team might get back. That always plays a role into their plan. If there's a second Saturday in November and we're somewhere and our team doesn't get back until 3 or 4 o'clock in the morning, that might be a problem.” Beyond weather concerns, Smith explains late games cause concerns for season ticket holders who come in front out of town. “For them to have to make a decision to come to a night game the Saturday before Thanksgiving, I just would prefer to take that burden off of them.” (link)

Nebraska AD Alberts talks about the process of selecting protected rivalries for the conference football schedule. First, the league asked each team what rivalry it would protect if it could protect one. The league then asked the same question for two games and three games. Alberts says he and Iowa AD Barta agreed that their rivalry needed to continue, making the Hawkeyes Iowa’s first choice. NU’s second and third choices were Wisconsin and Minnesota, respectively, and Alberts notes: “But then all of a sudden a little gamesmanship started happening. You can imagine (ADs saying), ‘Well, hey, if we can submit protected games, then maybe we should just select three teams that have been the least successful over the last 5-10 years in the Big Ten and protect them.’ Obviously, that wasn’t going to work. So, ultimately, as all of these other teams submitted who their protected rivals were, sometimes you submitted a protected rival and that school doesn’t submit you as a protected rival. So there’s nuance there." (link)

UCF AD Mohajir on his support for Men’s Basketball HC Dawkins as the Knights enter the Big 12: “I just believed wholeheartedly that we needed to do everything we possibly could to help him with resources to infuse into this program, to help with personnel and that’s what we’re doing. He’s got some help with NIL this year and we’ve got a lot of plans for him and his facilities. [...] Everybody thinks it’s really easy to make a change. There are a lot of people’s lives that are involved and you have to ask yourself as an AD and administrator that we’re doing everything to help that coach. If you’ve done everything to help that coach and they’re still unsuccessful, then you can feel, ‘OK this is the right time [to make a change].’ We’re going into the best basketball conference in the country.” (link)

The Atlanta Journal-Constitution investigates the recent history of off-the-field incidents involving Georgia football student-athletes. On how discipline is handed down, the AJC submits, in part: “Since Kirby Smart became Georgia’s head coach in late 2015, dozens of players have engaged in reckless, often lawless behavior that put them and others in jeopardy: excessive speeding, street racing and driving under the influence, among other offenses. … But Smart almost always lets athletes continue playing despite their off-field transgressions. Suspensions are unusual, dismissals from the team even rarer. Exactly how Smart punishes players is unclear. In one instance, in 2019, he ordered six players who had been arrested over the previous six weeks to run the steps of Sanford Stadium in front of a select audience of donors to Georgia’s athletics department. Otherwise, he routinely declines to disclose disciplinary actions after players break team rules or the law.” Lots here. (link)

+ Wichita State will pay new Baseball HC Green $2.2M in base salary over the life of his five-year deal, which runs through the 2028 season. That works out to an average annual salary of $437K, which is a slight uptick from what his predecessor, Wedge, pulled in ($410K). (link)
+ Montana State Football HC Vigen gets a raise to $214K in base salary, up from his $210K annual salary in his prior deal. DC Garza and OC Housewright, both of whom signed contracts in April that could keep them in Bozeman through March of 2024, will make $107K and $125K, respectively. Both Housewright and Garza have been cited for DUIs in the past eight months though their LOAs do not mention DUI or other specific violations of the law. More on the legal jargon. (link)
+ Wisconsin announces contract extensions for seven coaches: Men’s Tennis boss Westerman, Men’s Golf HC Wilson, Cross Country/T&F Director Byrne, Softball HC Healy and Women’s Golf HC Oehrlein all get another five years (extensions through May 31, 2028), while Men’s Rowing HC Clark and Women’s Tennis HC McKenna get an additional three years each (extensions through May 31, 2026). + TCU’s super regional hosting of Indiana State saw 8,994 in Lupton Stadium yesterday for the deciding game. The total set a record for the largest on-campus crowd in the state of Texas for college baseball. (link); Notably, the Horned Frogs donated $1 per concession transaction to the Indiana Special Olympics after the Sycamores were unable to host in Terre Haute. (link)

Florida took home the 2023 edition of the NCAA Men’s Outdoor Track & Field Championship last night and it came down to the wire as the Gators were trailing by five points in the team standings heading into the 4x400 final event. UF won the race, setting a collegiate record of 2:57.74 and securing the necessary number of points to edge Arkansas for the crown. Gators Head Coach Holloway: “I challenged them to be better. I challenged them to be men, and they were. That’s why we’re the national champions.” (link)

ESPN’s Thamel: “Just spoke to Big 12 Commissioner Brett Yormark about the multiple reports that the Big 12 has met with Memphis: ‘I’ve never met with anyone at Memphis about adding them to the Big 12, nor have I been on campus.’” Yormark’s comments come after CollegeAD reported on Thursday that Yormark and a “Big 12 contingent” were recently on the Memphis campus & checked out the Tigers’ facilities while meeting with university regents & city officials. CBS’ Dodd was first to point out the inaccurate report from CollegeAD: “What was reported didn’t happen at all, and I’ll leave it at that. No delegation. No Brett Yormark. That didn’t happen. I wouldn’t give it oxygen. If it had happened, I would’ve written it or confirmed it. This particular (visit) did not happen, according to my reporting.” (link, link)

JohnCanzano.com’s namesake after Washington State President Schulz provided more context yesterday on the coming Pac-12 rights deal: “I reached out to a source with direct knowledge on Friday and asked again — is the Pac-12 confident it will beat that $31.6 million distribution? The answer: ‘We will beat the Big 12 number.’ The Pac-12 Networks are an important piece of the puzzle. Is it possible the bet paid off? I won’t be surprised to see a streaming service heavily involved with this content. I also think the Pac-12 likely sold its data rights. I’m interested in hearing more about that.” (link)

Significant news for NIL collectives as the Office of the IRS Chief Counsel released a 12-page memo clarifying that donations to collectives are not tax exempt because benefits provided to student-athletes are “not incidental both qualitatively and quantitatively to any exempt purpose.” An unnamed Assoc. AD to Sports Illustrated’s Dellenger: “I’m glad we didn’t go with the 501c3 model. What I tell my donors is. ... What charity are you donating to? You’re not. You’re lining kids’ pockets to keep them at your school. That’s not a charity. That’s a way to get around tax laws which leads to tax evasion and opens a whole different can of worms for donors. With a vastly different look for Conference USA coming July 1, Western Kentucky AD Stewart chats with the Bowling Green Daily News about the state of the league. Specifically comparing it to the MAC: “[The MAC] had a better television arrangement than we did, but ours is better now. I think their basketball tournament’s at the Cleveland Cavaliers arena – that’s a really nice setup. Now ours is changing, it’s going to Huntsville – which I think our fans will like a lot better from a proximity standpoint than Frisco. Although I think once you were at Frisco, those who went down there had a good time. It was a good setup, but it wasn’t an easy trip and it was certainly an unusual configuration in a football practice facility with basketball arenas constructed. The MAC had an NBA arena where they had their tournament, their football championship game is at the Detroit Lions’ stadium, so all those things just kind of were a sense of stability and professionalism that at that time was really appealing.” More. New Hawai’i AD Angelos on his first week leading the Rainbow Warriors: “It’s been a whirlwind…I had a lot of meetings, a lot of receptions, conference meetings, Mountain West conference meetings were in town, so a little bit of everything. We’ve had a full staff meeting this week where I was able to meet with everybody, talk with them, start to have individual meetings with the coaches, individual meetings with the leaders in the department. I eventually want to meet with everybody in the department.” More: “The key to fundraising is making the connections is about personalization and it’s about effort. I mean, you can’t always control the outcome, but you can always control your effort and I always say activity breeds productivity. I think we need to have top notch facilities because young people buy with their eyes and we’re in this ever growing struggle to be better and an arms race as people say, but some people say, oh, you can’t really compete with some of those other people, so why try, I don’t believe in that.” (link)

The Seattle Times' Vorel digs in on the finances at Washington: “Despite a redemptive 2022 football season that included an 11-2 record, an Alamo Bowl win over Texas, a No. 8 national ranking and an undefeated 7-0 home slate, UW’s athletic department expects a loss of $5.8 million in financial year 2023… Even though UW’s 93% season ticket retention rate is a historic high and the Huskies are College Football Playoff contenders this fall, UW projects that deficit to expand to $7.8 million in the coming financial year.” Vorel pins some of the cost on severance payments for former Football HC Lake ($5M in FY23 and projected $3.8M in FY24), but also the increased salaries for new leadership of the football program. Other culprits, per Vorel, include lower season ticket sales than pre-pandemic numbers and the Pac-12’s current TV deal. UW’s reserves are estimated to be down to $9.1M next July, compared to the 2019 total of $34.5M, per Vorel. (link)

Minnesota’s Board of Regents approved construction of a new gymnastics performance center for the Gophers. It will be built in the Athletes Village footprint on the south side of the indoor football field where two sand volleyball courts are currently located. The $15.5M project is scheduled to start in March 2024 and should be wrapped up by January 2025. (link)

The championship series of this year’s Women’s College World Series averaged 1.6M viewers for the two games, including an average of 1.9M for game two, which peaked at 2.3M. The game two mark represented a 7% uptick from the second game last year. (link)

The Athletic’s Auerbach calls on the College Football Playoff Committee to make a point about strength of schedule with the expansion to 12 teams. “Reward the teams that play tougher nonconference schedules than their peers. Reward the teams in leagues that play nine league games over those in conferences that opted to stay at eight.” Auerbach goes on to write: “No team has ever made the four-team field with two losses, not even the good teams that tested themselves with nonconference games against Power 5 opponents on the road. There was zero respect given for the attempt, no effort from the selection committee to highlight those teams actually challenging themselves while others played FCS foes and directional schools. We all got too used to undefeated and one-loss teams being treated as the only real Playoff candidates … because they were. So, make the point now. If Georgia goes out and plays at Oregon and loses, don’t penalize the Dawgs for playing a game most of their peers wouldn’t dare to. If Penn State plays a nine-game conference schedule and Auburn plays eight, and their resumes are otherwise similar, put the Nittany Lions in over the Tigers.” (link)
